Herbert Spencer was regarded by the Victorians as the foremost philosopher of the age, the prophet of evolution at a time when the idea had gripped the popular imagination. Until recently Spencer's posthumous reputation rested almost excusively on his social and political thought, which has itself frequently been subject to serious misrepresentation. Hospital ethics committees have become widespread over the last 25 years, stimulated by the Quinlan decision of the New Jersey Supreme Court, the report of a President's Commission, and most recently by the Joint Commission on Accreditation of Health Care Organizations , which now man dates that each hospital seeking accreditation have a functioning process for the consideration of ethical issues in patient care. Laws and regulations in several states require that hospitals establish ethics committees, and some states stipulate that (...) certain types of cases and disputes be taken to such committees. The ethics of the Flexibility In duty hour Requirements for Surgical Trainees trial have been vehemently debated. Views on the ethics of the FIRST trial range from it being completely unethical to wholly unproblematic. The FIRST trial illustrates the complex ethical challenges posed by cluster randomised trials of policy interventions involving healthcare professionals. In what follows, we have three objectives. First, we critically review the FIRST trial controversy, finding that commentators have failed to sufficiently identify and address many of the (...) relevant ethical issues. The 2012 Ottawa Statement on the Ethical Design and Conduct of Cluster Randomized Trials provides researchers and research ethics committees with specific guidance for the ethical design and conduct of CRTs. Second, we aim to demonstrate how the Ottawa Statement provides much-needed clarity to the ethical issues in the FIRST trial, including: research participant identification; consent requirements; gatekeeper roles; benefit-harm analysis and identification of vulnerable participants. We nonetheless also find that the FIRST trial raises ethical issues not adequately addressed by the Ottawa Statement. Hence, third and finally, we raise important questions requiring further ethical analysis and guidance, including: Does clinical equipoise apply to policy interventions with little or no evidence-base? Do healthcare providers have an obligation to participate in research? Does the power-differential in certain healthcare settings render healthcare providers vulnerable to duress and coercion to participant in research? If so, what safeguards might be implemented to protect providers, while allowing important research to proceed? (shrink)

Seeking a decision theory that can handle both the Newcomb problems that challenge evidential decision theory and the unstable problems that challenge causal decision theory, some philosophers recently have turned to ‘graded ratifiability’. However, the graded ratifiability approach to decision theory is, despite its virtues, unsatisfactory; for it conflicts with the platitude that it is always rationally permissible for an agent to knowingly choose their best option.

This article develops the concept of wrongful depathologization, in which a psychiatric disorder is simultaneously stigmatized and trivialized. We use OCD as a case study to argue that cumulatively these two effects generate a profound epistemic injustice to OCD sufferers, and possibly to those with other mental disorders. We show that even seemingly positive stereotypes attached to mental disorders give rise to both testimonial injustice and wilful hermeneutical ignorance. Neo‐Aristotelian Plenitude is the thesis that, necessarily, any property that could be had essentially by something or other is had essentially by something or other if and only if and because it is instantiated; any essentializable property is essentialized iff and because it is instantiated. In this paper, I develop a partial nonmodal characterization of ‘essentializable' and show it cannot be transformed into a full characterization. There are several seemingly insurmountable obstacles that any full characterization of essentializability must overcome. The Study of Sociology, by English philosopher, biologist, anthropologist, and sociologist, Herbert Spencer, was originally published in 1873. Spencer was known for his contributions to evolutionary theory and for applying it outside of biology, to the fields of philosophy, psychology, and within sociology. In particular, this work is a survey of the foundations of sociology, by one of its founders. Within which he applies the idea of natural selection to the group survival and institutional structures.

This volume consists of a collection of articles published by Spencer in leading Victorian periodicals, such as The Westminster Review, The Fortnightly Review and Mind. The wide range of subjects explored includes science, philosophy, aesthetics, ethics, psychology and politics.

In this article, we argue that dominant norms of demographic data are insufficient for accounting for the complexities that characterize many lesbian, gay, bisexual, transgender, and queer lives. Here, we draw from the responses of 178 people who identified as non-heterosexual or non-cisgender to demographic questions we developed regarding gender and sexual orientation. Demographic data commonly imagines identity as fixed, singular, and discrete. However, our findings suggest that, for LGBTQ people, gender and sexual identities are often multiple and in flux. (...) An overwhelming majority of our respondents reported shifting in their understandings of their sexual identities over time. In addition, for many of our respondents, gender identity was made up of overlapping factors, including the relationship between gender and transgender identities. These findings challenge researchers to reconsider how identity is understood as and through data. Drawing from critical data studies, feminist and queer digital media studies, and social justice initiatives like Data for Black Lives, we call for a reimagining of identity-based data as “queer data” or “data for queer lives.” We offer also recommendations for researchers to develop more inclusive survey questions. At the same time, we address the ways that queer perspectives destabilize the underlying logics of data by resisting classification and “capture.” For marginalized people, the stakes of this work extend beyond academia, especially in the era of algorithms and big data when the issue of who is or is not “counted” profoundly affects visibility, access, and power in the digital realm. We show that there is a relatively mild forcing in this same model which destroys the tree property. Epistemic injustice occurs when we fail to appropriately respect others as epistemic agents. Philosophers building on the work of Miranda Fricker, who introduced the concept, have focused on epistemic injustices involving certain social categories, particularly race and gender. Can there be epistemic injustice attached to political conviction and affiliation? I argue yes: politics can be a salient social category that draws epistemic injustice. Epistemic injustices might also be intersectional, based on the overlap of politics and some other identity category like (...) race or sex. Further, and more provocatively, I argue that political minorities in academia, in particular conservatives and libertarians, are most likely the victims of epistemic injustice on the basis of their politics. Such epistemic injustices might even be routine. Although more limited in scope and severity than other forms of epistemic injustice, political epistemic injustices in academia ought to be of special concern from a standpoint of social justice because of the academy’s central role in knowledge production and dissemination. ‘The co-production of meaning’ is a popular, widely-used, but under-defined concept. To better understand the co-production of meaning, we shall attempt to develop an account of co-production through phenomenological psychopathology. Through Hans Georg Gadamer’s remarks on ‘the hermeneutic problem of psychiatry’, we distinguish kinds of contingent and intrinsic obstacles to 'co-production'. In calling attention to these obstacles, we problematise the concept of ‘co-production’ in public mental health, revealing it to be more complex than originally thought. Current research suggests consumers trade off price, quality, and sustainability attributes when making choices. Prior studies have typically focused on product attribute dyads, rather than multiattribute decision-making in the sustainability context. For scholars and practitioners, understanding which attributes are more important to consumers in tradeoff contexts has been a challenge. Self-other orientation may play a significant role in predicting consumers’ sustainable choices. We use prior research on equity sensitivity to demonstrate that segmenting consumers by their disposition to self-other tradeoffs helps (...) predict price–quality–sustainability tradeoffs. We hypothesize and test how members of these equity sensitivity segments tradeoff price, quality, and sustainability attributes in consumption decisions. Through four conjoint studies featuring diverse product assortments and sustainability issues, we find that price provides high utility for Entitled consumers, while sustainability provides high utility for Benevolent consumers. When product attributes are combined, Benevolents are more likely than Entitleds to purchase sustainable products. We also demonstrate that, in the absence of product choices, Equity Sensitives are more willing to choose a sustainable option over a conventional option, even when prices are high. In light of these findings, we discuss the implications for scholars looking to broadly predict consumers’ sustainable choices and for firms looking to target consumers with consumer-centric sustainability strategy. The FDA's new table of surrogate endpoints used for drug approvals is an important step forward for overseeing the use of biomarkers in clinical trials. Nevertheless, we present several ways in which the table can be improved.

From large cardinals we obtain the consistency of the existence of a singular cardinal κ of cofinality ω at which the Singular Cardinals Hypothesis fails, there is a bad scale at κ and κ ++ has the tree property. In particular this model has no special κ +-trees.

Herbert Spencer, Victorian philosopher, biologist, sociologist and political theorist, one of the founders of Social Darwinism and author of the phrase 'survival of the fittest', was nominated for the Nobel Prize for Literature in 1902, losing out to Theodor Mommsen. Spencer left his post at The Economist in 1857 to focus on writing his ten-volume System of Synthetic Philosophy, a work that offers an ethics-based guide to human conduct to replace that provided by conventional religious belief. Published in (...) 1879, this volume seeks to demonstrate that social evolution tends towards greater individualism, altruism and co-operation. Spencer argues that it is possible to establish rules of right conduct on a scientific basis, and declares that this work is the culmination of his life's study. Jaspers identifies empathic understanding as an essential tool for grasping not the mere psychic content of the condition at hand, but the lived experience of the patient. This method then serves as the basis for the phenomenological investigation into the psychiatric condition known as ‘Phenomenological Psychopathology’. In recent years, scholars in the field of phenomenological psychopathology have attempted to refine the concept of empathic understanding for its use in contemporary clinical encounters. Most notably, we have Stanghellini’s contribution of ‘second-order’ empathy (...) and Ratcliffe’s ‘radical empathy’. Through this paper, we reject the pursuit of a renewed version of ‘empathic understanding’, on the grounds that the concept is fundamentally epistemically flawed. We argue that ‘empathic understanding’ risks (1) error, leading to misdiagnosis, mistreatment and an overall misunderstanding of the experience at hand, (2) a unique form of epistemic harm that we call ‘epistemic co-opting’ and (3) epistemic objectification. To conclude, we propose that empathic understanding ought to be replaced with a phenomenological account of Fricker’s virtuous listening. (shrink)

Normative pluralism is the view that practical reason consists in an irreducible plurality of normative domains, that these domains sometimes issue conflicting recommendations and that, when this happens, there is never any one thing that one ought simpliciter to do. Here I argue against this view, noting that normative pluralism must be either unrestricted or restricted. Unrestricted pluralism maintains that all coherent standards are reason-generating normative domains, whereas restricted pluralism maintains that only some are. Unrestricted pluralism, depending on how it (...) is cashed out, is either nihilism about practical reason or else it is subjectivism. Neither view is consistent with normative pluralism; hence, pluralism must be restricted. Restricted pluralism, however, faces two problems. The first stems from the question: “Why is it that some standards are normative domains while others are not?” The question seems to demand an answer, but it is hard to give any answer without appealing to considerations that imply facts about what we ought simpliciter to do. Second, restricted pluralism has difficulty accounting for our intuitions about cases in which one option is optimal in all domains, but not better than each alternative in any one domain. The unique option that is optimal in every domain seems better than its competitors, though it isn’t better within any domain. This is different than the widely discussed argument from notable-nominal comparisons. So I conclude that we have good reason to reject restricted pluralism, the only form of normative pluralism really worthy of that name. (shrink)

One of the dominant behavioral markers of visual-expert search strategy, Holistic Visual Processing (HVP), suggests that experts process information from a larger region of space in conjunction with a more focused gaze pattern in order to improve search speed and accuracy. To date, extant literature suggests that visual search expertise is domain specific, including HVP and its associated behaviors. The current study is the first to use eye tracking to directly measure the HVP strategies of two expert groups, radiologists and (...) architects, in comparison to one another and a novice control. In doing so, we replicated and extended this prior research: visual expertise is domain specific. However, our eye tracking data indicate that contrary to this prior work, HVP strategies are transferable across domains. Yet, despite the transfer of HVP strategies, there is neither reduced search time nor greater accuracy in visual search outside of an expert’s domain. Therefore, our data suggest that HVP behaviors are a particular form of visual search mechanism that, outside of an expert’s native search-ecology, are not necessarily conducive to more general visual search success. It is in addition to explicit knowledge of an expert’s domain, how to search, and where to search, that HVP strategies are their most effective for visual search success. (shrink)

In this paper, I investigate the merits of an argument in the philosophy of mysticism which, if sound, appears to have serious implications for our estimation of various Christian saints, mystics, and theologians and some of their most profound spiritual experiences. After giving an initial statement of this argument, I offer a defense of the two main premises at play and conclude the argument is plausibly sound. Following this, I turn to a discussion of Nelson Pike’s important objection to this (...) argument and contend that, while doubtless more interesting than commonly supposed, it ultimately falls short of the mark. We then develop a semantic interpretation of Buridan's theory which pays particular attention to Buridan's ampliation of modal terms. We show that these semantics correctly capture his syllogistic reasoning.

The scope of this paper is an in-depth review of Sallie McFague’s metaphorical theology while demonstrating its valuable contribution to the growing conversation regarding the limits and possibilities of religious discourse. Through expositions on (...) narrative, parable, and metaphor, Sallie McFague challenges contemporary theology to move beyond self-imposed boundaries though the power of linguistic critique and embodied imagination. Christian Personalists have objected to Thomism’s claim that humans could have existed in a state of pure nature, on the grounds that this claim entails that historical states like grace do not give fundamental meaning to us, that these states are merely accidental, and that it led to modern secularism. I show that Thomism can affirm its traditional claims regarding grace and pure nature, while denying the first two implications, by developing the Thomistic metaphysics of status. In Thomism rightly understood (...) persons develop historically through status in non-accidental ways and grace gives fundamental meaning to our lives. But I also argue that modern secular experiences are natural to the human person, not merely the result of sin, and that this is rightly supported by the theory of pure nature. (shrink)
