Depuis Droit, mythe et raison (1980) écrit avec Jacques Lenoble jusqu’aux récents À quoi sert le droit? Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, avec (...) le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». Abordant les deux pôles de la dialectique à laquelle François Ost est si attaché - la critique et la reconstruction -, l’ouvrage propose un regard interdisciplinaire sur le droit, à travers les principaux thèmes qui ont nourri la pensée de l’auteur. Du statut épistémologique de la science du droit à un questionnement sur les fondements et l’avenir du droit et de la justice, des liens qu’entretiennent le droit et la littérature jusqu’à l’environnement saisi par le droit en passant par les « communs », les approches de ses collègues et amis sont toutes réflexives et critiques. En ce qu’elles sont soucieuses de soumettre le droit au regard des sciences sociales et, inversement, les normativités extra-juridiques au regard du droit, elles sont fidèles à la démarche de François Ost. Ce Liber Amicorum propose aussi un retour réflexif sur son œuvre par l’auteur lui-même, dans un entretien avec Manuel Atienza. Mathematical notation includes a vast array of signs. Most mathematical signs appear to be symbolic, in the sense that their meaning is arbitrarily related to their visual appearance. We explored the hypothesis that mathematical signs with iconic aspects—those which visually resemble in some way the concepts they represent—offer a cognitive advantage over those which are purely symbolic. An early formulation of this hypothesis was made by Christine Ladd in 1883 who suggested that symmetrical signs should be used to convey commutative (...) relations, because they visually resemble the mathematical concept they represent. Two controlled experiments provide the first empirical test of, and evidence for, Ladd's hypothesis. In Experiment 1 we find that participants are more likely to attribute commutativity to operations denoted by symmetric signs. In Experiment 2 we further show that using symmetric signs as notation for commutative operations can increase mathematical performance. (shrink)

This article defends a selective eliminativist position with respect to the concept of “biological lineage” as used in certain areas of contemporary evolutionary biology. We argue that its primary epistemic roles in these contexts—explaining social evolution and cumulative selection—clash with empirical evidence, and that enforcing the concept of “lineage” even obstructs fruitful research avenues in several biological research fields, including phylogenetic research. Drawing on this, we suggest that, in many instances, it would be best to get rid of the concept (...) of “lineage” and think in terms that are more closely aligned with the empirical complexity of the biological world. Specifically, this entails that, instead of looking for the lineage that may have given rise to the entities possessing certain biological characteristics, biologists should generally look for any potential process allowing such possession, with the formation of a lineage just one possibility among many. This commentary focuses on evidence from autism concerning the relation between metacognition and mindreading. We support Carruthers' rejection of models 1 (independent systems) and 3 (metacognition before mindreading), and provide evidence to strengthen his critique. However, we also present evidence from autism that we believe supports model 2 (one mechanism, two modes of access) over model 4 (mindreading is prior).

Introduction: People with Spinal Cord Injury are at risk of feeling socially disconnected. Competitive esports present an opportunity for people with SCI to remotely engage in a community. The aim of this study is to discuss barriers to esports participation for people with SCI, present adaptive solutions to these problems, and analyze self-reported changes in social connection.Materials and Methods: We presented a descriptive data collected in the process of a quality improvement initiative at Mount Sinai Hospital. In 2019, seven individuals (...) with cervical SCI and quadriplegia participated in a special interest group on esports. Group scores were then analyzed for evidence of between subjects variability using a single sample t-test. A Pearson's correlation was conducted to determine the relationship between social connectedness and demographic data.Results: All players experienced functional limitations as a result of their injury but managed to design personalized gaming setups with adaptive equipment that allowed them to successfully compete in esports. All players reported a positive change in perceived social connectedness after participating in the special interest group. Score on Social Connectedness Scale negatively correlated with Time since injury.Discussion: It is feasible to create adaptive gaming setups that can be used by people with differing degrees and severity of SCI in a competitive esports environment. Technology and adaptive competitive esports have a potential to improve social connectedness and inclusion in people with quadriplegia. Further research on efficacy and effectiveness of these inclusive environments and their effects on quality of life, activity, and participation is warranted. (shrink)

Background The European Union aims to optimize patient protection and efficiency of health-care research by harmonizing procedures across Member States. Nonetheless, further improvements are required to increase multicenter research efficiency. We investigated IRB procedures in a large prospective European multicenter study on traumatic brain injury, aiming to inform and stimulate initiatives to improve efficiency. Methods We reviewed relevant documents regarding IRB submission and IRB approval from European neurotrauma centers participating in the Collaborative European NeuroTrauma Effectiveness Research in Traumatic Brain Injury. (...) Documents included detailed information on IRB procedures and the duration from IRB submission until approval. They were translated and analyzed to determine the level of harmonization of IRB procedures within Europe. Results From 18 countries, 66 centers provided the requested documents. The primary IRB review was conducted centrally or locally and primary IRB approval was obtained after one, two or three review rounds with a median duration of respectively 50 and 98 days until primary IRB approval. Additional IRB approval was required in 55% of countries and could increase duration to 535 days. Total duration from submission until required IRB approval was obtained was 114 days and appeared to be shorter after submission to local IRBs compared to central IRBs. Conclusion We found variation in IRB procedures between and within European countries. There were differences in submission and approval requirements, number of review rounds and total duration. Research collaborations could benefit from the implementation of more uniform legislation and regulation while acknowledging local cultural habits and moral values between countries. (shrink)

Representational drift is a phenomenon of increasing interest in the cognitive and neural sciences. While investigations are ongoing for other sensory cortices, recent research has demonstrated the pervasiveness in which it occurs in the piriform cortex for olfaction. This gradual weakening and shifting of stimulus-responsive cells has critical implications for sensory stimulus–response models and perceptual decision-making. While representational drift may complicate traditional sensory processing models, it could be seen as an advantage in olfaction, as animals live in environments with constantly (...) changing and unpredictable chemical information. Non-topographical encoding in the olfactory system may aid in contextualizing reactions to promiscuous odor stimuli, facilitating adaptive animal behavior and survival. This article suggests that traditional models of stimulus–(neural) response mapping in olfaction may need to be reevaluated and instead motivates the use of dynamical systems theory as a methodology and conceptual framework. Though the concepts of diversity and inclusion are still widely used in the contexts of management, policy-making, and academic research, the notion of superdiversity is becoming increasingly popular. First articulated by social anthropologist Steven Vertovec (see Vertovec, 2006; 2007; 2012), superdiversity has been described as a concept and theoretical tool that enables us to study our ever-evolving, globalising social reality in great detail by taking the enormous amount of diversity that exists within different groups in societies around the world into (...) account as well, in addition to differences between different groups. Superdiversity is mainly linked to the growing ethnic and cultural complexity of Western European societies, and is therefore often associated with the rise of so-called majority-minority- cities, such as Amsterdam, Brussels, and London, to name a few – all cities in which ethnic minority groups are about to replace (or have already replaced) the ethnic majority group (see, e.g., Crul, Schneider, & Lelie, 2013; Crul, 2016; Geldof, 2015). The argument from potentiality for embryo protection relies on the assumption of a specific developmental potential of human embryos: as human embryos under normal conditions naturally developing into beings whose strong moral status is uncontroversial, namely into human persons, they likewise enjoy strong moral status. In my paper, I endeavour to spell out the ontological foundations of the argument from potentiality and to discuss them critically in the light of new empirical findings in embryology. Particular attention is hereby paid to (...) recent attempts to analyse the relevant notion of potentiality in terms of dispositions possessed by human embryos. I argue that, putting aside inappropriate essentialist speculations, there is no straightforward disposition of an embryo to become a person; such a disposition, if any, being rather successively generated in a multi-factored, highly context-sensitive process of biological development. Context can determine whether a given gene acts as an oncogene or a tumor suppressor. Deubiquitinating enzymes (DUBs) regulate the stability of many components of the pathways dictating cell fate so it would be expected that alterations in the levels or activity of these enzymes may have oncogenic or tumor suppressive consequences. In the current review we survey publications reporting that genes encoding DUBs are oncogenes or tumor suppressors. For many DUBs both claims have been made. For such “double agents,” (...) the effects of gain or loss of function will depend on the overall status of a complex of molecular signaling networks subject to extensive crosstalk. As the TGF‐β paradox makes clear context is critical in cell fate decisions, and the disconnect between experimental findings and patient survival outcomes can in part be attributed to disparities between culture conditions and the microenvironment in vivo. Convincing claims for oncogene or tumor suppressor roles require the documentation of gene alterations in patient samples; survival curves are alone inadequate. (shrink)

The article deals with the virtues of the procedural conception of justice for justifying multiculturalism. While proceduralism is at first sight poorly equipped to make democratic equality more inclusive of ethnocultural minorities, it has been supported by liberal philosophers as an efficient method to provide a principled defense of minority rights. By analysing this theoretical path and its limits, and by suggesting more particularly how Alan Patten’s “full proceduralism” fails to solve the difficulties of Will Kymicka’s “multicultural citizenship”, the article (...) raises doubts about the promise to ground multiculturalism on proceduralism. À cet égard, deux pratiques médiatives nées de l’activité de la DGFiP illustrent bien la diversité des expressions de ce phénomène. In many judicial systems, confessions are a requirement for criminal conviction. Even if confessions are intrinsically convincing, this might not entirely explain why they play such a paramount role. In addition, it has been suggested that confessions owe their importance to their legitimizing role, explaining why they could be required even when other evidence has convinced a judge. But why would confessions be particularly suited to justify verdicts? One possibility is that they can be more easily transmitted from one individual (...) to the next, and thus spread in the population without losing their convincingness. 360 English-speaking participants were asked to evaluate the convincingness of one of three justifications for a verdict, grounded either in a confession, eyewitnesses, or circumstantial evidence, and to pass on that justification to another participant, who performed the same task. Then, 240 English-speaking participants evaluated the convincingness of some of the justifications produced by the first group of participants. Compared to the other justifications, justifications based on confessions lost less of their convincingness in the transmission process. Modeling pointed to the most common forms the justifications would take as they are transmitted, and results showed that the most common variant of the justification based on a confession was more convincing. Empirical and experiential investigations allow the distinction between observational and non-observational forms of subjective bodily experiences. From a first-person perspective, the biological body can be (1) an "opaque body" taken as an intentional object of observational consciousness, (2) a "performative body" pre-reflectively experienced as a subject/agent, (3) a "transparent body" pre-reflectively experienced as the bodily mode of givenness of objects in the external world, or (4) an "invisible body" absent from experience. It is proposed that pre-reflective bodily experiences rely on (...) sensori-motor integrative mechanisms that process information on the external world in a self relative way. These processes are identification-free in that the self is not identified as an object of observation. Different points of Metzinger's position makes it a peculiar form of representationalism: (1) his distinction between intentional and phenomenal content, in relation to the internalism/externalism divide; (2) the notion of transparency defined at a phenomenal and not epistemic level, together with (3) the felt inwardness of experience. The distinction between reflexive and pre-reflexive phenomenal internality will allow me to reconsider Metzinger's theory of the self and to propose an alternative conception that I will describe both at an epistemic and a (...) phenomenal level. In the first part of this paper I characterize a minimal form of self-consciousness, namely pre-reflective self-consciousness. It is a constant structural feature of conscious experience, and corresponds to the consciousness of the self-as-subject that is not taken as an intentional object. In the second part, I argue that contemporary cognitive neuroscience has by and large missed this fundamental form of self-consciousness in its investigation of various forms of self-experience. In the third part, I exemplify how the notion of pre-reflective (...) self-awareness can be of relevance for empirical research. In particular, I propose to interpret processes of sensorimotor integration in light of the phenomenological approach that allows the definition of pre-reflective self-consciousness. (shrink)

L'approche biographique s'adresse à l'histoire de la vie de l'individu singulier, rencontrée dans sa texture complexe, en ce qu'elle trame toujours en elle, et la psyché, et l'individu social, et le sujet.

Comment combattre la langue de bois ? Ce devrait être la première préoccupation des commentateurs politiques, chargés de commenter, d’analyser et d’éditorialiser. Mais, comme celle des hommes politiques, la langue de bois des commentateurs a pour objectif principal de ne pas tout dire. Elle est faite pour leur permettre de s’adresser au plus grand nombre, sans choquer, souvent même en délivrant à l’auditeur ou au lecteur une pensée dans laquelle il peut se reconnaître. Il existe aussi une autre sorte de (...) langue de bois, plus problématique dans les métiers de commentateurs : une langue de bois réflexe, faite de formules creuses, de poncifs et de métaphores . Par ailleurs, l’une des tendances les plus spectaculaires de ces dernières années est l’avènement de ce que l’on peut appeler le « parler cash », façon de rejeter la langue de bois. Une parole cash devient un acte politique en lui-même, un acte creux, et les journalistes en sont coresponsables puisque travaillant à jet continu avec Internet et les chaînes tout-info. En revanche, le numérique permet de conserver et de classer ce qui se dit. La mémoire politique s’est démocratisée et Internet met à la disposition de chacun l’ensemble des propos des hommes politiques. Cette évolution du rapport entre le discours et son commentaire est bienvenue après des décennies de consanguinité entre les politiques et les commentateurs.How do you fight doublespeak? This ought to be the main concern of every political commentator, whose job is to comment on, analyse and editorialise what politicians say. But, like politicians, commentators use a language whose main purpose is to not say everything. It is made for them to address the widest possible audience, without giving offence and often by offering listeners or readers thoughts they can recognise as their own. This sort of language also exists in another more problematical form among commentators, as a kind of reflexive newspeak made up of clichés, commonplaces and metaphors involving warfare, sports or cookery. One of the more spectacular trends in the last few years is the advent of what the French call « parler cash », meaning « rude straight talk », as an antidote to doublespeak. « Talking rude and straight » then becomes a political – and hollow – act in itself, for which journalists are equally responsible since they are constantly working live with the Internet and 24-hour news channels. On the other hand, everything that is said can now be stored and classified on digital media. The archives of politics are becoming available to all and anyone can use the Internet to access anything a politician has ever said. This is a welcome development for the relationship between discourse and commentary, after decades of blood relationships between politicians and political commentators. (shrink)

As an introduction to our work, we emphasize the parallel interpretation of abstract tools and the concepts of undetermined and vague information. Imprecision, uncertainty and their relationships are inspected. Suitable interpretations of the fuzzy sets theory are applied to legal phenomena in an attempt to clearly circumscribe the possible applications of the theory. The fundamental notion of reference sets is examined in detail, hence highlighting their importance. A systematic and combinatorial classification of the relevant subsets of the legal field is (...) supplied for practical application. Although the use of the fuzzy sets theory is sometimes suggested as a palliative measure (no competition exists), it can also be complementary (serve as a building block to improve modelisation). An Appendix gives a brief recall of the key-concepts of the axiomatic theory of fuzziness and its developments: fuzzy sets, fuzzy logic, fuzzy control and theory of possibility. (shrink)

This book explores four principal accounts of the ontological basis of properties, including universals, trope theory, resemblance nominalism, and class nominalism, considering the assumptions and ontolological commitments which are required to make each into a plausible account of properties. -/- The latter half of the book investigates the applications of property theory and the different conceptions of properties which might be adopted with these in mind: first, the possibility and desirability of individuating properties, and (...) the distinction between sparse and abundant conceptions of properties; second, the distinction between intrinsic and extrinsic properties; third, the relationship between properties and their causal powers, and whether this is necessary or contingent; fourth, the relationship between properties and causation, modality, and laws of nature; finally, whether properties exist objectively, and if they do, what our epistemic position is with respect to such entities. We discuss the justification of Bickle's “ruthless” reductionism. Bickle intends to show that we know enough about neurons to draw conclusions about the “whole” brain and about the mind. However, his reductionism does not take into account the complexity of the nervous system and the fact that new properties emerge at each significant level of integration from the coupled functioning of elementary components. From a methodological point of view, we argue that neuronal and cognitive models have to exert a mutual (...) constraint(MC) on each other. This approach would refuse to award any priority of cognitive approaches over neuroscience, and reciprocally, to refuse any priority of neuroscience over cognitive approaches. MC thus argues against radicalreductionism at the methodological level. (shrink)

‘Exclusivity’ is the claim that when deliberating about whether to believe that p one can only be consciously motivated to reach one's conclusion by considerations one takes to pertain to the truth of p. The pragmatist tradition has long offered inspiration to those who doubt this claim. Recently, a neo-pragmatist movement, Keith Frankish (), and Conor McHugh ()) has given rise to a serious challenge to exclusivity. In this article, I defend exclusivity in the face of this challenge. First, I (...) dispute a crucial assumption underlying the challenge, namely, that one can have evidence sufficient to enable but not compel belief. Secondly, I examine several cases that McHugh in particular offers to call exclusivity into question and argue on independent grounds that these cases do not threaten exclusivity. Whether or not exclusivity holds, in addition to being of intrinsic interest, has a decisive consequence for the contemporary debate over Bernard Williams’ () claim that “beliefs aim at truth”. If exclusivity is true, as David Owens () has argued, the deliberator cannot be said to literally aim at truth. So, in defending exclusivity, I thereby show that the notion of ‘aiming’ fails to illuminate the nature of belief. (shrink)

Stéphane Legrand combine les ressorts de l'essai et du récit pour analyser sa pensée et ses romans les plus marquants, qui font d'elle une pièce essentielle à la compréhension du monde contemporain. Il brosse le portrait captivant de cette émigrée russe "bigger-than-life", qu'on a pu qualifier d'"ultime drogue de passage vers une vie de droite", et dont le destin n'a rien à envier à ses fictions les plus rocambolesques.
