Newborn bloodspot screening programs are some of the longest running population screening programs internationally. Debate continues regarding the need for parents to give consent to having their child screened. Little attention has been paid to how meanings of consent-related terminology vary among stakeholders and the implications of this for practice. We undertook semi-structured interviews with parents, healthcare professionals and policy decision makers in two Canadian provinces. Conceptions of consent-related terms revolved around seven factors within two broad domains, decision-making and information (...) attainment. Decision-making comprised: parent decision authority; voluntariness; parent engagement with decision-making; and the process of enacting choice. Information ascertainment comprised: professional responsibilities ; parent responsibilities; and the need for discussion and understanding prior to a decision. Our findings indicate that consent-related terms are variously understood, with substantive implications for practice. We suggest that consent procedures should be explained descriptively, regardless of approach, so there are clear indications of what is expected of parents and healthcare professionals. Support systems are required both to meet the educational needs of parents and families and to support healthcare professionals in delivering information in a manner in keeping with parent needs. I might remark in this connexion that Mr. Sharp (p. 61) remembers my obiter dicta better than I do. I do not now feel so sure about the use ws suggested there, but I must look into it further. A wider circle than those who study New Testament Greek will find much interest in the few pages which present parallels in Epictetus' thought. They should send some English readers to the accessible discourses of a very noble 'heathen, ' whose 'feeling after God' was assuredly not without reward. Recent incidences of fraud and the growing globalization of business have focused attention on the effect of culture on ethical decision making within organizations. Because fraud can be extremely costly and is more likely to be committed by employees than persons external to the organization, employees willing to report un-ethical acts are an important supplemental control tool. The current study provides evidence of the effects of culture (Canadian and Chinese) and the type of reporting (whistle-blowing and peer reporting) on reporting (...) unethical acts within organizations. Chinese and Canadian participants were asked to respond to scenarios describing unethical acts committed within organizations. Results indicate that Chinese are more likely to report the unethical acts of peers than Canadians. Chinese also appear more likely to report the unethical acts of peers than supervisors. The results also suggest that Graham’s model of principled organizational dissent may not be applicable to Chinese and perhaps other non-Western cultures. (shrink)

In recent years we have seen a dramatic shift, in several different areas of communication studies, from an information-theoretic to a dynamic systems paradigm. In an information processing system, communication, whether between cells, mammals, apes, or humans, is said to occur when one organism encodes information into a signal that is transmitted to another organism that decodes the signal. In a dynamic system, all of the elements are continuously interacting with and changing in respect to one another, and an aggregate (...) pattern emerges from this mutual co-action. Whereas the information-processing paradigm looks at communication as a linear, binary sequence of events, the dynamic systems paradigm looks at the relation between behaviors and how the whole configuration changes over time. One of the most dramatic examples of the significance of shifting from an information processing to a dynamic systems paradigm can be found in the debate over the interpretation of recent advances in ape language research (ALR). To some extent, many of the early ALR studies reinforced the stereotype that animal communication is functional and stimulus bound, precisely because they were based on an information-processing paradigm that promoted a static model of communicative development. But Savage-Rumbaugh's recent results with bonobos has introduced an entirely new dimension into this debate. Shifting the terms of the discussion from an information-processing to a dynamic systems paradigm not only highlights the striking differences between Savage-Rumbaugh's research and earlier ALR studies, but further, it sheds illuminating light on the factors that underpin the development of communication skills in great apes and humans, and the relationship between communicative development and the development of language. My comments will focus on the problem of the fascist self.1 All three essays—correctly to my mind—imply that it holds the key to a better understanding of the nature of fascism. It is disturbing enough to study people so enamored with death. Fascism remakes the nineteenth-century bourgeois individual into a type of “reduced complexity” who cultivates the role of a conquering hero through sacrifice and murder. Even worse, Helmut Lethen provocatively suggests that fascists share this affection for typologizing human beings (...) with other modern avant-garde movements. I would push this argument further. This collection of original essays, by some of the best known contemporary criminal law theorists, tackles a range of issues about the criminal law's 'special part' - the part of the criminal law that defines specific offences. One of its aims is to show the importance, for theory as well as for practice, of focusing on the special part as well as on the general part which usually receives much more theoretical attention. Some of the issues covered concern the proper (...) scope of the criminal law, for example how far should it include offences of possession, or endangerment? If it should punish only wrongful conduct, how can it justly include so-called 'mala prohibita', which are often said to involve conduct that is not wrongful prior to its legal prohibition? Other issues concern the ways in which crimes should be classified. Can we make plausible sense, for instance, of the orthodox distinction between crimes of basic and general intent? Should domestic violence be defined as a distinct offence, distinguished from other kinds of personal violence? Also examined are the ways in which specific offences should be defined, to what extent those definitions should identify distinctive types of wrongs, and the light that such definitional questions throw on the grounds and structures of criminal liability. Such issues are discussed in relation not only to such crimes as murder, rape, theft and other property offences, but also in relation to offences such as bribery, endangerment and possession that have not traditionally been subjects for in depth theoretical analysis. We prove results about nonstandard formulas in models of Peano arithmetic which complement those of Kotlarski, Krajewski, and Lachlan in [KKL] and [L]. This enables us to characterize both recursive saturation and resplendency in terms of statements about nonstandard sentences. Specifically, a model M of PA is recursively saturated iff M is nonstandard and M-logic is consistent.M is resplendent iff M is nonstandard, M-logic is consistent, and every sentence φ which is consistent in M-logic is contained in a full satisfaction (...) class for M. Thus, for models of PA, recursive saturation can be expressed by a (standard) Σ 1 1 -sentence and resplendency by a ▵ 1 2 -sentence. (shrink)

This is the text of The Lindley Lecture for 1961, given by Stuart Hampshire, a British philosopher.

Systematic semantic ambiguities result from the interaction of the two operations that are involved in resolving ellipsis in the presence of scoping elements such as quantifiers and intensional operators: scope determination for the scoping elements and resolution of the elided relation. A variety of problematic examples previously noted - by Sag, Hirschbüihler, Gawron and Peters, Harper, and others - all have to do with such interactions. In previous work, we showed how ellipsis resolution can be stated and solved in equational (...) terms. Furthermore, this equational analysis of ellipsis provides a uniform framework in which interactions between ellipsis resolution and scope determination can be captured. As a consequence, an account of the problematic examples follows directly from the equational method. The goal of this paper is merely to point out this pleasant aspect of the equational analysis, through its application to these cases. No new analytical methods or associated formalism are presented, with the exception of a straightforward extension of the equational method to intensional logic. (shrink)

While the issue of standards has received attention from analysts in science and technology studies, this attention has tended to focus on either units of measurement or compatibility standards. Much less attention has been devoted to equally important standards of practice. These are the procedural or process standards which govern how technologists go about designing and constructing artifacts. Such standards have a substantial documented history in the form of engineering codes of practice. As the embodiment of judgments rendered by a (...) particular community of technological practi tioners, these standards both reflect and shape the exercise of practitioner judgment. This article explores both these functions through examples drawn from structural and software engineering. These examples yield insights regarding both the role of formal procedural standards in technological practice and the unusual nature of software technology. (shrink)

This book describes Carmeli's cosmological general and special relativity theory, along with Einstein's general and special relativity. These theories are discussed in the context of Moshe Carmeli's original research, in which velocity is introduced as an additional independent dimension. Four- and five-dimensional spaces are considered, and the five-dimensional braneworld theory is presented. The Tully-Fisher law is obtained directly from the theory, and thus it is found that there is no necessity to assume the existence of dark matter in the halo (...) of galaxies, nor in galaxy clusters.The book gives the derivation of the Lorentz transformation, which is used in both Einstein's special relativity and Carmeli's cosmological special relativity theory. The text also provides the mathematical theory of curved space?time geometry, which is necessary to describe both Einstein's general relativity and Carmeli's cosmological general relativity. A comparison between the dynamical and kinematic aspects of the expansion of the universe is made. Comparison is also made between the Friedmann-Robertson-Walker theory and the Carmeli theory. And neither is it necessary to assume the existence of dark matter to correctly describe the expansion of the cosmos. (shrink)

The meta-scientific investigation of the various kinds of influence which determine both the establishment of the cultural institution of science and criteria governing its internal operations, including criteria of the concepts of cognition has been termed by Professor Jürgen Habermas as the critical theory of science. The five-fold thesis of his theory treats of what he considers to be the extrascientific interests which determine and accompany our traditional concepts of knowledge as characterized by science. The development of the theses is (...) preceded by his analysis of the faults of "positivist methodology" in which, he argues, distinctions such as that between facts and values are based upon fundamental confusions concerning inerradicable and pervasive practical concerns in terms of which the concepts of cognition are ultimately founded. He identifies the three all-embracing knowledge-guiding interests or concerns as the cognitive interest which determines logical and empirical categories, the practical interest which determines the character of human understanding within the cultural sciences, and the emancipatory interest which determines our concept for freedom and autonomy. The arguments for the critical theory are here analyzed and criticized in terms of their logical shortcomings, while the claims made in favor of the critical theory are found to be based upon inerradicable and pervaisive confusions concerning logical consistency in argumentation. The final section summarizes, moralizes, and speculates upon the criticalness of the critical theory. (shrink)
