It is generally held that doctors and researchers have an obligation to obtain informed consent. Over time there has been a move in relation to this obligation from a requirement to disclose information to a requirement to ensure that that information is understood. Whilst this change has been resisted, in this article I argue that both sides on this matter are mistaken. When investigating what information is needed for consent to be informed we might be trying to determine what information (...) a person would need in order to consent at all, or we might be trying to determine what information a person needs in order to make an informed choice about whether or not to consent. I argue that the obligation to ensure understanding only applies to information generated by the first type of enquiry; but that much of the information generally thought necessary in order for consent to be informed is only required if our concern is with the second type of enquiry. For this reason it is neither the case that doctors and researchers should ensure all the information they provide is understood, nor is it the case that their only obligation is to disclose it. Recent years have witnessed an enormous increase in behavioral and neuroimaging studies of numerical cognition. Particular interest has been devoted toward unraveling properties of the representational medium on which numbers are thought to be represented. We have argued that a correct inference concerning these properties requires distinguishing between different input modalities and different decision/output structures. To back up this claim, we have trained computational models with either symbolic or nonsymbolic input and with different task requirements, and showed that this allowed (...) for an integration of the existing data in a consistent manner. In later studies, predictions from the models were derived and tested with behavioral and neuroimaging methods. Here we present an integrative review of this work. (shrink)

: Phenomena of moral conflict and disagreement have led writers in ethics to two antithetical conclusions: Either valid moral distinctions hold universally or they hold relative to a particular and contingent moral framework, and so cannot be applied with universal validly. Responding to three articles in this issue of the Journal that criticize his previously published views on the common morality, the author maintains that one can consistently deny universality to some justified moral norms and claim universality for others. Universality (...) is located in the common morality and nonuniversality in other parts of the moral life, called "particular moralities." The existence of universal moral standards is defended in terms of: (1) a theory of the objectives of morality, (2) an account of the norms that achieve those objectives, and (3) an account of normative justification (both pragmatic and coherentist). : The belief persists in philosophy, religion, science, and popular culture that some special cognitive property of persons like self-consciousness confers a unique moral standing. However, no set of cognitive properties confers moral standing, and metaphysical personhood is not sufficient for either moral personhood or moral standing. Cognitive theories all fail to capture the depth of commitments embedded in using the language of "person." It is more assumed than demonstrated in these theories that nonhuman animals lack a relevant form of (...) self-consciousness or its functional equivalent. Although nonhuman animals are not plausible candidates for moral personhood, humans too fail to qualify as moral persons if they lack one or more of the conditions of moral personhood. It is relatively uncontroversial that some public health policies are paternalistic. Furthermore, that they are paternalistic is often taken to show that they are morally wrong. In this article I challenge this position. The article starts by arguing that given standard definitions of paternalism it is unclear why such policies count as paternalistic. Whilst it might appear that they impose restrictions on what individuals can, or cannot, do for their own good, this is not the case. The reason for this (...) is that whilst public health policies focus on achieving benefits at a population or group level, the imposition is made at the level of the individual. If we are to retain the idea that such policies are paternalistic we must characterize them in such a way that both the benefit and imposition are at the same level: either that of the individual or that of the group. I argue that in many cases moving to the group level is the only plausible option. However, if we move to the group level, the features that make a policy paternalistic will not, unlike in those cases where paternalism is targeted at an individual, make the policy morally wrong. Several scholars have argued that Internet use might be fundamentally incompatible with Confucian ethics, because the values that are embedded in the Internet might be in conflict with Confucian values. In addition, the design of various social network services considers very little of non-Western values in its engineering. Against this background, this article explores the philosophical question of whether Internet use, particularly social network services, is compatible with the fundamental values and norms of Confucian ethics. In addition, the article discusses (...) the Confucian notion of tian xia, and argues that tian xia, as a basic structuring principle of Confucian philosophy, helps to innovate a different social media. Beauchamp (bio)AbstractThis article is a reply to Robert Baker’s attempt to rebut moral fundamentalism, while grounding international bioethics in a form of contractarianism. Baker is mistaken in several of his interpretations of the alleged moral fundamentalism and findings of the Advisory Committee on Human Radiation Experiments. He also misunderstands moral fundamentalism generally and wrongly categorizes it as morally (...) bankrupt. His negotiated contract model is, in the final analysis, itself a form of the moral fundamentalism he declares bankrupt.Robert baker’s imaginative and incisive articles on international bioethics (Baker 1998a & b) are rich in history and philosophy, but they are as profoundly misguided as they are misdirected. In this comment, I will concentrate both on a pivotal interpretation and criticism that he offers of the Report of the Advisory Committee on Human Radiation Experiments (ACHRE 1996) and on his philosophical thesis that a moral fundamentalism of principles and rights is bankrupt. Baker seriously misinterprets the ACHRE report, distorts and fails to refute moral fundamentalism, and ultimately embraces a form of the very fundamentalism that he declares bankrupt. This interpretation eventuates in a critique of the work of both ACHRE and Ruth Macklin:[W]hen Macklin and the Radiation Committee consider the challenge of multiculturalism, they construe this challenge, not as dispute about anthropological fact, but as a dispute about philosophical theory. More specifically, they treat any assertion of the difference claim as a form of “ethical relativism.”... They thus respond to the multiculturalist’s factual observations—even to factual observations by anthropologists—as if they were philosophical analyses.(Baker 1998a, p. 209)Baker thinks that a factual question has been fallaciously transformed into a philosophical one. However, this false dilemma is a figment of his fancy. ACHRE received testimony, conducted interviews, and compiled documents that indicated how deeply these principles were woven into the fabric of American culture at the time, so deeply that no responsible research investigator could have been unaware of them. Economic insecurity is an endemic problem across the rich countries of the Global North. What is the solution? This paper compares and contrasts two major proposals: the conventional welfare state package of public services and regulations versus a basic income. By comparing and contrasting these systems in three different contexts – a “nightwatchman” context, a neoliberal context, and a social democratic context – and carefully modeling the monetary equivalence between them, we are able to provide a more precise and compelling (...) comparison of the two systems than has yet been accomplished. We evaluate the two systems on the basis of economic security as well as a number of other important criteria, including the economic well-being of oppressed groups, power, carbon emissions, the gender division of labor, free time, social stigma, and transformative potential. We find that without a welfare state background, services and regulations are generally preferable for most vulnerable groups. However, as the welfare state develops, into a neoliberal or a social democratic context, basic income becomes a generally superior option. (shrink)

This paper supports the view that the ongoing shift from orthodox to embodied-embedded cognitive science has been significantly influenced by the experimental results generated by AI research. Recently, there has also been a noticeable shift toward enactivism, a paradigm which radicalizes the embodied-embedded approach by placing autonomous agency and lived subjectivity at the heart of cognitive science. Some first steps toward a clarification of the relationship of AI to this further shift are outlined. It is concluded that the success of (...) enactivism in establishing itself as a mainstream cognitive science research program will depend less on progress made in AI research and more on the development of a phenomenological pragmatics. Transhumanism advances an ideology promising a positive human advance through the application of new and as yet unrealized technologies. Underlying the whole is a libertarian ethos married to a very Christian eschatology promising a miraculous transformation that will answer human needs and redress human failings. In this paper, the supposedly scientific basis on which transhumanist promises are built is critiqued as futurist imaginings with little likelihood of actualization. Transhumanists themselves are likened to the affable con man Professor Harold Hill who, (...) in The Music Man, describes as dire social problems whose solution is a youth band he seeks to sell but has no intention of building. Even were some of the transhumanist imaginings to be realized, I argue, the result would be a dystopia in which the few received benefits denied to the many. In advancing imaginary technologies as a solution to human needs, transhumanists and their bioethical fellow travelers handily avoid discussion of or advocacy for the kind of pedestrian social actions that demonstrably could achieve many of their purported goals. So their enthusiasms, I conclude, are not merely fanciful but damaging to the humanist goals they pretend to advance. (shrink)

The order of influence from thesis to hypothesis, and from philosophy to the social sciences, has historically governed the way in which the abstraction and significance of language as an empirical object is determined. In this article, an argument is made for the development of a more reflexive intellectual relationship between ordinary language philosophy (OLP) and the social sciences that it helped inspire. It is demonstrated that, and how, the social scientific traditions of ethnomethodology and conversation analysis (CA) press OLP (...) to re-consider the variety of problematic abstractions it has previously made for the sake of philosophical clarity, thereby self-reinvigorating. On November 21, 1994, Werner Marx passed away peacefully in the place he loved so well, his apartment in the Schloß in Bollschweil. Professor Marx was born in 1910 in Mulheim, Germany. He studied law and philosophy in Berlin, Freiburg, and Bonn before completing his state examination and doctorate in law in 1933. In the same year, he was removed from civil service and from an apprentice judgeship by the Nazis. After this, he emigrated first to Palestine and then in (...) 1938 to New York, where he took up academic studies again. After receiving an M.A. in economics, he completed the Ph.D. in philosophy, working with Kurt Reizler and Karl Löwith at the German University in Exile, later to become the New School for Social Research, and writing a dissertation on Aristotle’s ontology. During this period, he renewed his interest in Hegel and German Idealism, and also in Heidegger’s critique of the tradition and attempts to make “another beginning” in philosophy. Marx began teaching at the New School in 1949. After the appearance of his classic study, Heidegger and the Tradition, he was named successor to the Husserl-Heidegger chair in philosophy and director of Philosophical Seminar I in Freiburg, which he held from 1964 until his retirement in 1979. He also served as Director of the Husserl-Archives in Freiburg until his death. (shrink)

The aim of this volume is to "serve as a reference work for students and nonspecialists" and to provide "the most convenient, accessible guide to Hobbes available." As with any such anthology, the quality of the individual contributions and the degree to which they contribute to these goals vary somewhat from paper to paper. But on the whole, the work succeeds admirably and constitutes a valuable resource for those interested in learning more about the great English philosopher. Space does not (...) permit even a cursory discussion of all fourteen articles contained in the volume, so I will instead offer a few comments about the work as a whole and a few select comments on some of the particular papers within it.
