The U.S. Supreme Court's majority opinion in Vacco v. Quill assumes that the principle of double effect explains the permissibility of hastening death in the context of ordinary palliative care and in extraordinary cases in which painkilling drugs have failed to relieve especially intractable suffering and terminal sedation has been adopted as a last resort. The traditional doctrine of double effect, understood as providing a prohibition on instrumental harming as opposed to incidental harming or harming asa side effect, must be (...) distinguished from other ways in which the claim that a result is notintended might be offered as part of ajustification for it. Although double effectmight appropriately be invoked as a constrainton ordinary palliative care, it is not clearthat it can be coherently extended to justifysuch practices as terminal sedation. This chapter discusses the works of Danish philosopher Soren Kierkegaard that were discovered after his death on November 11, 1855. These papers were compiled by his nephew Henrik Lund and were later given to his brother Bishop Peter Christian Kierkegaard. Four major editions of the papers were published, which include Af Soren Kierkegaards Efterladte Papirer, Soren Kierkegaards Samlede Værker, Soren Kierkegaards Papirer, and Soren Kierkegaards Skrifter. The chapter also considers some aspects of Kierkegaard's working process.

Pisone Patre. The guest editors of this volume were Cynthia Damon and Sarolta Takacs. While it has not been the practice of the Journal to publish special issues, it seems appropriate (...) that we do so from time to time when a particularly interesting set of articles on a major theme presents itself. Such special issues are able to cover an author, work, or subject with more range and depth than one individual paper can, and they often contain layers of complexity and interdisciplinary insights that a single author would find it difficult to contribute.This special issue had its origins in the conference "Performing Aristophanes," held at Case Western Reserve University on February 24, 2001. Designed by the University's Theater Arts Department to complement the production of Mary-Kay Gamel's version of Aristophanes' Thesmophoriazousai, The Julie Thesmo Show, the conference was generously supported by the Baker-Nord Center and by the Susan and Ronald Heller Conferences for the Arts Fund. Two of the articles in this volume, those by Angeliki Tzanetou and Gonda Van Steen, were presented in an earlier version at the conference; others offering presentations were Niall W. Slater, Peter Meineck, John Starks, Jr., and Richard Perloff. Jeffrey Henderson provided incisive comments (which formed the basis for his epilogue in this volume). The other articles included here (Gamel, Scharffenberger, Stehle) were added at a later date.As Henderson points out in his epilogue, the Thesmophoriazousai is the Aristophanic play that has been least explored by scholars. But it has lately received more notice in new translations and a new critical [End Page 5] edition, and the time seems right for a new production of this play with accompanying reflections on its performance history, issues of gender and the body, the limits of a written text, the relationship between tragedy and comedy and between ritual and theatrical representation, and an unpublished, controversial, and relatively unknown translation of this play. Indeed, classicists are now paying more attention to both performance studies/performance criticism and translation as bona fide subdisciplines of classics. This work is devoted to the relations between Lambek’s Syntactic Calculus and noncommutative variants of Girard’s Linear Logic; in particular the paper will consider: the geometrical representation of the laws of LC by means of proof-nets; the discovery - due to such a geometrical representation - of some laws of LC not yet considered; the discussion of possible linguistic uses of these new laws.

Abstract: In Vacco v. Quill, 521 U.S. 793 (1997), the Supreme Court for the first time in American case law explicitly applied the principle of double effect to reject an equal protection claim to physician-assisted suicide. Double effect, traced historically to Thomas Aquinas, proposes that under certain circumstances it is permissible unintentionally to cause foreseen evil effects that would not be permissible to cause intentionally. The court rejected the constitutional claim on the basis of a distinction marked out by the (...) principle, i.e., between directly intending the death of a terminally ill patient as opposed to merely foreseeing that death as a consequence of medical treatment. The Court held that the distinction comports with fundamental legal principles of causation and intent. Id. at 802. -/- Critics allege that the principle itself is intrinsically flawed and that, in any event, its employment in Vacco is without legal precedent. I argue in response to contemporary objections that double effect is a valid principle of ethical reflection (Part II); claims to the contrary notwithstanding, double effect analysis is a pervasive, albeit generally unacknowledged principle employed regularly in American case law (Part III); and drawing on the preceding two sections, Vacco's application of the principle of double effect is appropriate (Part IV). -/- My conclusion is that [o]peration of some form of the principle, by whatever name, is inevitable. In an imperfect world where duties and interests collide, the possibility of choices of action foreseen to have both good and evil consequences cannot be avoided. In rare circumstances, ethics and the law require that a person refrain from acting altogether.
