The paper explores a case of partnership between a large pharmaceutical company and a national charity in the United Kingdom, a partnership from which the drug company sought improved public relations, and the charity money. Neither side was able to accept this reality. Managers of the partnership insisted that its only purpose was to improve the lifestyle of teenagers. They were supported by a literature on partnership that also tends to ignore the distinction between the task the partnership is set (...) and its fundamental purpose. While much is made of the benefits of partnership, there are likely to be costs, both private and social, associated with failure to admit the purpose of partnership. (shrink)

Recent simulation studies have pointed to the higher power of the test for the mediated effect vs. the test for the total effect, even in the presence of a direct effect. This has motivated applied researchers to investigate mediation in settings where there is no evidence of a total effect. In this paper we provide analytical insight into the circumstances under which higher power of the test for the mediated effect vs. the test for the total effect can be expected (...) in the absence of a direct effect. We argue that the acclaimed power gain is somewhat deceptive and comes with a big price. On the basis of the results, we recommend that when the primary interest lies in mediation only, a significant test for the total effect should not be used as a prerequisite for the test for the indirect effect. However, because the test for the indirect effect is vulnerable to bias when common causes of mediator and outcome are not measured or not accounted for, it should be evaluated in a sensitivity analysis. Accounts of the value of patient choice in contemporary medical ethics typically focus on the act of choosing. Being the one to choose, it is argued, can be valuable either because it enables one to bring about desired outcomes, or because it is a way of enacting one’s autonomy. This paper argues that all such accounts miss something important. In some circumstances, it is having the opportunity to choose, not the act of choosing, that is valuable. That is because in (...) many situations whether one has, or is denied, that opportunity conveys how one is seen. In particular, it conveys whether or not one is seen as an equal and competent member of society. Adequately recognising this fact has implications for what healthcare professionals should do, ones that require a move away from the current focus on autonomy. The paper draws out these implications by focusing on patients who may struggle to be recognised as competent and equal members of society, and whose autonomy may thus itself sometimes be in question. John Rawls's influential theory of justice and public reason has often been thought to exclude religion from politics, out of fear of its illiberal and destabilizing potentials. It has therefore been criticized by defenders of religion for marginalizing and alienating the wealth of religious sensibilities, voices, and demands now present in contemporary liberal societies. In this anthology, established scholars of Rawls and the philosophy of religion reexamine and rearticulate the central tenets of Rawls's theory to show they in fact offer (...) sophisticated resources for accommodating and responding to religions in liberal political life. The chapters reassert the subtlety, openness, and flexibility of his sense of liberal "respect" and "consensus," revealing their inclusive implications for religious citizens. They also explore the means he proposes for accommodating nonliberal religions in liberal politics, developing his conception of "public reason" into a novel account of the possibilities for rational engagement between liberal and religious ideas. And they reevaluate Rawls's liberalism from the "transcendent" perspectives of religions themselves, critically considering its normative and political value, as well as its own "religious" character. _Rawls and Religion_ makes a unique and important contribution to contemporary debates over liberalism and its response to the proliferation of religions in contemporary political life. Technological developments in the sphere of artificial intelligence (AI) inspire debates about the implications of autonomous weapon systems (AWS), which can select and engage targets without human intervention. While increasingly more systems which could qualify as AWS, such as loitering munitions, are reportedly used in armed conflicts, the global discussion about a system of governance and international legal norms on AWS at the United Nations Convention on Certain Conventional Weapons (UN CCW) has stalled. In this article we argue for the (...) necessity to adopt legal norms on the use and development of AWS. Without a framework for global regulation, state practices in using weapon systems with AI-based and autonomous features will continue to shape the norms of warfare and affect the level and quality of human control in the use of force. By examining the practices of China, Russia, and the United States in their pursuit of AWS-related technologies and participation at the UN CCW debate, we acknowledge that their differing approaches make it challenging for states parties to reach an agreement on regulation, especially in a forum based on consensus. Nevertheless, we argue that global governance on AWS is not impossible. It will depend on the extent to which an actor or group of actors would be ready to take the lead on an alternative process outside of the CCW, inspired by the direction of travel given by previous arms control and weapons ban initiatives. ‘Natural-History’ is one of the key concepts in the thought of the Frankfurt School critical theorist Theodor W. Adorno, appearing from his very earliest work through to his very last. Unfortunately, the existing literature provides little illumination as to what Adorno’s concept of natural-history is, or what it is supposed to do. This paper thus seeks to supply the required understanding. Ultimately, I argue that ‘natural-history’ is best understood as a sort of ‘therapeutic’ concept, intended to dissolve certain philosophical anxieties (...) which might otherwise present obstacles to our being able to obtain a critical-theoretical understanding of reality. Instead of impeding access to essential medicines in developing countries, the essay explores why and how patents can serve as a source of funding for the much needed access to medicine. Instead of a weakening of patents, prolonged protection periods are suggested in circumstances where there is widespread lack of access. The revenues from extended patents are seen as a source of funding for drug donations to the least developed countries.

Among the defining characteristics of moral cosmopolitanism are the convictions that personal relations, membership in social or political organizations like local communities or nation-states are insignificant for agents when determining their scope of moral concern. The moral scope is unlimited and the moral duties reach globally. Following up observations made by Onora O’Neill and others, it is argued that Singer’s model needs a complementary tool to allocate duties.That tool can be found by supplementing the agent centered perspective of the model (...) with a regard for the social and institutional circles encompassing right holders. Instead of focusing on the duty holder, I suggest that the cosmopolitan’s “ultimate unit of moral concern” – here, the claimholder is regarded central.Thus, Singer’s cosmological model is kept, but in a rights-based methodological approach for allocating duties. Methodologically, what needs to be investigated is whether the scope of legitimate moral claims expands from the agent for the same reasons that the circle of moral concern expands from Singer’s agent. In this article, I identify – and clear up – two problems for contemporary neo-Aristotelian ethical naturalism. The first I call the problem of alienation; the second the problem of conservatism. I argue that these problems will persist, both for ‘hard’ and ‘soft’ forms of ethical naturalism, unless ethical naturalists adopt what I call ‘Practical Realism’ about essential human form. Such a Practical Realism leaves open the possibility of radical social and political criticism – I therefore suggest that contemporary ethical (...) naturalists ought to be more interested in exploring the affinities their view shares with Marxist political thought. Robert Baker and Laurence McCullough argue that the "applied ethics model" is deficient and in need of a replacement model. However, they supply no clear meaning to "applied ethics" and miss most of what is important in the literature on methodology that treats this question. The Baker-McCullough account of medical and applied ethics is a straw man that has had no influence in these fields or in philosophical ethics. The authors are also on shaky historical grounds in dealing with two (...) problems: (1) the historical source of the notion of "practical ethics" and (2) the historical source of and the assimilation of the term "autonomy" into applied philosophy and professional ethics. They mistakenly hold (1) that the expression "practical ethics" was first used in a publication by Thomas Percival and (2) that Kant is the primary historical source of the notion of autonomy as that notion is used in contemporary applied ethics. In this book—the first large-scale survey of the complex relationship between Hegel’s idealism and Anglo-American analytic philosophy—Tom Rockmore argues that analytic philosophy has consistently misread and misappropriated Hegel. According to Rockmore, the first generation of British analytic philosophers to engage Hegel possessed a limited understanding of his philosophy and of idealism. Succeeding generations continued to misinterpret him, and recent analytic thinkers have turned Hegel into a pragmatist by ignoring his idealism. Rockmore explains why this has happened, defends Hegel’s idealism, and (...) points out the ways that Hegel is a key figure for analytic concerns, focusing in particular on the fact that he and analytic philosophers both share an interest in the problem of knowledge. Patents on biotech products have a scope that goes well beyond what is covered by the most widely applied ethical justifications of intellectual property. Neither natural rights theory from Locke, nor public interest theory of IP rights justifies the wide scope of legal protection. The article takes human genes as an example, focusing on the component that is not invented but persists as unaltered gene information even in the synthetically produced complementary DNA, the cDNA. It is argued that patent on (...) cDNA holds this information captive, or illegitimately appropriates it in limiting other researchers and inventors’ opportunity to explore new functions and uses based on this non-invented information. A tighter connection between legal IP protection and the use description stated in the patent claim is suggested. By binding protection to the product’s foreseeable functions and use, instead of the product itself and all future uses of it, legitimacy of biotech product patents is restored. (shrink)

In this article the reader is introduced to how restorative justice principles can be used in education as a way of supporting a school-wide culture of care, where building and maintaining healthy relationships are fundamental principles. Thisnew discourse offers an alternative to the traditional discipline practices in schools, which focus on rules and consequences. : The belief persists in philosophy, religion, science, and popular culture that some special cognitive property of persons like self-consciousness confers a unique moral standing. However, no set of cognitive properties confers moral standing, and metaphysical personhood is not sufficient for either moral personhood or moral standing. Cognitive theories all fail to capture the depth of commitments embedded in using the language of "person." It is more assumed than demonstrated in these theories that nonhuman animals lack a relevant form of (...) self-consciousness or its functional equivalent. Although nonhuman animals are not plausible candidates for moral personhood, humans too fail to qualify as moral persons if they lack one or more of the conditions of moral personhood. If moral personhood were the sole basis of moral rights, then these humans would lack rights--and precisely for the reasons that nonhuman animals would. (shrink)

In this article I critically discuss Michael Steven Green's Nietzsche and the Transcendental Tradition and R. Kevin Hill's Nietzsche's Critiques: The Kantian Foundations of his Thought. Firstly, I raise textual doubts about Hill's interpretation of the early Nietsche as a Kantian critic of Schopenhaur. Secondly, I argue that Hill fails to establish that Nietzsche's later theoretical philosophy developed through a direct engagement with Kant's. Thirdly, I raise broader criticisms of Hill's 'Kantian' approach, and argue that Green's alternative account identifies an (...) underappreciated Kantian theme in Nietzsche's theoretical philosophy, although Green misrepresents Nietzsche's ultimate conclusions. Finally, I argue that while Hill rehearses prevailing misinterpretations of Kant's and Nietzsche's moral philosophies, Green's accoung also illuminates Nietzsche's developing criticism of Kantian notions of moral agency.In diesem Artikel werden die Bücher Michael Steven Greens Nietzsche and the Transcendental Tradition un R. Kevin Hill's Nietzsche's Critiques: The Kantian Foundations of his Thought kritisch diskutiert. Erstens bezwifle ich aus textualen Gründen, dass Hills Interpretation richtig ist, der frühe Nietzsche habe mit Kant Schopenhaur kritisiert. Zweitens, so mein Argumentation gelingt es Hill nicht nachzuweisen, dass Nietzsches spätere theoretische Philosophie direkt aus seiner Auseinandersetzung mit Kant hervorgeht. Drittens kritisiere ich den Kantischen Ansatz Hills umfassender und ziehe die alternative Deutung Greens heran, die ein wenig beachteres Kantisches Thema in Nietzsches theoretischer Philosophie ausmacht, wenngleich Green Nietzsches letze Schlussforlgerungen falsch interpretiert. Schließlich zeige ich, dass hill die vorherrschenden Missdeutungen der Moralphilosophie von Kant und Nietzsche wiederholt, während Green Nietzsches wachsende Kritik an den Kantischen Vorstellungen vom moralisch handelnden Subjekt beleuchtet. This editor's preface introduces a special issue of Critical Horizons on the theme of “contestatory cosmopolitanism.” After identifying the broad failings of the standard cosmopolitan appeal to global community, it presents the defining features of the “contestatory” alternative and introduces the papers in light of them.

Since 1989, widely circulating statistics on gay teen suicide in the United States have acted as catalysts for institutional reforms, scientific research, and the creation of an identity category “gay youth.” While one figure has been replicated scientifically, these numbers originated not from a scientific research study but as risk estimates developed by a social worker and published in a government document. Many people within the public took up these original numbers, attributing their author the status of scientific researcher. In (...) effect, the numbers became “black boxed,” often traveling without citation. Drawing on Ian Hacking’s “dynamic nominalist” perspective, this article utilizes interviews with the author of these statistics and other key claimants, along with textual analysis, to trace the origins, uptake, and effects of these figures. While making vital policy contributions, the numbers have led to some ironic consequences including the fostering of gay youth identification with suicide as a potential correlate of their identity and the potential antigay redeployment of decontextualized numbers. They have also led to a reaction in the form of “resilience” narratives. (shrink)
