Essays in this volume honor Marcel Senn on the occasion of his retirement from the law department of Universität Zürich. The contributors of the essays are colleagues and friends.

Wang (_Philosophy & Technology_ 35, 2022) introduces a Foucauldian power account of algorithmic transparency. This short commentary explores when this power account is appropriate. It is first observed that the power account is a constructionist one, and that such accounts often come with both factual and evaluative claims. In an instance of Hume’s law, the evaluative claims do not follow from the factual claims, leaving open the question of how much constructionist commitment (Hacking, 1999) one should have. The concept of (...) acts in equilibrium (Nozick, 1981) is then used to explain how different individuals reading Wang can end up with different evaluative attitudes towards algorithmic transparency, despite factual agreement. The commentary concludes by situating constructionist commitment inside a larger question of how much to think of our actions, identifying conflicting arguments. (shrink)

Our paper addresses the question of what exactly the contribution of the humanities to management education could or should be, suggesting the concept of Literacy as both this contribution’s goal and method. Though there seems to emerge a consensus in the debate about the future of management education that the humanities should be involved with shaping it, some misconceptions about the humanities obscure the understanding of the why and how of it, most notably as to the manner in which they (...) are to provide for ethical values. Our paper in a first step endeavours to clear those misconceptions up drawing on some historical aspects of their development. It then proceeds to introducing the concept of Literacy and, based on it, the teaching framework of Critical Management Literacy we designed to operationalize the concept towards management students` needs. Our leading hypothesis is that the contribution of the humanities should focus on the cultivation of the capacity for epistemological doubt in order to prepare students for the complexity and indeterminacy of reality, thus at the same time laying the groundwork for ethical reflectivity. Bei Kant tauchen viele antike Autoren und Theorien auf. In dieser ersten Gesamtbearbeitung zum Thema wird gegen eine langjährige Forschungsmeinung gezeigt, dass nicht so sehr Platon und Aristoteles als vielmehr der hellenistischen Philosophie die entscheidende Rolle für sein Denken zukommt. Anhand der drei Kritiken werden Konstanzen und Umbrüche seines Antikeverständnisses herausgearbeitet und in ihren Konsequenzen für die Kantdeutung beleuchtet.

Das Placebo - konzipiert, um die Wirksamkeit des Arzneimittels objektiv zu überprüfen - entfaltet selbst unterschiedliche Eigenschaften und erzeugt vielfältige Effekte. Anhand von Vertreter_innen der Philosophie, wie Fleck, Rheinberger, Foucault, Baudrillard, Latour und Haraway, zeigt Ulrike Neumaier, dass sich - stellt man das Placebo in den Mittelpunkt einer Untersuchung - nicht nur in der Medizin Begriffe wie »Krankheit« und »Körper« verändern. Vielmehr wird sichtbar, wie Wissenschaft, Technik und Gesellschaft sich vernetzen, wie sich dadurch der Begriff von »Wissenschaft« wandelt und (...) warum vom Zeitalter der Technowissenschaften gesprochen werden kann. Aus philosophischer Perspektive diskutiert Ulrike Kleemeiers Studie einer Reihe auch aktuelle wieder sehr brisanter Probleme. Analysiert werden der Begriff des Krieges ebenso wie die Ursachen von Kriegen und die Kriegsprävention. Dabei untersucht die Autorin auch den Zusammenhang von Krieg und Gerechtigkeit bzw. Krieg und Recht, das Verhältnis von Krieg und Politik, das Problem des Bürgerkriegs sowie die Bedeutung kriegerisch-militärischer Tugenden und Kompetenzen. Die Auseinandersetzung erfolgt in exemplarischer Form anhand der Theorien von Platon, Hobbes und Clausewitz. Der Arbeit liegt die (...) Annahme zugrunde, dass eine Theorie des Krieges sinnvoll nur in einem interdisziplinären Bezugsrahmen entwickelt werden kann. Deshalb wendet sich dieses Buch an Fachphilosophen genauso wie an alle anderen am Thema Krieg interessierten Forscher, etwas an Historiker, Politologen und Sozialwissenschaftler. (shrink)

We examine in detail three classic reasoning fallacies, that is, supposedly ``incorrect'' forms of argument. These are the so-called argumentam ad ignorantiam, the circular argument or petitio principii, and the slippery slope argument. In each case, the argument type is shown to match structurally arguments which are widely accepted. This suggests that it is not the form of the arguments as such that is problematic but rather something about the content of those examples with which they are typically justified. This (...) leads to a Bayesian reanalysis of these classic argument forms and a reformulation of the conditions under which they do or do not constitute legitimate forms of argumentation. (shrink)

In this paper, it is argued that the most fruitful approach to developing normative models of argument quality is one that combines the argumentation scheme approach with Bayesian argumentation. Three sample argumentation schemes from the literature are discussed: the argument from sign, the argument from expert opinion, and the appeal to popular opinion. Limitations of the scheme-based treatment of these argument forms are identified and it is shown how a Bayesian perspective may help to overcome these. At the same time, (...) the contributions of the standard scheme-based approach are highlighted, and it is argued that only a combination of the insights of different traditions will yield a complete normative theory of argument quality. One of the most striking features of is the detail with which behavior on logical reasoning tasks can now be predicted and explained. This detail is surprising, given the state of the field 10 to 15 years ago, and it has been brought about by a theoretical program that largely ignores consideration of cognitive processes, that is, any kind of internal behavior that generates overt responding. It seems that an increase in explanatory power can be achieved by restricting a psychological (...) theory. (shrink)

This paper investigates the dynamic and performative construction of publics in public engagement exercises. In this investigation, we, on the one hand, analyse how public engagement settings as political machineries frame particular kinds of roles and identities for the participating publics in relation to ‘the public at large’. On the other hand, we study how the participating citizens appropriate, resist and transform these roles and identities, and how they construct themselves and the participating group in relation to wider publics. The (...) empirical basis of our argument is a discussion of four different kinds of participation events in Austria. Building on these observations we develop conclusions about the public up-take of public participation in technoscience and the role of public engagement in current techno-political cultures. The legal doctrine of ‘common purpose’ in South African criminal law considers all parties liable who have been in implicit or explicit agreement to commit an unlawful act, and associated with each other for that purpose, even if the consequential act has been carried out by one of them. It relieves the prosecution of proving the causal link between the conduct of an individual member of a group acting in common purpose, and the ultimate consequence caused by the action of (...) the group as a whole. The National Prosecuting Authority’s controversial and vociferously challenged decision to charge 270 demonstrators at Lonmin Platinum Mine in Marikana with the murders of 34 colleagues under the ‘common purpose’ doctrine, implying liability by association or agreement, raises the question as to the constitution and characteristics of the crowd and of the public, respectively. This article outlines the history of the application of the common purpose rule in South Africa, to then examine ‘common purpose’ within the philosophical parameters of group psychology and collective intentionality. It argues for methodological individualism within a psychoanalytic theorisation of group dynamics, and a non-summative approach to collective intentionality, in addressing some problems in the conceptualisation of group formation. Recent advances in artificial intelligence offer many beneficial prospects. However, concerns have been raised about the opacity of decisions made by these systems, some of which have turned out to be biased in various ways. This article makes a contribution to a growing body of literature on how to make systems for automated decision-making more transparent, explainable, and fair by drawing attention to and further elaborating a distinction first made by Nozick between first-level bias in the application of standards and (...) second-level bias in the choice of standards, as well as a second distinction between discrimination and arbitrariness. Applying the typology developed, a number of illuminating observations are made. First, it is observed that some reported bias in automated decision-making is first-level arbitrariness, which can be alleviated by explainability techniques. However, such techniques have only a limited potential to alleviate first-level discrimination. Second, it is argued that second-level arbitrariness is probably quite common in automated decision-making. In contrast to first-level arbitrariness, however, second-level arbitrariness is not straightforward to detect automatically. Third, the prospects for alleviating arbitrariness are discussed. It is argued that detecting and alleviating second-level arbitrariness is a profound problem because there are many contrasting and sometimes conflicting standards from which to choose, and even when we make intentional efforts to choose standards for good reasons, some second-level arbitrariness remains. In recent years, the receipt and the perception of information has changed in ways which have fueled fears about the fates of our democracies. However, real information on these possibilities or the direction of these changes does not exist. Into this gap, Hahn and colleagues bring the power of Condorcet's (1785) Jury Theorem to show that changes in our information networks have affected voter inter‐dependence so that it is likely that voters are now collectively more ignorant even if individual voter (...) competence remains unchanged. This short commentary on Peters identifies the entrenchment of political positions as one additional concern related to algorithmic political bias, beyond those identified by Peters. First, it is observed that the political positions detected and predicted by algorithms are typically contingent and largely explained by “political tribalism”, as argued by Brennan. Second, following Hacking, the social construction of political identities is analyzed and it is concluded that algorithmic political bias can contribute to such identities. Third, following Nozick, it is argued (...) that purist political positions may stand in the way of the pursuit of all worthy values and goals to be pursued in the political realm and that to the extent that algorithmic political bias entrenches political positions, it also hinders this healthy “zigzag of politics”. Background: Recent research has demonstrated that depressed individuals show impairments in inhibiting irrelevant emotional material, and that these impairments are linked to rumination. Cognitive inhibition, however, is not a unitary construct but consists of several components which operate at different stages of information processing. The present study was designed to assess two components of inhibition and examine their relation to depression and rumination in a sample of clinically depressed and healthy control participants. Methods: Twenty-two individuals diagnosed with a current depressive (...) episode and 27 never-disordered control participants completed an Emotional Flanker Task to assess individual differences in interference control and a modification of the Working Memory Selection Task to assess individual differences in the ability to discard no longer relevant emotional material from working memory. Participants completed self-report measures to assess depressive symptoms and rumination. Results: Clinically depressed compared to control participants showed significantly reduced interference control of irrelevant negative information. The groups, however, did not differ in their ability to discard no longer relevant negative information from working memory. In contrast, rumination was associated with difficulty removing no longer relevant negative material from working memory but not with deficits in interference control. Conclusions: Results highlight the importance of differentiating among components of inhibition to gain a better understanding of cognitive mechanisms underlying depression and rumination. (shrink)

Modern society makes extensive use of automated algorithmic decisions, fueled by advances in artificial intelligence. However, since these systems are not perfect, questions about fairness are increasingly investigated in the literature. In particular, many authors take a Rawlsian approach to algorithmic fairness. This article aims to identify some complications with this approach: Under which circumstances can Rawls’s original position reasonably be applied to algorithmic fairness decisions? First, it is argued that there are important differences between Rawls’s original position and a (...) parallel algorithmic fairness original position with respect to risk attitudes. Second, it is argued that the application of Rawls’s original position to algorithmic fairness faces a boundary problem in defining relevant stakeholders. Third, it is observed that the definition of the least advantaged, necessary for applying the difference principle, requires some attention in the context of algorithmic fairness. Finally, it is argued that appropriate deliberation in algorithmic fairness contexts often require more knowledge about probabilities than the Rawlsian original position allows. Provided that these complications are duly considered, the thought-experiment of the Rawlsian original position can be useful in algorithmic fairness decisions. (shrink)

Donald Davidson writes that “[r]easons for intending to do something are very much like reasons for action, indeed one might hold that they are exactly the same except for time.” That the reasons for forming an intention and the reasons for acting as intended are in some way related is a widely accepted claim. But it can take different forms: (1) the reasons may mirror each other so that there is a (derivative) reason to intend whenever there is a reason (...) to act; or (2) they may reduce to just one kind: perhaps all reasons for action are really reasons for forming intentions.3 Or the other way around: (3) all reasons for intentions are really reasons to act. The three versions are not equally strong contenders though. The third - that reasons to intend could reduce to reasons to act - seems unlikely. After all, there may be reasons to form future-directed intentions, in particular, independently of the reason to act as intended. The second suggestion falls prey to different considerations: reasons to act can, at least sometimes, be reasons to produce a certain outcome, quite independently of the intention with which the action is done, or whether it is done intentionally at all. In these cases, the reason to act is not (or not obviously) a reason to intend. Therefore, I don’t pursue the possibility of a reduction in this paper. My focus is on the first, non-reductive proposal. I will discuss various versions of it in some detail, but ultimately reject it. (shrink)

Our beliefs and opinions are shaped by others, making our social networks crucial in determining what we believe to be true. Sometimes this is for the good because our peers help us form a more accurate opinion. Sometimes it is for the worse because we are led astray. In this context, we address via agent-based computer simulations the extent to which patterns of connectivity within our social networks affect the likelihood that initially undecided agents in a network converge on a (...) true opinion following group deliberation. The model incorporates a fine-grained and realistic representation of belief and trust, and it allows agents to consult outside information sources. We study a wide range of network structures and provide a detailed statistical analysis concerning the exact contribution of various network metrics to collective competence. Our results highlight and explain the collective risks involved in an overly networked or partitioned society. Specifically, we find that 96% of the variation in collective competence across networks can be attributed to differences in amount of connectivity and clustering, which are negatively correlated with collective competence. A study of bandwagon or “group think” effects indicates that both connectivity and clustering increase the probability that the network, wholly or partly, locks into a false opinion. Our work is interestingly related to Gerhard Schurz’s work on meta-induction and can be seen as broadly addressing a practical limitation of his approach. (shrink)

Zebrafish is recognized as one of the most important vertebrate model organisms; however, its value in pharmacological studies has not been extensively explored and exploited. In this review, I summarize significant findings about the effects of drugs and medicines on important physiological processes in zebrafish. Our experiments have shown that cardiovascular, anti‐angiogenic and anti‐cancer drugs elicit comparable responses in zebrafish embryos to those in mammalian systems. Similar observations have been reported by other laboratories, exposing zebrafish to a variety of pharmaceutical (...) active compounds affecting a range of different processes. All the data summarized indicate that zebrafish represents a very valuable organism for different kinds of pharmacological studies, such as screenings of chemical libraries, lead validation and optimization, mode‐of‐action studies, analysis of gene function, predictive toxicology and teratogenicity, pharmacogenomics and toxicogenomics. Zebrafish pharmacological assays have specific advantages compared to in vitro cell culture studies and in vivo experiments using mice, complementing these assays to give valuable guides for future tests of new drugs for human therapy.
