Sous l’impulsion européenne, le droit de la médiation de la consommation a été profondément renouvelé avec la transposition de la directive 2013/11/UE relative au règlement extrajudiciaire des litiges de consommation par l’ordonnance n°2015-1033 du 20 août 2015. L’accès rapide, efficace et gratuit à un dispositif de médiation de la consommation a été appréhendé comme un droit pour le consommateur, dont la mise en place incombe aux professionnels dans tous les secteurs d’activités économiques. À la différence des autres modes amiables de (...) règlement des litiges, la médiation de la consommation a fait l’objet d’un encadrement strict avec l’élaboration d’un véritable statut de médiateur de la consommation et l’assujettissement du processus de médiation à des garanties d’ordre procédural. Placé sous le contrôle de la Commission d’évaluation et de contrôle de la médiation de la consommation, le dispositif de médiation de la consommation tend à s’imposer comme le mode privilégié de règlement des litiges de consommation. La Suma Teológica de Santo Tomás permite categorizar términos tecnológicos y establecer ontologías en clave filosófica. Con esta metodología de la Suma se va a estudiar aquí el término “metaverso” y sus implicaciones éticas. L'histoire des sciences suffit à réfuter la thèse de la mathématisation impossible, selon laquelle la mathématisation procéderait d'un formalisme abstrait manquant les choses mêmes ou la spécificité d'un domaine d'objets. Cette histoire montre en effet qu'on n'a pas cessé de mathématiser des choses dont il avait été longtemps dit qu'elles devaient, étant donné leur nature, éternellement résister à la mathématisation. À la thèse de la mathématisation impossible, il est dès lors tentant d'opposer la thèse de la mathématisation inéluctable, selon laquelle (...) une science bien formulée est une science mathématiquement constituée. Cette dernière thèse est cependant souvent associée à l'idée que l'introduction des mathématiques dans une discipline constituerait un processus qui ne présenterait aucune difficulté et qui ne serait suivie d'aucune perte. Contre cette idée, les articles rassemblés dans ce volume ont voulu, comme le titre de ce dernier l'indique, restituer à la mathématisation son caractère problématique. La méthode adoptée dans ce volume est résolument empirique : il s'appuie non pas sur des réflexions a priori sur ce que seraient les objets mathématiques, mais sur des études de cas empruntées à différentes périodes de l'histoire et à différentes sciences. Le pari a été fait que ces différentes rubriques pourraient être articulées les uns aux autres dans trois parties qui ont respectivement pour titres "Les exigences de la mesure : la quantification", "La formalisation : la puissance des formes symboliques", et "La modélisation, une nouvelle forme de mathématisation?" Assurément, une tendance historiographique générale de ces trente dernières années a consisté à privilégier les études de cas locales et singulières, ce qui nous a permis de prendre congé du style épique, qui néglige les détails de l'histoire. Cependant, l'espèce de nominalisme qui en résulte tourne rapidement court, si l'on en reste à ces études de cas singulières. Ce volume repose donc sur un pari : essayer d'articuler différentes études de cas de manière à dégager certaines formes de la mathématisation. Que ce pari ait été gagné ou perdu, ce sera au lecteur d'en juger. (shrink)

Cet article adopte un point de vue anthropologique pour explorer la place des individus affectés par des déficiences corporelles au sein de notre société, en s’appuyant sur une ethnographie du handi surf. En examinant ces dynamiques entre trois niveaux d’analyse : le corps, la nature et le monde, il vise à comprendre la transformation d’un corps meurtri « endormi » à un corps marin qui s’éveille à travers le contact avec la nature. Dans une perspective d’écologie corporelle, ce texte propose (...) une alternative au principe normatif qui enferme les individus dans la catégorie de « personne handicapée ». En mettant l’accent sur les capacités et sur les sensorialités maritimes, qui fondent l’identité « surfeur.se », il présentera de quelle façon l’expérience de l’immersion dans l’océan offre une autre possibilité : celle d’être au cœur du cosmos non plus dans ses limitations, mais bien dans ses capacités. In times of crisis and social turbulence, the mass media play a crucial role. This becomes particularly evident in economic crises within the European Union. The (biased) way the crisis is reported shapes people’s understanding of the crisis and the parties involved. In this study, the coverage of the Greek sovereign debt crisis in the German newspapers BILD, Die Welt, Frankfurter Allgemeine Zeitung, Süddeutsche Zeitung, tageszeitung and Der Spiegel (online) is examined for the quality criteria relevance, neutrality, balance, and analytical (...) quality. The results show that the reporting is appropriate to the relevance of the topic, but shows deficits in the criteria of balance, neutrality, and analytical quality. During the study period, coverage focuses on a small number of topics, journalists include their value judgments in news and reports. Overall, there is an obvious media bias against the Greek government’s position. (shrink)

The conservation laws do not establish the central premise within the argument from causal overdetermination – the causal completeness of the physical domain. Contrary to David Papineau, this is true even if there is no non-physical energy. The combination of the conservation laws with the claim that there is no non-physical energy would establish the causal completeness principle only if, at the very least, two further causal claims were accepted. First, the claim that the only way that something non-physical could (...) affect a physical system is by affecting the amount of energy or momentum within it, or redistributing the energy and momentum within it. Second, the claim that redistribution of energy and momentum cannot be brought about without supplying energy or momentum. Both of these claims, however, are exceedingly difficult to defend in the context of the argument. (shrink)

What are epiphanies, and why do so many people so frequently experience them? Are they just transient phenomena in our brains, or are they the revelations of objective value that they very often seem to be? What do they tell us about the world, and about ourselves? How, if at all, do epiphanies fit in with our moral systems and our theories of (...) how to live? And how do epiphanic experiences fit in with the rest of our lives? What determines qualitative sameness and difference? This book explores four principal accounts of the ontological basis of properties, including universals, trope theory, resemblance nominalism, and class nominalism, considering the assumptions and ontolological commitments which are required to make each into a plausible account of properties. -/- The latter half of the book investigates the applications of property theory and the different conceptions of properties which might be adopted with these in mind: first, the possibility and desirability of individuating properties, and (...) the distinction between sparse and abundant conceptions of properties; second, the distinction between intrinsic and extrinsic properties; third, the relationship between properties and their causal powers, and whether this is necessary or contingent; fourth, the relationship between properties and causation, modality, and laws of nature; finally, whether properties exist objectively, and if they do, what our epistemic position is with respect to such entities. Diverse agricultural technologies are promoted to increase yields and incomes, save time, improve food and nutritional security, and even empower women. Yet a gender gap in technology adoption remains for many agricultural technologies, even for those that are promoted for women. This paper complements the literature on gender and technology adoption, which largely focuses on reasons for low rates of female technology adoption, by shifting attention to what happens within a household after it adopts a technology. Understanding the expected benefits (...) and costs of adoption, from the perspective of women users in households with adult males, can help explain observed technology adoption rates and why technology adoption is often not sustained in the longer term. Drawing on qualitative data from Ethiopia, Ghana, and Tanzania, this paper develops a framework for examining the intrahousehold distribution of benefits from technology adoption, focusing on small-scale irrigation technologies. The framework contributes to the conceptual and empirical exploration of joint control over technology by men and women in the same household. Efforts to promote technology adoption for agricultural development and women’s empowerment would benefit from an understanding of intrahousehold control over technology to avoid interpreting technology adoption as an end in and of itself. Preterm birth is defined as delivery occurring before 37 weeks gestation.1 Infants born prematurely have increased risks of morbidity and mortality throughout life, especially during the first year. These risks increase as the gestational age at birth decreases.2 Additionally, there are significant racial and ethnic differences in preterm birth rates. In 2022, the rate of preterm birth among non-Hispanic black women was approximately 50% higher than that observed in non-Hispanic white women.1 The outcomes for these infants are also disparate–preterm birth (...) and low birth weight are the second-leading causes of infant mortality (deaths before 1 year of age). Notably, among preterm neonates, infants born to non-Hispanic black women have a mortality rate more than double that of infants born to non-Hispanic white mothers.3 Importantly, there is a small but significant group of neonates that can be classified as severely premature (those born <28 weeks). Infants born before 28 weeks have varied and uncertain outcomes. While this group accounts for only 0.4% of preterm births, it also accounts for 40% of deaths among preterm neonates.4 As noted by Romanis and Adkins, the advent of artificial amnion and placenta technology (AAPT) holds promise for its potential to address the physiologic complications and mortality risks of extreme prematurity by introducing amniotic substitutes that mimic in vivo placental oxygenation and substrate delivery. Credences, unlike full beliefs, can’t be true or false. So what makes credences more or less accurate? This chapter offers a new answer to this question: credences are accurate insofar as they license true educated guesses, and less accurate insofar as they license false educated guesses. This account is compatible with immodesty; : a rational agent will regard her own credences to be best for the purposes of making true educated guesses. The guessing account can also be used to justify (...) certain coherence constraints on rational credence, such as probabilism. The chapter concludes by discussing some advantages of the guessing account over rival accounts of accuracy. (shrink)

Many views rely on the idea that it can never be rational to have high confidence in something like, “P, but my evidence doesn’t support P.” Call this idea the “Non-Akrasia Constraint”. Just as an akratic agent acts in a way she believes she ought not act, an epistemically akratic agent believes something that she believes is unsupported by her evidence. The Non-Akrasia Constraint says that ideally rational agents will never be epistemically akratic. In a number of recent papers, the (...) Non-Akrasia Constraint has been called into question. Objective To explore attitudes towards conscientious objections among medical students in the UK. Methods Medical students at St George's University of London, Cardiff University, King's College London and Leeds University were emailed a link to an anonymous online questionnaire, hosted by an online survey company. The questionnaire contained nine questions. A total of 733 medical students responded. Results Nearly half of the students in this survey stated that they believed in the right of doctors to conscientiously object to any procedure. (...) Demand for the right to conscientiously object is greater in Muslim medical students when compared with other groups of religious medical students. Discussion Abortion continues to be a contentious issue among medical students and this may contribute to the looming crisis in abortion services over the coming years. This project sheds some light on how future doctors view some of their ethical rights and obligations. Using empirical evidence, it reveals that conscientious objection is an issue in the UK medical student body today. These data could help anticipate problems that may arise when these medical students qualify and practise medicine in the community. Conclusion Clearer guidance is needed for medical students about the issue of conscientious objection at medical school. (shrink)

In the contemporary mental causation debate, two dualist models of psychophysical causal relevance have been proposed which entail that although mental events are causally relevant in the physical domain, this is not in virtue of them causing any physical event. It is widely assumed that the principle of the causal completeness of the physical domain provides a general argument against interactive dualism. But, whether the completeness principle presents a problem for these alternative forms of interactive dualism is questionable. In his insightful review, Eugene V. Koonin discusses various aspects of CRISPR-Cas systems with a strong focus on their qualities as "adaptive immune systems". The CRISPR-Cas system is most famous for its application as a gene-editing tool. Koonin provides a deeper insight into its biological function in bacteria, which is to immunize the cell against parasite DNA. I shall comment on one issue discussed in the text, in two steps. First, I shall elaborate on CRISPR-Cas systems and their supposed Lamarckian (...) character. Criteria for calling biological phenomena genuinely Lamarckian will be narrowed down and then applied to the CRISPR-Cas system, considering interference-driven spacer acquisition as an instantiation of a truly Lamarckian paradigm. Second, I shall consider whether Lamarckian and "canonical" instances of inheritance are a case of theoretical pluralism, being two non-reducible, yet interconnected paradigms. (shrink)

For some time now, the study of cognitive development has been far and away the most active discipline within developmental psychology. Although there would be much disagreement as to the exact proportion of papers published in develop mental journals that could be considered cognitive, 50% seems like a conservative estimate. Hence, a series of scholarly books devoted to work in cognitive devel opment is especially appropriate at this time. The Springer Series in Cognitive Development contains two basic types of books, (...) namely, edited collections of original chapters by several authors, and original volumes written by one author or a small group of authors. The flagship for the Springer Series is a serial publication of the "advances" type, carrying the subtitle Progress in Cognitive Development Research. Each volume in the Progress sequence is strongly thematic, in that it is limited to some well-defined domain of cognitive developmental research (e.g., logical and mathematical development, development of learning). All Progress volumes will be edited collections. Editors of such collections, upon consultation with the Series Editor, may elect to have their books published either as contributions to the Progress sequence or as separate volumes. In recent years, immune systems have sparked considerable interest within the philosophy of science. One issue that has received increased attention is whether other phyla besides vertebrates display an adaptive immune system. Particularly the discovery of CRISPR-Cas9-based systems has triggered a discussion about how to classify adaptive immune systems. One question that has not been addressed yet is the transgenerational aspect of the CRISPR-Cas9-based response. If immunity is acquired and inherited, how to distinguish evolutionary from immunological adaptation? To shed light (...) on this issue and obtain conceptual clarity, I will investigate the inheritance of small RNA responses to pathogens in the nematode C. elegans as a further potential instantiation of a transgenerational adaptive immune system. I will explore how to make sense of systems that lie at the crossroads between genetic, immunological, and evolutionary spheres and explore the consequences of a transgenerational perspective on immune systems for immunology and its philosophy. This paper provides an account of the nature of creativity in high-energy physics experiments through an integrated historical and philosophical study of the current and planned attempts to measure the self-coupling of the Higgs boson by two experimental collaborations at the Large Hadron Collider and the planned High Luminosity Large Hadron Collider. A notion of creativity is first identified broadly as an increase in the epistemic value of a measurement outcome from an unexpected transformation, and narrowly as a condition for (...) knowledge of the measurement of the self-coupling of the Higgs. Drawing upon Tal’s model-based epistemology of measurement this paper shows how without change to ‘readings’ a transformation to the model of the measurement process can increase the epistemic value of the measurement outcome. Such transformations are attributed to the creativity of the experimental collaboration. Creativity, in this context, is both a product, a creative and improved model, and the distributed collaborative process of transformation to the model of the measurement process. For the case of the planned measurements at the HL-LHC, where models of the measurement process perform the epistemic function of prediction, creativity is included in the models of the measurement process, both as projected quantified creativity and as an assumed property of the future collaborations. What is salience? This collection addresses this neglected question by considering the role of salience in a wide variety of areas. All 13 chapters are specially commissioned, and written by an international team of contributors.

The philosophical difficulties presented by self-deception are vexed and multifaceted. One such difficulty is what I call the ‘doxastic problem’ of self-deception. Solving the doxastic problem involves determining whether someone in a state of self-deception that ∼p both believes that p and believes that ∼p, simply holds one or the other belief, or, as I will argue, holds neither. This final option, which has been almost entirely overlooked to-date, is what I call ‘ nondoxasticism ’ about self-deception. In this article, (...) I present a negative case for nondoxasticism according to which, in the paradigm case of self-deception, there is no explanatory need to attribute the self-deceived person either their undesired belief that p, or their desired belief that ∼p. Folk psychology is replete with concepts other than belief, and if we bear this in mind, it becomes clear that the explanatory roles for which the self-deceived person's purported beliefs have traditionally been enlisted can be comfortably filled without recourse to belief. Today, a new vein of queer Marxist-feminist family-abolitionist theorising is reviving contemporary feminists’ willingness to imagine, politically, what women's liberationists in the 1970s called ‘mothering against motherhood’. Concurrently, the jokey portmanteau ‘momrade’, i.e. mom + comrade, has circulated persistently in the twenty-first century on online forums maintained by communities of mothers and/or leftists. This article asks: what if, in the name of abolishing the family, we took the joke entirely seriously? What makes a ‘mom’ a ‘momrade’, or vice versa? In (...) what ways does the work of reproduction, conceivably, actively participate in class struggles, producing new worlds (and un-producing others)? How do the collective arts of mothering unmake selves? And how does the verb ‘to mother’ work to abolish the present state of things? The chosen point of departure for exploring these questions is the concept of xenohospitality; a term I borrow from Helen Hester – one of the authors of the Xenofeminist Manifesto – who defines it as openness to the alien, a definition I link closely to ‘comradeliness’. Further, the meaning of the term ‘family abolition’, here, is aptly summed up by the formula ‘xenofam ≥ biofam’; to abolish the family is not to destroy relationships of care and nurturance, but on the contrary, to expand and proliferate them. Reflecting on the conditions of possibility for such universally xenofamilial – that is to say, comradely – kin relations, this article implicitly argues for utopia(nism) in feminist kinship studies. It grounds this utopianism, however, in first-hand experiences of informal ‘death doula’ labour. The labour of mothering one's mother is offered as a potential practice of un-mothering oneself and others. In fact, the argument pivots on these auto-ethnographic observations about maternal bereavement, because the event of the author's mother's death interrupted and intruded upon the feminist theorising involved. Believing rationally is epistemically valuable, or so we tend to think. It’s something we strive for in our own beliefs, and we criticize others for falling short of it. We theorize about rationality, in part, because we want to be rational. But why? I argue that how we answer this question depends on how permissive our theory of rationality is. Impermissive and extremely permissive views can give good answers; moderately permissive views cannot.

‘Exclusivity’ is the claim that when deliberating about whether to believe that p one can only be consciously motivated to reach one's conclusion by considerations one takes to pertain to the truth of p. The pragmatist tradition has long offered inspiration to those who doubt this claim. Recently, a neo-pragmatist movement, Keith Frankish (), and Conor McHugh ()) has given rise to a serious challenge to exclusivity. In this article, I defend exclusivity in the face of this challenge. First, I (...) dispute a crucial assumption underlying the challenge, namely, that one can have evidence sufficient to enable but not compel belief. Secondly, I examine several cases that McHugh in particular offers to call exclusivity into question and argue on independent grounds that these cases do not threaten exclusivity. Whether or not exclusivity holds, in addition to being of intrinsic interest, has a decisive consequence for the contemporary debate over Bernard Williams’ () claim that “beliefs aim at truth”. If exclusivity is true, as David Owens () has argued, the deliberator cannot be said to literally aim at truth. So, in defending exclusivity, I thereby show that the notion of ‘aiming’ fails to illuminate the nature of belief. (shrink)

I propose a programme of research in ethical philosophy, into the peak-experiences or wow-moments that I, following James Joyce and others, call epiphanies. As a first pass, I characterize an epiphany as an (1) overwhelming (2) existentially significant manifestation of (3) value, (4) often sudden and surprising, (5) which feels like it “comes from outside” – it is something given, relative to which I am a passive perceiver – which (6) teaches us something new, which (7) “takes us out of (...) ourselves”, and which (8) demands a response. Often the correct response is love, often it is pity, or again creativity. It might also be anger or reverence or awe or a hunger to put things right – a hunger for justice; or many other things. It may be something that leads directly to action, but it may also be something that prompts contemplation; or other responses again. Since epiphanies are what I call a focal-case category, not all of the conditions listed above have to be fulfilled by all instances of epiphanies. In order to allow the reader to get a better grip on which range of phenomena may count as an epiphany, I examine in some detail several examples from literature, in particular from works by Murdoch, Hopkins, Wordsworth, C.S. Lewis, and by James Joyce. (shrink)

Recent years have seen increased interest among 4E cognition scholars in physical disability, leading to the development of the EE-model of disability. This paper contributes to the literature on disability and 4E cognition in three key ways. First, it examines the relationship between the EE-model and social constructivist views that address the bodily reality of disablement, highlighting commonalities and distinctions. Second, it critiques the EE-model’s focus on individual strategies for expanding disabled persons’ affordance landscapes, arguing that disability policy should integrate (...) insights from both the EE-model and social constructivist approaches. Finally, it assesses the EE-model against the 'dogma of harmony'. We argue that while the EE-model’s focus on active human-environment collaboration is valuable, it can inadvertently perpetuate this dogma. We contend that integrating certain social constructivist insights can help the EE-model avoid the dogma of harmony. (shrink)

The aim of this research is to explore the process linking participative leadership to organizational identification. The study examines the relationship between participative leadership and internal CSR perceptions of employees and also investigates the role that pride in membership plays in the affiliation of CSR perceptions with organizational identification. By studying these relationships, the paper aspires to contemplate new presumed mediators in the association of participative leadership with organizational identification as well as determine a possible novel antecedent of employee CSR (...) perceptions. Empirical evidence is provided from data that was collected through a survey distributed to employees working for small- and medium-sized enterprises in three countries in the Middle East and North Africa regions, particularly the United Arab Emirates, Lebanon, and Tunisia. Findings show that participative leadership leads to positive internal CSR perceptions of employees and that these CSR perceptions lead to pride in membership which, in turn, results in organizational identification.
