John Roemer points out that there are two views of equality of opportunity that are widely held today. The first, which he calls the nondiscrimination principle, states that in the competition for positions in society, individuals should be judged only on attributes relevant to the performance of the duties of the position in question. Attributes such as race or sex should not be taken into account. The second states that society should do what it can to level the playing field (...) among persons who compete for positions, especially during their formative years, so that all those who have the relevant potential attributes can be considered. -/- Common to both positions is that at some point the principle of equal opportunity holds individuals accountable for achievements of particular objectives, whether they be education, employment, health, or income. Roemer argues that there is consequently a “before” and an “after” in the notion of equality of opportunity: before the competition starts, opportunities must be equalized, by social intervention if need be; but after it begins, individuals are on their own. The different views of equal opportunity should be judged according to where they place the starting gate which separates “before” from “after.” Roemer works out in a precise way how to determine the location of the starting gate in the different views. Imagine a society of fisherfolk, who, in the state of nature, fish on a lake of finite size. Fishing on the lake is characterized by decreasing returns to scale in labor, because the lake's finite size imply that each successive hour of fishing labor is less effective than the previous one, as the remaining fish become less dense in the lake. In the state of nature, the lake is commonly owned: each fishes as much as he pleases, and, we might (...) suppose, calculates his fishing plan by taking the labor of the others as given, as he sees it. Each knows that the distribution of fish will be proportional to labor expended among the fisherfolk: if I fish twice as long as you, I will end up with twice as much fish as you. This is not due to some kind of concern with equity among the fisherfolk; it is a technological fact, implied by the assumption that fishing labor is homogeneous, and all are equally likely to catch a fish in a unit of time. An equilibrium under common ownership can be thought of as a Nash equilibrium of the game where each computes his optimal fishing plan, given the labor of the others and knowing what the consequent distribution of fish would be. All advanced societies maintain a commitment to equal educational opportunity, which they claim to implement through a public school system that is charged toprovide all children with an education up to a state-enforced standard. Indeed, what public schools do, even in the best of circumstances, is to provide all children with a more or less equal exposure to educational inputs, rather than to guarantee them equal educational attainment. Children, as the schools receive them, differ markedly in their docility — due (...) in part to innate ability, but perhaps due more to the economic status and cultural practices of their families. Many, including myself, believe that the task of schools should be to provide some measure of equal educational attainment among students of heterogeneous talent and background. Schools should devote more educational resources to students who require them in order that they be educated to an acceptable standard. (shrink)

During the last 40 years, political philosophers have made important advances in our understanding of why equality is valuable, and what kind of equality is important. This article summarizes the development of these ideas, in particular, the contributions of John Rawls, Amartya Sen, Ronald Dworkin, Robert Nozick, Richard Arneson, and G. A. Cohen. It shows how these ideas have filtered into economic thinking in the conceptualization of equality of opportunity. It concludes with a brief discussion of how these ideas might (...) be extended to evaluate intergenerational and global distributions of income or welfare. (shrink)

ZusammenfassungDie Zulässigkeit der terminalen Sedierung als ultima-ratio-Maßnahme der Palliativmedizin bei sterbenden Patienten, die unter anders nicht kontrollierbaren schwersten Schmerzen und seelischen Qualen leiden, wird neuerdings auch in Europa kontrovers diskutiert. Während ihre Befürworter betonen, dass die terminale Sedierung nur dann zum Einsatz kommt, wenn die Standardmethoden der Palliativmedizin versagt haben, äußern ihre Gegner Angst vor einer neuen, unkontrollierten Form der aktiven Sterbehilfe. Insbesondere dann, wenn zeitgleich mit der terminalen Sedierung auf künstliche Ernährung und Flüssigkeitszufuhr verzichtet wird, wirft man ihr die (...) Umgehung der verbotenen aktiven Sterbehilfe vor, und es wird die Forderung nach einem strafrechtlichen Verbot erhoben. In diesem Artikel wird die rechtliche Bedeutung der terminalen Sedierung untersucht. Im Laufe der Analyse wird gezeigt, dass sie weder mit aktiver Sterbehilfe noch mit verbotener ärztlicher Beihilfe zum Suizid gleichgesetzt werden kann und dass sie — unter bestimmten Bedingungen — nicht unter ein strafrechtliches Verbot fällt. Der Beitrag schließt mit einer Diskussion rechtlicher und ethischer Aspekte für die Entwicklung von Leitlinien. (shrink)

An increasing number of states have ratified and incorporated them into their national legislations. But are such norms and values truly universal? And with states no longer being the only actors that shape global developments, what can be said about the role of social contracts between state and society for shaping the agenda of international (...) cooperation? And how do these social contracts develop in heterogeneous societies? If people themselves are the main drivers behind development, what does this imply for foreign aid?These and other questions are addressed in "Global Values in a Changing World," the 2010-2011 lecture series organized by the Netherlands Chapter of the Society for International Development. As John Roemer says in his introduction to this volume, 'During the past decade, what now appears as a new species in social theory has been forming: analytically sophisticated Marxism. Its practitioners are largely inspired by Marxian questions which they pursue with contemporary tools of logic, mathematics, and model building … These writers are, self-consciously, products of both the Marxian and non-Marxian traditions.' This volume assembles substantial and original essays, both published and unpublished, by some of the leading practitioners of (...) 'analytical Marxism'. The essays discuss a number of the fundamental issues of Marxian thought as well as questions that conventional Marxists see no need to raise. They exemplify the ways in which analytical Marxists are beginning to reinvigorate the Marxian tradition and, in doing so, to break down the barriers that have divided it from other forms of social theory. This volume aimed to highlight narrative identities of European cities or city neighbourhoods that have been overlooked, such as mid-sized cities. These cities are neither small towns nor metropolises, cities that are now unveiling their appeal or specificity. The present special issue thus covers a range of representations of cities. The articles investigate more systematically how different texts deal with various cities from different experiential and fictional perspectives. The issue covers the geographical scope across Europe, from east to west or (...) vice versa, as well as a range of different works of national literature(s), but with a clear emphasis on mid-sized European cities that have until now been deemed as lesser-known, secondary, peripheral, ‘other’ cities that are in the focus of the research of the COST project Writing Urban Places. The formal theory of equality of opportunity emerged as a response – a friendly amendment – to Ronald Dworkin's (1981) characterization of resource egalitarianism, as defined by the allocation that would emerge from insurance contracts arrived at behind a thin veil of ignorance. This article compares several of the prominent versions of this response, put forth in the period 1993–2008. I argue that a generalization of Roemer's (1998) proposal is the most satisfactory approach. Inherent in that generalization is an indeterminism, (...) which reflects a philosophical problem: that we do not know what comprise the ethically correct rewards to effort. The indeterminism should be resolved, I propose, by an ancillary theory which limits the degree of inequality which is acceptable. (shrink)

In this paper, I discuss Christian Wolff’s conception of motivating and normative reasons. My aim is to show that in the discussion of error cases, Wolff pursues a strategy that is strikingly similar to the strategy of contemporary defenders of nicht-psychologist accounts of motivating reasons. According to many nicht-psychologist views, motivating reasons are facts. My aim is to show that Wolff’s motivation in pursuing this strategy is very different. The point is that due to his commitment to the Principle of (...) Sufficient Reason, Wolff has to show that error cases are compatible with the PSR. The issue is worth discussing because it is not yet sufficiently explored what motivating reasons are, according to Wolff, and how they relate, in substance, to normative reasons. Methodologically, my approach can be characterized as one of “mutual illumination”: I think it is possible to highlight some crucial ambiguities of Wolff’s conception against the backdrop of the contemporary conception of motivating reasons, but also to question the importance and role of the ontological question of what motivating reasons are in contemporary discussions against the backdrop of Wolff’s position. What is astro-culture? In The Babylonian Planet it is unfolded as an aesthetic, an idea, a field of study, a position, and a practice. It helps to engineer the shift from a world view that is segregated to one that is integrated - from global to planetary; from distance to intimacy and where closeness and cosmic distance live side-by-side. In this tour de force, Sonja Neef takes her cue from Edouard Glissant's vision of multilingualism and reignites the myth of (...) the Tower of Babel to anticipate new forms of cultural encounter. For her, Babel is an organic construction site at which she fuses theoretical analysis and case studies of artists, writers and thinkers like William Kentridge, Orhan Pamuk and Immanuel Kant. Her skilful interrogations then allow her to paint a portrait of art and culture that abolishes the horizon as a barrier to vision and reclaims it as a place of contact and relation. By combining the Babylonian concept of the encounter and the planetary concept of the whole-earth, Neef creates a space - an astro-culture - in which she can examine topics as varied as language, translation, media, modernity, migration and the moon. In doing so, she instigates a renewed cultural understanding receptive to the kinder forms of cultural encounter and globalisation she hopes will come. (shrink)

Al clásico principio del mérito opone la igualdad de oportunidades en la adquisición del mérito, que discute apoyándose en la metáfora de la nivelación del terreno de juego. Roemer propone un modelo matemático elemental para analizar el peso del esfuerzo y las circunstancias individuales en la formación individual y, de acuerdo con éste, desarrolla un algoritmo para evaluar la (...) inversión estatal en los programas de igualación de oportunidades. The theory of equal opportunity as I have expounded it in Roemer uses a language comprising five words: objective, circumstance, type, effort, and policy. The objective is the kind of outcome or well-being or advantage for whose acquisition one wishes to equalize opportunities, in a given population. Circumstances are the set of environmental influences, beyond the individual’s control, that affect his or her chances of acquiring the objective. A type is the group of individuals in the population with a given (...) set of circumstances. Effort is autonomously chosen action—within the individual’s control—which, if expended in greater amounts, will increase the degree to which the individual acquires the objective. A policy is a social intervention that is used to influence the degree to which individuals acquire the objective. The equal-opportunity policy is the one from the set of feasible policies that will make it the case that the degree to which individuals acquire the objective is independent of their circumstances, and sensitive only to their effort. I propose a way of computing the equal-opportunity policy in any given situation, given the appropriate data, and a decision as to what environmental aspects should be taken to constitute circumstances. This book considers different forms of voluntarism developed from the 13th to 18th centuries. By crossing the conventional dividing line between the medieval and early modern periods, the volume draws important new insights on the historical development of voluntarism. Voluntarism places a special emphasis on the will when it comes to the analysis and explanation of fundamental philosophical questions and problems. Since the Middle Ages, voluntarist considerations and views played an important role in the development of different theories of action, (...) ethics, metaethics, and metaphysics. The chapters in this volume are grouped according to three distinct kinds of voluntarism: psychological, ethical, and theological voluntarism. They address topics such as the threat of irrationality as the standard objection to voluntarism, incontinent actions and their explanation, the nature of the will as rational appetite, the relationship between intellect and will, the implications of conceptions of the will for political freedom, and the relations between divine freedom and the modal status of eternal truths. The chapters not only consider towering figures of the Middle Ages--Thomas Aquinas, Henry of Gent, William of Ockham, Francisco de Vitoria--and early modern period--René Descartes, Thomas Hobbes, Gottfried Wilhelm Leibniz, Samuel Pufendorf--but also engage with less well-known figures such as Peter John Olivi, John of Pouilly, Catharine Trotter Cockburn, and Christian August Crusius. Varieties of Voluntarism in Medieval and Early Modern Philosophy will appeal to scholars and advanced students working in medieval philosophy, early modern philosophy, the history of ethics, and philosophy of religion. Urban dwellers are more likely to develop mental disorders such as mood and anxiety disorder as well as schizophrenia compared to rural dwellers. Moreover, it has been demonstrated that even short-term exposure to nature can improve mood and decrease stress, but the underlying neural mechanisms are currently under investigation. In the present intervention study we examined the effects of a one-hour walk in an urban vs. natural environment on activity in the amygdala, a brain region previously associated with stress processing. (...) Before and after the walk 63 participants underwent an fMRI paradigm inducing social stress. Since there is a pronounced gap in the literature regarding interindividual differences in stress-related neural effects of urban and natural environments, we set out to explore sex differences. We observed that amygdala activity decreased after the walk in nature, but only in women, suggesting that women may profit more from salutogenic effects of nature. Moreover, performance on the arithmetic tasks improved in women after the walk in nature, whereas men performed better after the walk in the urban environment. To our knowledge, this is the first study to report differencial tendencies in men and women concerning the stress-related neural activity as an effect of acute exposure to urban vs. natural environments. Furthermore, our findings highlight the importance of sex differences when exploring effects of the environment on brain function and stress. Evidence for beneficial effects of nature on stress-related brain regions may inform urban design policies to focus on providing more accessible green areas in cities and this study suggests that sex differences in experiencing the environment should be taken into consideration. Professor Roemer's goal in this book is to give a rigorous view of classical Marxian economic theory by presenting specific analytic models. The theory is not extended to deal with new problems, but it is deepened: Marxian theory is given micro-foundations and upon those foundations the author begins to rebuild a tightly constructed Marxian economics. The book begins, after a methodological introduction, with an examination of the Marxian notion of equilibrium and the theory of exploitation, and goes on to deal (...) with the theory of the falling rate of profit. The next section explores one of the points made in the first section of the book, that the Marxian theory of exploitation can be constructed completely independently of the labor theory of value as a theory of exchange. Technical study of this problem allows comment on various issues, such as the relative importance of 'marginal utilities' and 'class struggle' in determining relative prices. Background: After their attempts to have patient safety concerns addressed internally were ignored by wilfully blind managers, nurses from Bundaberg Base Hospital and Macarthur Health Service felt compelled to ‘blow the whistle’. Wilful blindness is the human desire to prefer ignorance to knowledge; the responsibility to be informed is shirked. Objective: To provide an account of instances of wilful blindness identified in two high-profile cases of nurse whistleblowing in Australia. Research design: Critical case study methodology using Fay’s Critical Social Theory (...) to examine, analyse and interpret existing data generated by the Commissions of Inquiry held into Bundaberg Base Hospital and Macarthur Health Service patient safety breaches. All data was publicly available and assessed according to the requirements of unobtrusive research methods and secondary data analysis. Ethical considerations: Data collection for the case studies relied entirely on publicly available documentary sources recounting and detailing past events. Findings: Data from both cases reveal managers demonstrating wilful blindness towards patient safety concerns. Concerns were unaddressed; nurses, instead, experienced retaliatory responses leading to a ‘social crisis’ in the organisation and to whistleblowing. Conclusion: Managers tasked with clinical governance must be aware of mechanisms with the potential to blind them. The human tendency to favour positive news and avoid conflict is powerful. Understanding wilful blindness can assist managers’ awareness of the competing emotions occurring in response to ethical challenges, such as whistleblowing. (shrink)

If one is an egalitarian, what should one want to equalize? Opportunities or outcomes? Resources or welfare? These positions are usually conceived to be very different. I argue in this paper that the distinction is misconceived: the only coherent conception of resource equality implies welfare equality, in an appropriately abstract description of the problem. In this section, I motivate the program which the rest of the paper carries out.

Utilitarians, maximinners, prioritarians, and sufficientarians each provide examples of situations demonstrating, often apparently compellingly, that a sensible ethical observer must adopt their view and reject the others. I argue, to the contrary, that an attractive ethic is eclectic or pluralistic, in the sense of coinciding with these apparently different views in different regions of the space of social states. I reject the view that an appealing ethic can be universally maximin, prioritarian, or utilitarian. Key Words: distributive justice • utilitarianism • (...) maximin • sufficiency • priority. The article discusses the relation between the concepts of unfair trade, exploitation, and below-subsistence wages with regard to individual economic transactions. Starting from the common notion that exploitation involves some kind of unfair advantage taking, it asks how “unfair” is to be understood, and what it is that is taken advantage of in exploitative exchanges. On this basis it then explores a line of argument for grounding the claim that below-subsistence wages are exploitative, focusing on the condition of morally transformative (...) voluntary consent to transactions. By analyzing the structure of coercion with regard to threats, offers, and circumstances it comes to the conclusion that consent to an offer is morally non-transformative with regard to legitimizing the outcome of a transaction if the person giving the “consent” has only unacceptable options in absolute terms to choose from, since this reduces “consent” to a mere act of rationality devoid of any normative content. Accordingly, it argues that insofar as below-subsistence wages are unacceptable options in absolute terms, they are to be considered exploitative and an instance of unfair trade. (shrink)
