Ethical Issues in Psychosocial Interventions Research Involving Controls.Lawrence Schneiderman, Barton W. Palmer, Eric Granholm, Dilip V. Jeste & Elyn R. Saks - 2002 - Ethics and Behavior 12 (1):87-101.
Psychiatric research is of critical importance in improving the care of persons with mental illness. Yet it may also raise difficult ethical issues. This article explores those issues in the context of a particular kind of research: psychosocial intervention research with control groups. We discuss 4 broad categories of ethical issues: consent, confidentiality, boundary violations, and risk-benefit issues. We believe that, despite the potential difficulties, psychosocial intervention research is vital and can be accomplished in an ethical manner. Further discussion and (...)

Mixed legal systems, east and west.Vernon V. Palmer, Muḥammad Yaḥyá Maṭar & Anna Koppel (eds.) - 2015 - Burlington, VT, USA: Ashgate.
This book takes us far beyond the usual focus of comparative law with analysis of a broad range of jurisdictions, including mixtures of common and civil law, and also those mixing Islamic and/or traditional legal systems with those derived from common and/or civil law traditions. The discussion is situated within the broader context of the continuing tides of globalization, the emergence of Islamic governments in some parts of the Middle East, the calls for a legal status for Islamic law in (...)

Women and Men Differ in Relative Strengths in Wisdom Profiles: A Study of 659 Adults Across the Lifespan.Emily B. H. Treichler, Barton W. Palmer, Tsung-Chin Wu, Michael L. Thomas, Xin M. Tu, Rebecca Daly, Ellen E. Lee & Dilip V. Jeste - 2022 - Frontiers in Psychology 12.
Wisdom is a multi-component trait that is important for mental health and well-being. In this study, we sought to understand gender differences in relative strengths in wisdom. A total of 659 individuals aged 27–103 years completed surveys including the 3-Dimensional Wisdom Scale and the San Diego Wisdom Scale. Analyses assessed gender differences in wisdom and gender’s moderating effect on the relationship between wisdom and associated constructs including depression, loneliness, well-being, optimism, and resilience. Women scored higher on average on the 3D-WS (...)

Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...)

AstraZeneca Pharmaceuticals LP, part of the class action suit known as In re Pharmaceutical Industry Average Wholesale Price Litigation. The First Circuit upheld a Massachusetts District Court finding that AstraZeneca violated Massachusetts’ consumer protection laws by manipulating the “average wholesale price” of its physician-administered injectable cancer drug Zoladex, leading to overpayment by the government, third-party payers, and consumers. Thinking in the Dark: Cinema, Theory, Practice.Murray Pomerance & R. Barton Palmer (eds.) - 2015 - New Brunswick, New Jersey: Rutgers University Press.
Today’s film scholars draw from a dizzying range of theoretical perspectives—they’re just as likely to cite philosopher Gilles Deleuze as they are to quote classic film theorist André Bazin. To students first encountering them, these theoretical lenses for viewing film can seem exhilarating, but also overwhelming. _Thinking in the Dark _introduces readers to twenty-one key theorists whose work has made a great impact on film scholarship today, including Rudolf Arnheim, Sergei Eisenstein, Michel Foucault, Siegfried Kracauer, and Judith Butler. With respect to editions, translations and secondary literature appearing after 1900 it is virtually complete in several languages. It also includes the important editions and translations from the nineteenth century as well as a good deal of the philosophical and philological literature on the dialogue from that period. The works which have been cited fall into five main sections: I) Editions and Translations; II) Discussions devoted to a Comprehensive Interpretation of the Cratylus; (...)

Explaining theoretical disagreement.Brian Leiter - manuscript
Shapiro has recently argued that Dworkin posed a new objection to legal positivism in Law's Empire, to which positivists, he says, have not adequately responded. Positivists, the objection goes, have no satisfactory account of what Dworkin calls “theoretical disagreement” about law, that is, disagreement about “the grounds of law” or what positivists would call the criteria of legal validity. I agree with Shapiro that the critique is new, and disagree that it has not been met. Positivism can not offer an (...)

Widespread, deep controversy as to the content of the law of a community is compatible with the view that the law is a system of rules. I defend that view through a critique of Ronald Dworkin's discussion of Riggs v. Palmer 22 N.E. 188. Dworkin raised an important challenge for jurisprudence: to account for the fact that legal rights and duties are frequently controversial. I offer an explanation of the possibility of deep disagreement about the application of social rules, (...)

Statutory interpretation and the counterfactual test for legislative intention.Win-Chiat Lee - 1989 - Law and Philosophy 8 (3):383-404.
In this paper I examine the counterfactual test for legislative intention as used in Riggs v. Palmer. The distinction between the speaker's meaning approach and the constructive interpretation approach to statutory interpretation, as made by Dworkin in Law's Empire, is explained. I argue that Dworkin underestimates the potential of the counterfactual test in making the speaker's meaning approach more plausible. I also argue that Dworkin's reasons for rejecting the counterfactual test, as proposed in Law's Empire, are either too weak (...)

  27. The moral relevance of the distinction between domesticated and wild animals.Clare Palmer - 2011 - In Beauchamp Tom & Frey R. G. (eds.), The Oxford Handbook of Animal Ethics,. Oxford University Press. pp. 701-725.
This article considers whether a morally relevant distinction can be drawn between wild and domesticated animals. The term “wildness” can be used in several different ways, only one of which (constitutive wildness, meaning an animal that has not been domesticated by being bred in particular ways) is generally paired and contrasted with“domesticated.” Domesticated animals are normally deliberately bred and confined. One of the article's arguments concerns human initiatives that establish relations with animals and thereby change what is owed to these (...)
