Our primary focus is on analysis of the concept of voluntariness, with a secondary focus on the implications of our analysis for the concept and the requirements of voluntary informed consent. We propose that two necessary and jointly sufficient conditions must be satisfied for an action to be voluntary: intentionality, and substantial freedom from controlling influences. We reject authenticity as a necessary condition of voluntary action, and we note that constraining situations may or may not undermine voluntariness, depending on the (...) circumstances and the psychological capacities of agents. We compare and evaluate several accounts of voluntariness and argue that our view, unlike other treatments in bioethics, is not a value-laden theory. We also discuss the empirical assessment of individuals? perceptions of the degrees of noncontrol and self-control. We propose use of a particular Decision Making Control Instrument. Empirical research using this instrument can provide data that will help establish appropriate policies and procedures for obtaining voluntary consent to research. (shrink)

El presente artículo busca señalar la existencia de dos conflictos, al menos, que se presentan en Colombia. El primero es un conflicto directo mayoritariamente sufrido en zonas rurales. El segundo es un tele-conflicto. De su raíz griega es un conflicto que se vive desde lejos (tele). Este último, si bien es virtual, produce efectos reales en los sujetos con un alto poder de decisión, especialmente en zonas urbanas. Con ello se busca señalar el rol de los medios como condición de (...) posibilidad para la existencia del conflicto, pero no sólo debido al uso (abuso) que se pueda dar de ellos para la continuación del conflicto, sino por la misma manera en que es medializado. Para ello se analiza como caso empírico la refrendación de los acuerdos de paz de La Habana entre el estado colombiano y la guerrilla de las FARC-EP. Para ello se hará un análisis fenomenológico de la manera en que los medios interactúan con el sujeto. Con ello se busca observar el rol constitutivo de los medios de la experiencia humana. Appeals to some thesis of underdetermination, to the idea that scientific theories and hypotheses are not entailed by the evidence that supports them, are common in feminist philosophy of science. These appeals seek to understand and explain how androcentrism and other problematic approaches to gender have found their way into good science, as well as the reverse – how feminist approaches to gender and science that are also value-laden, can contribute to good science. Focusing on W.V. Quine’s positions on holism (...) and underdetermination, I argue that although Quine’s general thesis of holism does not entail his thesis of global underdetermination, his account of and arguments for moderate holism entail a localized and generalizable underdetermination, which I call moderate underdetermination. This moderate underdetermination is not transient or true of only some theories and hypotheses. Rather, it is a permanent state of affairs that characterizes all reasonably inclusive theories and hypotheses, however much evidence for them accumulates. I contend that Quine’s moderate holism entails the most robust and defensible argument for localized underdetermination, and that feminists would do well to appeal to it in arguing that values inform good science. A new way of understanding entropy as a macroscopic property is presented. This is based on the fact that heat flows from a hot body to a cold one even when the hot one is smaller and has less energy. A quantity that determines the direction of flow is shown to be the increment of heat gained divided by the absolute temperature. The same quantity is shown to determine the direction of other processes taking place in isolated systems provided that (...) q is determined by the state of the system. Entropy emerges as the potent energy of a system [Σ], the potency being determined by 1/T. This is shown to tie in with the statistical mechanical interpretation of entropy. The treatment is shorter than the traditional one based on heat engines. (shrink)

In this paper I assess the labour ward admission policies introduced by some National Health Service trusts during the COVID-19 pandemic, arguing that these intersected with other policies in a manner which may have coerced birthing people into consenting to vaginal examinations they might have otherwise refused. In order to fully understand the potential severity of these policies, I situate this critique in the historical and contemporary context of the problematic relationship between consent and vaginal examinations. Identifying the legal wrongs (...) associated with performing coerced vaginal examinations, I highlight that the law is inadequately equipped to provide appropriate redress. Further, I illustrate that the issue explored in this paper reflects broader problems which exist with regard to the focus of, and the investment in, the maternity services. (shrink)

Descartes’s interrelated theories of attributes and conceptual distinction (or rational distinc­tion) are developed. This follows Nolan (1997) in identifying substances and their attributes as they exist apart from the mind’s concepts. This resource is then used to articulate a solution to a famous problem about Descartes’s concept of substance. The key is that the concept of substance is itself to be regarded as an attribute of independently existing things.

Adorno and Levinas argue from distinct yet intersecting perspectives that there are pathological forms of freedom, formed by systems of power and economic exchange, which legitimate the neglect, exploitation and domination of others. In this paper, I examine how the works of Adorno and Levinas assist in diagnosing the aporias of liberty in contemporary capitalist societies by providing critical models and strategies for confronting present discourses and systems of freedom that perpetuate unfreedom such as those ideologically expressed in possessive individualist (...) and libertarian conceptions of freedom. The best judge of the soundness of a philosophical argument is the philosopher with the greatest philosophical aptitude, the deepest knowledge of the relevant subject matter, the most scrupulous character, and a disinterested position with respect to the subject matter. This last feature is important because even a highly intelligent and scrupulous judge may find it hard to reach the right conclusion about a subject in which he or she has a vested interest. When the subject of inquiry is the (...) soundness of theistic arguments, the best judge will be the most intelligent and scrupulous philosopher who is also disinterested in the soundness of the theistic argument under consideration. I argue that, in this case, the disinterestedness requirement is best satisfied by the theist whose belief in God is “properly basic”, and in the course of defending this argument I uncover a little-recognized desideratum for theistic arguments. The very idea of promulgation has been given little to no treatment in the philosophy of law. In this exploratory essay, I introduce three possible theories of promulgation: the ‘no-theory theory’ (which treats promulgation as a matter of particular contexts), the ‘conveyance theory’ (which treats promulgation as a function of intellectual good faith interpreters), and ‘agonistic theory’ (which treats promulgation as indistinguishable from propaganda). I suggest that (at least) three kinds of models are consistent with the theories, and can potentially (...) help us understand when law is successfully promulgated in particular legal contexts: the spread model, the chain model, and the memetic model. I end the paper by comparing the two theories with respect to a case study. Throughout I will show that the conveyance and agonistic theories have a serious advantage over the no-theory theory, in that they allow us to comparatively examine the epistemic weaknesses of diverse theories about the grounding of law on the basis of their contents. Many philosophers have wrongly assumed that there is an asymmetry between the problem of induction and the logocentric predicament (the justification of deductive inferences). This paper will show that the demand for justification, for the very inferences that are required for justification, is deeply problematic. Using a Wittgensteinian approach, I will argue that justification has an internal relation with deductive and inductive inferences. For Wittgenstein, two concepts are internally related if my understanding of one is predicated on my understanding of (...) the other. Separating the two concepts so that one can be applied to the other is then a misunderstanding of role that these concepts play. (shrink)

Nursing history has been a much debated subject with a wide range of work from many countries discussing the profession’s identity and questioning the nature of nursing and professional practice. Building upon a review of the recent developments in nursing history worldwide and on primary research that examined the structure of mandated nursing history courses in 14 nursing schools in the state of Santa Catarina, Brazil, this paper analyzes both the content and the pedagogical style applied. We postulate that the (...) study of history offers an important opportunity for the development of student learning, and propose that more creative and dynamic teaching strategies be applied. We argue the need for professors to be active historical researchers, so they may meaningfully contribute to the development of local histories and enrich the professional identities of both nursing students and the profession. We conclude that historical education in nursing is limited by a traditional and universalist approach to nursing history, by the lack of relevant local sources or examples, and by the failure of historical education to be used as a vehicle to provide students with the intellectual tools for the development of professional understanding and self‐identity. All biologists use classifications to one degree or another, and those of us who work on classifications use the results of all other biologists to one degree or another, so you might reasonably expect that biologists in general would share some common conception of how classifications should be constructed and how they can be used. Certainly one might expect that all taxonomists, at least, would share such a perspective. But this is not the case; in fact, the theory of taxonomy (...) is at present a very controversial subject, with much of the controversy revolving around the question of how to go about constructing an ideal classification.Surprisingly, there is relatively little controversy about what properties an ideal classification would have. Admittedly, different terms are used to describe these properties, various workers arguing that classifications should be maximally stable, or maximally useful, or maximally informative, or maximally testable, or maximally refutable, or maximally predictive, and so on. The Clarke/Rowe version of the Cosmological Argument is sound only if the Principle of Sufficient Reason (PSR) is true, but many philosophers, including Rowe, think that there is not adequate evidence for the principle of sufficient reason. I argue that there may be indirect evidence for PSR on the grounds that if we do not accept it, we lose our best justification for an important principle of metaethics, namely, the Principle of Universalizability. To show this, I argue that all the (...) other justifications of the Principle of Universalizability on offer, including Richard Hare's, are inadequate. (shrink)

According to the cosmological argument, there must be a self-existent being, because, if every being were a dependent being, we would lack an explanation of the fact that there are any dependent beings at all, rather than nothing. This argument faces an important, but little-noticed objection: If self-existent beings may exist, why may not also self-explanatory facts also exist? And if self-explanatory facts may exist, why may not the fact that there are any dependent beings be a self-explanatory fact? And (...) if that fact is self-explanatory, why make recourse to self-existent beings? This line of questioning is surprisingly hard to answer, but I find resources for an answer in Bertrand Russell's logical atomism. (shrink)

The present study is an analysis of Plato’s _Timaeus-Critias_ composition process, from the point of view of discourse modeling. It intends to show that the dialogue is distinguished by an insightful articulation of composition techniques, which combine the pictorial and dramatic aspects of poetic _mimesis_. Establishing the Panateneias as an implicit reference, the work presents the performance of a sequence of narratives, produced as true discursive images. Platonic originality is revealed in _Timaeus-Critias_, therefore, as the accomplishment of a formal construction (...) that is both dramatic and representational, through a singular mimetic agency of discursive forms. What do Ross’s The Right and the Good; Chisholm’s Theory of Knowledge; Kripke’s Naming and Necessity; and Audi’s The Architecture of Reason have in common? They all advance important philosophical positions, but not so much via analytic arguments as via formal schemas, distinctions, examples, and analogies. They use such formal schemas, etc, to describe the world so as to make some aspect of it manifest. That is, they simply try to ‘tell it like it is’. This ‘method of descriptive manifestation’ (...) is less commonly recognized than it should be given its divergence from the self-image of analytic philosophy. (shrink)

I argue that utilitarianism cannot accommodate a basic sort of moral judgment that many people want to make. I raise a real-life example of shockingly bad behavior and ask what can the utilitarian say about it. I concede that the utilitarian can say that this behavior caused pain to the victim; that pain is bad; that the agent’s behavior was impermissible; even that the agent’s treatment of the victim was vicious. However, there is still one thing the utilitarian cannot say, (...) namely that the agent wronged the victim, that they violated her. According to utilitarianism, moral offenses are offenses against global utility, right reason or the totality of sentient beings, but never against individual victims, yet this aspect of the action – that it is an offense against a particular person –is highlighted when we say that this action wronged that woman. Studies of learning in marine invertebrates have yielded new information, implicating protein kinase C and calmodulin‐dependent protein kinase as critical components in pathways for learning and memory that are shared with higher vertebrates. Recent advances correlating in vitro biochemical and biophysical measurements with in vivo learning have begun to elaborate the roles in memory storage for these two kinases, their substrates, and signaling proteins such as calexcitin and calmodulin. Other studies have implicated transcription factors associated with kinases such as the (...) cyclic AMP response element binding protein (CREB). These experiments have resulted in a greater understanding of the role of second messengers, principally calcium and cyclic AMP (cAMP), as vehicles for transforming memory‐specific effects occurring at the membrane into permanent DNA‐mediated cellular and structural changes.
