The ethics of the Flexibility In duty hour Requirements for Surgical Trainees trial have been vehemently debated. Views on the ethics of the FIRST trial range from it being completely unethical to wholly unproblematic. The FIRST trial illustrates the complex ethical challenges posed by cluster randomised trials of policy interventions involving healthcare professionals. In what follows, we have three objectives. First, we critically review the FIRST trial controversy, finding that commentators have failed to sufficiently identify and address many of the (...) relevant ethical issues. The 2012 Ottawa Statement on the Ethical Design and Conduct of Cluster Randomized Trials provides researchers and research ethics committees with specific guidance for the ethical design and conduct of CRTs. Second, we aim to demonstrate how the Ottawa Statement provides much-needed clarity to the ethical issues in the FIRST trial, including: research participant identification; consent requirements; gatekeeper roles; benefit-harm analysis and identification of vulnerable participants. We nonetheless also find that the FIRST trial raises ethical issues not adequately addressed by the Ottawa Statement. Hence, third and finally, we raise important questions requiring further ethical analysis and guidance, including: Does clinical equipoise apply to policy interventions with little or no evidence-base? Do healthcare providers have an obligation to participate in research? Does the power-differential in certain healthcare settings render healthcare providers vulnerable to duress and coercion to participant in research? If so, what safeguards might be implemented to protect providers, while allowing important research to proceed? (shrink)

We present an account of the evolutionary development of the experiences of empathy that marked the beginning of morality and art. We argue that aesthetic and moral capacities provided an important foundation for later epistemic developments. The distinction between phenomenal consciousness and attention is discussed, and a role for phenomenology in cognitive archeology is justified-critical sources of evidence used in our analysis are based on the archeological record. We claim that what made our species unique was a form of meditative (...) and empathic thinking that made large-scale human cooperation possible through pre-linguistic, empathic communication. A critical aspect of this proposal is that the transformation that led to the dawn of our species was not initially driven by semantic or epistemic factors, although clearly, these factors increased the gap between us and other species dramatically later on. Our proposal suggests that recent philosophy of mind and psychology might have "epistemicized" phenomenal consciousness too much by construing it in terms of semantic content rather than by describing it in terms of empathic and meditative thinking. Instead of the prevailing approach, we favor the type of subjectivity that is fundamentally "other-involving" as essential, because on our account, a necessary condition for subjectivity is the empathic understanding of other individuals' psychology, not through inference or judgment, but through immediate conscious engagement. In this essay, I examine the reception and use of Aristotle’s four causes by twelfth- and thirteenth-century Latin Christian theologians, primarily at Paris. I pay special attention to the early thirteenth century, when Aristotle’s works on natural philosophy were officially prohibited in the French capital. By looking at a wide range of texts from both prominent and obscure theologians, I hope to contribute to an expanded view of the ways in which intellectuals in the Latin west received and appropriated Aristotle’s (...) ideas. Most egalitarians believe, however, that people ought to be equal on the whole, by some overall measure of well-being or life-prospects; it would be a massive coincidence if distributing healthcare according to medical need turned out to be an effective way of promoting equality overall. I argue that distributing healthcare according to medical need is important for reducing individuals' uncertainty surrounding their future medical needs. In Property Rights and Poverty, / argued that seventeenth? to mid?nineteenth?century liberal theories of the natural right to property included both the ability to exclude others from resources lawfully acquired and the ability to claim as property the resources necessary for life and livelihood. Virtually every defense of the right to exclude written during this period carried limits which allowed and even required the government to enforce the rights of those without resources to the property of others. But although Locke, (...) among others, was a theorist of welfare rights, it is a mistake to describe him as a radical, as Richard Ashcraft does, which identifies Locke's purposes too closely with the legitimately radical theorists of the early nineteenth century who were deeply influenced by his work. Moral psychologists have shown that people’s past moral experiences can affect their subsequent moral decisions. One prominent finding in this line of research is that when people make a judgment about the Trolley dilemma after considering the Footbridge dilemma, they are significantly less likely to decide it is acceptable to redirect a train to save five people. Additionally, this ordering effect is asymmetrical, as making a judgment about the Trolley dilemma has little to no effect on people’s judgments about the (...) Footbridge dilemma. We argue that this asymmetry is the result of a difference in how each dilemma affects people’s beliefs about the importance of saving lives. In two experiments, we show that considering the Footbridge dilemma disconfirms these beliefs, while considering the Trolley dilemma does not significantly affect them. Consistent with predictions of sequential learning models, our findings offer a clear and parsimonious account of the asymmetry in the ordering effect. (shrink)

This paper focuses on a water management project in the remote Aboriginal community of Milingimbi, Northern Australia. Drawing on materials and experiences from two distinct stages of this project, we revisit a policy report and engage in ethnographic storytelling in order to highlight a series of sensing practices associated with water management. In the former, a working symmetry between Yolngu and Western water knowledges is actively sought through the practices of the project. However, in the latter, recurrent asymmetries in the (...) research work continue to appear: a bilingual diagram of water usage is displayed but produces confusion; measuring a water hole for salinity, a member of the scientific team throws in a water meter, while a Yolngu elder prefers the telling of an ancestral story; a collaborative 3-D mapping exercise invites participation from community members but struggles to develop an outcome that differs from existing maps used by scientists and government staff. Focusing on these moments as subtle points of rupture, we suggest that attending to “seeing,” “telling,” and “mapping” in both stages of this water management project offers a way to explore the political work of crafting climate futures and beginning to interrogate differing means for “doing difference” within them. Recently, brain imaging has provided controversial evidence of persisting awareness in some people whose brains are so severely injured that consciousness is minimal or absent, but in whom prolongation of life depends on the provision of continuing medical care. The clinicians understanding of the persistent vegetative state is briefly outlined and the evidence provided by brain imaging of awareness in this condition is reviewed. Information regarding consciousness in progressive acquired dementias are considered in the context of management of these conditions. (...) This paper maintains that, for all his ethical interests, his philosophical and theological essays, political treatises and linguistic studies, Dante was primarily a poet; a poet who, moreover, believed that poetry could change the world, and that the Comedy must be read, first, as a poem. This is not a trivial point, because the Comedy remains a text that is endlessly fascinating to philosophers and theologians as well as moralists who read it for its philosophy, theology and ethics and who (...) sometimes fail to see that a poet's imagination, even one as egregiously rational as Dante's, is synthetic rather than analytic. This paper offers an examination of the moral universe of the Comedy, paying particular attention to his presentation of the virtues. It endeavours to show how Dante's entry into the moral universe is by way of beauty through the operation of love, and considers how, for Dante, the inevitability of beauty, when properly understood, opens out on to truth and goodness, which, in turn, fold back upon beauty as the Beatific Vision is reached. If he were a writer given to poetic lapses or mythical adornments to his work we could consider dismissing the whole chapter as unessential. However, we know that Aristotle does not write unessential chapters, and that he is invariably engaged in an attempt to explain his subject fully and systematically, neither adding to it nor leaving anything (...) out.TheDe Anima, for example, is an attempt to describe the characteristics of living things, in an ascending order from the basic functions of vegetables to the most abstract thinking by human beings. A brief poll of my scientific colleagues confirmed that, to a person, they regard addiction as a disease, whereas most non-science acquaintances consider it to be a failure of willpower. Reconciliation of these polarized views seems difficult and rather than finding a middle path, such as suggested by Foddy and Savulescu. I am an entrenched supporter of the view that addiction can be a disease. I first should declare my position as a card-carrying biologist, holding the view that behavior emanates (...) from the brain and, accordingly, that behavior and emotions result from brain function. This brain function also produces addiction and related behaviors, whereas Foddy and Savulescu seem to credit humans with a greater capacity to choose than biological evidence suggests. The second problem relates to definitions of disease: I argue that there are at least three ways addiction might be considered a disease. 1.? ? ? Addiction is a disease because it results in pathology. For example, hypertension is a disease. Hypertension per se does not cause dysfunction, but leads to pathologically definable conditions such as stroke and myocardial infarction. Smoking, like hypertension, can result in pathologies such as emphysema and cancer. The problem is not smoking per se, or even addiction to nicotine, rather it is the consequent diseases caused by tobacco. Nevertheless, if hypertension is a disease, so is smoking. The question of “choosing‘ to persist with smoking has no bearing on whether it is disease. Whether a person chooses to care for their hypertension or ignore it does not alter the fact that they have hypertension; it is still a disease and it will still harm them. Whether addiction affects the capacity to choose is not relevant because it does not alter the fact that smoking causes pathology and hence is a disease. 2.? ? ? Many philosophers of science follow Hempel in embracing both substantive and methodological anti-psychologism regarding the study of explanation. The former thesis denies that explanations are constituted by psychological events, and the latter denies that psychological research can contribute much to the philosophical investigation of the nature of explanation. Substantive anti-psychologism is commonly defended by citing cases, such as hyper-complex descriptions or vast computer simulations, which are reputedly generally agreed to constitute explanations but which defy human comprehension and, as a result, (...) fail to engender any relevant psychological events. It is commonly held that the truth of the substantive thesis would lend support to the methodological thesis. However, the standard argument for the substantive thesis presumes that philosophers’ own judgments about the aforementioned cases issues from mastery of the lay or scientific norms regarding the use of ‘explanation.’ Here we challenge this presumption with a series of experiments indicating that both lay and scientific populations require of explanations that they actually render their targets intelligible. This research not only undermines a standard line of argument for substantive anti-psychologism, it demonstrates the utility of psychological research methods for answering meta-questions about the norms regarding the use of ‘explanation.’. We propose a Bayesian framework for the attribution of knowledge, and apply this framework to generate novel predictions about knowledge attribution for different types of “Gettier cases”, in which an agent is led to a justified true belief yet has made erroneous assumptions. We tested these predictions using a paradigm based on semantic integration. We coded the frequencies with which participants falsely recalled the word “thought” as “knew” (or a near synonym), yielding an implicit measure of conceptual activation. Our experiments (...) confirmed the predictions of our Bayesian account of knowledge attribution across three experiments. We found that Gettier cases due to counterfeit objects were not treated as knowledge (Experiment 1), but those due to intentionally-replaced evidence were (Experiment 2). Our findings are not well explained by an alternative account focused only on luck, because accidentally-replaced evidence activated the knowledge concept more strongly than did similar false belief cases (Experiment 3). We observed a consistent pattern of results across a number of different vignettes that varied the quality and type of evidence available to agents, the relative stakes involved, and surface details of content. Accordingly, the present findings establish basic phenomena surrounding people’s knowledge attributions in Gettier cases, and provide explanations of these phenomena within a Bayesian framework. The (...) indirect form of communication, which he later advocated in more direct terms in his "Point of View," 1 was not only a maieutic means that helped the reader conceive of the latent and strictly private messages of the texts; it was also a strategy for Kierkegaard's undercover assaults on the Hegelian turn of the Geistesleben around him. By interweaving many of the Hegelian platitudes and self-confident pronouncements that circulated in the intellectual life of the day into the pseudonymous writings, Kierkegaard contested them with parody rather than argumentation. This is the local background against which these texts are structured and to which they are addressed in multiple and very subtle ways. That also goes for that of the pseudonymous writings which has become the best known but which may also be regarded as the most private and most secretive of them all, Fear and Trembling, published pseudonymously in 1843.Secrecy, silence, and unspeakable messages are abundantly thematized in Fear and Trembling, as one could expect from the name of the narrator, Johannes de Silentio. Silentio is a prominent member of the choir of pseudonymous figures Kierkegaard invented to communicate indirectly with his audience and in [End Page 303] the name of which he published his most celebrated works. The silence that Silentio speaks of is that of Abraham of the Old Testament, who was commanded by God to sacrifice his only son on Mount Moriah. Although Genesis 22 includes fragments of the dialogue between Abraham and Isaac on their way to the mountain, Silentio insists that Abraham remained silent on the essential issue: the command he acts upon. The unmediated message Abraham had received from God could not be conveyed, and he was therefore barred from communication and bereft of his community as he journeyed to the Mountain. Yet Silentio's discourse upon this silence in Fear and Trembling has given impetus to innumerable pages of commentary. The questions and answers he poses in his reflections upon Abraham's ordeal have called for critical attention and controversy since the time of its publication. His obsession with the biblical narrative certainly seems to have been passed on to many readers of Fear and Trembling, which, a recent commentator has remarked, "continues to haunt us like no other of [Kierkegaard's] writings." 2 So far, it would seem, then, that Kierkegaard was right when he predicted, in an undated journal entry, that "Fear and Trembling will be enough to immortalise my name." It has indeed been "read and translated into foreign languages," as he foresaw it would. 3Even so, what has passed unnoticed in its long history of reception is the significance of the titles that the manuscript text bore before it came to be called Fear and Trembling. On the title page the definitive appellation is placed together with two alternatives with less suggestion of pathos: "Movements and Postures" (Bevægelser og Stillinger) and "Between-each-other" (Mellemhver-andre). 4 Not much can be discerned from these unpeculiar phrases in isolation. This paper offers an overview of the philosophical work on epistemic injustices as it relates to psychiatry. After describing the development of epistemic injustice studies, we survey the existing literature on its application to psychiatry. We describe how the concept of epistemic injustice has been taken up into a range of debates in philosophy of psychiatry, including the nature of psychiatric conditions, psychiatric practices and research, and ameliorative projects. The final section of the paper indicates future directions for philosophical research (...) of epistemic injustices and psychiatry, concerning neurocognitive disorders, identity prejudices in psychiatric illness, concepts of epistemic privilege in psychiatry, and the prospects for combining phenomenological psychopathology and epistemic justice. We argue that much remains to be done in the conceptualization of these epistemic injustices and suggest that this future work should be multidisciplinary in character and sensitive to the phenomenology of psychiatric conditions. Potentiality, Entanglement and Passion-at-a-Distance is a book for theoretical physicists and philosophers of modern physics. Some well-known metaphysical arguments against relativism rest on the claim that relativity somehow must be accompanied by relationality. I argue otherwise, and trace the consequences for some prominent disputes between relativists and absolutists.

A material simple is a material object that has no proper parts. Some philosophers have argued for the possibility of extended simples. Some have even argued for the possibility of heterogeneous simples or simples that have intrinsic variations across their surfaces. There is a puzzle, though, that is meant to show that extended, heterogeneous simples are impossible. Although several plausible responses have been given to this puzzle, I wish to reopen the case against extended, heterogeneous simples. In this paper, I (...) briefly canvass responses to this puzzle which may be made in defense of extended, heterogeneous simples. I then present a new version of this puzzle which targets simples that occupy atomic yet extended regions of space. It seems that none of the traditional responses can be used to successfully save this particular kind of extended simple from the new puzzle. I also consider some non-traditional defenses of heterogeneous extended simples and argue that they too are unsuccessful. Finally, I will argue that a substantial case can be made against the possibility of extended heterogeneous simples of any kind. (shrink)

Sentence comprehension involves maintaining and continuously integrating linguistic information and, thus, makes demands on working memory. Past research has demonstrated that semantic WM, but not phonological WM, is critical for integrating word meanings across some distance and resolving semantic interference in sentence comprehension. Here, we examined the relation between phonological and semantic WM and the comprehension of center-embedded relative clause sentences, often argued to make heavy demands on WM. Additionally, we examined the relation between phonological and semantic WM and the (...) comprehension of transitive and dative active and passive sentences, which may also draw on WM resources depending on the number of propositions that must be maintained and the difficulty of processing passive clauses. In a large sample of individuals with aphasia, we assessed whether comprehension performance on more complex vs. simpler active-passive or embedded relative clause sentences would be predicted by semantic but not phonological WM when controlling for single word comprehension. For performance on the active-passive comprehension task, we found that semantic WM, but not phonological WM, predicted comprehension of dative sentences when controlling for comprehension of transitive sentences. We also found that phonological WM, but not semantic WM, predicted mean comprehension for reversible active-passive sentences when controlling for trials with lexical distractors. On the relative clause comprehension task, consistent with prior results, we found that semantic WM, but not phonological WM, predicted comprehension of object relative clause sentences and relative clause sentences with a passive construction. However, both phonological WM and semantic WM predicted mean comprehension across all relative clause types for reversible trials when controlling for trials with lexical distractors. While we found evidence of semantic WM’s role in comprehension, we also observed unpredicted relations between phonological WM and comprehension in some conditions. Post-hoc analyses provided preliminary evidence that phonological WM maintains a backup phonological representation of the sentence that may be accessed when sentence comprehension processing is less efficient. Future work should investigate possible roles that phonological WM may play across sentence types. (shrink)
