This paper discusses counterexamples to the thesis that the probabilities of conditionals are conditional probabilities. It is argued that the discrepancy is systematic and predictable, and that conditional probabilities are crucially involved in the apparently deviant interpretations. Furthermore, the examples suggest that such conditionals have a less prominent reading on which their probability is in fact the conditional probability, and that the two readings are related by a simple step of abductive inference. The fact that the standard probabilistic calculus does not define probabilities for sentences with embedded conditionals is a fundamental problem for the probabilistic theory of conditionals. Several authors have explored ways to assign probabilities to such sentences, but those proposals have come under criticism for making counterintuitive predictions. This paper examines the source of the problematic predictions and proposes an amendment which corrects them in a principled way. The account brings intuitions about counterfactual conditionals to bear on the interpretation of (...) indicatives and relies on the notion of causal (in)dependence. (shrink)

Equal Justice explores the role of the idea of equality in liberal theories of justice. The title indicates the book’s two-part thesis: first, I claim that justice is the central moral category in the socio-political domain; second, I argue for a specific conceptual and normative connection between the ideas of justice and equality. This pertains to the age-old question concerning the normative significance of equality in a theory of justice. The book develops an independent, systematic, and comprehensive theory of equality (...) and egalitarianism. The principal question is about the importance of equality in a theory of justice. More precisely, we should pose questions in four contracting circles: 1. Is justice the supreme value guiding our setup of the basic structure of society, or are there other, equally important values, such as recognition, care, communal belonging? 2. If justice is the highest guiding principle, which competing ideals—especially equality and freedom—ought to have precedence in a policy oriented toward justice? What status does the ideal of equality have in that framework? 3. If equality is a basic ideal of just policy, how should it be practically realized? What sort of equality (equal opportunity, equality of welfare, resource equality) should be demanded? 4. What patterned distribution of which specific goods does the ideal of equality demand? Which principles of distribution can be justified according to our justice ideal? To conclude and summarize: 5. What is the essential core of an egalitarian theory of justice, as opposed to an inegalitarian theory? These five questions structure the work’s order of argumentation. Part A elaborates the conceptual foundations and basic moral principles of justice and equality. Chapter I sets out to install justice as the central moral category in the socio-political domain. At the beginning of the first chapter, the conceptual foundations of justice are clarified. While not eliminating the classical distinctions between different forms of justice, I argue that the distributive paradigm is of primary importance. The primacy of justice in the socio-political domain is developed out of a confrontation with alternative positions, those which maintain either that justice generally, or distributive justice in particular, are subsidiary virtues. At the end of Chapter I, the first of the questions mentioned above is answered in a way that establishes justice as the guiding normative concept for the foundation and evaluation of any social order. To clarify the role of equality in a theory of justice, Chapter II separates the idea of equality into four different principles. They are organized in a way that begins with the most general and uncontroversial principle of equality, and progresses towards increasingly detailed and contested principles. There are two theses that articulate and defend the significance of equality for justice: First there is a conceptual connection between justice and equality, in that principles of formal and proportional equality are necessary in order to explicate the concept of justice. These two principles establish an unbreakable bond between justice and equality. Justice can only be explained—or so I argue—by reference to these and other (normative) principles of equality. The second thesis posits a normative relationship between justice and equality, which is disclosed by three substantive principles of equality: moral equality, the presumption of equality, and the principle of responsibility. I argue that the normative core of an egalitarian theory of justice is expressed by the latter two principles, which are themselves based on the first principle, that of moral equality. When we view one another as persons, what form of equality or equal treatment is normatively demanded? I argue that the answer to this question is given by the procedural principle of the presumption of equality: regardless of their apparent differences, all persons deserve strictly equal treatment, unless certain kinds of differences have whatever particular relevance would justify, on generally acceptable grounds, unequal treatment or unequal distribution. The justification of the presumption of equality is central to this work and has considerable importance. If the presumption principle’s validity can be justified by enlisting the principle of general justification, then the primacy of equality, and the essential argument for an egalitarian theory of justice, is established. This would likewise provide a procedure for the construction of a material theory of justice. The second question is answered thereby at the end of Chapter II: Equality should have primacy over competing ideals within a justice-oriented policy. The presumption of equality establishes this primacy and, at the same time, offers an appropriate metric and guideline for the construction of a material theory of distributive justice. The presumption of equality in Part B offers an elegant procedure for the development of a theory of distributive justice. Chapter III clearly sets out the necessary prerequisites that a theory of distribution must satisfy in order to determine a liberal-egalitarian distributional framework. We need to specify in which situation the distribution takes place; which goods are and are not to be distributed; in which respect the presumptive equality is to be produced; and by and to whom, and for what period, the relevant goods are to be distributed. The distribution is based on resources understood as general-purpose means. It is necessary to divide goods into different categories, since the justification for unequal treatment in one domain will not carry over into another. This makes presumptive equality necessarily complex. To that end, four spheres of justice are distinguished: (1) the political sphere, which involves allocating rights through the distribution of civil liberties; (2) the democratic sphere, in which political power and the rights of political participation are regulated; (3) the economic sphere, in which income and property are distributed; (4) the social sphere, in which social positions and opportunities are distributed. This framework of distributive justice answers the third of our guiding questions, about the nature of equality, in terms of equality of resources. Chapters IV and V set out the egalitarian distributive criteria for each sphere. I argue that the generally accepted, fundamental rights of classical liberalism are more effectively reconstructed by reference to the equal resource distribution presumptively required in those spheres. Chapter IV shows that when it comes to the first two spheres, those involving basic rights and freedoms and entitlement political participation, there can be no justified exceptions to the equal distribution of the relevant goods. That section argues, contrary to what we commonly find in theories of freedom or popular sovereignty, that the value of freedom and self-determination as the political basis of autonomy is best realized through the presumption of equal distribution. Chapter V deals with the other two spheres, those of economic goods and social positions, and argues for justified exceptions to equal distribution. In the economic sphere we find one principal reason favouring unequal distribution of resources, and three restrictions and compensations limiting that inequality. The basic exception to equal economic distribution arises from the unequal consequences of personal responsibility. From a suitably egalitarian standpoint, the principle of responsibility is the normative principle that determines which reasons justify economic inequality. Here the basic idea is that unequal shares of social goods are fair if they result from the choices and deliberate actions of the relevant parties. That individuals have to bear the costs of their own choices is a condition of autonomy. However, benefits or disadvantages arising from arbitrary and unmerited differences in social circumstances or natural endowments is unfair. The unequal consequences of independent decision-making and action must therefore be limited by compensating first for preferences, secondly for disadvantages, and thirdly by redistributing wealth in aid of the worse-off. I situations of emergency, compensating for disadvantages has priority over all other claims, owing to the urgency of the situation. Social inequalities go beyond the permissible limit if it is possible to improve the long-term social or economic situation of the worse-off by redistributing wealth to them. These exceptions lead to a complex system of free economic action within a framework of compensatory tax and transfer mechanisms. Finally, in the social sphere, the distribution of social positions, offices and opportunities must be structured to ensure that equally talented and motivated citizens have roughly equal chances of obtaining those offices or positions, irrespective of their economic or social class backgrounds. This compromise is permissible for reasons of freedom and prudence, and it makes a certain measure of inequality acceptable. The fourth of our guiding questions is answered accordingly. There are five principles of justice for the basic structure of society, and five legal principles that govern the special distribution of goods in the respective spheres—all are ranked according to their most defensible grounds of priority, ensuring that everyone is accorded equal justice. Chapter VI recapitulates the initial question of equality’s value. The conception of equal justice developed in this work postulates five principles of equality and five principles of law; these constitute an egalitarian framework because they support and promote social justice. Equality has value with respect to them, but is not given any independent, intrinsic value. That is why I call the account developed here a form of constitutive egalitarianism: justice is realized through the realization of equality, itself accomplished by applying the five postulates of equality and five distributive principles of law. This is an egalitarianism on two levels. The first level is involves the claim that morality or justice is conceptually connected with equality. The second level gives equality a substantial weight in what is conceptually validated at the first level, namely the presumption of equality, and constructs an appropriate interpretation and conception of distributive justice through principles of distribution for the individual spheres. The weight and importance of equality is shown by the distributive criteria applied to those spheres. This answers our final guiding question about the nature of an egalitarian theory. (shrink)

The entropy-reduction hypothesis claims that the cognitive processing difficulty on a word in sentence context is determined by the word's effect on the uncertainty about the sentence. Here, this hypothesis is tested more thoroughly than has been done before, using a recurrent neural network for estimating entropy and self-paced reading for obtaining measures of cognitive processing load. Results show a positive relation between reading time on a word and the reduction in entropy due to processing that word, supporting the entropy-reduction (...) hypothesis. Although this effect is independent from the effect of word surprisal, we find no evidence that these two measures correspond to cognitively distinct processes. (shrink)

How do we get out knowledge of the natural numbers? Various philosophical accounts exist, but there has been comparatively little attention to psychological data on how the learning process actually takes place. I work through the psychological literature on number acquisition with the aim of characterising the acquisition stages in formal terms. In doing so, I argue that we need a combination of current neologicist accounts and accounts such as that of Parsons. In particular, I argue that we learn the (...) initial segment of the natural numbers on the basis of the Fregean definitions, but do not learn the natural number structure as a whole on the basis of Hume's principle. Therefore, we need to account for some of the consistency of our number concepts with the Dedekind-Peano axioms in other terms. (shrink)

Artificial Intelligence (AI) is increasingly adopted in society, creating numerous opportunities but at the same time posing ethical challenges. Many of these are familiar, such as issues of fairness, responsibility and privacy, but are presented in a new and challenging guise due to our limited ability to steer and predict the outputs of AI systems. This chapter first introduces these ethical challenges, stressing that overviews of values are a good starting point but frequently fail to suffice due to the context (...) sensitivity of ethical challenges. Frequently, additional (ethical) values emerge for specific applications, as e.g. challenges with fraud detection are very different from those around language technologies. Second, methods to tackle these challenges are discussed. Main ethical theories (virtue ethics, consequentialism, and deontology) are shown to provide a starting point, but often lack the details needed for actionable AI Ethics. Instead, mid-level philosophical theories coupled to design-approaches such as Design for Values, together with interdisciplinary working methods, offer the best way forwards. The chapter aims to show how these approaches can lead to an ethics of AI that is actionable and that can be proactively integrated in the design of AI systems. (shrink)

An English double-embedded relative clause from which the middle verb is omitted can often be processed more easily than its grammatical counterpart, a phenomenon known as the grammaticality illusion. This effect has been found to be reversed in German, suggesting that the illusion is language specific rather than a consequence of universal working memory constraints. We present results from three self-paced reading experiments which show that Dutch native speakers also do not show the grammaticality illusion in Dutch, whereas both German (...) and Dutch native speakers do show the illusion when reading English sentences. These findings provide evidence against working memory constraints as an explanation for the observed effect in English. We propose an alternative account based on the statistical patterns of the languages involved. In support of this alternative, a single recurrent neural network model that is trained on both Dutch and English sentences is shown to predict the cross-linguistic difference in the grammaticality effect. Philosophers investigating the interpretation and use of conditional sentences have long been intrigued by the intuitive correspondence between the probability of a conditional `if A, then C' and the conditional probability of C, given A. Attempts to account for this intuition within a general probabilistic theory of belief, meaning and use have been plagued by a danger of trivialization, which has proven to be remarkably recalcitrant and absorbed much of the creative effort in the area. But there is a strategy (...) for avoiding triviality that has been known for almost as long as the triviality results themselves. What is lacking is a straightforward integration of this approach in a larger framework of belief representation and dynamics. This paper discusses some of the issues involved and proposes an account of belief update by conditionalization. (shrink)

The rise of causality and the attendant graph-theoretic modeling tools in the study of counterfactual reasoning has had resounding effects in many areas of cognitive science, but it has thus far not permeated the mainstream in linguistic theory to a comparable degree. In this study I show that a version of the predominant framework for the formal semantic analysis of conditionals, Kratzer-style premise semantics, allows for a straightforward implementation of the crucial ideas and insights of Pearl-style causal networks. In the past few decades, a growth in ethical consumerism has led brands to increasingly develop conscientiousness and depict ethical image at a corporate level. However, most of the research studying business ethics in the field of corporate brand management is either conceptual or has been empirically conducted in relation to goods/products contexts. This is surprising because corporate brands are more relevant in services contexts, because of the distinct nature of services and the key role that employees have in the (...) services sector. Accordingly, this article aims at empirically examining the effects of customer perceived ethicality in the context of corporate services brands. Based on data collected for eight service categories using a panel of 2179 customers, the hypothesized structural model is tested using path analysis. The results show that, in addition to a direct effect, customer perceived ethicality has a positive and indirect effect on customer loyalty, through the mediators of customer affective commitment and customer perceived quality. Further, employee empathy positively influences the impact of customer perceived ethicality on customer affective commitment, and customer loyalty positively impacts customer positive word-of-mouth. The first implication of these results is that corporate brand strategy needs to be aligned with human resources policies and practices if brands want to turn ethical strategies into employee behavior. Second, corporate brands should build more authentic communications grounded in their ethical beliefs and supported by evidence from actual employees. (shrink)

Users of sociotechnical systems often have no way to independently verify whether the system output which they use to make decisions is correct; they are epistemically dependent on the system. We argue that this leads to problems when the system is wrong, namely to bad decisions and violations of the norm of practical reasoning. To prevent this from occurring we suggest the implementation of defeaters: information that a system is unreliable in a specific case (undercutting defeat) or independent information that (...) the output is wrong (rebutting defeat). Practically, we suggest to design defeaters based on the different ways in which a system might produce erroneous outputs, and analyse this suggestion with a case study of the risk classification algorithm used by the Dutch tax agency. ABSTRACT:The notion of “democracy” has become a much-debated concept in scholarship on business ethics, management, and organization studies. The strategy of this paper is to distinguish between a principle of organization that fosters participation (type I democracy) and a principle of legitimation that draws on consent (type II democracy). Based on this distinction, we highlight conceptual shortcomings of the literature on stakeholder democracy. We demonstrate that parts of the literature tend to confound ends with means. Many approaches employ type I (...) democracy notions of participation and often take for granted that this also improves type II democratic legitimation. We hold this to be a mistake. We provide examples of the ambiguity of organizational procedures and show that under some circumstances a decrease in the degree of participation may actually increase legitimation because a governance structure that results in higher productivity can provide higher benefits for all parties involved, serve their interests and therefore meet their agreement. Less type I democracy may mean more type II democracy. We believe this to be an important insight for judging (and further improving) the legitimacy of both capitalistic firms and competitive markets. (shrink)

What is life? A gathering consensus in anthropology, science studies, and philosophy of biology suggests that the theoretical object of biology, “life,” is today in transformation, if not dissolution. Proliferating reproductive technologies, along with genomic reshufflings of biomatter in such practices as cloning, have unwound the facts of life.

Machine learning is used more and more in scientific contexts, from the recent breakthroughs with AlphaFold2 in protein fold prediction to the use of ML in parametrization for large climate/astronomy models. Yet it is unclear whether we can obtain scientific explanations from such models. I argue that when machine learning is used to conduct causal inference we can give a new positive answer to this question. However, these ML models are purpose-built models and there are technical results showing that standard (...) machine learning models cannot be used for the same type of causal inference. Instead, there is a pathway to causal explanations from predictive ML models through new explainability techniques; specifically, new methods to extract structural equation models from such ML models. The extracted models are likely to suffer from issues though: they will often fail to account for confounders and colliders, as well as deliver simply incorrect causal graphs due to ML models tendency to violate physical laws such as the conservation of energy. In this case, extracted graphs are a starting point for new explanations, but predictive accuracy is no guarantee for good explanations. (shrink)

This book offers a scientific whistleblower’s perspective on current implementation of federal research misconduct regulations. It provides a narrative of general interest that relates current cases of research ethics to philosophical, historical and sociological accounts of fraud in scientific research. The evidence presented suggests that the problems of falsification and fabrication remain as great as ever, but hidden because the current system puts universities in charge of investigations and permits them to use confidentiality regulations to hide the outcomes of investigations. The book documents the significant conflict of interest that arises because federal regulation gives universities the responsibility to conduct investigations of their own faculty with severely limited oversight. The book is intended for young research scientists or anyone who wishes to understand the challenges faced by scientists in the workplace today. The central thread in the book is an exclusive account of an experienced research scientist who was the first to expose the facts that led to the longest running research misconduct investigation in the history of the National Science Foundation. This article develops an objection to Kant’s proof of freedom from the Critique of Practical Reason. In his proof — the fact of reason argument — Kant deduces the reality of freedom, understood as the ability to act independently of all inclinations, from our consciousness of the unconditional validity of morality. He calls this consciousness the "fact of reason". After a systematic reconstruction of the argument, I develop an objection that relies on three points: (i) the cultural embeddedness of human (...) beings ("fact of culture"), (ii) an "external" perspective on human deliberative processes, and (iii) an alternative interpretation of the unconditional validity of morality that appears in practical deliberation. Contrary to Kant’s claims, I argue that the reality of freedom cannot be deductively derived from the fact of reason. I then discuss two objections to my argument. The first objection claims that my considerations regarding the "external" perspective misunderstand Kant's methodology. The second objection states that, based on my considerations, the fact of reason ultimately turns out to be an illusion. I discuss both objections and refute them. My ultimate conclusion is that Kant's fact of reason argument is not convincing. (shrink)

The standard argument for longtermism assumes that we should care as much about far future people as about our contemporaries. I challenge this assumption. I first consider existing interpretations of ‘temporal discounting’, and argue that such discounting seems either unwarranted or insufficient to block the argument. I then offer two alternative reasons to care less about far future people: caring as much about them as about our contemporaries would make our lives less authentic and less meaningful. If I’m right, this (...) undermines at least the strongest versions of longtermism. Plausibly, we should do much more for the far future than we’re currently doing. Still, we often ought to act for contemporaries’ sakes, even if longtermist actions would expectably do more good. (shrink)

This answers an old question from the problem list “Surrealist landscape with figures” by A. Mathias from 1968. We also construct a model in which the (lightface) [math]-separation property is true.

There is some limited contemporary scholarship on the theory of metaphor Kant appears to provide in his Critique of Judgment. The dominant interpretations that have emerged of Kant’s somewhat nascent account of metaphors are what I refer to as the symbolist view, which states that Kantian symbols should be viewed as Kantian metaphors, and the aesthetic idea view, which holds that Kant defi ned metaphors as aesthetic ideas . In this essay, I claim that the symbolist view of Kantian metaphors (...) is not plausible and that we should accept the aesthetic idea view in its stead. The jumping off points for my discussion are two fairly recent essays on the subject: A. T. Nuyen’s “The Kantian Theory of Metaphor” and Kirk Pillow’s “Jupiter’s Eagle and the Despot’s Hand Mill: Two Views of Metaphor in Kant.” Nuyen defends the symbolist view of Kantian metaphor and Pillow defends a split view, i.e., Pillow thinks Kant has a dual-aspect view of metaphor that can bear both the symbolist and the aesthetic idea interpretations. Although I make use of some of Pillow’s objections against the symbolist view, I conclude that both he and Nuyen are wrong in thinking that Kantian symbols have any relationship to Kantian metaphors at all. Lastly, I will provide my own positive account of Kant’s theory of metaphors as well as show how this debate affects Kant’s overallaesthetic theory. (shrink)

Most accounts of our knowledge of the successor axiom claim that this is based on the procedure of adding one. While they usually don’t claim to provide an account of how children actually acquire this knowledge, one may well think that this is how they get that knowledge. I argue that when we look at children’s responses in interviews, the time when they learn the successor axiom and the intermediate learning stages they find themselves in, that there is an empirically (...) viable alternative. I argue that they could also learn it on the basis of a method that has to do with the structure of the numeral system. Specifically, that they (1) use the syntactic structure of the numeral system and (2) attend to the leftmost digits, the one with the highest place-value. Children can learn that this is a reliable method of forming larger numbers by combining two elements. First, a grasp of the syntactic structure of the numeral system. That way they know that the leftmost digit receives the highest value. Second, an interpretation of numerals as designating cardinal values, so that they also realise that increasing or adding digits on the lefthand side of a numeral produces a larger number. There are thus two, currently equally well-supported, ways in which children might learn that there are infinitely many natural numbers. (shrink)

In order to at least begin addressing the extensive the problem of moral clarity in aiding the deprived to some degree, I first argue that the duty to aid the deprived is not merely a charitable one, dependent on the discretion, or the arbitrary will, of the giver (1). Then, before further analysing the individual duty to aid, I critically examine whether deprivation is better alleviated or remedied through the duties of corrective justice. I argue that the perspective of corrective (...) justice is important, but not sufficient when it comes to dealing with deprivation (2). I then argue that non-domination cannot serve as a first-order principle of justice. It is too minimalistic, since it would not require duties of justice where deprivation exists, but dominating relations and institutions do not. (3). Going back to the individual duty to help, I argue that the duties to aid the needy must be assessed according to the situation at hand (4). In order to avoid meaninglessness and morality’s excessive demands, one should be able to identify the responsible agents by constructing a shared and, in the last resort, institution-based duty to help (5). The institutional approach in this paper argues that we should create and reform institutions in order to realize the pre-existing requirement to alleviate global deprivation. This is a form of “global political justice” that does not start with politics, but ends with global political institutions. (shrink)

Mathematical cognition has become an interesting case study for wider theories of cognition. Menary :1–20, 2015) argues that arithmetical cognition not only shows that internalist theories of cognition are wrong, but that it also shows that the Hypothesis of Extended Cognition is right. I examine this argument in more detail, to see if arithmetical cognition can support such conclusions. Specifically, I look at how the use of numerals extends our arithmetical abilities from quantity-related innate systems to systems that can deal (...) with exact numbers of arbitrary size. I then argue that the system underlying our grasp of small numbers is an unhelpful case study for Menary; it doesn’t support an argument for externalism over internalism. The system for large numbers, on the other hand, clearly displays important interactions between public numeral systems and our cognitive processes. I argue that the large number system supports an argument against internalist theories of arithmetical cognition, but that one cannot conclude that the Hypothesis of Extended Cognition is correct. In other words, the large number case doesn’t decide between the Hypothesis of Extended Cognition and the Hypothesis of EMbedded Cognition. (shrink)

Linsky and Zalta try to explain how we can refer to mathematical objects by saying that this happens through definite descriptions which may appeal to mathematical theories. I present two issues for their account. First, there is a problem of finding appropriate pre-conditions to reference, which are currently difficult to satisfy. Second, there is a problem of ensuring the stability of the resulting reference. Slight changes in the properties ascribed to a mathematical object can result in a shift of reference (...) and this leads to various problems, e.g., it makes inferring knowledge much harder than it is. We consider the following problem: Given a proof of the Skolemization of a formula F, what is the length of the shortest proof of F? For the restriction of this question to cut-free proofs we prove corresponding exponential upper and lower bounds.

So-called Neo-Russellians, such as Salmon, Braun, Crimmins, and Perry, hold that the semantic content of ‘ n is F ’ in a context c is the singular proposition ⟨ o, P ⟩, where o is the referent of the name n in c, and P is the property expressed by the predicate F in c. This is also known as the Neo-Russellian theory. Using truth ascriptions with names designating propositions, such as ‘Goldbach's conjecture’, in this paper, I will argue that, (...) together with highly plausible principles regarding a priori knowledge, the Neo-Russellian theory leads to unacceptable consequences. I will call this ‘the Goldbach puzzle’. Since the solution to the Goldbach puzzle cannot be to reject the discussed principles regarding a priori knowledge, the puzzle will undermine the Neo-Russellian theory. (shrink)

How come we ought to do things? Current metanormative debates often suffer from the fact that authors implicitly use adequacy conditions not shared by their opponents. This leads to an unsatisfying dialectical gridlock: One author accuses her opponents of not being able to account for stuff she judges essential, but the opponents do not think this to be a major flaw. In an attempt to meet the problem of gridlock head-on, the current investigation approaches oughtness differently. -/- I start with (...) the introduction of a grounding framework for thinking about oughtness -- the central normative property -- that allows a lucid presentation of the views on the market. It soon becomes clear that one necessary part of any plausible assessment of accounts of oughtness is a discussion of their adequacy conditions. I continue with a detailed evaluation of four different accounts, as presented by Halbig (2007), Schroeder (2007), Stemmer (2006), and Scanlon (2014). My main result is that desire-based or Humean theories of oughtness are more plausible because desire-independent accounts fail to explain something crucial: the for-me character of oughtness. Based on the insights gathered thus far, I then develop a new Humean theory – metaethical conativism – and defend it against some historically influential objections. (shrink)

Kant wird oft als einer derjenigen großen Philosophen angesehen, dessen Werk wesentlich zum jetzigen Verständnis der Menschenrechte und Menschenwürde beigetragen hat. Kant scheint, wenn man in seine Schriften schaut, jedoch keine Theorie der Menschenrechte im modernen Sinne gehabt zu haben. Bei näherem Hinsehen zeigt sich folgender Grund: Kant unterscheidet zwischen dem bloß privaten Recht, das dem positiven Recht untergeordnet ist, und dem öffentlichen Recht, das die begrifflichen Bedingungen einer jeden legitimen, legalen Ordnung darstellt. Der Inhalt des öffentlichen Rechts wird bei (...) ihm weder direkt aus einer freistehenden Moraltheorie abgeleitet, noch aus vertraglichen Übereinkünften oder dem positiven Recht. Stattdessen soll es aus den Ermöglichungsbedingungen einer rechtmäßigen Verfassung expliziert werden, unter der allein Ansprüchen auf (ein) „Recht“ irgendeine verbindliche Autorität zukommt. Wenn man diesen Ansatz ernst nimmt, kann man kaum eine Lesart bei Kant finden, die sich mit der modernen Auffassung von Menschenrechten vereinbaren lässt. Warum aber denken dann manche, dass Kant etwas zum modernen Verständnis der Menschenrechte beizutragen hätte? So lauten denn die Leitfragen der Erörterung: Welche Auffassungen in Kants Werk kommen einem zeitgenössischen Verständnis von Menschenrechten am nächsten? Warum jedoch können diese menschrechtlich vielleicht ähnlich klingenden Auffassungen Kants den heutigen Befürwortern der Menschenrechte doch keine Quelle oder Stütze bieten? (shrink)

We consider the historic Harress-Sagnac experiment in the light of our absolute space-time theory, proposing two modifications, and we give an account of its recent practical performance. We show that the effect of the rotating disk experiment is a direct result of the light velocity's direction dependence and we point out that our recently performed coupled-mirrors experiment, with whose help for the first time we have measured the Earth's absolute velocity, can be considered as a logical result of the rotating (...) disk experiment. One of the important discussions in the philosophy of mathematics, is that centered on Benacerraf’s Dilemma. Benacerraf’s dilemma challenges theorists to provide an epistemology and semantics for mathematics, based on their favourite ontology. This challenge is the point on which all philosophies of mathematics are judged, and clarifying how we might acquire mathematical knowledge is one of the main occupations of philosophers of mathematics. In this thesis I argue that this discussion has overlooked an important part of mathematics, namely mathematics (...) as it is exercised by ordinary people. I do so by looking at the different theories that have been put forward in the recent debate, and showing for each of these that they are unable to account for the mathematical practices of ordinary people. In order to show that these practices do need to be accounted for, I also argue that ordinary people are doing mathematics, i.e. that they engage in properly mathematical practices. Because these practices are properly mathematical, they should be accounted for by any philosophy of mathematics. The conclusion of my thesis, then, is that current theories fail to do something that they should do, while remaining neutral on how well they perform when it comes to accounting for the practices of professional mathematicians. I compare Sellars’s criticism of the ‘myth of the given’ with Quine’s criticism of the ‘two dogmas’ of empiricism, that is, the analytic–synthetic distinction and reductionism. In Sections I to III, I present Quine’s and Sellars’s views. In IV to X, I discuss similarities and differences in their views. In XI to XII, I show that Sellars’s arguments against the ‘myth of the given’ are incompatible with Quine’s rejection of the analytic–synthetic distinction.

According to Humean promotionalism about practical reasons, the fact that I have a reason to φ holds in virtue of the fact that φ-ing promotes one or more of my desires. The topic of this discussion note is the question of how best to understand the promotion relation. In particular, I defend a probabilistic understanding of promotion against a line of argument recently brought forth by Jeff Behrends, Joshua DiPaolo, and Nate Sharadin. Roughly, their argument is that probabilistic promotion leads (...) to implausible results in cases in which the relevant desires are certain to be satisfied. In these cases, a probabilistic understanding tells us that we do not have a reason to φ because the probability of desire satisfaction is 1 already. Contrary to Behrends', DiPaolo's, and Sharadin's claims, I argue that this is precisely the result a Humean theory of reasons should generate. According to Humeanism, we have reasons for actions because these actions make a difference to the occurrence of desire satisfaction - where the causal route to desire satisfaction is normatively irrelevant. Thus, if desire satisfaction is dead certain, we have no reason to do anything. (shrink)

Proceeding from our absolute space-time conceptions, we obtain the formula for the gravitational frequency shift in an extremely simple way. Using our “burst” model for photons, we show that the different rates of clocks placed in spatial regions with different gravitational potentials appear as a direct result of the gravitational frequency shift and the axiomatic assumption that at any space point the time unit is to be defined by light clocks with equal “arms,” i.e., that at any space point the (...) light velocity (in moving frames the “there-and-back” velocity) has the same numerical valuec. Considering the principle of equivalence, we come to the logical conclusion that the kinematic (Einstein-Lorentz) time dilation is an absolute phenomenon. (shrink)

Neue Themenfelder wie die sich wandelnde Rolle der Patienten, die neue Verantwortung von Ärzten und Pflegenden, neue digitale Möglichkeiten in der Medizin, Smart Hospitals im Klinikalltag, die gesellschaftliche Legitimität eines möglichen dritten Datengesundheitsmarktes, eine zukunftsfeste Ausbildungslandschaft für den Gesundheits-/Medizinbereich sowie die Grenzen der digitalen Forschung bedürfen einer kritischen und gleichzeitig (...) thematisch breiten Auseinandersetzung mit ethischen Aspekten in der digitalen Gesundheitswirtschaft und Medizin. With the widespread use of artificial intelligence, it becomes crucial to provide information about these systems and how they are used. Governments aim to disclose their use of algorithms to establish legitimacy and the EU AI Act mandates forms of transparency for all high-risk and limited-risk systems. Yet, what should the standards for transparency be? What information is needed to show to a wide public that a certain system can be used legitimately and responsibly? I argue that process-based approaches fail (...) to satisfy, as knowledge about the development process is insufficient to predict the properties of the resulting system. Current outcome-based approaches [Mitchell et al., 2019; Loi et al., 2021] are also criticized for a lack of attention to the broader socio-technical system and failure to account for empirical results that show that people care about more than just the outcomes of a process [as reported by Meyerson et al. (Procedural justice and relational theory: Empirical, philosophical, and legal perspectives, Taylor & Francis, 2021)]. Instead, I propose value-based transparency, on which the information we need to provide is what values have been considered in the design and how successful these have been realized in the final system. This can handle the objections to other frameworks, matches with current best practices on the design of responsible AI and provides the public with information on the crucial aspects of a system’s design. This systematic review identified and evaluated instruments measuring patients' perceptions of patient‐centred nursing care. Of 2629 studies reviewed, 12 were eligible for inclusion. Four instruments were reported: The Individualized Care Scale, the Client‐Centred Care Questionnaire, the Oncology patients' Perceptions of the Quality of Nursing Care Scale and the Smoliner scale. These instruments cover themes addressing patient participation and the clinician–patient relationship. Instruments were shown to have satisfactory psychometric properties, although not all were adequately assessed. More research is needed regarding test–retest (...) reliability, convergent and discriminant validity, validity with known groups and structural validity using confirmatory factor analysis. (shrink)

This manuscript describes the institutional and clinical considerations that apply to the question of whether to mandate opioid dose reduction in patients who have received opioids long-term. It describes how a calamitous rise in addiction and overdose involving opioids has both led to a clinical recalibration by healthcare providers, and to strong incentives favoring forcible opioid reduction by policy making agencies. Neither the 2016 Guideline issued by the Centers for Disease Control and Prevention nor clinical evidence can justify or promote (...) such policies as safe or effective. (shrink)

Anniversary commemorations are ambivalent events, particularly when they celebrate philosophers. Such commemorations focus on a life's work and occasionally contribute to its elucidation. However, they frequently do violence to those they intend to honor, by emphasizing primarily those aspects of a thinker's work which make him acceptable to the spirit of the age. And such was the fate of Theodor Adorno, whose eightieth birthday was observed in 1983 at a major conference, held in Frankfurt, West Germany. There his interpreters, embarked (...) on the task of rediscovering, brought out important aspects and opened up new perspectives. But die heart of Adorno's work, the negative dialectic, encountered outright resistance. (shrink)
