In this article I assess the Invariance Principle, which states that only quantities that are invariant under the symmetries of our theories are physically real. I argue, contrary to current orthodoxy, that the variance of a quantity under a theory’s symmetries is not a sufficient basis for interpreting that theory as being uncommitted to the reality of that quantity. Rather, I argue, the variance of a quantity under symmetries only ever serves as a motivation to refrain from any commitment to (...) the quantity in question. (shrink)

Our aim here is to present a result that connects some approaches to justifying countable additivity. This result allows us to better understand the force of a recent argument for countable additivity due to Easwaran. We have two main points. First, Easwaran’s argument in favour of countable additivity should have little persuasive force on those permissive probabilists who have already made their peace with violations of conglomerability. As our result shows, Easwaran’s main premiss – the comparative principle – is strictly (...) stronger than conglomerability. Second, with the connections between the comparative principle and other probabilistic concepts clearly in view, we point out that opponents of countable additivity can still make a case that countable additivity is an arbitrary stopping point between finite and full additivity. As a neo-liberal economy, India has become one of the new health tourism destinations, with commercial gestational surrogacy as an expanding market. Yet the Indian Assisted Reproductive Technology Bill has been pending for five years, and the guidelines issued by the Indian Council of Medical Research are somewhat vague and contradictory, resulting in self-regulated practices of fertility clinics. This paper broadly looks at clinical ethics in reproduction in the practice of surrogacy and decision-making in various procedures. Through empirical research in (...) New Delhi, the capital of India, from December 2011 to November 2012, issues of decision-making on embryo transfer, fetal reduction, and mode of delivery were identified. Interviews were carried out with doctors in eighteen ART clinics, agents from four agencies, and fourteen surrogates. In aiming to fulfil the commissioning parents’ demands, doctors were willing to go to the greatest extent possible in their medical practice. Autonomy and decision-making regarding choice of the number of embryos to transfer and the mode of delivery lay neither with commissioning parents nor surrogate mothers but mostly with doctors. In order to ensure higher success rates, surrogates faced the risk of multiple pregnancy and fetal reduction with little information regarding the risks involved. In the globalized market of commercial surrogacy in India, and with clinics compromising on ethics, there is an urgent need for formulation of regulative law for the clinical practice and maintenance of principles of reproductive ethics in order to ensure that the interests of surrogate mothers are safeguarded. A study found that women participating in mammography screening were content with the programme and the paternalistic invitations that directly encourage participation and include a pre-specified time of appointment. We argue that this merely reflects that the information presented to the invited women is seriously biased in favour of participation. Women are not informed about the major harms of screening, and the decision to attend has already been made for them by a public authority. This short-circuits informed decision-making and the (...) legislation on informed consent, and violates the autonomy of the women. Screening invitations must present both benefits and harms in a balanced fashion, and should offer, not encourage, participation. It should be stated clearly that the choice not to participate is as sensible as the choice to do so. To allow this to happen, the responsibility for the screening programmes must be separated from the responsibility for the information material. (shrink)

Several lines of evidence show that systematic exposure to negative social acts at the workplace i.e., workplace bullying, results in symptoms of depression and anxiety among those targeted. However, little is known about the association between bullying, inflammatory genes and sleep problems. In the present study, we examined the indirect association between exposure to negative social acts and sleep through distress, as moderated by the miR-146a genotype. The study was based on a nationally representative survey of 1179 Norwegian employees drawn (...) from the Norwegian Central Employee Register by Statistics Norway. Exposure to workplace bullying was measured with the 9-item version of Negative Acts Questionnaire – Revised (NAQ-R) inventory. Seventeen items from Hopkins Symptom Checklist (HSCL-25) was used to measure distress. Insomnia was assessed with three items reflecting problems with sleep onset, maintenance of sleep and early morning awakening. Genotyping with regard to miR-146a rs2910164, previously linked to inflammatory processes, was carried out using Taqman assay. The data revealed that individuals systematically exposed to negative social acts at the workplace reported higher levels of sleep problems than non-exposed individuals. Moreover, the relationship between distress induced by exposure to negative social acts and insomnia was significantly stronger for individuals with the miR-146a GG genotype. Thus, the miR-146a genotype moderated the association between distress and insomnia among individuals exposed to negative social acts. The present report support the hypothesis that inflammation could play a role in stress-induced insomnia among individuals exposed to workplace bullying. (shrink)

In his paper, ‘Regarding the ‘Hole Argument”, Weatherall suggests that models of general relativity related by a hole diffeomorphism must be regarded as being physically equivalent. At a later stage in the paper, however, he also argues that there is a sense in which two such models may be regarded as being empirically distinct—a fortiori physically distinct. We attempt to delineate the logic behind these two prima facie contradictory claims. A new model for environmental and urban sustainability living architecture that connects artifice with the natural world through the use of materials that possess some of the properties of living systems, and can therefore actively exchange energy with the ecosphere, is proposed.

Metaphilosophy is itself philosophy about philosophy. It is not something before or independent of philosophy. Both Kai Nielsen and Richard Rorty are deeply concerned (someone might say obsessively preoccupied) with metaphilosophy. They both are thoroughly historicist and contextualist resolutely rejecting any form of a transcendental or metaphysical turn. They argue against claims to absolute validity (as well as against absolutism in any form) and a natural order of reasons: some 'Reason' to which any rational agent must be committed. They (...) both see philosophy as a transitional genre first (historically speaking) from religion then metaphysics and more latterly from scientistic conceptions of the world. But they differ about what philosophy is transitional to. For Rorty it is historical narrative and utopian proposals; for Nielsen it is critical theory. Rorty claims this, Nielsen's intentions to the contrary notwithstanding, commits him to enlightenment rationalism. Nielsen replies that his form of critical theory is deeply historicist and contextual without being resolutely atheoretical. This plays out in political orientation to Nielsen's being a socialist while Rorty is a social democrat. (shrink)

Inferences that result from exhaustification of a sentence S depend on the set of alternatives to S. In this paper, we present some inference patterns that are problematic for previous theories of alternatives and propose some structural constraints on the derivation of formal alternatives which derive the observations.

Kai Nielsen is one of Canada's most distinguished political philosophers. In a career spanning over 40 years, he has published more than 400 papers in political philosophy, ethics, meta-philosophy, and philosophy of religion. Pessimism of the Intellect presents a thoughtful collection of Nielsen's essays complemented by an extended reflective interview with Nielsen. This collection allows the reader to grasp the systematic scope of his thought and methodology.

This festschrift includes a dozen essays on issues that have been at the focus of Kai Nielsen's research, mainly issues in ethics and political philosophy. Among these are four essays on socialism and Marxism. There are also essays on philosophy of religion, epistemology, and meta-philosophy.

Breheny et al. argue against the structural approach to alternatives. The empirical force of their argument comes mostly from challenges raised against Trinh and Haida. This paper aims to respond to these challenges, showing how they can be met by a natural refinement of Trinh and Haida’s proposal which turns out to capture additional facts previously not accounted for. The essay examines the intersection between aesthetic the-ory and representations of the city in the periodical essay_ The Spectator_ (1711-1714). Focusing on this intersection allows for an analysis of the cultural work aesthetic pleasure is supposed to do according to _The Spectator_, and also shows key differenc-es between “spectatorial” and later, Kantian aesthetics. In _The Spectator_ aesthetic pleasure has to do with producing a model for how one should relate to the realm of politics—rather than disin-terest, the precondition of aesthetic (...) pleasure turns out to be disengagement. Read through the lens of the city, aesthetic pleasure turns out to be a key component in The Spectator’s vision of how to live a good life as a privileged subject of a modern state. (shrink)

Prioritarianism pertains to the generic idea that it matters more to benefit people, the worse off they are, and while prioritarianism is not uncontroversial, it is considered a generally plausible and widely shared distributive principle often applied to healthcare prioritisation. In this paper, I identify social justice prioritarianism, severity prioritarianism and age-weighted prioritarianism as three different interpretations of the general prioritarian idea and discuss them in light of the effect of pandemic consequences on healthcare priority setting. On this analysis, the (...) paper arrives at the following three conclusions: that we have strong prioritarian reasons for special concern about the vulnerable and socially disadvantaged in reference to pandemic effects, that severity of illness is an important factor in identifying the worse off in priority setting but that this must not over-ride the special priority to the socially disadvantaged and that the maximisation rationale of the age-weighted view runs against the core prioritarian idea, and the age-weighted prioritarianism is thus unfitting as a prioritarian response to the COVID-19 case. I argue that there is tension in Wittgenstein’s position on trivialities (i.e. tautologies and contradictions) in the Tractatus, as it contains the following claims: (A) sentences are pictures; (B) trivialties are not pictures; (C) trivialities are sentences. A and B follow from the “picture theory” of language which Wittgenstein proposes, while C contradicts it. I discuss a way to resolve this tension in light of Logicality, a hypothesis recently developed in linguistic research. Logicality states that trivialities are excluded by the (...) grammar, and that under the right analysis sentences which look trivial are in fact contingent. The tools necessary to support Logicality, I submit, were not available to Wittgenstein at the time, which explains his commitment to C. I end the paper by commenting on some points of contact between analytic philosophy and the generative enterprise in linguistics which are brought into relief by the discussion. (shrink)

For both philosophers and managers, reasoning with ourselves and others can be used both as (1) a way of knowing what is ethical and (2) a way of acting to help ourselves, others and organizations behave ethically. However, for many of us, knowing is frequently not the same as acting. Four areas are addressed: (1) thirteen limitations of ethical reasoning as an action strategy; (2) how a better understanding of these limitations can strengthen ethical reasoning as an action strategy; (3) (...) how an understanding of these limitations can serve as a conceptual foundation for exploring other ethical action strategies; and, (4) implications for experiential learning and teaching. Torbjörn Tännsjö has written a clear and thought-provoking book on healthcare priority setting. He argues that different branches of ethical theory—utilitarianism, egalitarianism, and prioritarianism—are in general agreement on real-world healthcare priorities, and that it is human irrationality that stands in the way of complying with their recommendations. While I am generally sympathetic to the overall project and line of argumentation taken by the book, this paper raises two concerns with Tännsjö’s argument. First, that he is wrong to set aside deontic (...) constraints as irrelevant or as pointing in the same direction as consequentialism. Secondly, that his argument against prioritarianism in favor of utilitarianism is insufficient and under-developed. Given these problems, I conclude that we should welcome Tännsjö’s contribution but with these qualifications in mind. (shrink)

It is well established within the ethics and institutional theory literatures that institutions can have conflicting logics with ethical dimensions and that there are solutions to the conflicts. Within institutional, ethics, and change leadership theory, quantitative, mixture solutions such as distributive solutions have been frequently considered. The ethics, institutional, and change leadership theory literatures have recognized that there are qualitative transformational solutions that are different than quantitative mixture solutions. However and for the most part, with the notable exception of the (...) Thornton et al. :801–843, 2012) typology of solutions, the institutional, change leadership, and ethics literatures have not considered typologies of transformational solutions. And more specifically with respect to this article, the institutional, change leadership, and ethics literatures have not considered different types of transformational solutions to institutional logic conflicts with ethical dimensions. This article: develops a typology of transformational solutions; applies the typology with historical examples of conflicting institutional ethics logics within factory, cultural, and institutional social change leadership cases; and, considers practical and theoretical implications for institutional ethics change leadership for achieving and/or resisting different types of transformational solutions. Phenomenology of illness has grown increasingly popular in recent times. However, the most prominent phenomenologists of illness defend a psychologizing notion of phenomenology, which argues that illness is primarily constituted by embodied experiences, feelings, and emotions of suffering, alienation etc. The article argues that this gives rise to three issues that need to be addressed. (1) How is the theory of embodiment compatible with the strong distinction between disease and illness? (2) What is the difference between problematic embodiment and illness? (...) (3) How is existential edification, that illness can give rise to according to the phenomenologists, to be understood? The article then engages in an analysis of Heidegger’s and Waldenfels’ phenomenology with the ambition of developing a notion of existence, which can transgress the psychologization of illness. Rather than arguing that illness is constituted by experiences of suffering and alienation, it emphasizes that broaches upon conatively guided activities constitute illness. (shrink)

Setting out to defend luck egalitarianism in matters of justice in health, Shlomi Segall outlines a pluralistic version of the luck egalitarian framework allowing egalitarian justice to be traded-off against other moral requirements. The suggested pluralism enables luck egalitarian justice to coexist with a concern for meeting everyone’s basic needs thereby avoiding Elizabeth Anderson’s ‘abandonment objection’. In this article, however, we present three objections to Segall’s luck egalitarian justice in health. Firstly, the account is vulnerable to the common objection that (...) luck egalitarianism becomes too expansive, and that Segall’s defence against this is inadequate. Secondly, Segall’s pluralist attempt to balance luck egalitarian justice and other moral requirements ends up compromising its own ideal of justice. Due to the fact that resource scarcity is the reality of health and health care distribution, this problem would often arise in actual health policy. Finally, the account has a way of intensifying blameworthy behaviour which seems contrary to luck egalitarian principles. Based on these three objections, we conclude that Segall’s luck egalitarian account of justice in health must either be rejected or qualified further. (shrink)

This article strengthens a dilemma posed by Eva and Hartmann (2021). They show that accounts of partial subjunctive supposition based on imaging sometimes violate a natural monotonicity condition. The paper develops a more general framework for modelling partial supposition and shows that, in this framework, imaging-based accounts of partial subjunctive supposition always violate monotonicity. In fact, the only account of partial supposition that satisfies monotonicity is the one that Eva and Hartmann defend for indicative suppositions. Insofar as one is committed (...) to monotonicity, then, one cannot distinguish the indicative and subjunctive moods for partial supposition. One might avoid this result by rejecting the general framework that it relies upon, but that itself would be a surprising and interesting outcome. (shrink)

ARGUMENT ABOUT whether in any significant sense we can derive an ought from an is has been persistent and intractable. Fifteen to twenty years ago it was orthodoxy in analytical philosophical circles to claim that for all their other differences Hume and Moore were right in agreeing that in no significant sense can we derive an ought from an is. At present there is no orthodoxy or even anything like a dominant view and, given our current understanding of how language (...) works and our understanding of moral and ideological discourse, we could not possibly reasonably remain content with old orthodoxies or take the question to be as straightforward as it was often thought to be. Ethical reasoning as an action (praxis) as opposed to a knowing (epistemology) strategy is not always effective in guilding ethical, stopping or turning around unethical organizational behavior. In contrast, nonviolent forcing strategies can be very effective, but also destructive. If reasoning is an idealistic thesis and forcing is its pragmatic, material antithesis, then do we need a synthesis action (praxis) strategy such as problem solving negotiating? There are also limitations with negotiating.

In a recent paper, Pettigrew reports a generalization of the celebrated accuracy-dominance theorem due to Predd et al., but Pettigrew’s proof is incorrect. I will explain the mistakes and provide a correct proof.

The problem this article focuses on is not the isolated individual act of corruption, but the systematic, pervasive sub-system of corruption that can and has existed across historical periods, geographic areas, and political-economic systems. It is important to first understand how corrupt and unethical subsystems operate, particularly their network nature, in order to reform and change them while not becoming what we are trying to change. Twelve key system elements are considered that include case examples from Asia, Latin America, the (...) Mediterranean, and North America. A key operating feature of corruption sub-systems is that they are relatively stable networks rather than exceptional, independent, individual events. Drawing on social network, social movement, and action-learning theories, six theory building propositions concerning ethical corruption reform are developed. (shrink)

This paper explores the role individual responsibility plays in contemporary political theory. It argues that the standard luck egalitarian view—the view according to which distributive justice is ensured by holding people accountable for their exercise of responsibility in the distribution of benefits and burdens—obscures the more fundamental value of being responsible. The paper, then, introduces an account of ‘self-creative responsibility’ as an alternative to the standard view and shows how central elements on which this account is founded has been prominently (...) defended in the history of Western political thought but are comparatively neglected in contemporary political theory. Relying on this account, the paper argues that society should hold persons responsible when, and only when, doing so enables them to lead responsible lives, and only on the condition that doing so does not infringe other persons’ equivalently valuable ability to lead responsible lives. The account of self-creative responsibility, the paper concludes, plausibly captures the intuitive attraction of holding responsible while respecting the value of being responsible. (shrink)

ABSTRACT:In this updated and revised version of his 2008 Society for Business Ethics presidential address, Richard Nielsen documents the characteristics and extent of the 2007–2009 economic crisis and analyzes how the ethics issues of the economic crisis are structurally related to a relatively new form of capitalism, high-leverage finance capitalism. Four types of high-leverage finance capitalism are considered: hedge funds; private equity-leveraged buyouts; high-leverage, subprime mortgage banking; and high-leverage banking. The structurally related problems with the four types of high-leverage (...) finance capitalism converged in something of a perfect economic storm. Explanations for the crisis are offered in the context of the type of the high-leverage finance capitalism system that permitted and facilitated the economic crisis. Ethics issues and potential reforms are considered that may be able to mitigate the destructive effects of what Schumpeter referred to as the “creative destructive” effects of evolutionary forms of capitalism while realizing the Aristotelian economic ideal of creating wealth in such a way as to make us better people and the world a better place. Causal decision theory is often motivated as a ‘revision of [decision theory] intended to solve Newcomb’s problem’ (Bacon 2022). In this paper, I give a direct argument for CDT by deriving it from a venerable decision-theoretic principle: the value of knowledge principle. The general framework that I use to deliver this result also supports a new argument for conditionalization.

This paper contributes to a recent research program that extends arguments supporting elementary conditionalization to arguments supporting conditionalization with general, measure-theoretic conditional probabilities. I begin by suggesting an amendment to the framework that Rescorla (2018) has used to characterize regular conditional probabilities in terms of avoiding Dutch book. If we wish to model learning scenarios in which an agent gains complete membership knowledge about some subcollection of the events of interest to her, then we should focus on updating policies that (...) are what I shall call proper. I go on to characterize regular conditional probabilities in proper learning scenarios using what van Fraassen (1999) calls The General Reflection Principle. (shrink)

Olav Vassend has recently (2021) presented a decision-theoretic argument for updating utility functions by what he calls “utility conditionalization.” Vassend’s argument is meant to mirror closely the well-known argument for Bayesian conditionalization due to Hilary Greaves and David Wallace (2006). I show that Vassend’s argument is inconsistent with ZF set theory and argue that it therefore does not provide support for utility conditionalization.

Argues that morality can exist without religion, suggests that values and principles of conduct emerge from life, and examines the consequences of moral absolutism.
