Despite its complex experiential structure, the phenomenon of grief following bereavement has not been a major topic of phenomenological research. The paper investigates its basic structures, elaborating as its core characteristic a conflict between a presentifying and a ‘de-presentifying’ intention: In grief, the subject experiences a fundamental ambiguity between presence and absence of the deceased, between the present and the past, indeed between two worlds he lives in. This phenomenological structure will be analyzed under several aspects: regarding bodily experience, as (...) disruption of a shared intercorporeality; as a loss of the shared world and shared habitualities, leaving the bereaved person with ubiquitous indications of absence and with a contraction of their own self; regarding temporality, as a separation of two strands of time, namely a still ongoing past and an alienated present which become more and more desynchronized; finally, as an “as-if presence” of the deceased which the bereaved continue to feel and sometimes to perceive, leading to a cognitive-affective conflict between two experienced realities. The transforming process of grief is then analyzed as a gradual adjustment to the loss, finally enabling a re-integration of the conflicting realities. This is achieved through an incorporation and identification with the deceased on the one hand, and through various forms of representation on the other hand, in particular by recollection and symbolization. In “Tense and Reality”, Kit Fine () proposed a novel way to think about realism about tense in the metaphysics of time. In particular, he explored two non-standard forms of realism about tense, arguing that they are to be preferred over standard forms of realism. In the process of defending his own preferred view, fragmentalism, he proposed a fragmentalist interpretation of the special theory of relativity, which will be our focus in this paper. After presenting Fine's position, we will raise (...) a problem for his fragmentalist interpretation of STR. We will argue that Fine's view is in tension with the proper explanation of why various facts obtain. We will then consider whether similar considerations also speak against fragmentalism in domains other than STR, notably fragmentalism about tense. (shrink)

Die vorliegende Arbeit will diese Reflexion leisten. Ihr Gegenstand ist mithin die Transformation Platonischer Gedanken in Husserls Phänomenologie. Dabei werden sechs Problemgebiete thematisiert: (...) A) Philosophie als Wissenschaft, B) Philosophie als Ethik, C) Philosophie als Polemik, D) Philosophie und das Ende der Lebenswelt, E) Philosophie und das Eigenrecht des Eidetischen, F) Philosophie und das Absolute. Den Abschnitten folgen jeweils kritische Erwägungen zu den Spannungen, die vor dem Platonischen Hintergrund innerhalb der Phänomenologie sichtbar werden. Die Arbeit zeigt, dass die Phänomenologie tatsächlich als eine eigenwillige Endstiftung des Platonismus betrachtet werden kann, wodurch sich eine neue Perspektive auf ihre programmatische und systematische Grundkonfiguration ergibt. A new public philosophy began to emerge in the United States during the Progressive Era. Promoted by such intellectuals as John Dewey, William James, and the coUectivists of the New Republic magazine, it called for a citizenry trained in an experimental milieu, free of dogma and emancipated from sources of allegiance other than the new centralized democratic state then being forged. Catholics, however, neither capitulated to the new creed nor retreated into a self-righteous isolation. In the years since Enron corporate social responsibility, or “CSR,” has become a ubiquitous phenomenon in both research and business practice. CSR is used as an umbrella term to describe much of what is done in terms of ethics-related activities in firms around the globe to such an extent that some consider it a “tortured concept” (Godfrey and Hatch 2007, Journal of Business Ethics 70, 87–98). Addressing this skepticism, I argue in this article that the focus on CSR is indeed (...) problematic for three main reasons: (1) the term carries a lot of historical baggage – baggage that is not necessarily conducive to the clarity of the concept; (2) it is the object of increasing ethical instrumentalism; and (3) given the multiple ethical challenges that corporations face, and given the fact that the “social” responsibilities of business are but one set of corporate responsibilities, a suitable term would have to be more inclusive and integrative. I therefore suggests moving instead toward a sound definition of corporate integrity and aim in this article to develop a working definition by fleshing out “7 Cs” of integrity: commitment, conduct, content, context, consistency, coherence, and continuity. I then discuss how these 7 Cs impact our understanding of CSR or, more broadly, corporate responsibility in general. (shrink)

This issue includes a number of papers on reproductive ethics, broadly construed. In a recent book, Anja Karnein proposed that embryos created in vitro should be offered up for adoption before being discarded or used in research;1 here Timothy Murphy offers a critical response . Elsewhere, Tak Chan and Stark & Delatycki debate the role of medical professionals in providing parentage determination. Chan argues that doctors are obliged to provide parentage tests when this is requested by parents, provided there is (...) a low risk that the child will be abandoned . Stark & Delatycki discuss some difficulties raised by the ‘risk of abandonment’ condition . Finally, papers by Kate Greasley and David Lang discuss the controversy surrounding the criminal prosecution of abortion doctor Kermit Gosnell. Greasley criticises the way in which some commentators capitalised on horror at Gosnell's extreme practices to advance more general anti-abortion objectives . Lang argues, against Greasley, that the dominant pro-life response to the case was neither self-contradictory nor intellectually dishonest .The issue is dominated, however, by discussions of ‘bioenhancement’ – the use of biomedical technologies to augment human capacities. A common criticism of bioenhancements is that they are anti-social: though they may benefit the user, they will have a negative effect on society-at-large. Such concerns are perhaps well placed in relation to the most obvious contemporary examples of bioenhancement: doping in sport, aesthetic medicine, and the use of stimulants to enhance examination performance. The mathematician G.F.C. Griss is known for his program of negationless intuitionistic mathematics. Although Griss’s rejection of negation is regarded as characteristic of his philosophy, this is a consequence of an executability requirement that mental constructions presuppose agents’ executing corresponding mental activity. Restoring Griss’s executability requirement to a central role permits a more subtle characterization of the rejection of negation, according to which D. Nelson’s strong constructible negation is compatible with Griss’s principles. This exposes a ‘holographic’ theory of negation in (...) negationless mathematics, in which a full theory of negation is ‘flattened’ in a putatively negationless setting. (shrink)

Codes of ethics are directly aimed at behavioral control, but they also affect a company’s ethical culture, which in turn concerns compliance and ethical behavior. To positively influence a company’s ethical culture, employees must be familiar with its code of ethics, perceive that top management is committed to the code, and believe that their peers also comply with the code. The evidence on whether a code’s design affects a company’s ethical culture is limited. This study’s factorial survey experiment contributes to (...) this gap in two ways: first, it investigates whether a code’s design affects how easily the code can be learned and, therefore, contributes to code familiarity. Second, it examines how a code can convey expectations regarding top management’s commitment and peers’ behavior, both of which are part of ethical culture. The results indicate that a positive tone increases code familiarity, and a code signed by top managers sends a strong signal of their commitment to the code. This book is an investigation of the relationship between self and body in the Indian, Japanese, and Chinese philosophical traditions. The interplay between self and body is complex and manifold, touching on issues of epistemology, ontology, social philosophy, and axiology. The authors examine these issues and make relevant connections to the Western tradition. The authors' allow the Asian traditions to shed new light on some of the traditional mind-body issues addressed in the West.

Many of the problems studied in cognitive science are inductive problems, requiring people to evaluate hypotheses in the light of data. The key to solving these problems successfully is having the right inductive biases—assumptions about the world that make it possible to choose between hypotheses that are equally consistent with the observed data. This article explores a novel experimental method for identifying the biases that guide human inductive inferences. The idea behind this method is simple: This article uses the responses (...) produced by a participant on one trial to generate the stimuli that either they or another participant will see on the next. A formal analysis of this “iterated learning” procedure, based on the assumption that the learners are Bayesian agents, predicts that it should reveal the inductive biases of these learners, as expressed in a prior probability distribution over hypotheses. This article presents a series of experiments using stimuli based on a well-studied set of category structures, demonstrating that iterated learning can be used to reveal the inductive biases of human learners. Abstractabstract:There are two ways of hearing Philo's unexpected endorsement of a version of the design hypothesis in the final part of Hume's Dialogues. We might register it in accordance with Cleanthes's descriptivist approach to religious speech, taking Philo to be reasoning with Cleanthes in Cleanthes's own way. Or we might hear Philo's words in accordance with his own expressivist account of religious speech, an account that Philo appears to have borrowed from Hobbes. I argue that Hume intended this double layering (...) of meanings, presenting us with two distinct ways we might understand Philo's closing remarks. Each possible reading reveals a distinct Humean lesson about the limitations of natural theology. (shrink)

The article focuses on the ability of some animals and plants to respond to changing environmental conditions by temporarily suspending metabolic processes. In contemporary biology, this state between life and death is commonly labelled ‘cryptobiosis’, combining the Greek kryptos (hidden, concealed, secret) with biōsis (mode of life). I argue that the notion of ‘cryptobiosis’ does not account sufficiently for the processual and relational dimensions of ametabolic life. The article advances a related but different concept, which better addresses this liminal state (...) of biological organisation: s uspended life. While cryptobiosis still nurtures the imaginary of some latent life, suspended life stresses the liminality of the neither-nor life and death. The notion also grasps the dynamic and ongoing transfer between the biological and the technological. While the debate on cryptobiosis has so far remained confined to the description of natural processes, suspended life (or limbiosis) promises to account for contemporary technological practices of cryopreservation. The aim of this paper is to present a solution to a problem that arises from the fact that people who commit crimes under the influence of serious mental disorders may still have a capacity to refuse treatment. Several ethicists have argued that the present legislation concerning involuntary treatment of people with mental disorder is discriminatory and should change to the effect that psychiatric patients can refuse care on the same grounds as patients in somatic care. However, people with mental (...) disorders who have committed crimes and been exempted from criminal responsibility would then fall outside the scope of criminal justice as well as that of the psychiatric institutions if they were to refuse care. In this paper, I present and develop a solution to how society should deal with this group of people, called Advance criminal responsibility. The basic idea being that if a person with a potentially responsibility exempting psychiatric condition refuses care, that person is responsible for any future criminal acts which are due to the mental disorder. Drawing from Kant's moral theory, this essay develops an account of what is required to treat persons with dignity, or as "ends in themselves". It proposes to regard the implications of Kant's humanity formula as a cluster of related precepts that can guide and constrain moral deliberation about how to specify and interpret the principles that should guide day to day decisions. The essay then addresses three questions: What is implied regarding how offenders should be treated while undergoing punishment? Apart from Kant's official theory of punishment, what would the humanity formula recommend regarding who should be punished, how much, in what way, and why? Abstract This article identifies the tropes of “maturity” and “immaturity” in the dialogue between religion and science. On both sides of the aisle, authors charge, either directly or indirectly, that their dissenting interlocutors are not mature enough to see the value of their respective positions. Such accusations have recently emerged in discussions pertaining to Hindu theology, Indology, and science. Those who dismiss the substance dualism of Hindu yoga, according to Jonathan B. Edelmann, evince immaturity. Appeals to Hindu yoga are yet (...) one more appeal to religious experience. Indeed, what we find in Edelmann's text is an appeal to appreciate the private, unverifiable—or falsifiable, for that matter—“insights” of Hindu yogis. Yogic experience is interminably steeped in motivated perception and confirmation bias. There is simply no good evidence or rational argument to take yogic claims seriously. Insofar as that is the case, Indology must achieve consilience with the natural and human sciences, remaining thereby reductive of such supernatural claims. (shrink)

However, the "professionalization" of teachers traced by sociology generally refers to only the transition early in the twentieth century from two years ofteacher preparation in normal schools to four years in newly created (...) professional schools, departments, orprogramsofeducationinuniversities. Traditional sociological theory still considers teaching to be at best a "semiprofession."1 In the "ideal" descriptionofsociologist Max Weber, professionals shared these traits: They were self-employed providers of services, diey entered dieir profession because diey were 'called' to it out of some deep personal commitment, and dieir qualifications were based upon tiieir possessionof'expert' andesotericknowledge. In addition, dieir knowledge base could be acquired only by a select few who underwent long and rigorous study. Their services dealt widi serious, often life or deadi matters, and dieywere remunerated by fees from clients. Communication between professionals and dieir clients was legally privileged so uiat courts oflaw could not require its disclosure. Most important, entrance to mese professions was controlled by professional peers, who set requirements for entry, training, and certification. Boards ofpeers also developed reviewprocesses to maintain standards and competence. 2 A further criterion of a true profession is that praxis3 relies upon underlying theory4 and the fundofwidelyacceptedpractice-basedknowledge generated by theory that is required to deal with the extensive variety ofpredictably unique problems and needs presented by those served. Teaching clearly deviates substantially from these conditions. The theory serving as the basis of any profession is not amatterofsimple speculation; it is rooted in research and theoretical principles-fundamentals that importantly include commonly recognized and accepted action ideals of the profession's ethical and other guiding philosophicalconsiderations. Uponsuchtheoretical bases, professional praxis generates ever-new praxial knowledge. Because ofthe particulars of the situatedness governing both the practitioner andthose served, praxis-based knowledge always takes idiosyncratic form for a particularpractitioner -but, importantly, within the general theoretical, ethical, and philosophical stance ofthe profession. As a result, there are no "standard results " for any practitioner or for the overall profession. Furthermore, there are no standard methods ;just "standards ofcare" rooted in the profession 's theoretical and ethical premises. Music educationhas evolvedno such shared action ideals concerning ends and so the issue of theory-guided practice or of a professional ethic remainsambiguous, evencontroversial.1 Without professionally based consensus on ends, no stable criteria exist for selecting means and evaluating results and, thus, no ethic of accountability can apply. The comparisons made here to helping professions are made only in a very general way. However, overall, the field ofmusic education fails to compare well with the most obvious traits of familiar professions. As shall be argued, judgments concerning successful practice in music education should depend in large part on criteria provided by theoretically substantiated auricular goals and ideals and by implied and explicit process criteria of both an ethical and practical nature.6 Lacking such criteria, the question or degree of teaching success remains vague. As a result music education fails to promote predictable and pragmatic "right results" that students, parents, and the public at large can easily recognize as the professional "value-added" to general education and society by music education and this creates the increasing need foradvocacyofschool music. Public announcement logic is an extension of epistemic logic with dynamic operators that model the effects of all agents simultaneously and publicly acquiring the same piece of information. One of the extensions of PAL, group announcement logic, allows quantification over announcements made by agents. In GAL, it is possible to reason about what groups can achieve by making such announcements. It seems intuitive that this notion of coalitional ability should be closely related to the notion of distributed knowledge, the implicit (...) knowledge of a group. Thus, we study the extension of GAL with distributed knowledge, and in particular possible interaction properties between GAL operators and distributed knowledge. The perhaps surprising result is that, in fact, there are no interaction properties, contrary to intuition. We make this claim precise by providing a sound and complete axiomatisation of GAL with distributed knowledge. We also consider several natural variants of GAL with distributed knowledge, as well as some other related logic, and compare their expressive power. (shrink)

We obtain an array of consistency results concerning trees and stationary reflection at double successors of regular cardinals $\kappa $, updating some classical constructions in the process. This includes models of $\mathsf {CSR}(\kappa ^{++})\wedge {\sf TP}(\kappa ^{++})$ (both with and without ${\sf AP}(\kappa ^{++})$ ) and models of the conjunctions ${\sf SR}(\kappa ^{++}) \wedge \mathsf {wTP}(\kappa ^{++}) \wedge {\sf AP}(\kappa ^{++})$ and $\neg {\sf AP}(\kappa ^{++}) \wedge {\sf SR}(\kappa ^{++})$ (the latter was originally obtained in joint work by Krueger and (...) the first author [9], and is here given using different methods). Analogs of these results with the failure of $\sf {SH}(\kappa ^{++})$ are given as well. Crises such as water quality, pollution, climate change, overfishing, biodiversity, energy, waste, and carbon sequestration mean that legislation protecting the marine environment is under intense pressure to be effective and to demonstrate positive results in a vast array of public and private spheres. Thus far, scholarship of EU marine environmental law has been focused primarily on (i) interaction with international agreements (ii) spatial/jurisdictional studies (iii) analysis of new laws, plans and programmes (iv) principles (e.g. good environmental status, precautionary approach, polluter (...) pays) (v) CJEU case analysis (vi) enforcement (vii) specific issues (plastics, litter…). However, over the years the mass constituted by the EU marine environment acquis has grown ever-larger, leading to risks of poor coordination, over-regulation in some areas and lack of regulation in others. By triangulating complementary investigatory methodologies, this study teases out systemic, diachronic and legilinguistic interlinkages—within and across key instruments as well as EU institutions, bodies and agencies. Our results provide avenues for policymakers nationally and at EU level to improve the legibility and coherence of marine environmental regulation—to the benefit of citizens and the wider body of stakeholders, and, ultimately, to benefit the marine world.
