The most striking economic and political fact of the past forty years has been the dramatic increase in economic and political inequality throughout the advanced economies. This Article considers this development as an occasion to explore the contribution of contemporary law and legal thought to the problem of inequality. I focus on two main themes: the naturalization of the present institutional form of the regulated market economy, and the naturalization of the present low-energy form of democracy. I argue that in (...) each case, the absence of structural vision in law prevents us from understanding the sources of and remedies for inequality. We must rescue the insight from the compromise and begin to develop a better way of thinking about law and the economy, if we are to understand and address the rise of inequality. Therefore, three programmatic implications are suggested in this Article regarding three domains: politics, production and finance. (shrink)

Despite their centrality and importance to both science and philosophy, relatively little has been written about thought experiments. This volume brings together a series of extremely interesting studies of the history, mechanics, and applications of this important intellectual resource. A distinguished list of philosophers and scientists consider the role of thought experiments in their various disciplines, and argue that an examination of thought experimentation goes to the heart of both science and philosophy.

Although there is evidence that supports the safety of planned home birth for healthy women, less than 1 percent of women in the United States choose to have their baby at home. An ethnographic study of the experience of planned home birth provided rich descriptions of women’s experiences planning, preparing for, and having a home birth. This article describes findings related to how women make the decision to have a planned home birth. For these women, being safe emerged as central (...) in making the decision. For them, being safe included four factors: avoiding technological birth interventions, knowing the midwife and the midwife knowing them, feeling comfortable and protected at home, and knowing that backup hospital medical care was accessible if needed. This edition of John M. Lothian’s transcription of an almost com­plete set of a student’s notes on Smith’s lectures given at the University of Glasgow in 1762–63_ _brings back into print not only an important discovery but a valuable contribution to eighteenth-century rhetorical theory.

This paper develops a domination-based practice-dependent approach to justice, according to which it is practices of systemic domination which can be said to ground demands from justice. The domination-based approach developed overcomes the two most important objections levelled to alternative practice-dependent approaches. First, it eschews conservative implications and hence is immune to the status quo objection. Second, it is immune to the redundancy objection, which doubts whether empirical facts and practices can really play an irreducible role in grounding justice. In (...) theorising dominating practices in terms of practices of social power, a domination-based approach makes justice dependent on factual information in three ways: First, the principle of non-domination is indeterminate and can only be spelled out by taking into view particular contexts of domination. Second, the principle of non-domination is conditional on the existence of practices of social power. Third, social power possesses a structural ontology – to know whether A has social power over B we need to turn to social rules distributing agents' higher order status of normative authority towards each other. This explains in what way practices of social power – and of domination – are both factual and normative practices and hence how such practices are non-redundant in grounding justice. (shrink)

On the most common interpretation of occasion-sensitivity what varies cross-contextually is the truth-conditional content of representations. Jerry Fodor argues that when extended to mental representation this view has some problematic consequences. In this paper I outline an approach to occasion-sensitivity which circumvents Fodor’s objections but still maintains that the aspect of thought that guides deliberation and action is occasion-sensitive. On the proposed view, what varies cross-contextually are not truth conditions but rather the conditions for accepting a representation as true relative (...) to a practical goal that is pursued on an occasion. I show that although the proposal entails an error theory this theory is not problematic since it is meant to compensate for the over-generating nature of semantic competence, namely, the fact that not all of the representation’s truth-makers are conducive to a given contextually salient goal. To what extent can philosophical thought experiments reveal norms? Some ethicists have argued that certain thought experiments reveal that people draw a morally significant distinction between "doing" and "allowing". I examine one such thought experiment in detail and argue that the intuitions it elicits can be explained by "prospect theory", a psychological theory about the way people reason. The extent to which such alternative explanations of the results of thought experiments in philosophy are generally available is an empirical question.

This article starts by noting the general lack of acknowledgment of alternative traditions in the dominant western sustainability discourse in education. After critically analyzing the western human–nature relationship in the context of Enlightenment, modernity and colonial expansion, this article introduces two non-western ecological discourses from Eurasia and Asia, Noöspherism and Neo-Confucianism, which offer clear contrasts to the western sustainability framework. Using theoretical argumentations, the article goes on to examine the cosmological and ontological categories expounded by Vladimir Vernadsky of Russia and (...) Yulgok Yi of Korea, whose philosophical foundations with unique foci on the anthropocosmic and cosmoanthropic types of human–nature relationships could well be alternatives and/or additions to the dominant western discourse. The article concludes with a twofold comparison: between Eurasian and Confucian heritages, and these two with the mainstream western ecological discourse. (shrink)

Non-medical sex selection is premised on the notion that the sexes are not interchangeable. Studies of individuals who undergo sex selection for non-medical reasons, or who have a preference for a son or daughter, show that they assume their child will conform to the stereotypical roles and norms associated with their sex. However, the evidence currently available has not succeeded in showing that the gender traits and inclinations sought are caused by a “male brain” or a “female brain”. Therefore, as (...) far as we know, there is no biological reason why parents cannot have the kind of parenting experience they seek with a child of any sex. Yet gender essentialism, a set of unfounded assumptions about the sexes which pervade society and underpin sexism, prevents parents from realising this freedom. In other words, unfounded assumptions about gender constrain not only a child’s autonomy, but also the parent’s. To date, reproductive autonomy in relation to sex selection has predominantly been regarded merely as the freedom to choose the sex of one’s child. This paper points to at least two interpretations of reproductive autonomy and argues that sex selection, by being premised on gender essentialism and/or the social pressure on parents to ensure their children conform to gender norms, undermines reproductive autonomy on both accounts. In 1951, the eight o’clock nightly news reported on Jean-Paul Sartre for the first time. By the end of the twentieth century, more than 3,500 programs dealing with philosophy and its practitioners—including Bachelard, Badiou, Foucault, Lyotard, and Lévy—had aired on French television. According to Tamara Chaplin, this enduring commitment to bringing the most abstract and least visual of disciplines to the French public challenges our very assumptions about the incompatibility of elite culture and mass media. Indeed, it belies the (...) conviction that television is inevitably anti-intellectual and the quintessential archenemy of the book. Chaplin argues that the history of the televising of philosophy is crucial to understanding the struggle over French national identity in the postwar period. Linking this history to decolonization, modernization, and globalization, _Turning On the Mind _claims that we can understand neither the markedly public role that philosophy came to play in French society during the late twentieth century nor the renewed interest in ethics and political philosophy in the early twenty-first unless we acknowledge the work of television. Throughout, Chaplin insists that we jettison presumptions about the anti-intellectual nature of the visual field, engages critical questions about the survival of national cultures in a globalizing world, and encourages us to rethink philosophy itself, ultimately asserting that the content of the discipline is indivisible from the new media forms in which it has found expression. In this article, we present ideas related to three key aspects of mindfulness training: the regulation of attention via noradrenaline, the importance of working memory and its various components (particularly the central executive and episodic buffer), and the relationship of both of these to mind-wandering. These same aspects of mindfulness training are also involved in the preparation and execution of movement and implicated in the pathophysiology of psychosis. We argue that by moving in a mindful way, there may be an (...) additive effect of training as the two elements of the practice (mindfulness and movement) independently, and perhaps synergistically, engage common underlying systems (the default mode network). We discuss how working with mindful movement may be one route to mindfulness training for individuals who would struggle to sit still to complete the more commonly taught mindfulness practices. Drawing on our clinical experience working with individuals with severe and enduring mental health conditions, we show the real world application of these ideas and how they can be used to help those who are suffering and for whom current treatments are still far from adequate. This article focuses on the follow question: Are human enhancement technologies likely to be justice impairing or justice promoting? We argue that human enhancement technologies may not be inherently just or unjust, but when situated within obtaining social contexts they are likely to exacerbate rather than alleviate social injustices.

World Philosophy mourns the loss of Professor Yegane Shayegan. Half Iranian and half Georgian, Professor Shayegan was destined to a cosmopolitan life from a young age. She studied Islamic philosophy in Geneva (Switzerland) and at Harvard University where she received her PhD degree with a dissertation entitled Avicenna on Time (1986). She was a research scholar at the University College in London, taught at the Sorbonne, Paris, and finally at the Iranian Institute of Philosophy, Tehran (2003-2007). She was a fine (...) translator of Aristotle, Alexandre of Aphrodisias, and Ibn Sina (Avicenna). Her scholarly work adorned some of the most important publications within the research on Islamic philosophy. She thus contributed to An Anthology of Philosophy in Persia (ed. by Seyyed Hossein Nasr and Mehdi Aminrazawi, 1999) and History of Islamic Philosophy (ed. by Seyyed Hossein Nasr and Oliver Leaman, 1996. Her perhaps greatest gift was her ability to convey her passion for Greek philosophy and the history of its reception in Islamic sources to a great number of students. Not surprisingly, when Professor Shayegan left her comfortable position at the Sorbonne to teach in Tehran, she took her private philosophical library with her. Students could thus consult books not available in Iranian libraries in the privacy of her home. The author of these lines was privileged to be a guest in Professor Shayegans home in Tehran in May of 2004. Her home was a salon in the classical sense of the word. It welcomed Tehrans finest intellectuals and artists. Professor Shayegan died in Paris on June 5, 2007 at the age of seventy. (shrink)

Epochenübergreifend wird darin aufgezeigt, wie philosophische Probleme transformiert werden: sei es, daß sie neuen systematischen Zusammenhängen angepaßt werden oder daß sie sich in diesen neu stellen. Darüber hinaus bietet der Festschriftband eine Reihe von Aufsätzen zur Renaissancephilosophie. Insbesondere jene Beiträge, die neues Licht auf den Zusammenhang von Mathematik und Methodenproblem in der Philosophie (...) dieser Epoche werfen, dürften für die Forschung von höchstem Interesse sein. We present a representation for reasoning and planning with an incomplete state description (open-world) called PSIPLAN-S. The presented formalism has several properties critical for application domains with a large degree of incompleteness in the state description, particularly, in domains with a large or unknown set of all objects. The formalism offers (1) considerably expressive state and goal description language, that includes limited universal quantification, (2) representation of sensing actions and knowledge goals, (3) a correct and complete state update procedure, and (...) (4) complete reasoning within a substantial subset of the language. The approach is illustrated by examples from a working system. (shrink)

This essay examines texts from Kierkegaard's signed and pseudonymous authorship on immortality and the resurrection, challenging the received opinion that Kierkegaard's account of eternal life merely connotes a temporal, existential modality of experience as a present eternity. Kierkegaard's thoughts on immortality are more complicated than this reading allows. I demonstrate that Kierkegaard's ideas on the afterlife emerge out of a context in which the topic had been vigorously debated in both Germany and Denmark for more than a decade. In responding (...) to these debates, Kierkegaard establishes a "new argument" for immortality that stands as a robust account of the Christian resurrection and highlights the power of a personal God at the center of life, death, and post-mortem existence. The paper discusses the difference between philosophy and sophistry. More precisely, it discusses the differences between Socrates and Sophists of the first generation, as well as the differences between Epictetus and Sophists of both first and second generation. While Sophists were the first professional teachers and Epictetus one of the greatest Stoic teachers of all times, Socrates, according to Plato, denied being a teacher by any means, despite many who thought otherwise. Sophists were known for their speeches that most attracted (...) those with a wish to be successful politicians. Socrates and Epictetus were also excellent orators surrounded by Athenian and Roman politicians. However, that didn’t make them Sophists. Socrates and Epictetus opted for a life in accordance with excellence that could be achieved by philosophy rather than rhetoric. Rhetoric could only have instrumental value, not an intrinsic one. Творчий потенціал особистості є неповторним елементом перетворення навколишнього середовища людиною. Однак протягом історії становлення та розвитку творчості в контексті філософської традиції відбувалися значні зміни. Аристотель розглядає людину з точки зору природної істоти, що наділена розумом, духом, а творчість постає суспільним явищем. У теологічній концепції людина розглядається як надприродне утворення, що має свій сенс, призначення і свою історію виникнення. Творчість властива Богу, а не людині. Таким чином, у теологічній концепції (...) людина втрачає свій творчий потенціал. Це стає передумовою розуміння людини як творця власного життя та долі. Відбувається антропологічний поворот до розуміння творчості. На пізніх етапах розвитку людства творчість ототожнюється з мисленням. Творчість людини залежить від творення, що постає діяльністю Абсолютної ідеї, яка у нього є «вічною творчістю, вічною життєвістю». Творча сила людського серця розкривається у філософській концепції Г. Сковороди. В екзистенціальній філософії свобода постає як специфічна складова людського буття, що є ірраціональної ідеєю, яка надихає на творчість. А творчість розкриває величезні можливості людського духу. Resisting oppression evokes images of picket lines and crowds of protestors demanding large-scale reform. But not all resistance is political or publicly broadcast. Some acts of resistance are done solo, in private, aim to achieve personal goals, and may not even be recognizable as resistance by others. I present a taxonomy of resistance to oppression that distinguishes acts of resistance along four dimensions: their subject, target, scope, and tone. The taxonomy brings to light a range of forms of resistance that (...) differ significantly from political activism and that theories of the morality of resistance should be able to evaluate. Attitudes toward sow husbandry differ between citizens and conventional pig farmers. Research showed that moral values could only predict the judgment of people in case of culling healthy animals in the course of a disease epidemic to a certain extent. Therefore, we hypothesized that attitudes of citizens and pig farmers cannot be predicted one-on-one by moral values. Furthermore, we were interested in getting insight in whether moral values can be useful in bridging the gap between attitudes toward sow husbandry of (...) citizens and pig farmers. Based on a questionnaire, it was found that pig farmers and citizens, when considered as one group, shared the valuation of most moral values. However, when studying the four clusters of citizens with different attitudes toward sow husbandry, determined in a previous study, a variation in valuation of the moral values between the clusters of citizens and farmers came to the fore. This means that moral values are interpreted differently by groups of people when forming attitudes toward sow husbandry. The results of our study give an indication of which moral values are weighed differently between clusters of citizens and pig farmers. This information can be useful in future research on attitudes toward animal husbandry in order to understand why attitudes differ between groups of people. Besides, our results can be useful for the pig sector and citizens to learn to understand each other’s attitudes. With this understanding it is possible to invest in a husbandry system that can build on societal support. (shrink)

In criminal trials, evidence often involves a degree of uncertainty and decision-making includes moving from the initial presumption of innocence to inference about guilt based on that evidence. The jurors’ ability to combine evidence and make accurate intuitive probabilistic judgments underpins this process. Previous research has shown that errors in probabilistic reasoning can be explained by a misalignment of the evidence presented with the intuitive causal models that people construct. This has been explored in abstract and context-free situations. However, less (...) is known about how people interpret evidence in context-rich situations such as legal cases. The present study examined participants’ intuitive probabilistic reasoning in legal contexts and assessed how people’s causal models underlie the process of belief updating in the light of new evidence. The study assessed whether participants update beliefs in line with Bayesian norms and if errors in belief updating can be explained by the causal structures underpinning the evidence integration process. The study was based on a recent case in England where a couple was accused of intentionally harming their baby but was eventually exonerated because the child’s symptoms were found to be caused by a rare blood disorder. Participants were presented with a range of evidence, one piece at a time, including physical evidence and reports from experts. Participants made probability judgments about the abuse and disorder as causes of the child’s symptoms. Subjective probability judgments were compared against Bayesian norms. The causal models constructed by participants were also elicited. Results showed that overall participants revised their beliefs appropriately in the right direction based on evidence. However, this revision was done without exact Bayesian computation and errors were observed in estimating the weight of evidence. Errors in probabilistic judgments were partly accounted for, by differences in the causal models representing the evidence. Our findings suggest that understanding causal models that guide people’s judgments may help shed light on errors made in evidence integration and potentially identify ways to address accuracy in judgment. The latest revision, the DSM-5, contains several controversial diagnoses that have been the subject of much debate. One of the central criticisms of DSM-5 is that it pathologizes some behaviors that were previously considered simply problematic, or variations of normal behavior—for example, fidgetiness, noisiness, abundance of energy, shyness, anxiety, and bereavement. Diagnoses such as Binge Eating Disorder, Disruptive Mood Dysregulation Disorder...

Leading experts and rising stars in the field explore whether cosmopolitanism becomes impossible in the theoretical framework that assumed the absence of a final ground. The questions that the volume addresses refer exactly to the foundational predicament that characterizes cosmopolitanism: How is it possible to think cosmopolitanism after the critique of foundations? Can cosmopolitanism be conceived without an ‘ultimate’ ground? Can we construct theories of cosmopolitanism without some certainties about the entire world or about the cosmos? Should we continue to (...) look for foundations of cosmopolitan rights, norms and values? Alternatively, should we aim towards cosmopolitanism without foundations or towards cosmopolitanism with ‘contingent foundations’? Could cosmopolitanism be the very attempt to come to terms with the failure of ultimate grounds? Written accessibly and contributing to key debates on political philosophy, and social and political thought, this volume advances the concept of post-foundational cosmopolitanism by bridging the polarised approaches to the concept. Esta es la realidad las trabajadoras sexuales migrantes en España quienes sufren múltiples discriminaciones derivadas de la intersección entre las políticas de intervención abolicionistas y la política migratoria europea. Desde la epistemología feminista y la perspectiva de los derechos (...) humanos, se recogen en este trabajo una aproximación al estatuto jurídico de estas mujeres desde sus experiencias y sus reclamaciones.
