The integration of machine learning algorithms into the legal recommendation system marks a burgeoning area of research, with a particular focus on enhancing the accuracy and efficiency of judicial decision-making processes. The application of Bayesian Network (BN) emerges as a potent tool in this context, promising to address the inherent complexities and unique nuances of legal texts and individual case subtleties. However, the challenge of achieving high accuracy in BN parameter learning, especially under conditions of limited data, remains a significant (...) hurdle. This study proposes an Enhanced Maximum Parameter Learning (EMPL) algorithm, tailored for BN parameter optimization in scenarios characterized by small sample sizes. The EMPL algorithm, innovatively incorporating the Synthetic Minority Over-sampling Technique (SMOTE), begins with the formulation of inequality constraints derived from domain expertise. It establishes a minimal dataset threshold necessary for effective parameter learning. Through the introduction of an index weighting factor function that dynamically adjusts according to the sample size, the algorithm facilitates the derivation of refined BN parameters. The core innovation of the EMPL algorithm lies in its use of an exponentially weighted factor function, designed to be responsive to variations in sample size, and its capacity to expand the parameter space using SMOTE to align with qualitative constraints from expert insights. This approach enables the integration of data-derived parameters with those obtained through expert experience in an exponentially weighted manner, culminating in the optimization of BN parameters. Comparative analysis reveals that the EMPL algorithm achieves superior learning accuracy over traditional Maximum Likelihood Estimation (MLE) and qualitative maximum a posteriori (QMAP) approach, particularly in contexts of sparse data. Furthermore, it demonstrates enhanced performance relative to variable weight learning algorithms, underscoring its potential to significantly improve decision-making processes in the legal domain through advanced BN parameter learning. Abstract It would be puzzling if the morally best agents were not so good after all. Yet one prominent account of the morally best agents ascribes to them the exact motivational defect that has famously been called a “fetish.” The supposed defect is a desire to do the right thing, where this is read de dicto . If the morally best agents really are driven by this de dicto desire, and if this de dicto desire is really a fetish, then (...) the morally best agents are moral fetishists. This is puzzling. I resolve the puzzle by showing that on a proper understanding of the interaction between de dicto and de re moral motivation, it is not only not fetishistic, but quite possibly desirable, to be motivated by a de dicto desire to do the right thing. My argument relies partly on an appeal to a non-buck-passing account of moral rightness, according to which rightness is itself an additional reason-giving property over and above the right-making properties of an action. If this account of moral rightness is correct, then we would expect the morally best agents to exhibit de dicto moral motivation. However, since their de dicto desire acts in concert with de re desires, there is no reason to consider it a fetish. Susan Wolf famously claimed that the life of the moral saint is unattractive from the “point of view of individual perfection.” I argue, however, that the unattractive moral saints in Wolf’s account are self-defeating on two levels, are motivated in the wrong way, and are called into question by real-life counter-examples. By appealing to a real-life case study, I argue that the best life from the moral point of view is not necessarily unattractive from the individual point of view.

Why do racist oppression and capitalist exploitation often seem so inescapable and intractable? To describe and explain adequately the persistence of racist ideology, to specify its role in the maintenance of racial capitalism, and to imagine the conditions of its abolition, we must understand racist ideology as a form of false consciousness. False consciousness gets things “right” at the level of appearance, but it mistakes that appearance for a “deep” or essential truth. This chapter articulates a novel, positive account of (...) first-order false consciousness, which occurs in the case of false beliefs about the world that are sustained and superficially justified by objective social arrangements, and of second-order false consciousness, which occurs in the case of false beliefs about how one has come to hold the beliefs that one does. To dismantle racist ideology requires political movements that craft theoretical interventions highlighting the inessentiality and contingency of despised racial groups’ oppressed status, as well as practical interventions aimed at directly undermining the oppressive conditions that are reflected in racist beliefs about the “naturalness” or “appropriateness” of these groups’ degraded status. What is belief? "Beliefs aim at truth" is the commonly accepted starting point for philosophers who want to give an adequate account of this fundamental state of mind, but it raises as many questions as it answers. For example, in what sense can beliefs be said to have an aim of their own? If belief aims at truth, does it mean that reasons to believe must also be based on truth? Must beliefs be formed on the basis of evidence alone? (...) Is truth the constitutive norm of belief? Does aiming at truth bring in a normative dimension to the nature of belief? How can the aim of truth guide the formation of our beliefs? In what ways do partial beliefs aim at truth? Is truth the aim of epistemic justification? Last but not least, is it knowledge rather than truth which is the fundamental aim of belief? In recent years, pursuing these questions has proved extremely fertile for our understanding of a wide range of current issues in philosophy of mind and action, epistemology, and meta-ethics. Between the fall of the Soviet Union and the fall of Lehman Brothers, if the Anglophone academy could be said to have arrived at any consensus about the value of Marxist theory, it would be that Marxism was a quaint historical curio at best and a world-historically hubristic folly at worst. Today, however, well on our way through the first quarter of the twenty-first century, we live in a moment of greatly renewed interest in Marxist ideas. This curiosity is stoked (...) by, among other factors, the worldwide economic shocks of 2008 and, in more recent times, by impending climate catastrophe, incipient fascisticization, and the still-ongoing global COVID-19 pandemic. Any of these on its own would stand out as a rebuke to the neoliberal triumphalism of the 1990s, famously crystallized in Francis Fukayama's assertion that humanity had arrived at "the end of history," there to find permanently expanding capitalist prosperity. Taken together, they present at least strong prima facie evidence for what Karl Marx identified as the inherently and ineluctably crisis-ridden nature of capital and, therefore, good reason to encounter his writings anew. The moral community is a social community, and as such it is vulnerable to social problems and pathologies. In this essay I identify a particular way in which participation in the moral community can be constrained by social factors. I argue that features of the social world—including power imbalances, oppression, intergroup conflict, communication barriers, and stereotyping—can make it nearly impossible for some members of the moral community to hold others responsible for wrongdoing. Specifically, social circumstances prevent some marginalized people from (...) engaging in what Stephen Darwall calls “felicitous moral address” (Darwall 2006). We should think of some members of the moral community as having “second-class moral citizenship” in ways that parallel second-class political citizenship. The injustice of second-class moral citizenship can be understood by drawing an analogy with Miranda Fricker’s notion of “epistemic injustice” (Fricker 2007). Fricker’s account of how people can be undermined in their capacity as knowers can be extended to show how people can be undermined in their capacity as makers of moral claims, which can be called “claimant injustice”. I argue for the existence of a ‘ratcheting-up effect’: the behavior of moral saints serves to increase the level of moral obligation the rest of us face. What we are morally obligated to do is constrained by what it would be reasonable for us to believe we are morally obligated to do. Moral saints provide us with a special kind of evidence that bears on what we can reasonably believe about our obligations. They do this by modeling the level of (...) sacrifice a person can realistically bear. Moral distress has been well reviewed in the literature with established deleterious side effects for all healthcare professionals, including nurses, physicians, and others. Yet, little is known about the quality and effectiveness of interventions directed to address moral distress. The aim of this integrative review is to analyze published intervention studies to determine their efficacy and applicability across hospital settings. Of the initial 1373 articles discovered in October 2020, 18 were appraised as relevant, with 1 study added by hand search (...) and 2 after a repeated search was completed in January and then in May of 2021, for a total of 22 reviewed articles. This review revealed data mostly from nurses, with some studies making efforts to include other healthcare professions who have experienced moral distress. Education-based interventions showed the most success, though many reported limited power and few revealed statistically lowered moral distress post intervention. This may point to the difficulty in adequately addressing moral distress in real time without adequate support systems. Ultimately, these studies suggest potential frameworks which, when bolstered by organization-wide support, may aid in moral distress interventions making a measurable impact. (shrink)

Emotional development is one of the largest and most productive areas of psychological research. For decades, researchers have been fascinated by how humans respond to, detect, and interpret emotional facial expressions. Much of the research in this area has relied on controlled stimulus sets of adults posing various facial expressions. Here we introduce a new stimulus set of emotional facial expressions into the domain of research on emotional development—The Child Affective Facial Expression set (CAFE). The CAFE set features photographs of (...) a racially and ethnically diverse group of 2- to 8-year-old children posing for six emotional facial expressions—angry, fearful, sad, happy, surprised, and disgusted—and a neutral face. It is well-known that racism is encoded into the social practices and institutions of medicine. Less well-known is that racism is encoded into the material artifacts of medicine. We argue that many medical devices are not merely biased, but materialize oppression. An oppressive device exhibits a harmful bias that reflects and perpetuates unjust power relations. Using pulse oximeters and spirometers as case studies, we show how medical devices can materialize oppression along various axes of social difference, including race, gender, class, (...) and ability. Our account uses political philosophy and cognitive science to give a theoretical basis for understanding materialized oppression, explaining how artifacts encode and carry oppressive ideas from the past to the present and future. Oppressive medical devices present a moral aggregation problem. To remedy this problem, we suggest redundantly layered solutions that are coordinated to disrupt reciprocal causal connections between the attitudes, practices, and artifacts of oppressive systems. Depuis un peu plus de cinq ans, il existe dans le nord du Brésil des tensions sociales autour de la construction d’un projet de développement. La construction du barrage hydroélectrique de Belo Monte est un parfait exemple, à la fois pour illustrer la relation confuse entre le pouvoir public et les entreprises privées, durant la réalisation d’un ouvrage d’infrastructures et pour étudier comment cette relation influence l’« acceptabilité sociale » du projet. Pour Belo Monte, le gouvernement a mis en place (...) une politique d’investissements locaux par l’intermédiaire d’un plan de développement durable, parallèle à la construction de l’ouvrage civil. Le plan, pionnier dans son format, est financé par des ressources publiques et privées et distribue des financements pour divers projets proposés par la société civile et les gouvernements locaux. Il vise une meilleure insertion sociale du projet et son acceptation à l’échelle locale. Néanmoins, ce plan est aussi accusé, par les opposants au barrage, d’être une tentative de coopter la population locale. La situation que nous exposons vise à remettre en question le rôle de l’État dans l’acceptabilité sociale. Nous proposons d’aborder le croisement entre les sphères publiques et privées en ce qui concerne l’implémentation de services et de projets d’intérêts publics, en nous posant plusieurs questions : comment la gestion de l’acceptabilité sociale se fait-elle au Brésil, dans un cadre officiellement démocratique, mais où les pratiques sont historiquement populistes? Quelle place reste-t-il pour les populations locales et leurs représentants et comment survivent les mouvements sociaux désireux de faire entendre leur voix dans le débat et la gestion du projet? Les questions démontrent la nécessité d’inclure le rôle central de l’État et son influence dans les débats sur l’« acceptabilité sociale », élargissant la littérature, jusqu’alors trop souvent exclusivement centrée sur le binôme entreprise-population concernée. Indeed, the major determinants that should guide the international laws and their enactors regarding justifiable foreign intervention are: the negative duty not to partake in an unjust system that oppresses the people of another country, moral uncertainty, and the realities of the agents in question. Os dados obtidos indicam que a branquitude, em suas diversas representações, configura-se um agente central na manutenção do racismo. We know that microbes contribute to the production of odors that some animals use to communicate, but how common is this phenomenon? Recent studies capitalizing on new molecular technologies are uncovering fascinating associations between microbes and odors of wild animals, but causality is difficult to ascertain. Fundamental questions about the nature of these unique host‐microbe interactions also remain unanswered. For instance, do microbes benefit from signaling associations with hosts? How does microbial community structure influence signal production? How do hosts regulate (...) microbes in order to generate appropriate signals? Here, we review the current state of knowledge on microbially produced signals in animals and discuss key research foci that can advance our understanding of microbial‐based signaling in the animal world. From the point of view of a theorist in ethics, the interest in public policy usually centres on the policy outcomes. But this point of view does not take much account of the roles and practices through which public policies are enacted. What additional ethical focuses for the policy agent might these entail? I outline four features of policy making, centred on the agent's performance of their role in the process, that raise ethical issues. These features are: the nature of (...) the policy process; the definition of the public; the treatment of policy agents; and accounting for public policy decisions. Brief examples are used to illustrate the nature of the issues and support the conclusion that these present additional ethical focuses for agents in public policy roles. (shrink)

Historians of twentieth-century science have been systematically ignoring some of the subject’s richest sources and most exciting stories; this has left us with a body of work that is necessarily lopsided and that can be self-reinforcing in its insistence on certain features of “modern” science as uniquely dominant or significant after 1900. Methods, concepts, research questions, research areas, and resources that have been routinely and productively used by historians of science immersed in earlier centuries appear to drop out of our (...) toolkits when we turn to the twentieth century. This essay highlights one neglected area—human physiology studied in the field—and points to other topics where asking questions appropriate to natural history or “museum” ways of knowing might cast a completely new light on scientific practices and knowledge production. There is a persisting debate about what chemical bonds are and whether they exist. I argue that chemical bonds are real patterns of interactions between subatomic particles. This proposal resolves the problems raised in the context of existing understandings of the chemical bond and provides a novel way to defend the reality of chemical bonds.

The Enlightenment saw a critical engagement with the ancient idea that music carries certain powers - it heals and pacifies, civilizes and educates. Yet this interest in musical utility seems to conflict with larger notions of aesthetic autonomy that emerged at the same time. In Enlightenment Orpheus, Vanessa Agnew examines this apparent conflict, and provocatively questions the notion of an aesthetic-philosophical break between the eighteenth and nineteenth centuries.

The stability of low student math scores has been a concern of education systems around the world for many years. While teaching practices are pointed out as a determining factor in student engagement and the quality of student learning, they are only the tip of the iceberg. Much work has shown that these practices are strongly colored by epistemological beliefs as well as by beliefs related to the teaching and learning of the school discipline under investigation. On this subject, if (...) some research reports a peremptory influence of beliefs on teaching practices, others present more moderate results by underlining, for example, the permeability of beliefs in pre-service training. Based on the results of a quantitative study that identified three belief profiles (pro-traditional, anti-traditionnal, flexible) among 190 future secondary school mathematics teachers in their final year of training, this contribution aims to shed qualitative light on the articulation between beliefs and teaching practices of eleven of them. The analysis of the semi-directive interviews highlights the reconcilable nature of transmissive and constructivist conceptions of teaching-learning. Moreover, the presence of similar pedagogical practices, supported in training, within profiles with contrasting beliefs argues in favor of a belief-practice non-linearity. (shrink)

This research focuses on a profession, that of pedagogical consultant (PC) in mathematics, which has been little explored. Interviews were conducted with eight PCs in mathematics at the elementary school level, based on two professional situations related to problem solving and professional development of teachers. An emerging analysis brought to light, within their professional practice, common elements, characterizing what we can call “a PC’s professional genre”. This book digs into the complex archaeology of empathy illuminating controversies, epistemic problems and unanswered questions encapsulated within its cross-disciplinary history. The authors ask how a neutral innate capacity to directly understand the actions and feelings of others becomes charged with emotion and moral values associated with altruism or caregiving. They explore how the discovery of the mirror neuron system and its interpretation as the neurobiological basis of empathy has stimulated such an enormous body of research and how in a (...) number of these studies, the moral values and social attitudes underlying empathy in human perception and action are conceptualized as universal traits. It is argued that in the humanities the historical, cultural and scientific genealogies of empathy and its forerunners, such as Einfühlung, have been shown to depend on historical preconditions, cultural procedures, and symbolic systems of production. The multiple semantics of empathy and related concepts are discussed in the context of their cultural and historical foundations, raising questions about these cross-disciplinary constellations. ObjectivesThis paper aims to identify potential areas for refinement in existing theoretical models of suicide, and introduce a new integrative theoretical framework for understanding suicide, that could inform such refinements.MethodsLiterature on existing theoretical models of suicide and how they contribute to understanding psychological processes involved in suicide was evaluated in a narrative review. This involved identifying psychological processes associated with suicide. Current understanding of these processes is discussed, and suggestions for integration of the existing literature are offered.ResultsExisting approaches to understanding (...) suicide have advanced the current knowledge of suicide in various ways. They have guided valuable research in the following areas: motivations for suicide and the psychological distress which influences suicide attempts; ambivalence about suicide; suicidal individuals’ focus of attention; and ways in which individuals who contemplate suicide differ from individuals who attempt suicide. We outline a new theoretical framework as a means to integrating all of these concepts into the three principles of control, conflict, and awareness. Within this framework, suicide is regarded as occurring due to a long standing conflict between an individual’s personal goals, culminating in an episode of acute loss of control. The new framework posits that the individual then strives to regain control through the means of suicide because of a narrowed awareness of consequences of their actions on other valued goals. This psychological mechanism of limited awareness is posited to be the common pathway by which individuals make a suicide attempt, regardless of which risk factors are present.ConclusionThis article introduces a theoretical framework that generates several hypotheses for future research, and focuses on psychological processes occurring during immediate crisis. One of the key hypotheses resulting from our predictions on how individuals progress from contemplating to attempting suicide will be tested in an ongoing program of research: Individuals who attempt suicide have a significantly reduced awareness of consequences of suicide, which would negatively impact on their important life goals, values, principles, or ideals, compared to individuals who contemplate suicide. Therapy guided by the new framework may be more flexible, immediate, and client-focused than other therapies for suicidal individuals. (shrink)

This study tests how various kinds of trust impact attitudes toward euthanasia among the general public. The indication that trust might have an impact on euthanasia attitudes is based on the slippery slope argument, which asserts that allowing euthanasia might lead to abuses and involuntary deaths. Adopting this argument usually leads to less positive attitudes towards euthanasia. Tying in with this, it is assumed here that greater trust diminishes such slippery slope fears, and thereby increases euthanasia acceptance.

Ryan The eighteenth-century discussion of the sublime is primarily concerned not with works of art but with how a particular experience of being moved impacts the self. The discussion of the sublime most fully explores the question of how we make sense of our experience: "Why (...) and how does this object move me?" Focusing on the perceiving subject, most critics cast the British discussion of the sublime as reflecting a gradual shift towards a Kantian focus not on the object judged, but on the judging mind. Certainly, eighteenth-century thinkers move away from understanding the sublime as a set of qualities that are presumed to be internal to a given object, and shift their attention to the mental effects of those objects. Yet the increasing interest in the perceiving subject in eighteenth-century British thought should not be understood as necessarily anticipating a Kantian perspective. In his classic work on the sublime Samuel H. Monk claims that this aspect of the British debate provides a preliminary discussion of the Kantian "autonomy of the subject" and that it constitutes a movement towards the "subjectivism of Kant." 1 This reading of British aesthetics exclusively in [End Page 265] terms of a preparation for the Kantian description of the subject obscures the differences between the British and the German traditions. It thereby fails to accommodate the reluctance of British thinkers to give up the social and ethical when faced with the sublime: instead of explaining the commonality of the aesthetic experience by positing a "disinterested" and "autonomous" subject, thinkers such as Adam Smith, John Dennis, and Edmund Burke subordinate the freedom of the individual subject in an attempt to reconcile the aesthetic affect with moral conduct.The teleological and Kantian understanding of British eighteenth-century aesthetic theory is largely the result of the central position that has been given to its most famous theorist, Edmund Burke. Although Burke's conception of the sublime differs in some points markedly from that of his British contemporaries, his treatment of the sublime in the Philosophical Enquiry (1757) has come to represent eighteenth-century British thought, and as such it is routinely compared to Kant's analytic of the sublime. Yet at the point where the British tradition seems to come closest to the Kantian, namely, in the writings of Burke, it also most clearly marks its distance from it. A survey on the knowledge and attitudes towards the Austrian organ donation legislation (an opt-out solution) of selected groups of the Austrian population taking into account factors such as age, gender, level of education, affiliation to healthcare professions and health related studies was conducted.

This research examines the ethical orientations of students (ethical idealism, ethical relativism and Machiavellianism) towards their attitude to plagiarize. It also examines the moderating effect of religious orientation on the relationship of the independent variables toward students’ attitude towards plagiarism. Data was collected from 160 business diploma and undergraduate students from a local private college and a local public university in Malaysia. Results from the hierarchical regression analysis showed that ethical relativism and Machiavellianism had a positive relationship with students’ attitude (...) towards plagiarism whilst ethical idealism was negatively related to students’ attitude towards plagiarism. Religious orientation was found to have no moderating effect on the relationship between the three independent variables: ethical idealism, ethical relativism and Machiavellianism and the dependent variable, students’ attitude towards plagiarism. The European Commission has suggested that the use of joint audits should lead to improved auditor skepticism and—by extension—audit quality, through increased accountability. However, archival research does not find support for improved audit quality in a joint audit setting. To better understand the relationship between accountability in different review regimes and auditors’ judgments, we examine the behavioral effect of implementing a joint audit relative to other review regimes based on a 1 × 3 experimental design. Forty-seven senior auditors and partners (...) from a Big Four firm performed a going concern evaluation task under one of three review regimes: the joint audit, the internal review, and the no review regime. Notwithstanding the difference in the audiences to which auditors are accountable, there is no difference in the judgment process. In terms of their judgment outcome, however, auditors in the joint audit setting were the least skeptical in their judgment of the going concern assumption. Overall, we suggest that the joint audit may lead to unintended behavioral consequences. (shrink)

ABSTRACT The aim of this article is to analyze the character Alison, the wife of Bath, in Geofrey Chaucer’s The Canterbury Tales. To do this, based on Bakhtin (1984a, 1984b), especially from the perspective of carnivalization, together with Butler’s theory of gender performativity (1988, 1999), we intend to show how this character carnivalistically subverts certain biblical texts relating to the role of women in marriage. Thus, for the purposes of this study, we have taken the Wife of Bath’s prologue from (...) Chaucer’s work, because in it she constructs her polemical more explicitly and the comic relationship with the Bible at the same time. From this analysis, we conclude that Bath’s wife, in a carnivalized way, performs the feminine gender in the middle of the medieval period, showing herself to be subversive of the stereotypes of the time by profaning certain biblical guidelines, from both the Old and New Testaments, regarding what it means to be a woman and a wife. RESUMO O objetivo do artigo é proceder a uma análise da personagem Alison, esposa de Bath, na obra Os contos de Canterbury, de Geofrey Chaucer. Para isso, com base em Bakhtin (2010, 2018), em particular a partir da perspectiva da carnavalização, somada à teoria da performatividade de gênero de Butler (1988, 2017), pretendemos mostrar como a referida personagem subverte, carnavalizadamente, certos textos bíblicos referentes ao papel da mulher no matrimônio. Dessa forma, nesse estudo, para efeito de análise, tomamos da obra (...) chaucereana o prólogo da esposa de Bath visto que nele a personagem elabora, de modo mais evidente, sua relação tensa e, ao mesmo tempo cômica, com a Bíblia. Da análise feita, concluímos, assim, que a esposa de Bath, de maneira carnavalizada, performatiza o gênero feminino em pleno período medieval, mostrando-se subversiva aos estereótipos da época ao profanar certas orientações bíblicas, tanto do Velho como do Novo Testamento, relativamente ao que é ser mulher e esposa. Harold Kincaid in Individualism and the Unity of Science postulates a model of unity-without-reduction in order to accurately describe the relation between individualism and macroeconomics. I present this model and apply it to the description of the relation between chemistry and quantum mechanics. I argue that, when it comes to the description of molecular structure, chemistry and quantum mechanics are unified in Kincaid’s sense. Specifically, the two disciplines contribute to the formation of a unified body of knowledge with respect to (...) molecular structure. (shrink)

There are many- not just one- periodic laws in chemistry. These laws correspond to non-accidental regularity relations about physical and chemical properties of (sets of) chemical elements. I support this by showing how these regularity relations can be understood from the perspective of a philosophical analysis of laws. Specifically, I show that these relations instantiate standard features associated with laws; they can be spelled out in terms of two standard accounts of laws; and, they can coherently figure in debates about (...) the reality of laws as plausible candidates of ceteris paribus laws.
