ZusammenfassungVom Konzept ›Menschenwürde‹ machte die ethisch geprägte Philosophie Robert Spaemanns weniger und vorsichtiger Gebrauch, als man – angesichts der Positionen, die sie verteidigen möchte – vermuten würde. Dies liegt vor allem an einem in den Begriff einmontierten und von Spaemann in einer Abhandlung von 1987 hervorgehobenen »Trugschluss«, den auszuräumen der von ihm anschließend in mehreren Büchern entwickelte Personenbegriff dienen soll. Der Trugschluss verbindet und begründet auf der einen Seite die Würde mit der Kompetenz personaler Selbstbestimmung, auf der anderen Seite möchte (...) er allen und nur den Mitgliedern der menschlichen Spezies die Menschenwürde zubilligen. Doch handelt es sich hier – ohne starke metaphysische Hintergrundannahmen – um eine metabasis eis allo genos, da ein natürlicher Sortalbegriff mit dem Vernunftkonzept ›Person‹ mir nichts dir nichts identifiziert werden müsste – was aber insbesondere die zeitgenössisch führende analytische Philosophie mit recht kritisierte. Im Aufsatz wird gezeigt, wie Spaemanns Philosophie diesen Trugschluss durch sein neues Verständnis dessen, was Personen eigentlich sind, tatsächlich zur Auflösung zu bringen vermag. Zugleich wird deutlich gemacht, dass Spaemann auch in diesem Verständnis noch an gewissen, unter dem Verdacht religiöser Parteilichkeit stehende Auffassungen festhält – von denen aber auch vollkommen abgesehen werden kann, ohne den Kern von Spaemanns Verständnis der Person aufgeben zu müssen. Der Status des Liberalismus in der Französischen Revolution und ihrer Folgezeit lässt sich nicht näher bestimmen, ohne zunächst von dem Wort zu reden, das seinen Kern ausmacht: Freiheit. Zu diskutieren sind die Unterscheidung zwischen zwei Freiheitsbegriffen, die die französischen Liberalen der ersten Stunde vorschlagen, und die These, dass die politische Freiheit als Instrument für die private oder bürgerliche Freiheit anzusehen sei. Am Ende soll das Verhältnis zwischen Französischer Revolution und Liberalismus anhand eines markanten Votums TocquevillesTocqueville, Alexis de illustriert werden.

Konnen die vielen padagogischen Einsichten und das Verhaltnis von Lehrer zu Schuler, mit dem wir alle in unserem Leben zu tun hatten oder noch haben, auch philosophisch aufgearbeitet werden? (...) Thomas von Aquin (1225 - 1274) hat als einziger mittelalterlicher Autor eine 'Quaestio' uber den Lehrer geschrieben ('De magistro'). Darin und in weiteren Texten uber einen 'ordo addiscendi' - eine Ordnung des Lernens - expliziert er anhand philosophischer Mittel die Tatigkeiten des Lehrens und Lernens, auch auf dem Hintergrund der in seinem Jahrhundert entstehenden Universitaten. Die vorliegende Arbeit analysiert auf vier unterschiedlichen Ebenen - epistemisch, schopfungstheologisch, anthropologisch und sozial - das Verstandnis des Aquinaten hinsichtlich der Struktur und Genese des Lehrens und Lernens. Diese differenzierte Strukturierung eroffnet einen Einblick in die Wirkweise des menschlichen Geistes und exemplifiziert im Kern die wissenschaftstheoretische und anthropologische Konzeption des Aquinaten. What is discrimination and what makes wrongful discrimination wrong? Even after an ever-rising tide of research over the course of the past twenty-five or so years these questions still remain hard to answer. Exercising candid and self-critical hindsight, Larry Alexander, who contributed his fair share to this tide, thus remarked: “All cases of discrimination, if wrongful, are wrongful either because of their quite contingent consequences or perhaps because they are breaches of promises or fiduciary duties.” If this is true it (...) raises serious doubts as to how wrongful discrimination can be a moral wrong in itself. Also, the question comes up as to who it is who breaches a promise or a fiduciary duty. This paper defends the view that the substance of these remarks is better understood by couching them in a political approach towards discrimination. Against this background, they give rise to real and pressing concerns. Once we conceptualise the realm political along Hobbesian lines as the battleground comprising both the private sphere of the individual and the public sphere of the commonwealth it emerges that discrimination has different significance with regard to these respective spheres. In order to illustrate this, I adopt Kasper Lippert-Rasmussen’s descriptive account of discrimination as „differential treatment on the basis of membership of a socially salient group“ and the common view that wrongful discrimination is wrong because it is harmful, disrespectful, or both. In the private sphere the case can be made for morally permissible cases of discrimination. Sexual discrimination due to sexual self-determination with consequently freely choosing your sexual or romantic partner is the central case in point. Where somebody feels unfairly rejected and consequently hurt neither the charge of harm inflicted nor that of disrespect endured need be justified. No “breach of promises or fiduciary duties” is involved. The case is different, however, when it comes to the fiduciary of power. In discriminating, he who exercises the power of the commonwealth necessarily breaches a promise and a fiduciary duty. Discrimination thus appears to be more of a problem of political philosophy than one of applied ethics. Um dies zu verdeutlichen, lege ich Kasper Lippert-Rasmussens deskriptives Verständnis von Diskriminierung als „differential treatment on the basis of membership of a socially salient group“ zugrunde und mache von der in der Diskussion verbreiteten Ansicht Gebrauch, dass das Zufügen von Schaden oder die Verweigerung von Respekt Diskriminierung verwerflich macht. In der privaten Sphäre kann es nun Fälle moralisch zulässiger Diskriminierung geben. Zentral ist die sexuelle Diskriminierung aufgrund der Ausübung einer freien Wahl des eigenen Sexual- oder Liebespartners. Auch wenn sich der Abgewiesene womöglich geschädigt sieht, wird unbilliger Schaden nicht zugefügt und geschul- deter Respekt nicht verweigert. Den Grund finden wir in Alexanders Formel: Ein „breach of promises“ oder eine Verletzung „fiduciary duties“ liegt nicht vor. Mit seinem Werk Politeia wurde Platon zum Begrunder einer neuen literarischen Gattung: der politisch-philosophischen Utopie. Schon im Altertum versuchten eine Reihe von Autoren ihm nachzueifern, und nachdem Thomas Morus mit dem namengebenden Werk "Utopia" die Gattung gleichsam neu belebt hatte, entstand eine nicht mehr zu uberblickende Flut utopischer Entwurfe. Doch nicht nur durch die hier entfaltete Staatslehre erwies sich die "Politeia" als grundlegendes und richtungsweisendes Werk: Platons Ausfuhrungen zu solch verschiedenen philosophischen Gebieten wie der Theorie der Erziehung, der Theorie (...) der Dichtung, der Ethik und Tugendlehre, der Seelenlehre haben die Diskussion bis in unsere Tage beeinflusst. Platon ist aber auch ein Sprachkunstler, der seine Werke als Dialog-"Dramen" meisterhaft gestaltete. Dabei weiss er sich souveran von dem Medium Schrift zu distanzieren, das drei Hauptmangel aufweist: Sie sagt immer dasselbe, kann auf Fragen nicht antworten; sie wendet sich unterschiedslos an alle, weiss nicht, zu wem sie reden und zu wem sie schweigen soll; und wird sie angegriffen, so kann sie sich nicht selbst zur Hilfe kommen. Dass der Kern der platonischen Ideenlehre nicht in dafur ungeeignete Kopfe "gepflanzt" werden kann, beweist das Erste Buch: Das aufgezwungene Gesprach uber die Gerechtigkeit mit Polemarchos und dem Sophisten Thrasymachos endet in einer Aporie. Erst als Platon mit seinen Brudern Glaukon und Adeimantos das Gesprachsthema wieder aufgreift, kann der Funken der Erkenntnis uberspringen, und "Einsicht leuchtet auf."". (shrink)

Evidence suggests that the Ca2+/calmodulin-sensitive adenylyl cyclase may play a key role in neural plasticity and learning in Aplysia, Drosophila, and mammals. This dually-regulated enzyme has been proposed as a possible site of stimulus convergence during associative learning. This commentary discusses the evidence that is required to demonstrate that a protein in a second messenger cascade actually functions as a molecular site of associative integration. It also addresses the issue of how a dually-regulated protein could contribute to the temporal pairing (...) requirements of classical conditioning: that relationship between stimuli display both temporal contiguity and predictability. In this paper, I combine the actor-network economic sociology of disability with recent developments in phenomenological, embodied cognitive science, to discuss how ability, calculative agency, and meaning are distributed throughout materially situated sociocognitive systems. I begin by outlining the actor-network approach to disability, market formation, and economic agency. Next, I turn to the cognitive sciences, and describe the emergence of consciousness and meaning in embodied human being. With an operative synthesis of the two projects in place, I turn to government-organized (...) disability savings plans in Canada. I suggest that the low uptake of these plans can be explained using the theoretical synthesis provided in the first two sections of this paper, giving a robust account of the threefold distribution of ability, calculative agency, and meaning. This paper uses an ongoing ethnography of childhood rehabilitation to rethink the Heideggerian phenomenology of death. We argue that Heidegger’s threefold perishing/death/dying framework offers a fruitful way to chart how young people, their parents, and practitioners address mortality in the routine management of muscular dystrophies. Heidegger’s almost exclusive focus on being-towards-death as an individualizing existential structure, rather than the social life with and around death, is at odds with the clinical experience we explore in this paper. After looking to the (...) basic structures of Heidegger’s philosophy of death, we point to recent work by Leder, Svenaeus, Aho, and Carel, bringing health and the spaces of healthcare into our purview. Turning to ethnographic data, we argue that a revised phenomenology of death gives a nuanced account of how health care practitioners address death, dying, and perishing, and outline some steps toward a more ontologically sensitive clinical space. These revisions are in line with recent work in disability studies, that see disability as more than a death sentence. We advocate adjusting phenomenological reflections on disability, to be framed as a way of life, rather than as a deficient or especially deadly mode of human existence. (shrink)

Tragedy is a founding theme in disability studies. Critical disability studies have, since their inception, argued that understandings of disability as tragedy obscure the political dimensions of disability and are a barrier facing disabled persons in society. In this paper, we propose an affirmative understanding of tragedy, employing the philosophical works of Nietzsche, Spinoza and Hasana Sharp. Tragedy is not, we argue, something to be opposed by disability politics; we can affirm life within it. To make our case, we look (...) to an ongoing ethnography of two Canadian children’s rehabilitation clinics. Looking to the clinical experience of Canadian boys and young men diagnosed with Duchenne Muscular Dystrophy and those of their families, we show how this affirmative understanding of tragedy allows us to pursue the themes of disability politics within tragedy. Contrary to an optimism that would eschew tragedy at all costs or a pessimistic approach that declines to act in the face of tragic circumstance, we argue that a revised understanding of tragedy allows us to situate the occasionally-tragic clinical experience of disability in a philosophy of life. Both disability and tragedy point us to the shared entanglements that make life what it is. (shrink)

As Perry Schmidt-Leukel remarks in his helpful introduction, they are an experiment in correlating auto-interpretation and hetero-interpretation, introspection and extrospection.Each of the (...) first three sections—on China/Japan, Southeast Asia, and Europe—begins with a historical study. Iso Kern clears up some misconceptions about the Jesuits' approach to mission work in China, stating that they did in fact preach Jesus crucified (37) and the doctrine of Atonement (41) in the face of a grave danger that Christianity would simply be absorbed into Buddhism (33). Whereas Buddhism had no specifically religious clash with the state, Christianity did, and this was eventually sealed by martyrdom in both China and Japan. Introducing part 2, Heinz Murmel gives a sober reassessment of the vehement controversies between a certain segment of Buddhism and a certain type of Christianity in Ceylon. Only the high-caste highland nikayas were protected by the British (63); the more popular, rural Buddhists of the lowlands felt excluded and threatened and gave rise to what became known as "Protestant Buddhism." The "great debates" between bitterly anti-Christian monks and Protestant clergymen were not as important as the records may suggest, and even the fiery Anagarika Dharmapala later disclosed that he felt great devotion to Jesus. Finally, Frank Usarski reviews the heated debates between ill-informed Christians and overaggressive Buddhist converts such as Karl B. Seidenstucker as Buddhism established itself in Germany in the early decades of the twentieth century. Christianity was inauthentic, derivative, "Buddhism in Jewish garments" (120).Yet even Seidenstucker, the renegade Protestant, converted to Catholicism toward the end of his life.Each historical contribution is followed by an essay on the contemporary situation in the three regions, and these vary greatly in substance. Shizuteru Ueda offers a profound meditation on the significance of Keiji Nishitani for Buddhist approaches to Christianity. If Nietzsche posed the fundamental question of "life without why " (44-45), the thought of Meister Eckhart contains the answer (curiously, Ueda insists that this answer must be European, because Europe "determines the world" [47]). The "ground" on which we stand, interpreted as Nishida's "place (basho) of nothingness," is "ground-less." This is not nihilism but the overcoming of nihilism by nihilism, the shûnyatâ of shûnyatâ (46). Jesus as the Christ is the God/man and therefore the mediator, the absolute in history (53). He occupies the "place" (basho) of infinite openness, unconditioned ultimacy (55). He is thus unique, but not universal: the ultimate "for me" is not necessary "for the whole of mankind" (56). The actual encounter between Buddhist and Christian absolutes takes place in silence.Santikaro Bhikkhu, the friend and translator of Buddhadâsa Bhikkhu in the last eight years of his life, tells how his mentor gradually overcame his initial suspicion ofChristianity, perhaps because he was not confronted with colonial oppression as Dharmapala was in Ceylon. Distinguishing between "people language" and " dhamma language," he eventually arrived at a certain equivalence between the Christian God and Buddhist dhamma understood as a nonpersonal, nondual transcendent that is nevertheless not outside nature (85, 90). What Jesus the Teacher of Wisdom offers in the Sermon on the Mount, if practiced, is sufficient for salvation (93). In the perspective of dhamma language, however, the God of Christian convention is conditioned, and Jesus as Son of God cannot be unique. Though inconclusive and sometimes obscure because of Buddhadâsa's indifferent grasp of English, this is surely an astonishing journey for one who tried to understand each tradition, including his own, from the sources. In Natural Minds Thomas Polger advocates, and defends, the philosophical theory that mind equals brain -- that sensations are brain processes -- and in doing so brings the mind-brain identity theory back into the philosophical debate about consciousness. The version of identity theory that Polger advocates holds that conscious processes, events, states, or properties are type- identical to biological processes, events, states, or properties -- a "tough-minded" account that maintains that minds are necessarily indentical to brains, a position held (...) by few current identity theorists. Polger's approach to what William James called the "great blooming buzzing confusion" of consciousness begins with the idea that we need to know more about brains in order to understand consciousness fully, but recognizes that biology alone cannot provide the entire explanation. Natural Minds takes on issues from philosophy of mind, philosophy of science, and metaphysics, moving freely among them in its discussion.Polger begins by answering two major objections to identity theory -- Hilary Putnam's argument from multiple realizability and Saul Kripke's modal argument against mind-brain identity. He then offers a detailed account of functionalism and functional realization, which offer the most serious obstacle to consideration of identity theory. Die ersten vier von Brentanos 25 Habilitationsthesen fordern eine Erneuerung der Philosophie - worauf diese Forderung jedoch abzielt, ist nicht so klar. Vielfach wird behauptet, daß dieses Ziel eng verwandt mit der Konzeption einer wissenschaftlichen Philosophie im Sinne Russells und des Logischen Empirismus sei. Diese insbesondere auch von Rudolf Haller vertretene Auffassung setzt aber voraus, daß der katholisch-klerikale Kontext, in den der junge Priester Brentano eingebunden war, nur die unwesentliche Hülle eines eigentlichen Kernes bildet. Dagegen wird gezeigt, daß dieser Kontext (...) nicht so ablösbar, sondern vielmehr für das Verständnis der Habilitationsthesen unabdingbar ist. Es ergibt sich, daß das, worauf die vier ersten Thesen abzielen, eine Erneuerung der philosophia perennis aus dem Geiste des Thomas von Aquin und im Rahmen der Vorgaben der Kirchenlehre ist. Die "Deutsche Ideologie" enthält zu großen Teilen fragmentarische Textstücke, die Bausteine der historisch-materialistischen Gesellschafts- und Geschichtstheorie bilden, die tief in das 19. Jahrhundert und die Philosophiegeschichte eingebettet ist. Die vornehmlich von Marx und Engels verfasste Schrift ist gleichermaßen Gedankenlaboratorium, polemische Streitschrift und der Beginn der Dogmatisierung. Diese Schwellensituation macht den anhaltenden Reiz der Schrift aus, in der eine Vielzahl von systematischen und methodischen Fragen diskutiert und variiert werden. Das unvollendete Werk hat eine eigentümliche Editionsgeschichte und bis heute steht die Publikation (...) in der MEGA aus. Der Band in der Reihe "Klassiker Auslegen" ist international der erste Versuch, das Werk als Ganzes und in seiner Widersprüchlichkeit zu thematisieren und zu kommentieren. Aus heutiger Sicht kann man dies sowohl als philosophisch inspirierte Gesellschaftstheorie begreifen, wie auch als eine politische Philosophie, deren Kern eine Kritik an der "bürgerlichen" Auffassung von Politik ist. Der Text gewährt Einblicke, in den Prozess der Formierung einer neuartigen Form von Makrotheorie, wobei sich neben dem klassentheoretisch-kollektivistischen, individualistische, philosophisch-normative und positivistische Ansätze in ihr finden. This Element defends a version of the classical theory of divine ideas, the containment exemplarist theory of divine ideas. The classical theory holds that God has ideas of all possible creatures, that these ideas partially explain why God's creation of the world is a rational and free personal action, and that God does not depend on anything external to himself for having the ideas he has. The containment exemplarist version of the classical theory holds that God's own nature is the (...) exemplar of all possible creatures, and therefore that God's ideas of possible creatures are in some sense ideas of himself. Containment exemplarism offers a monotheism fit for metaphysics, insofar as it is coherent, simple, and explanatorily powerful; and offers a metaphysics fit for monotheism, insofar as it leaves God truly worthy of the unconditional worship which Christians, along with Jews and Muslims, aspire to offer to God. How can I know something? How can I convince someone of the rightness of my position? How does reality function? What is artistic creativity? What is the role of the state? It is well known that people from various cultures give dissimilar answers to such philosophical questions. After three decades in the cross-cultural study of ideas and values, Thomas Kasulis found that culture influences not only the answers to these questions, but often how one arrives at the answers. In (...) generalizing cultural difference, Kasulis identifies two kinds of orientation: intimacy and integrity. Both determine how we think about relations among people and among things, and each is reasonable, effective, and consistent. Yet the two are so incompatible in their basic assumptions that they cannot successfully engage each other. Cultural difference extends beyond nations. Cultural identities crystallize in relation to religion, occupation, race, gender, class. Thomas Weber's book comprises a series of biographical reflections about people who influenced Gandhi, and those who were, in turn, influenced by him. Whilst previous literature tended to focus on Gandhi's political legacy, Weber's book explores the spiritual, social and philosophical resonances of these relationships, and it is with these aspects of the Mahatma's life in mind, that the author selects his central protagonists. These include friends such as Henry Polak and Hermann Kallenbach, who are not as well known (...) as those usually cited, but who left a deep impression nevertheless, and motivated some of Gandhi's major life changes. This article presents a new interpretation and critique of some aspects of Aquinas’s metaphysics of relations, with special reference to a theological problem—the relation of God to creatures—that catalyzed Aquinas’s and much medieval thought on the ontology of relations. I will show that Aquinas’s ontologically reductive theory of categorical real relations should equip him to identify certain relations as real relations, which he actually identifies as relations of reason, most notably the relation of God to creatures.

In his ethical writings, Duns Scotus emphasized both divine freedom and natural goodness, and these seem to conflict with each other in various ways. I offer an interpretation of Scotus which takes seriously these twin emphases and shows how they cohere. I argue that, for Scotus, all natural laws obtain just by the natures of actual things. Divine commands, such as the Ten Commandments, contingently track natural laws but do not make natural laws to be natural laws. I present textual (...) evidence for this claim. I also show how this view of Scotus on the natural law is consistent with a number of troubling passages. Scotus’s ethical theory implies that there are genuinely moral reasons for acting which are not absolutely binding (because subject to a divine command or permission otherwise) and also some moral reasons for acting which are absolutely binding (because not thus subject). The historical continuity of spinal catastrophism, traced across multiform encounters between philosophy, psychology, biology, and geology. Drawing on cryptic intimations in the work of J. G. Ballard, Georges Bataille, William Burroughs, Andre Leroi-Gourhan, Elaine Morgan, and Friedrich Nietzsche, in the late twentieth century Daniel Barker formulated the axioms of spinal catastrophism: If human morphology, upright posture, and the possibility of language are the ramified accidents of natural history, then psychic ailments are ultimately afflictions of the spine, which itself is a (...) scale model of biogenetic trauma, a portable map of the catastrophic events that shaped that atrocity exhibition of evolutionary traumata, the sick orthograde talking mammal. Tracing its provenance through the biological notions of phylogeny and "organic memory" that fueled early psychoanalysis, back into idealism, nature philosophy, and romanticism, and across multiform encounters between philosophy, psychology, biology, and geology, Thomas Moynihan reveals the historical continuity of spinal catastrophism. The rich have two defining capabilities: independence from and command over others. These make being wealthy very pleasant indeed, but they are also toxic to democracy. First, I analyse the mechanisms by which the presence of very wealthy individuals undermines the two pillars of liberal democracy, equality of citizenship and legitimate social choice. Continuous short-term technological bail outs without taking into account the longer socio-cultural incubation times required to transition to ‘weakly sustainable’ economies squander valuable resources and time. Increasingly, international governmental networks and organisations make it necessary to master the legal principles of other jurisdictions. Since the advent of international criminal tribunals this need has fully reached criminal law. A large part of their work is based on comparative research. The legal systems which contribute most to this systemic discussion are common law and civil law, sometimes called continental law. So far this dialogue appears to have been dominated by the former. While there are many reasons for this, (...) one stands out very clearly: Language. English has become the lingua franca of international legal research. The present book addresses this issue. Thomas Vormbaum is one of the foremost German legal historians and the book's original has become a cornerstone of research into the history of German criminal law beyond doctrinal expositions; it allows a look at the system's genesis, its ideological, political and cultural roots.
