This commentary explores Medicaid's role for children with special health care needs today and considers how changes to Medicaid's federal financing structure under a per capita cap or block grant could affect coverage for these children.

Suppose you perform two actions. The first imposes a risk of harm that, on its own, would be excessive; but the second reduces the risk of harm by a corresponding amount. By pairing the two actions together to form a set of actions that is risk-neutral, can you thereby make your overall course of conduct permissible? This question is theoretically interesting, because the answer is apparently: sometimes Yes, sometimes No. It is also practically important, because it bears on the moral (...) status of practices such as offsetting personal greenhouse gas (GHG) emissions. In this article we propose a criterion for distinguishing between cases where pairing risk-increasing and risk-reducing actions makes each action permissible, and those where it does not: the Principle of Aggregate Risk-Imposition. We work towards this by considering a range of examples that illustrate various illegitimate ways of pairing risk-increasing actions with risk-reducing ones, and asking what goes wrong in each case. We then use this criterion to evaluate GHG offsetting. Is offsetting a legitimate way of removing the risk-imposition associated with GHG emissions, or not? Controversially, we argue that this turns out to depend on the form that the offsetting takes. (shrink)

ABSTRACT In ‘Should I offset or should I do more good?’, H. Orri Stefansson defends an argument that calls into question the belief that we can discharge our duties to prevent harm by carbon offsetting. Stefansson suggests that other actions, such as donations, should be preferred. This paper questions aspects of that analysis by evaluating the normative assumptions underlying it. It does so from a broadly Kantian perspective. I begin by highlighting assumptions that could benefit from elaboration and defense. (...) Do carbon-offsetting schemes morally offset emissions? The moral equivalence thesis is the claim that the combination of emitting greenhouse gasses and offsetting those emissions is morally equivalent to not emitting at all. This thesis implies that in response to climate change, we need not make any lifestyle changes to reduce our emissions as long as we offset them. An influential argument in favor of this thesis is premised on two claims, one empirical and the other normative: (1) When (...) you emit + offset, the net result is the same as that of not emitting. (2) With emissions, the net result is what matters morally. I argue against both premises. The net result of emitting + offsetting is never equivalent to that of not emitting, and even if it were equivalent, the net result is not the only thing that matters morally. My conclusion is that although we should offset our emissions, avoiding emissions is morally preferable. This conclusion supports a stronger claim: that carbon offsets cannot relieve us of our duty to make significant lifestyle changes so as to reduce emissions and thus lesson our contribution to the harms of climate change. Carbon offsets either remove greenhouse gases from the air or prevent emissions thereof. They face questions both economic (is ‘net zero’ really reached?) and moral. I defend the moral permissibility of off-sets. They likely shift climate harms around, but that need not be unjust—and in any case we cannot avoid doing that.

This paper explores the idea of moral offsetting: the idea that good actions can offset bad actions in a way roughly analogous to carbon offsetting. For example, a meat eater might try to offset their consumption of meat by donating to an animal welfare charity. In this paper, I clarify the idea of moral offsetting, consider whether the leading moral theories and theories of moral worth are consistent with the possibility of moral offsetting, and consider potential benefits of (...) moral offsetting. Luke Elson defends carbon offsetting on the basis that it is not morally objectionable to shift harms or risks around. As long as emitting and offsetting does not increase the overall harms or risks—and merely shifts them—compared to refraining from emitting, he suggests there is no injustice involved. I respond in several ways, suggesting that the time delay involved in offsetting can increase these risks but, regardless, there is a defensible default which could justify refraining from emitting, even when planning (...) to offset. ABSTRACT Offsetting is a very ineffective way to do good. Offsetting your lifetime emissions may increase aggregated life expectancy by at most seven years, while giving the amount it costs to offset your lifetime emissions to a malaria charity saves in expectation the life of at least one child. Is there any moral reason to offset rather than giving to some charity that does good so much more effectively? There might be such a reason if your offsetting compensated (...) or somehow benefitted the victims of your emission, since that could mean that you would satisfy the duty not to harm others by emitting and offsetting. But that is typically not true. If your emission harms some person and your offsetting benefits some person, then these are most likely different people. Hence, I conclude, we have a stronger reason to give to effective charities than we have to offset our emissions. (shrink)

For all the talk there has been lately about privilege, few have commented on the moral obligations that are associated with having privilege. Those who have commented haven't gone much beyond the idea that the privileged should be conscious of their privilege, should listen to those who don't have it. Here we want to go further, and build an account of the moral obligations of those with a particular kind of privilege: race privilege. In this paper we articulate an understanding (...) of race privilege, say how a person can know when she has it, and argue that a race-privileged person has obligations to offset her privilege. We make concrete suggestions for how she can, at least approximately, do this. We use particular racial group disparities in the United States as our running example throughout the paper, although our conclusions generalize. (shrink)

It is typically wrong to act in a way that foreseeably makes some impending harm worse. Sometimes it is permissible to do so, however, if one also offsets the harm increasing action by doing something that decreases the badness of the same harm by at least as much. This chapter argues that the standard deontological constraint against doing harm is not compatible with the permissibility of harm increases that have been offset. Offsetting neither prevents one's other actions from doing (...) harm nor ensures that the harm those actions do is made permissible by any of the constraint's familiar provisos. To make sense of offsetting, the old constraint against doing harm should be replaced with a new constraint against making unoffset harm increases. The chapter discusses how to formulate the new constraint so that it can handle both the offsetting cases that the old constraint gets wrong as as well as the non-offsetting cases that the old constraint gets right. Adopting this constraint against unoffset harm increases may have important implications both for theoretical questions about the sources of deontological constraints as well as for practical questions, such as whether buying carbon offsets can make emitting carbon dioxide permissible. This essay addresses moral aspects of using carbon offsets for counteracting individuals’ luxury emissions. After introducing and outlining the main topics and terms related to carbon offsetting, this essay answers three objections that have been levied against carbon offsetting: objections from the indulgences analogy, objections from the directness of the duty not to harm, and separateness objections. The essay argues that advocates for offsetting have resources to defend against these criticisms by pointing to particularities of individual emissions’ harmfulness, as well (...) as the preemptive nature of offsetting. The essay then shows that in spite of these defenses there is reason to regard not emitting as a better option because of a host of problems that plague offsetting in its current forms. The essay concludes that offsetting enhances individuals’ options for discharging their duty not to harm, but that standards of justice and efficacy need to be adopted. (shrink)

The UK is an unequal society. Societies like these raise significant ethical questions for those who live in them. One is how they should respond to such inequality, and in particular, to its effects on those who are worst-off. In this article, I’ll approach this question by focusing on the obligations of a particular group of those who are best-off. I’ll defend the idea of morally objectionable class-based advantage, which I’ll call ‘class privilege’, argue that class privilege can be non-culpable, (...) and put forward an account of the obligations those with class privilege have. My main claim will be that those with class privilege have obligations to ‘offset’ their privilege, in something like the same way high emitters have obligations to offset their greenhouse gas emissions. This article scrutinizes this apparent badness and demonstrates that on most plausible consequentialist frameworks, the extinction of humanity is not necessarily bad. The best accounts of the badness of the extinction of humanity focus on the loss of potential utility, but this loss can be offset if it is the result of sufficiently large gains by the present generation. Carbon offsetting can be loosely characterized as a mechanism by which an organization or individual contributes to a scheme that is projected either to remove carbon dioxide from the atmosphere or to deliver carbon dioxide emission reductions on the part of other organizations or individuals. An activity that has been offset therefore purports to make no long-term net contribution to atmospheric greenhouse gas concentrations. The ethical basis for using carbon offsetting as an approach to tackling climate change is very (...) much contested. We seek to expose some of the underlying reasons for these ethical disagreements. We show that they relate both to empirical disagreements about what the likely benefits of offsetting are and, more fundamentally, to principled disagreements about the right way to discharge duties to deliver carbon reductions. Many companies offer their customers voluntary carbon ‘offset’ certificates to compensate for greenhouse gas emissions. Voluntary offset certificates are cheap because the demand for them is low, allowing consumers to compensate for their emissions without significant sacrifices. Regarding the distribution of emission reduction responsibilities I argue that excess emissions are permissible if they are offset properly. However, if individuals buy offsets only because they are cheap, they fail to be robustly motivated to choose a permissible course of (...) action.This suspected lack of robust motivation raises both pragmatic questions about the functioning of offsetting schemes and moral questions about the worth of such unstable motives. The analysis provided here also has wider implications for the normative analysis of partial compliance and ‘many hands’ problems, especially for those cases where compliance levels and costs interact. In this article, we explore the world's response to the increasing impact of carbon emissions on the sobering threat posed by global warming: the carbon offset market. Though the market is a relatively new one, numerous offset providers have quickly emerged under both regulated and voluntary regimes. Owing to the lack of technical literacy of some stakeholders who participate in the market, no common quality or certification structure has yet emerged for providers. To the contrary, the media warns (...) that a relative "cowboy" atmosphere prevails in the current environment, and that there are "widespread instances of people and organizations buying worthless credits that do not yield any reductions in carbon emissions" (Harvey and Fidler, Financial Times, 2007). At this point in the evolution of the market, only a handful of offset provider-rating schemes exist; and, even these systems leave consumers with few answers when they seek to find a means by which to ensure that the said systems are having their intended impact. The purpose of this article is, first, to provide a grounded understanding of the nature of the offset market, a tendency toward carbon neutrality as a possible point of equilibrium, and the ethical tensions that surround it from the perspective of the consuming public. Second, we outline the standards environment for offset providers to illustrate most effectively the need for a single set of criteria among providers that is readily understandable by the common consumer stakeholder. We then explore the differences among the providers and articulate the specific criteria upon which providers may be evaluated by this particular stakeholder constituency, by bringing together best practices based on currently available analyses. Finally, we share the results of preliminary data collection in connection with 117 offset providers and highlight early findings. These findings allow us comparing providers effectively and efficiently on a common scale that services both providers, who thereby have greater guidance for self-assessment purposes, as well as consumer stakeholders, who then have the ability to make useful and more informed choices about carbon emission reduction in the future. Many real-world agents recognise that they impose harms by choosing to emit carbon, e.g., by flying. Yet many do so anyway, and then attempt to make things right by offsetting those harms. Such offsetters typically believe that, by offsetting, they change the deontic status of their behaviour, making an otherwise impermissible action permissible. Do they succeed in practice? Some philosophers have argued that they do, since their offsets appear to reverse the adverse effects of their emissions. But we show that (...) they do not. In practice, standard carbon offsetting does not reverse the harms of the original action, nor does it even benefit the same group as was harmed. Standard moral theories hence deny that such offsetting succeeds. Indeed, we show that any moral theory that allows offsetting in this setting faces a dilemma between allowing any wrong to be offset, no matter how grievous, and recognising an implausibly sharp discontinuity between offsettable actions and non-offsettable actions. The most plausible response is to accept that carbon offsetting fails to right our climate wrongs. (shrink)

Biodiversity offsetting is an increasingly popular policy instrument used to compensate for losses in biodiversity and ecosystem services caused by development projects. Although evidence suggests that offsetting can yield significant environmental benefits, application of the policy instrument is surrounded by controversy. Among other things, critics argue that offsetting builds on normatively contentious assumptions regarding the value of nature and the fungibility of biodiversity components, such as species, habitats, ecosystems, and landscapes. A large portion of the criticism targets the allegedly illegitimate (...) commodification of nature that the policy instrument entails. Exploring the significantly more developed normative discussion on carbon offsetting, this article identifies four arguments that plausibly could be made to support the claim that it is wrong to commodify nature in the way biodiversity offsetting schemes do: the common ownership argument, the price argument, the non‐substitutability argument, and the “crowding out” argument. Although none of the arguments definitively invalidate the use of biodiversity offsets, they provide good reasons to proceed with caution when designing and implementing them. (shrink)

This dissertation develops a Kantian philosophical framework for understanding our individual obligations under public law. Because we have a right to do anything that is not wrong, the best interpretation of Immanuel Kant's Universal Principle of Right tracks the two ways--material and formal--in which actions can be wrong. This interpretation yields surprising insights, most notably a novel formulation of Kant's standard for formal wrongdoing. Because the wrong-making property of a formally wrong action does not depend on whether or not the (...) action in question has been prohibited by statute, Kant's legal philosophy is consistent with a natural law theory of public crime. Moreover, because the law can obligate us only by establishing a universal external incentive to obey its commands, statutes that impose only fines on nominal violators do not constrain our lawful options. Instead, if they are otherwise just, such statutes must be regarded as rightful permissive laws, according to which we may incur liabilities through our voluntary choices. (shrink)

The article uses typological understanding of the Lord's Supper to analyze Old Testament text. Intertextual hermeneutics, which connects the lexical units of various parts of texts for comprehensive understanding allowed to see an echo of the Eucharist in Old Testament. One of the most expressive prototypes or typos of the Lord's Supper in the Old Testament is the idea of the Covenants and changing of the covenants. The author analyzes the concept of testament and all cases of using this term (...) in Old Testament texts, and concludes that the word “berith” in the biblical text cannot be identified only with the concept of contract, agreement or union. Also, it cannot be identified only with the concept of law, command or statute. The Testament should be taken holistically, combining different meanings of this concept. In this way, the “berith” describes the idea of a specific agreement, which has the character of a bloody decree. Therefore, on the basis of biblical ideas, the concept of a covenant in a broad sense can be presented as a relationship between God and people, which can be described as a God-initiated contract of a personal-corporate nature, which provides for mutual obligations. This kind of relationship is characterized by a fixed immutability and is accompanied by signs, evidence and a special memory procedure. Therefore, in the Old Testament period, we can confidently talk only about the Covenant with Noah, Abraham and Moses, who were revealed and showed their inner, spiritual essence in the New Testament of Jesus Christ. Only in these cases did the signs of covenant relations in the narrow sense be revealed, namely: God's initiative, personal-corporate relations, the invariability and obligatory commemorativeness are caused. Other ancient covenants do not contain a complete religious component and are not eucharistic prototypes. An important sign of the typos of the Lord's Supper in the Old Testament is the blood of the covenant. All covenants were accompanied by the shedding of sacrificial blood, which indicated the sacrifice of Christ and its echo in the Eucharistic cup. This emphasizes the difference between “berith” as a covenant and “berith” as a commandment or statute. Bloodless covenant are not testaments in the full biblical sense of the word. The idea of a testament as a bloodline expresses the highest seriousness of mutual testamentary obligations. That is, a Testament is an inviolable contract, the non-fulfillment of which threatens death. An additional feature of the testament, as shown in the article, was the theophanic Presence. It manifested itself not only at the time of the covenant, but also in an invisible way throughout its validity. The establishment of a covenant relationship has always been associated with theophany and could not have been otherwise, because the covenant is always personal, so God considered it necessary to show a personal presence at this crucial time. The author proves that in all pre-Christian covenants there is a single prototype line that was revealed in Jesus Christ. By the faith and merit of the ancestor, his descendants enter into the covenant and enjoy the benefits and blessings of their predecessor, as well as inherit all his obligations to God. The people of the New Testament enjoy all the benefits and advantages not because of their own merits, but only because of the merits of Jesus. The sign of entering into the Covenant of Jesus is water baptism, which, as an external action, plays the role of a spiritual sign that indicates spiritual circumcision as a clipping of all sins. Thus, the intertextual analysis of the New Testament and Old Testament texts revealed the typos of Lord's Supper and shows the Christ as a single one, who determines the conditions of the covenants and makes it valid. We have defined the Neutrosophic Over- /Under-/Off-Set and -Logic for the first time in 1995 and published in 2007. During 1995-2016 we presented them to various national and international conferences and seminars ([16]-[37]) and did more publishing during 2007-2016 ([1]-[15]). These new notions are totally different from other sets/logics/probabilities. We extended the neutrosophic set respectively to Neutrosophic Overset {when some neutrosophic component is > 1}, to Neutrosophic Underset {when some neutrosophic component is < 0}, and to Neutrosophic Offset {when (...) some neutrosophic components are off the interval [0, 1], i.e. some neutrosophic component > 1 and other neutrosophic component < 0}. This is no surprise since our real-world has numerous examples and applications of over-/under-/off-neutrosophic components. (shrink)

There is a difference between acting with a probability of making a difference to who is harmed, and worsening someone’s prospect. This difference is relevant to debates about the ethics of offsetting, since it means that showing that emitting-and-offsetting has the first feature is not a way of showing that it has the second feature. In an earlier paper, we illustrate this difference with an example of a lottery in which you shake the bag from which a ball will be (...) drawn to determine the identity of the person who will suffer a harm. I analyse Alexander’s polemic account atDe anima68.10–21, I demonstrate that it differs from Chrysippus’ criticism of Cleanthes (contrary to some commentators), and I show how it fits in the context of his argument. From this analysis it will emerge how (...) Alexander uses Stoic ideas to form his Aristotelian account. Then, I show that Alexander, by taking ‘typos’ metaphorically, not only prefers the term ‘enkataleimma’ over ‘typos’ in his theory ofphantasia, but he keeps the ‘typos’ terminology only to remain faithful to Aristotle’s use (contrary to some commentators). “I type very quickly, very badly, with many errors [fautes],” Jacques Derrida confessed in a late interview. This paper proposes that the typographical error – usually viewed as a mere “accident” – may in fact be understood as a productive site for deconstructive reading and thought. Drawing on Nietzsche’s suggestion that the typewriter acts as a “collaborator” in thinking, this paper examines Derrida’s use of the typewriter, with particular attention to his typos. Following Derrida’s reading in the Geschlecht series and (...) his own typographical practice, this paper argues that the typo should be thought of as the condition of possibility of every type – and as a defining difference between Derrida and Heidegger. Evidence for motion extrapolation at motion offset is scarce. In contrast, there is abundant evidence that subjects mentally extrapolate the future trajectory of weak motion signals at motion offset. Further, pointing movements overshoot at motion offset. We believe that mental and sensorimotor extrapolation is sufficient to solve the problem of perceptual latencies. Both present the advantage of being much more flexible than motion extrapolation.

Christian Barry and Garrett Cullity argue that there is a morally important distinction between offsetting by “sequestering” and offsetting by “forestalling.” They further claim that offsetting by sequestering will often make risk-imposing actions permissible, while offsetting by forestalling typically will not. In this article, I highlight some reasons to be skeptical about their view and suggest an alternative account of the conditions in which offsetting can make a risk-imposing action permissible. Resumo A conservação da biodiversidade tornou-se um compromisso inquestionável diante do seu papel inexorável para a manutenção da vida na Terra. Apesar do consensual compromisso em sustentá-la, as razões pelas quais fazê-lo ainda são alvo de discussões e controvérsias. Que valores devem reger sua proteção? Contudo, a conservação da biodiversidade está cada vez mais voltada para um lado objetivo-econômico, na qual a natureza é marginal aos interesses que parecem mais evidentes: a eficiência econômica. Esse artigo faz uma reflexão sobre os (...) esquemas de biodiversity offsets, instrumentos cujo objetivo é a compensação pelos danos à biodiversidade provocados pelas atividades de desenvolvimento; e sobre a mudança nos valores da conservação da biodiversidade que tais instrumentos tendem a provocar. Uma mudança discursiva, institucional, técnica e material que altera o sentido de se fazer conservação e a relação humana com o mundo natural. Essa ‘nova’ perspectiva da conservação revela dilemas éticos fundamentais, e vem se tornando uma estratégia cada vez mais difundida no âmbito das políticas ambientais para a conservação. (shrink)
