That the extraordinary narrative experiment known as theSatyriconhas regularly stimulated scholarly investigation into the relationship between status and freedom is not surprising for a work, the longest surviving section of which features an excessive dinner party at the house of alibertus. Much of the discussion has concentrated on the depiction of the dinner's host and his freedmen friends. Following the lead of F. Zeitlin and others in seeing the depiction of a ‘freedmen's milieu’ in theCena, J. Bodel argued in a (...) seminal paper published twenty years ago that theCenaopens a window onto the ‘freedman's mentality’. The last ten years or so have seen a revival of the theme, with much emphasis on the display of an open society in theCena, even a Saturnalian world-view, based on a suspension or reversal of the traditional social hierarchies, all framed by a general air of excessive liberality: whatever satirical lens theSatyricon’s author is seen to have projected onto Trimalchio and his freedmen friends,theyare understood as celebrating ‘freedom's defining difference’. In the light of such a unifying conceptualization of theCena’s motley crew, it is not surprising that scholars have come to understand the libertine assemblage as a reflection of ‘the social class of the “freedmen” in first-centurya.d.Italy’. After all, ‘class’ can be defined as ‘a number of individuals (persons or things) possessing common attributes’, and, with specific regard to human society, as ‘a division of society according to status’. This article deals with one particular aspect of Livy's narrative of the Gallic Sack of Rome, told in Book 5, and traditionally placed in 390b.c.—namely the issue over the validity of the ransom agreement struck by the Romans with the Gauls. The broader context is well known—and needs only brief reiteration here. When the Gauls march on Rome, the Romans give battle at the river Allia, leading to a resounding Gallic victory. Most of the Romans flee the battlefield and then (...) the city, except for a small group of both old and young, male and female, who hold out on the Capitoline Hill. That hill is subsequently put under siege by the Gauls. Following several months of beleaguerment, both sides are depicted as severely worn out by hunger and fighting. It is important for present purposes to stress that, when the Gauls stood at the gates and besieged the city, one of Rome's greatest heroes, Marcus Furius Camillus, was noticeably absent. Camillus was in neighbouring Ardea, some fifty miles south of Rome, training an army of Roman soldiers to challenge the Gallic invaders after his recent recall from exile and appointment to the dictatorship. But before Camillus’ return to Rome, the besieged Romans surrendered and agreed a ransom with the Gauls in order to liberate their city. The continuation of the story as given in Livy is equally well known. Camillus arrives in the middle of the ransom exchange, asking for the exchange to be stopped. Unsurprisingly, the Gauls are not keen on following Camillus’ orders, and insist on the ransom. Consequently, Camillus challenges the agreement between Romans and Gauls on a constitutional basis; the agreement was reached with a lesser magistrate after Camillus’ appointment to the dictatorship (5.49.2):cum illi renitentes pactos dicerent sese, negat eam pactionem ratam esse quae postquam ipse dictator creatus esset iniussu suo ab inferioris iuris magistratu facta esset, denuntiatque Gallis ut se ad proelium expediant.When they, resisting, said that they had come to an agreement, he [Camillus] denied that an agreement was valid which, after he himself had been made dictator, had been concluded by a magistrate of lower status without his instructions, and he announced to the Gauls that they should prepare themselves for battle.The constitutional argument has often been repeated by modern scholars. Ogilvie comments that ‘(t)he dictatorship was held to put all other magistracies into suspension.’ Feldherr notes similarly that, ‘(o)nce Camillus has been appointed dictator, hisimperiumsupersedes that of the lesser magistrates who negotiated the surrender.’ And to explain why the Gauls nevertheless entered into negotiations in Camillus’ absence, Ross observes that ‘the Gauls, of course, could hardly have known either of Camillus’ appointment as dictator or of the fact that the dictatorship superseded all other magistracies.’. From the first months of life, human infants produce “protophones,” speech-like, non-cry sounds, presumed absent, or only minimally present in other apes. But there have been no direct quantitative comparisons to support this presumption. In addition, by 2 months, human infants show sustained face-to-face interaction using protophones, a pattern thought also absent or very limited in other apes, but again, without quantitative comparison. Such comparison should provide evidence relevant to determining foundations of language, since substantially flexible vocalization, the inclination to (...) explore vocalization, and the ability to interact socially by means of vocalization are foundations for language. Here we quantitatively compare data on vocalization rates in three captive bonobo (Pan paniscus) mother–infant pairs with various sources of data from our laboratories on human infant vocalization. Both humans and bonobos produced distress sounds (cries/screams) and laughter. The bonobo infants also produced sounds that were neither screams nor laughs and that showed acoustic similarities to the human protophones. These protophone-like sounds confirm that bonobo infants share with humans the capacity to produce vocalizations that appear foundational for language. Still, there were dramatic differences between the species in both quantity and function of the protophone and protophone-like sounds. The bonobo protophone-like sounds were far less frequent than the human protophones, and the human protophones were far less likely to be interpreted as complaints and more likely as vocal play. Moreover, we found extensive vocal interaction between human infants and mothers, but no vocal interaction in the bonobo mother–infant pairs—while bonobo mothers were physically responsive to their infants, we observed no case of a bonobo mother vocalization directed to her infant. Our cross-species comparison focuses on low- and moderate-arousal circumstances because we reason the roots of language entail vocalization not triggered by excitement, for example, during fighting or intense play. Language appears to be founded in flexible vocalization, used to regulate comfortable social interaction, to share variable affective states at various levels of arousal, and to explore vocalization itself. We critique five points that impede the target article's far-reaching efforts toward formulating a neurobiological theory of language. Neurolinguistics amounts to no more than neurology in linguistics in this account, because it assumes “perceptual representational isomorphism,” processing autonomy and “meaning,” thereby aiming primarily at justifying modular concepts in terms of associative principles.

The debate about the use of robots in the care of older adults has often been dominated by either overly optimistic visions (coming particularly from Japan), in which robots are seamlessly incorporated into society thereby enhancing quality of life for everyone; or by extremely pessimistic scenarios that paint such a future as horrifying. We reject this dichotomy and argue for a more differentiated ethical evaluation of the possibilities and risks involved with the use of social robots. In a critical discussion (...) surrounding the capabilities approach to the ethical evaluation of quality of life, we develop an ethical framework that is more appropriate to the situation of the oldest old. We urge employment of a context-dependent approach to the ethical evaluation of new technologies in the care and therapy of older adults, and using the example of the robotic seal Paro, we show how this can be accomplished in a sensible and practical way. We study sincere-strategy preference-based approval voting (SP-AV), a system proposed by Brams and Sanver [1] and here adjusted so as to coerce admissibility of the votes (rather than excluding inadmissible votes a priori), with respect to procedural control. In such control scenarios, an external agent seeks to change the outcome of an election via actions such as adding/deleting/partitioning either candidates or voters. SP-AV combines the voters' preference rankings with their approvals of candidates, where in elections with at least two candidates (...) the voters' approval strategies are adjusted – if needed – to approve of their most-preferred candidate and to disapprove of their least-preferred candidate. This rule coerces admissibility of the votes even in the presence of control actions, and hybridizes, in effect, approval with pluralitiy voting. We prove that this system is computationally resistant (i.e., the corresponding control problems are NP-hard) to 19 out of 22 types of constructive and destructive control. Thus, SP-AV has more resistances to control than is currently known for any other natural voting system with a polynomial-time winner problem. In particular, SP-AV is (after Copeland voting, see Faliszewski et al. [2, 3]) the second natural voting system with an easy winner-determination procedure that is known to have full resistance to constructive control, and unlike Copeland voting it in addition displays broad resistance to destructive control (© 2009 WILEY-VCH Verlag GmbH & Co. Norms—that is, specifications of what we ought to do—play a critical role in the study of informal argumentation, as they do in studies of judgment, decision-making and reasoning more generally. Specifically, they guide a recurring theme: are people rational? Though rules and standards have been central to the study of reasoning, and behavior more generally, there has been little discussion within psychology about why (or indeed if) they should be considered normative despite the considerable philosophical literature that bears on this (...) topic. In the current paper, we ask what makes something a norm, with consideration both of norms in general and a specific example: norms for informal argumentation. We conclude that it is both possible and desirable to invoke norms for rational argument, and that a Bayesian approach provides solid normative principles with which to do so. (shrink)

Description logics are a family of knowledge representation formalisms that are descended from semantic networks and frames via the system Kl-one. During the last decade, it has been shown that the important reasoning problems (like subsumption and satisfiability) in a great variety of description logics can be decided using tableau-like algorithms. This is not very surprising since description logics have turned out to be closely related to propositional modal logics and logics of programs (such as propositional dynamic logic), for which (...) tableau procedures have been quite successful.Nevertheless, due to different underlying institutions and applications, most description logics differ significantly from run-of-the-mill modal and program logics. Consequently, the research on tableau algorithms in description logics led to new techniques and results, which are, however, also of interest for modal logicians. In this article, we will focus on three features that play an important rôle in description logics (number restrictions, terminological axioms, and role constructors), and show how they can be taken into account by tableau algorithms. Critical factors that appear to encourage vocal development in humans are altriciality and long immaturity. Hominid infants appear to have evolved a specific tendency to use elaborate vocalization as a means of soliciting long-term investment from caregivers. The development of such vocal capacity provides necessary infrastructure for language development across human life history.

Although argumentation plays an essential role in our lives, there is no integrated area of research on the psychology of argumentation. Instead research on argumentation is conducted in a number of separate research communities that are spread across disciplines and have only limited interaction. With a view to bridging these different strands, we first distinguish between three meanings of the word ?argument?: argument as a reason, argument as a structured sequence of reasons and claims, and argument as a social exchange. (...) All three meanings are integral to a complete understanding of human reasoning and cognition. Cognitive psychological research on argumentation has focused mostly on the first and second of these meanings, so we present perspectives on argumentation from outside of cognitive psychology, which focus on the second and third. Specifically, we give anoverview of the methods, goals, and disciplinary backgrounds of research on the production, the analysis, and the evaluation of arguments. Finally, inintroducing the experimental studies included in this special issue, which were conducted by researchers from a range of theoretical backgrounds, weunderline the breadth of argumentation research as well as stress opportunities for mutual awareness and integration. Emotion evaluations are assumed to play a crucial role in the emotion regulation process. We tested a postulate from our framework of emotion dysregulation (Nowak, U., Wittkamp, M. F., Clamor, A., & Lincoln, T. M. [2021]. Using the Ball-in-Bowl metaphor to outline an integrative framework for understanding dysregulated emotion. Frontiers in Psychiatry, 12, 118), namely that the extent to which individuals evaluate an emotion as harmful and their personal resources to modify and accept/tolerate the emotion as sufficient predict the subsequent (...) use of regulation strategies. Participants (n = 118) from a community sample took part in an experience-sampling assessment over 7 days including 10 daily paired measurements. The first measured momentary affective valence and arousal along with harmfulness evaluations and evaluations of personal resources to modify and accept/tolerate an emotion. The second followed three minutes later and measured emotion regulation strategies. The more harmful individuals evaluated an emotion, the more likely they were to use an emotion regulation strategy. The more harmful individuals evaluated an emotion, and the less sufficient they evaluated their personal resources to accept/tolerate an emotion, the more likely they were to use a maladaptive emotion regulation strategy. We conclude that emotions that people evaluate as harmful or difficult to accept are most likely to be regulated in a maladaptive manner. This implies that modifying beliefs about emotions could represent a promising treatment approach. (shrink)

Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be 'believed' by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the 'religious' affinities of the constitutional preambles. They were held as (...) 'creeds' of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents' big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the 'renaissance' of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law. Joseph Raz addresses one of the most basic philosophical questions: how to explain normativity in its many guises. His value-based account is brought to bear on many aspects of the lives of rational beings and their agency, such as their ability to maintain relationships, and to live their lives as social beings with a sense of their identity.

A large body of work has demonstrated the utility of the Bayesian framework for capturing inference in both specialist and everyday contexts. However, the central tool of the framework, conditionalization via Bayes’ rule, does not apply directly to a common type of learning: the acquisition of conditional information. How should an agent change her beliefs on learning that “If A, then C”? This issue, which is central to both reasoning and argumentation, has recently prompted considerable research interest. For valid informed consent, it is crucial that patients or research participants fully understand all that their consent entails. Testing and revising informed consent documents with the assistance of their addressees can improve their understandability. In this study we aimed at further developing a method for testing and improving informed consent documents with regard to readability and test-readers’ understanding and reactions. We tested, revised, and retested template informed consent documents for biobank research by means of 11 focus group interviews with (...) members from the documents’ target population. For the analysis of focus group excerpts we used qualitative content analysis. Revisions were made based on focus group feedback in an iterative process. Focus group participants gave substantial feedback on the original and on the revised version of the tested documents. Revisions included adding and clarifying explanations, including an info-box summarizing the main points of the text and an illustrative graphic. Our results indicate positive effects on the tested and revised informed consent documents in regard to general readability and test-readers’ understanding and reactions. Participatory methods for improving informed consent should be more often applied and further evaluated for both, medical interventions and clinical research. Particular conceptual and methodological challenges need to be addressed in the future. (shrink)

In a recent paper, Merabet and Hudry discuss models explaining the functional evolution of fushi tarazu (ftz) from an ancestral homeotic to a pair‐rule segmentation gene in Drosophila. As most of the experimental work underlying these models comes from our research, we wish to reply to Merabet and Hudry providing an explanation of the experimental approaches and logical framework underlying them. We review experimental data that support our hypotheses and discuss misconceptions in the literature. We emphasize that the change in (...) ftz function required changes in both expression pattern and protein function and review the evidence that these functional changes involved a switch in cofactor‐interaction motifs during arthropod radiations. While agreeing with Merabet and Hudry that protein context likely contributes to Ftz function, we argue that until supporting evidence for alternative mechanisms is obtained, the role of cofactor‐interaction motifs in driving a functional switch remains compelling. There is a crisis of valuation practices in the current academic life sciences, triggered by unsustainable growth and “hyper-competition.” Quantitative metrics in evaluating researchers are seen as replacing deeper considerations of the quality and novelty of work, as well as substantive care for the societal implications of research. Junior researchers are frequently mentioned as those most strongly affected by these dynamics. However, their own perceptions of these issues are much less frequently considered. This paper aims at contributing to a better (...) understanding of the interplay between how research is valued and how young researchers learn to live, work and produce knowledge within academia. We thus analyze how PhD students and postdocs in the Austrian life sciences ascribe worth to people, objects and practices as they talk about their own present and future lives in research. We draw on literature from the field of valuation studies and its interest in how actors refer to different forms of valuation to account for their actions. We explore how young researchers are socialized into different valuation practices in different stages of their growing into science. Introducing the concept of “regimes of valuation” we show that PhD students relate to a wider evaluative repertoire while postdocs base their decisions on one dominant regime of valuing research. In conclusion, we discuss the implications of these findings for the epistemic and social development of the life sciences, and for other scientific fields. (shrink)

This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power). In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation (...) of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this 'new order of the ages' suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically 'higher' form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments - from the French Revolution to Napoleon's downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory. Also included in this volume are the French originals and English translations of two vital documents. The first - Emmanuel Joseph Sieyès' Du Jury Constitutionnaire (1795) - highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second - the 1812 draft of the Constitution of the Kingdom of Poland - presents the 'constitutional propaganda' of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe's constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty. A longstanding question is the extent to which "reasonable doubt" may be expressed simply in terms of a threshold degree of belief. In this context, we examine the extent to which learning about possible alternatives may alter one's beliefs about a target hypothesis, even when no new "evidence" linking them to the hypothesis is acquired. Imagine the following scenario: a crime has been committed and Alice, the police's main suspect has been brought to trial. There are several pieces of evidence (...) that raise the probability that Alice committed the crime. Her attorney's defense strategy is not to challenge this evidence, but instead to provide personal details about Alice's neighbour, Jane. While Jane is one of many people the police spoke to, they saw no reason to investigate her further. You now learn that Jane, too, had access to the shed where the murder weapon was stored, just like Alice. To what extent should this alter your beliefs about Alice's guilt? In this paper, we provide a formal description of the problem and a solution indicating circumstances under which learning about Jane will more or less impact beliefs about Alice. (shrink)

Certain patients with a possible contribution of the sympathetic system to pain may not fit the definition of complex regional pain syndromes (CRPS), which raises the question of terminology for those patients. To further clarify the relationship between the sympathetic system and pain, apart from the need for placebo studies, there remains an urgent need for a satisfactory definition of the criteria for a complete sympathetic block. It also remains uncertain whether a change in the discharge pattern of sympathetic fibres (...) underlies the changes in sympathetic organ function, often found in patients with CRPS. (shrink)

The target article discusses various aspects of the relationship between the sympathetic system and pain. To this end, the patients under study are divided into three groups. In the first group, called (RSD), the syndrome can be characterized by a triad of autonomic, motor, and sensory symptoms, which occur in a distally generalized distribution. The pain is typically felt deeply and diffusely, has an orthostatic component, and is suppressed by the ischemia test. Under those circumstances, the pain is likely to (...) respond to sympatholytic interventions. In a second group, called (SMP) syndrome, the principal symptoms are spontaneous pain, which is felt superficially and has no orthostatic component, and allodynia. These symptoms, typically confined to the zone of a lesioned nerve, may also be relieved by sympathetic blocks. Since the characteristics of the pain differ between RSD and SMP, the underlying kind of sympathetic–sensory coupling may also vary between these cases. A very small third group of patients exhibits symptoms of both RSD and SMP. The dependence or independence of pain on sympathetic function reported in most published studies seems to be questionable because the degree of technical success of the block remains uncertain. Therefore, pain should not be reported as sympathetic function independent until the criteria for a complete sympathetic block have been established and satisfied. (shrink)

Van Gelder's specification of the dynamical hypothesis does not improve on previous notions. All three key attributes of dynamical systems apply to Turing machines and are hence too general. However, when a more restricted definition of a dynamical system is adopted, it becomes clear that the dynamical hypothesis is too underspecified to constitute an interesting cognitive claim.

The paper introduces, compares and contrasts formal models of source reliability proposed in the epistemology literature, in particular the prominent models of Bovens and Hartmann and Olsson :127–143, 2011). All are Bayesian models seeking to provide normative guidance, yet they differ subtly in assumptions and resulting behavior. Models are evaluated both on conceptual grounds and through simulations, and the relationship between models is clarified. The simulations both show surprising similarities and highlight relevant differences between these models. Most importantly, however, our (...) evaluations reveal that important normative concerns arguably remain unresolved. The philosophical implications of this for testimony are discussed. (shrink)

There has been much interest in group judgment and the so-called 'wisdom of crowds'. In many real world contexts, members of groups not only share a dependence on external sources of information, but they also communicate with one another, thus introducing correlations among their responses that can diminish collective accuracy. This has long been known, but it has-to date-not been examined to what extent different kinds of communication networks may give rise to systematically different effects on accuracy. We argue that (...) equations that relate group accuracy, individual accuracy, and group diversity are useful theoretical tools for understanding group performance in the context of research on group structure. In particular, these equations may serve to identify the kind of group structures that improve individual accuracy without thereby excessively diminishing diversity so that the net positive effect is an improvement even on the level of collective accuracy. Two experiments are reported where two structures are investigated from this perspective. It is demonstrated that the more constrained network outperforms the network with a free flow of information.
