This article explores the potential of feminist new materialisms and theories of affect for reframing how we might think about beauty and the body. Through an exploration of girls, beauty and the school ball, the article engages with Karen Barad’s concept of intra-action to conceptualise beauty as an affective-material process. This perspective involves an ontological shift in how girls, bodies and beauty are understood; from thinking about beauty and the human as discursively produced, towards a relational approach that conceptualises materiality (...) and affect as co-constitutive forces. The article is interested in how such a framing might invite ways of understanding beauty that avoid binary frameworks, such as good/bad, subject/object and discourse/matter. I consider the potential this might offer feminist analyses of beauty, where the focus is less on what beauty is or what it means, and more on how it comes to be. (shrink)

Dr Erskine's 'embedded cosmopolitanism' embraces the perspective of local loyalties, communities and cultures in the theory of why we have duties to 'strangers' and 'enemies' in world politics. Taking examples from the 'war on terror', she examines duties to 'enemies' through norms of non-combatant immunity and the prohibition against torture.

To address the underrepresentation of women in philosophy effectively, we must understand the causes of the early loss of women. In this paper we challenge one of the few explanations that has focused on why women might leave philosophy at early stages. Wesley Buckwalter and Stephen Stich offer some evidence that women have different intuitions than men about philosophical thought experiments. We present some concerns about their evidence and we discuss our own study, in which we attempted to replicate their (...) results for 23 different responses to 14 scenarios . We also conducted a literature search to see if other philosophers or psychologists have tested for gender differences in philosophical intuitions. Based on our findings, we argue that that it is unlikely that gender differences in intuitions play a significant role in driving women from philosophy. (shrink)

According to what Jonathan Bennett calls the Kant–Frege view of existence, Frege gave solid logical foundations to Kant’s claim that existence is not a real predicate. In this article I will challenge Bennett’s claim by arguing that although Kant and Frege agree on what existence is not, they agree neither on what it is nor on the importance and justification of existential propositions. I identify three main differences: first, whereas for Frege existence is a property of a concept, for Kant (...) it is a relational property pertaining between the concept and intuition of an object. Second, whereas for Frege truth about individuals presupposes their existence, for Kant truth is in many cases independent of the existence of objects. Third, whereas Frege binds logic to existence and removes modalities from logic, for Kant existence is a modal category that is emphatically removed from the domain of logic and set in the core of metaphysics. Due to these differences in Kant’s and Frege’s theories of existence, Frege cannot be seen as giving logical clarity to Kant’s view. (shrink)

In the presentation I will analyse Kant’s conception of modalities and consider its relevance to his critical metaphysics. With his Tables of Judgements and of Categories Kant makes an important division between two kinds of modality, of which the former is only logical and the latter transcendental, i.e., objective. Only judgements that are necessary in both ways are properly metaphysical. This distinction is important for Kant’s distinction between Transcendental Analytic and Transcendental Dialectic, i.e., between acceptable and unacceptable metaphysics. I submit (...) that not only is Kant’s theory of modality useful for properly understanding his arguments in the Dialectic, but that only by distinguishing between the two types of modality can one can make sense of his theory that the ideas of reason are simultaneously inevitable and erroneous. This modal analysis thus offers a new and important point of view to Kant’s metaphysics and its critique. (shrink)

The article explores some of the issues that have arisen in the discourse on pharmaceutical cognitive enhancement (PCE), that is, the use of stimulant drugs such as methylphenidate, amphetamine and modafinil by healthy individuals of various populations with the aim of improving cognitive performance. Specifically, we explore the presumed sizes of existing PCE user populations and the policy actions that have been proposed regarding the trend of PCE. We begin with an introductory examination of the academic stances and philosophical issues (...) involved in defining PCE. We then focus on an examination of the population sizes of presumed current PCE users that have been listed in the academic literature on PCE, on presuppositions, which have been problematized by some authors as based on anecdotal or misinterpreted survey data. We follow this with an empirical examination of a potential PCE user population in a national context (students at the University of Ljubljana in Slovenia). We then proceed to examine the regulatory options proposed in the academic literature to address PCE, finally comparing them with an empirical overview of the policy recommendations on PCE produced in the multinational context of several national ethics advisory bodies (EABs) in Europe. Our main conclusion is that there is still little debate among the national EABs on what type of public policy responses, if any, are needed to address PCE in European countries, and that the issues they do address are similar to those discussed and proposed in the academic articles on PCE. Florence Ashley has argued that requiring patients with gender dysphoria to undergo an assessment and referral from a mental health professional before undergoing hormone replacement therapy (HRT) is unethical and may represent an unconscious hostility towards transgender people. We respond, first, by showing that Ashley has conflated the self-reporting of symptoms with self-diagnosis, and that this is not consistent with the standard model of informed consent to medical treatment. Second, we note that the model of informed consent involved in cosmetic (...) surgery resembles the model Ashley defends, and that psychological assessment and referral is recognised as an important aspect of such a model. Third, we suggest that the increased prevalence of psychiatric morbidity in the transgender population arguably supports the requirement of assessment and referral from a mental health professional prior to undergoing HRT. La doctrine de droit international privé a tendance à organiser le rapport entre le droit de l’Union européenne et les réglementations nationales de droit international privé par le biais des principes de hiérarchie normative et d’attribution de compétence, de sorte que l’on s’interroge principalement sur le contenu et les limites de la nécessaire adaptation du droit national à la construction européenne. Le droit international privé est ainsi soumis à l’épreuve du droit européen. À l’inverse, à partir d’une conception alternative du (...) rapport entre les deux, comme un conflit entre visions du droit différentes, nous proposons de soumettre le droit de l’Union européenne, en particulier l’application des libertés de circulation par la Cour de justice de l’Union européenne, aux outils analytiques de droit international privé. En particulier, les notions de droit applicable, lois de police et exception d’ordre public vont nous permettre de mieux comprendre l’originalité et particularité de la « cosmologie juridique » qui anime cette jurisprudence. En un segundo apartado, trataremos la obra Ravel, Ravel, Unravel (2013) en la que debatimos las manipulaciones del tiempo (...) y el espacio. There are two traditional ways to read Kant's claim that every event necessarily has a cause: the weaker every-event some-cause and the stronger same-cause same-effect causal principles. The focus of the debate about whether and where he subscribes to the SCP has been in the Analogies in the Critique of Pure Reason and in the Metaphysical Foundations of Natural Science. By analysing the arguments and conclusions of both the Analogies and the Postulates as well as the two Latin principles non (...) datur casus and non datur fatum that summarise their results, I will argue for the novel thesis that the SCP is actually demonstrated in the Postulates of the First Critique. It remains heavily debated whether there actually is any formal error in the inferences Kant presents: according to Grier and Allison, they are deductively invalid syllogisms, whereas Bennett, Ameriks, and Van Cleve deny that they are formal fallacies. I advance an interpretation that reconciles these extremes: transcendental paralogisms are sound in general logic but constitute formal fallacies in transcendental logic. By formalising the paralogistic (...) inference, I will pinpoint the error as an illegitimate existential presupposition. Since - unlike transcendental logic - general logic abstracts from all objects, this error can only be detected in transcendental logic. (shrink)

Determining who, or indeed what, is to respond to prescriptions for action in cases of international crisis is a critical endeavor. Without such an allocation of responsibilities, calls to action–whether to protect the environment or to rescue distant strangers–lack specified agents, and, therefore, any meaningful indication of how they might be met. A fundamental step in arriving at this distribution of duties is identifying moral agents in international relations, or, in other words, identifying those bodies that can deliberate and act (...) and thereby respond to ethical guidelines. Often, the most effective and relevant moral agents in international relations are not individuals but institutions. However, it is necessary to qualify any claim that institutions can bear duties in international relations. Not only must they possess capacities for decision-making and purposive action, they must also enjoy the conditions under which specific duties can be discharged. The importance of this latter stipulation can be usefully illustrated by examining the disparate circumstances within which states–those that exercise positive sovereignty and those that are sovereign only in name–are expected to act. The conventional historical account of the concept of brain death credits developments and discoveries of the twentieth century with its inception, emphasizing the role of technological developments and professional conferences, notably the 1968 Ad Hoc Committee of the Harvard Medical School to Examine the Definition of Brain Death. This essay argues that the French physician Eugène Bouchut anticipated the concept of brain death as early as 1846. Correspondence with Bouchut’s understanding of brain death and one important contemporary concept of brain (...) death is established then contrasted with current trends of defining death as the death of the brain. The philosophical factors that influenced Bouchut and the later developments of concepts of brain death are considered, with special reference to mechanistic philosophy and vitalism. (shrink)

This paper presents a novel argumentation framework to support Issue-Based Information System style debates on design alternatives, by providing an automatic quantitative evaluation of the positions put forward. It also identifies several formal properties of the proposed quantitative argumentation framework and compares it with existing non-numerical abstract argumentation formalisms. Finally, the paper describes the integration of the proposed approach within the design Visual Understanding Environment software tool along with three case studies in engineering design. Recently, some have attempted to reformulate debates in first-order metaphysics, particularly in the metaphysics of time and modality, for reasons due to Williamson. In this paper, we focus on the ways in which the likes of Cameron, Correia and Rosenkranz, Deasy, Ingram, Tallant, Viebahn, inter alia, have initiated and responded to attempts to capture the core of presentism using a formal, logical machinery. This article examines parallels between the increasing mental burnout and environmental overshoot in the organisational context. The article argues that there is a particular philosophy of management that connects these two phenomena of overshoot and burnout, namely productivism. As there are boundaries in all ecological processes and systems, the productivist aim of having ever more output and growth is deemed absurd. It is proposed that productivity as a management philosophy not only leads to mental ill-health in organisations but also to (...) overshoot in the environment. The article concludes that productivism, which denies the limits in utilisation of humans and other natural resources, fits poorly with circular economy and sustainability. Hence, ecological management should be complemented with a more holistic and processual view of organizations, as well as have an aim of peaceful coexistence between all earthbound objects. This signifies acknowledging and caring for human and non-human needs both now and in future by applying the idea of moderation to production of goods and services. (shrink)

It is argued that the so-called fitting attitude- or buck-passing pattern of analysis may be applied to personal values too if the analysans is fine-tuned in the following way: An object has personal value for a person a, if and only if there is reason to favour it for a’s sake. One benefit with it is its wide range: different kinds of values are analysable by the same general formula. Moreover, by situating the distinguishing quality in the attitude rather than (...) the reason part, the analysis admits that personal value is recognizable as a value not only by the person for whom it has personal value, but for everyone else too. We thereby avoid facing two completely different notions of value, viz., one pertaining to impersonal value, and another to personal value. The analysis also elucidates why we are justified in our concern for objects that are valuable for us; if value just is, as it is suggested, the existence of reasons for such a concern, the justification is immediately forthcoming. It is well known that Rawls and Habermas propose different strategies for justifying and classifying human rights. The author argues that neither approach satisfies what he regards as threshold conditions of determinacy, rank ordering, and completeness that any enforceable system of human rights must possess. A related concern is that neither develops an adequate account of group rights, which the author argues fulfills subsidiary conditions for realizing human rights under specific conditions. This latter defect is especially serious in light of (...) the different but equal roles that both subnational groups as well as supernational organizations play in bringing about a just global distribution of economic resources. Truths depend upon what there is. So say many. A significant subset of that group say more; they say that the best way—perhaps the only way—to make sense of the claim that truth depends upon what there is, is to adopt a form of truth-maker theory. Truth-maker theorists claim that truths require ground; what’s true must depend upon what there is. Typically, truth-maker theory isn’t seen as a theory about the nature of truth. Rather, it’s seen as a theory about (...) what truths must do. Truths must depend. Relatedly, the claim that truths require ‘truth-makers’, that is, some putative ontological grounds, is used as a methodological tool in metaphysics. Put somewhat crudely, fix on what truths there are and locate the truth-makers—if necessary, add to your ontology until you satisfy this demand for truth-makers. Truth-making is thus at once both narrow and broad. It’s narrow insofar as it’s not a theory (it’s not a claim) about the nature of truth, and yet it’s broad insofar as it enables us to determine our ontological commitments. We take this to be a two-part orthodoxy about truth-making. We reject the orthodoxy on both counts. (shrink)

The debate on how to interpret Kant's transcendental idealism has been prominent for several decades now. In his book Kant's Transcendental Proof of Realism (2004) Kenneth R. Westphal introduces and defends his version of the metaphysical dual-aspect reading. But his real aim lies deeper: to provide a sound transcendental proof for (unqualified) realism, based on Kant's work, without resorting to transcendental idealism. In this sense his aim is similar to that of Peter F. Strawson – although Westphal's approach is far (...) more sophisticated. First he attempts to show that noumenal causation – on the reality of which his argument partly rests – is coherent in and necessary for Kant's transcendental idealism. Westphal then aims to undermine transcendental idealism by two major claims: Kant can neither account for transcendental affinity nor satisfactorily counter Hume's causal scepticism. Finally Westphal defends his alternative for transcendental idealism by showing that it solves these problems and thus offers a genuine transcendental proof for realism. In this paper I will show that all the three steps outlined above suffer from decisive shortcomings, and that consequently, regardless of its merits, Westphal's transcendental argument for realism remains undemonstrated. The much endorsed idea that reasons are facts, gives raise to several issues, not least when it is applied to the distinction between agent-neutral and agent-relative reasons. The paper distinguish in broad terms between two important views on the nature of facts. Given in particular a view that conceives of facts as abstract entities, the dichotomy is not particularly problematic. We might run into problems when it comes to identifying which facts are reasons and which are not, but the very (...) dichotomy itself seems sound. On this, the so-called thin approach, it is at least a possibility that some reasons will be (in some sense of the dichotomy) agent-neutral and some will be agent-relative. The second approach, the thick account, is, much less popular. It is argued that the thin approach trivializes an interesting issue among practical philosophers. The thin account is also in one respect less appealing than its thick cousin. The thick account is not flawless, though. At the end, a couple of objections to it will be considered. (shrink)

Conscientious Objection (CO) has become a highly contested topic in the bioethics literature and public policy. However, when CO is discussed, it is almost universally referred to as a single entity. Reality reveals a more nuanced picture. Healthcare professionals may object to a given action on numerous grounds. They may oppose an action because of its ends, its means, or because of factors that lay outside of both ends and means. Our paper develops a taxonomy of CO, which makes it (...) possible to describe the refusals of healthcare professional with greater finesse. The application of this development will potentially allow for greater subtlety in public policy and academic discussions – some species of CO could be permitted while others could be prohibited. In a recent article in this journal, Abram Brummett argues that new and future assisted reproductive technologies will provide challenging ethical questions relating to lesbian, gay, bisexual and transgender (LGBT) persons. Brummett notes that it is likely that some clinicians may wish to conscientiously object to offering assisted reproductive technologies to LGBT couples on moral or religious grounds, and argues that such appeals to conscience should be constrained. We argue that Brummett's case is unsuccessful because he: does not adequately interact (...) with his opponents’ views; equivocates on the meaning of ‘natural’; fails to show that the practice he opposes is eugenic in any non‐trivial sense; and fails to justify and explicate the relevance of the naturalism he proposes. We do not argue that conscience protections should exist for those objecting to providing LGBT people with artificial reproductive technologies, but only show that Brummett's arguments are insufficient to prove that they should not.
