The 13th-15th centuries were witness to lively and broad-ranging debates about the nature of persons. In this paper, I look at how the uses of ‘person’ in logical/grammatical, legal/political, and theological contexts overlap in the works of 13th-15th century contemplatives in the Latin West, such as Hadewijch, Meister Eckhart, and Catherine of Siena. After explicating the key concepts of individuality, dignity, and rationality, I show how these ideas combine with the contemplative use of first- and second-person perspectives, personification, and introspection (...) to yield a concept of 'person' that both prefigures Locke's classic 17th century definition and deeply influences the development of personalism. The Middles Ages are often portrayed as a time in which people with physical disabilities in the Latin West were ostracized, on the grounds that such conditions demonstrated personal sin and/or God’s judgment. This was undoubtedly the dominant response to disability in various times and places during the fifth through fifteenth centuries, but the total range of medieval responses is much broader and more interesting. In particular, the 13th-15th century treatment of three groups (martyrs, mothers, and mystics - whose physical (...) ‘defects’ were often understood as signs of special connection to God in this life, and who were often represented as retaining these signs in the life to come) challenge standard notions of beauty, disfigurement, and bodily perfection, particularly as the notion is applied to eternal life and our ultimate end. As workers struggle to combine work and family responsibilities, discrimination against workers based on their status as caregivers is on the rise. Although both women and men feel the pinch, caregiver discrimination is particularly damaging for women, because care is intricately tied to gendered norms and expectations. In this article, we analyze caregiver discrimination cases resolved by Canadian Human Rights Tribunals from 1985 through 2016, to explore how work and caregiving clash. We identify issues involved in disputes and the ways (...) gendered expectations about work–life facilitation inform disputes and outcomes. We find that although women are more likely to bring claims and obtain favorable outcomes, the legal interpretation of claims is highly gendered. Women bring claims involving both their presumed status as caregivers and the practical challenges of seeking accommodations for care, whereas men’s claims are largely accommodation based. In adjudicating cases, Tribunals are more likely to see women than men as lacking credibility when making their claims, questioning their competence and legitimacy. In contrast, men struggle to demonstrate the legal basis of work–family interference, failing to convey how seriously work interferes with family responsibilities. (shrink)

I argue that Before Sunrise, Before Sunset, and Before Midnight are best seen as an example of memento mori art. Memento mori, the admonition to remember death, can take many forms, but the idea remains the same, namely that an awareness of our inevitable end should bear on how we live. I show how Richard Linklater’s warning works in each of the movies and argue that with the Before trilogy he makes a Frankfurt-style case that romantic love is life’s summum (...) bonum--i.e. "the ultimate ground of practical rationality.". Post-structuralist discourses have usually been associated with forms of critique and deconstruction of social, cultural and philosophical phenomena. However, this article attempts to provide a generative approach to understanding educational leadership through Michel Foucault’s notions of power and subjectification, and Judith Butler’s notions of performativity and discursive agency through re-signification. We argue that leadership is not simply a list of traits, characteristics or behaviours to be implemented. Rather, we argue that leaders are performatively constituted through everyday practices and discourses. The (...) aim is to interrupt prevailing discourses that often re-inscribe certain forms of meaning and understanding in educational leadership. This disruption subsequently provides possibility for putting forward otherwise silenced ideas about what leadership is and how leadership ‘identity’ (subjectivity) is formed, thus expanding the methodological tools scholars can use to talk about leadership. Maintaining intersubjectivity is crucial for accomplishing coordinated social action. Although conversational repair is a recognised defence of intersubjectivity and routinely used to address ostensible sources of trouble in social interaction, it is less clear how people address more equivocal trouble. This study uses conversation analysis to examine preschool classroom interaction, focusing on practices used to identify and address such trouble. Repair is found to be a recurrent frontline practice for addressing equivocal trouble, occasioning space for further information that might enable (...) identifying a specific trouble source. Where further information is forthcoming, a range of strategies are subsequently employed to address the trouble. Where this is not possible or does not succeed, a secondary option is to progress a broader activity-in-progress. This allows for the possibility of another opportunity to identify and address the trouble. Given that misunderstandings can jeopardise interactants’ ability to mutually accomplish courses of action, these practices defend intersubjectivity against the threat of equivocal trouble. (shrink)

The branch of evolutionary theory known as signaling theory attempts to explain various forms of communication. Social scientists have explained many traditional rituals as forms of communication that promote cooperative social relationships among participants. Both evolutionists and social scientists have realized the importance of trust for the formation and maintenance of cooperative social relationships. These factors have led to attempts to apply signaling theory to traditional cultural rituals in various ways. This paper uses the traditional ritual of mumming in small (...) Newfoundland fishing villages to evaluate alternative hypotheses about the connection between rituals, communication, trust, and cooperation. Mumming is found to be most consistent with the hypothesis that it is a ritual of trust wherein participants take a specific type of risk: the risk of harm at the hands of other participants. Individuals who take this risk actively signal their trust. Conversely, individuals who restrain themselves from inflicting harm on other participants actively signal their trustworthiness. (shrink)

This work analyses how the philosophers of the Enlightenment viewed their writing; and, how their institutional positions as teachers and writers influenced their understanding of human consciousness.

The aim of this study was to explore the relational aspects of the consent process for HPV vaccination as experienced by school nurses, based on the assumption that individuals have interests related to persons close to them, which is not necessarily to be apprehended as a restriction of autonomy; rather as a voluntary and emotionally preferred involvement of their close ones. Thirty Swedish school nurses were interviewed in five focus groups, before the school based vaccination program had started in Sweden. (...) The empirical results were discussed in light of theories on relational autonomy. The school nurses were convinced that parental consent was needed for HPV vaccination of 11-year-old girls, but problems identified were the difficulty to judge when a young person is to be regarded as autonomous and what to do when children and parents do not agree on the decision. A solution suggested was that obtaining informed consent in school nursing is to be seen as a deliberative process, including the child, the parents and the nurse. The nurses described how they were willing strive for a dialogue with the parents and negotiate with them in the consent process. Seeing autonomy as relational might allow for a more dialogical approach towards how consent is obtained in school based vaccination programs. Through such an approach, conflicts of interests can be made visible and become possible to deal with in a negotiating dialogue. If the school nurses do not focus exclusively on accepting the individual parent’s choice, but strive to engage in a process of communication and deliberation, the autonomy of the child might increase and power inequalities might be reduced. Olive tree cultivation in theMediterranean goes back to ancient times. Evensince the Roman Age, olive cultivation spreadto the entire Mediterranean basin. Thislongevous tree integrates and identifieseconomically, socially, and culturally theinhabitants of this basin and determines itsrural landscape. For the residents of theMediterranean, olive oil constituted the mainsource of nutritional fats, their most valuableexport product, and was identified with theirculture. Even now, olive cultivation has amultiple importance for the Mediterranean. Theolive groves, which grow mostly on inclined,shallow, and low fertility soils, and (...) onhand-made stone terraces, have limited wateringrequirements and sustain the fragile naturalresources of the Mediterranean. Today,olive cultivation in the Mediterranean is anadditional income source and supports thepopulation in rural areas during the winterperiod, which profit from summer and seatourism activity. Although anagro-ecosystem, the olive grove resembles thenatural Mediterranean ecosystem and abandonmenttransforms them into natural Mediterranean typeforests. Their change of use from olivecultivation to pasture degrades the ecosystemand decreases the natural resources, because ofover-grazing. At this time, two major factorsthreaten the traditional olive cultivation (i)the competition of the intensive olive grovesin plain and irrigated areas and (ii) thecheaper seed-oils, which intensify theabandonment of traditional olive groves andchange them into pasture, resulting in thedeterioration of the ecosystem. Olivecultivation has left its mark on life in theMediterranean and has contributed to thesustainability of natural resources.Nevertheless, it succumbs under the pressure ofcurrent socioeconomic situations. Today, theconservation of olives in productionconstitutes a necessity for the fragileMediterranean ecosystems and a challenge foreverybody involved. (shrink)

This book is an unusually readable and lucid account of the development of Derrida's work, from his early writings on phenomenology and structuralism to his most recent interventions in debates on psychoanalysis, ethics and politics. Christina Howells gives a clear explanation of many of the key terms of deconstruction - including differance, trace, supplement and logocentrism - and shows how they function in Derrida's writing. She explores his critique of the notion of self-presence through his engagement with Husserl, and (...) his critique of humanist conceptions of the subject through an account of his ambivalent and evolving relationship to the philosophy of Sartre. The question of the relationship between philosophy and literature is examined through an analysis of the texts of the 1970s, and in particular Glas, where Derrida confronts Hegel's totalizing dialectics with the fragmentary and iconoclastic writings of Jean Genet. The author addresses directly the vexed questions of the extreme difficulty of Derrida's own writing and of the passionate hostility it arouses in philosophers as diverse as Searle and Habermas. She argues that deconstruction is a vital stimulus to vigilance in both the ethical and political spheres, contributing significantly to debate on issues such as democracy, the legacy of Marxism, responsibility, and the relationship between law and justice. The philosophical work of Jean-Luc Marion has opened new ways of speaking about religious convictions and experiences. In this exploration of Marion’s philosophy and theology, Christina M. Gschwandtner presents a comprehensive and critical analysis of the ideas of saturated phenomena and the phenomenology of givenness. She claims that these phenomena do not always appear in the excessive mode that Marion describes and suggests instead that we consider degrees of saturation. Gschwandtner covers major themes in Marion’s work—the historical event, art, (...) nature, love, gift and sacrifice, prayer, and the Eucharist. She works within the phenomenology of givenness, but suggests that Marion himself has not considered important aspects of his philosophy. (shrink)

According to one understanding of the problem of dirty hands, every case of dirty hands is an instance of moral conflict, but not every instance of moral conflict is a case of dirty hands. So, what sets the two apart? The dirty hands literature has offered widely different answers to this question but there has been relatively little discussion about their relative merits as well as challenges. In this paper I evaluate these different accounts by making clear which understanding of (...) concept distinctness underlies them and which of them is, ultimately, the most plausible one in the case of dirty hands and ordinary moral conflict. In order to do so, I will borrow from the terminology employed in recent debates in the philosophy of evil which have tackled a similar problem to the one at hand, i.e. defining what sets evil apart from ordinary wrongdoing. Here it has been argued that concepts could be distinct in three ways: they can have a quantitative difference, a strong qualitative or a moderate qualitative difference. I conclude that the most convincing definition of dirty hands draws a moderate qualitative distinction between ordinary moral conflict according to which dirty hands are those moral conflicts that involve a serious violation or betrayal of a core moral value. Microaggressions are a new moral category that refers to the subtle yet harmful forms of discriminatory behavior experienced by members of oppressed groups. Such behavior often results from implicit bias, leaving individual perpetrators unaware of the harm they have caused. Moreover, microaggressions are often dismissed on the grounds that they do not constitute a real or morally significant harm. My goal is therefore to explain why microaggressions are morally significant and argue that we are responsible for their harms. I offer (...) a conceptual framework for microaggressions, exploring the central mechanisms used for identification and the empirical research concerning their harm. The cumulative harm of microaggressions presents a unique case for understanding disaggregation models for contributed harms, blame allocation, and individual responsibility within structural oppression. Our standard moral model for addressing cumulative harm is to hold all individual contributors blameworthy for their particular contributions. However, if we aim to hold people responsible for their unconscious microaggressions and address cumulative harm holistically, this model is inadequate. Drawing on Iris Marion Young's social connection model, I argue that we, as individual perpetrators of microaggressions, have a responsibility to respond to the cumulative harm to which we have individually contributed. Every day situations arising in health care contain ethical issues influencing care providers' conscience. How and to what extent conscience is influenced may differ according to how conscience is perceived. This study aimed to explore the relationship between perceptions of conscience and stress of conscience among care providers working in municipal housing for elderly people. A total of 166 care providers were approached, of which 146 (50 registered nurses and 96 nurses' aides/enrolled nurses) completed a questionnaire containing the Perceptions of (...) Conscience Questionnaire and the Stress of Conscience Questionnaire. A multivariate canonical correlation analysis was conducted. The first two functions emerging from the analysis themselves explained a noteworthy amount of the shared variance (25.6% and 17.8%). These two dimensions of the relationship were interpreted either as having to deaden one's conscience relating to external demands in order to be able to collaborate with coworkers, or as having to deaden one's conscience relating to internal demands in order to uphold one's identity as a `good' health care professional. On 14 January 1999, the woman theologian Christina Landman published an article in the religious column, Godsdiens Aktueel, of the Afrikaans daily newspaper Beeld under the heading ‘Poligamie, ditsem!’ (Yes, for polygamy!). In the article, Landman pondered whether polygamy – which is allowed in South Africa for indigenous cultures – would not be an advantage for the Afrikaans society where extra-marital affairs were allegedly high. There was an immediate and long-running reaction to this article in the Afrikaans, as well (...) as in the English media, nationally and internationally, in the printed media, as well as on radio and television. This article will isolate themes in the responding letters of Afrikaans readers. The rejection of polygamy by Afrikaans readers rests on arguments that it is unbiblical, dehumanising to women and impractical. On the other hand, those Afrikaans readers who opt for polygamy argue that multiple-partner-relationships can save marriages from ending in divorce because of extra-marital affairs and can lighten the burden on overworked women. Contribution: This article contributes to the debate on polygamy and in particular from the Afrikaans population in South Africa whose culture and religion forbid polygamy. The discussion and findings as thematised in this article contribute to a body of knowledge not been dealt with in academic research. (shrink)

The Cognitive Reflection Test is purported to test our inclination to overcome impulsive, intuitive thought with effortful, rational reflection. Research suggests that philosophers tend to perform better on this test than non-philosophers, and that men tend to perform better than women. Taken together, these findings could be interpreted as partially explaining the gender gap that exists in Philosophy: there are fewer women in Philosophy because women are less likely to possess the ideal ‘philosophical personality’. If this explanation for the gender (...) gap in Philosophy is accepted, it might be seen to exonerate Philosophy departments of the need to put in place much-needed strategies for promoting gender diversity. This paper discusses a number of reasons for thinking that this would be the wrong conclusion to draw from the research. Firstly, the CRT may not track what it is claimed it tracks. Secondly, the trait tracked by the CRT may not be something that we should value in philosophers. Thirdly, even if we accept that the CRT tracks a trait that has value, this trait might be of limited importance to good philosophising. Lastly, the causal story linking the gender gap in CRT score and the gender gap in Philosophy is likely to be far more complex than this explanation implies. (shrink)

RATIONALE, AIM AND OBJECTIVE: Factors influencing doctors in prescribing of drugs have mostly been studied in primary care. Studies performed in hospital care have primarily focused on new drugs, not prescribing in general. An in-depth understanding of the prescribing process in the more specialized secondary care is not only important for secondary care itself, but because it also influences prescribing in primary care. The aim of this study is therefore to identify factors that secondary care doctors believe influence them in (...) prescribing drugs, using a qualitative approach. (shrink)

This paper considers three arguments by David Shugarman and Maureen Ramsay for why dirty hands cannot be democratic. The first argues that it is contradictory, in principle, to use undemocratic means to pursue democratic ends. There is a conceptual connection between means and ends such that getting one’s hands dirty is incompatible with acting in accordance with democratic ends. The second claims that using dirty-handed means, in practice, will undermine democracy more than it promotes it and therefore cannot be justified. (...) The final criticism states that politicians with dirty hands are a sign that politics is no longer meeting the criteria necessary to be called democratic. The paper shows that such rejections of democratic dirty hands are based on misunderstandings of the nature of dirty hands and democratic politics. (shrink)

Although birth marks the entrance of a human being into the world and establishes the very possibility of experience the philosophical implications of this event have been largely ignored in the history of thought. This is particularly troubling in phenomenology in general and in the work of Martin Heidegger in particular. While Heidegger raises the issue of birth he drops it very quickly on the path to defining Dasein''s existence as constituted from the standpoint of death, as being-towards-death. In this (...) paper I argue, contra Heidegger, that intentional existence can only be understood from the standpoint of birth. I begin by showing that intentionality inheres in a double difference that is fundamentally dependent on birth insofar as birth is an original differentiating from prenatal existence. I conclude with the argument that only a philosophy that regards Dasein from the standpoint of birth, as being-from-birth, can give an adequate account of humans as beings who live with others and who can initiate sense constitution and action. This book provides an introduction to the emerging field of continental philosophy of religion by treating the thought of its most important representatives, including its appropriations by several thinkers in the United States. Part I provides context by examining religious aspects of the thought of Martin Heidegger, Emmanuel Levinas, and Jacques Derrida. Christina Gschwandtner contends that, although the work of these thinkers is not apologetic in nature, it prepares the ground for the more religiously motivated work of more recent (...) thinkers by giving religious language and ideas some legitimacy in philosophical discussions. Part II devotes a chapter to each of the contemporary French thinkers who articulate a phenomenology of religious experience: Paul Ricoeur, Jean-Luc Marion, Michel Henry, Jean-Louis Chrétien, Jean-Yves Lacoste, and Emmanuel Falque. In it, the author argues that their respective philosophies can be read as an apologetics of sorts--namely, as arguments for the coherence of thought about God and the viability of religious experience--though each thinker does so in a different fashion and to a different degree. Part III considers the three major thinkers who have popularized and extended this phenomenology in the U.S. context: John D. Caputo, Merold Westphal, and Richard Kearney. The book thus both provides an introduction to important contemporary thinkers, many of whom have not yet received much treatment in English, and also argues that their philosophies can be read as providing an argument for Christian faith.
