The establishment of the African Court on Human and Peoples’ Rights was a pivotal moment for the African human rights system. To date, 30 of the African Union’s 55 member states have accepted the Court’s jurisdiction by ratifying the Protocol to the African Charter on Human and Peoples’ Rights on the Establishment of an African Court on Human and Peoples’ Rights. This article uses statistical analysis of state action on the Protocol to shed light upon the factors that have led (...) some states to accept the Court’s jurisdiction and other states to thus far decline to do so. The results provide strong support for accounts of the origins of international human rights regimes that emphasize transitional states’ desire to “lock in” new commitments to democracy and human rights. Potential compliance costs, regimes’ ideological orientations, domestic legal traditions, and regional dynamics have also exerted significant effects upon the likelihood of ratification. (shrink)

What would it mean to apply quantum theory, without restriction and without involving any notion of measurement and state reduction, to the whole universe? What would realism about the quantum state then imply? This book brings together an illustrious team of philosophers and physicists to debate these questions. The contributors broadly agree on the need, or aspiration, for a realist theory that unites micro- and macro-worlds. But they disagree on what this implies. Some argue that if unitary quantum evolution has (...) unrestricted application, and if the quantum state is taken to be something physically real, then this universe emerges from the quantum state as one of countless others, constantly branching in time, all of which are real. The result, they argue, is many worlds quantum theory, also known as the Everett interpretation of quantum mechanics. No other realist interpretation of unitary quantum theory has ever been found. Others argue in reply that this picture of many worlds is in no sense inherent to quantum theory, or fails to make physical sense, or is scientifically inadequate. The stuff of these worlds, what they are made of, is never adequately explained, nor are the worlds precisely defined; ordinary ideas about time and identity over time are compromised; no satisfactory role or substitute for probability can be found in many worlds theories; they can't explain experimental data; anyway, there are attractive realist alternatives to many worlds. Twenty original essays, accompanied by commentaries and discussions, examine these claims and counterclaims in depth. They consider questions of ontology - the existence of worlds; probability - whether and how probability can be related to the branching structure of the quantum state; alternatives to many worlds - whether there are one-world realist interpretations of quantum theory that leave quantum dynamics unchanged; and open questions even given many worlds, including the multiverse concept as it has arisen elsewhere in modern cosmology. A comprehensive introduction lays out the main arguments of the book, which provides a state-of-the-art guide to many worlds quantum theory and its problems. (shrink)

Anthony Simon Laden explores the kind of reasoning we engage in when we live together: when we are responsive to others and neither commanding nor deferring to them. He argues for a new, social picture of the activity of reasoning, in which reasoning is a species of conversation--social, ongoing, and governed by a set of characteristic norms.

Climate change poses grave threats to many people, including the most vulnerable. This prompts the question of who should bear the burden of combating ?dangerous? climate change. Many appeal to the Polluter Pays Principle. I argue that it should play an important role in any adequate analysis of the responsibility to combat climate change, but suggest that it suffers from three limitations and that it needs to be revised. I then consider the Ability to Pay Principle and consider four objections (...) to this principle. I suggest that, when suitably modified, it can supplement the Polluter Pays Principle. (shrink)

This paper develops and defends a new account of B-theoretic endurantism and a new account of the metaphysics of the quantum state, and highlights the parallels between the considerations that motivate them. These new accounts are both fragmentalist, in the sense that they follow Fine (2005) in invoking a symmetric coordination relation between facts, such that facts that are pairwise incompatible (like Hugh's being happy and Hugh's being sad) can both obtain provided that they are not related by this relation. However, while Fine allows that fragments can be logically incoherent— P can obtain in one fragment while not-P obtains in another—the fragmentalist accounts defended here are motivated even if we insist on logical coherence between fragments. According to the B-theory, the passage of time is an illusion. The B-theory therefore requires an explanation of this illusion before it can be regarded as fullysatisfactory; yet very few B-theorists have taken up the challenge of trying to provide one. In this paper I take some first steps toward such an explanation by first making a methodological proposal, then a hypothesis about a key element in the phenomenology of temporal passage. The methodological proposal focuses onthe representational content of the (...) element of experience by virtue of which time seems to pass. According to the Everett interpretation, branching structure and ratios of norms of branch amplitudes are the objective correlates of chance events and chances; that is, 'chance' and 'chancing', like 'red' and 'colour', pick out objective features of reality, albeit not what they seemed. Once properly identified, questions about how and in what sense chances can be observed can be treated as straightforward dynamical questions. On that basis, given the unitary dynamics of quantum theory, it follows that relative and never absolute (...) chances can be observed; that only on repetition of a large numbers of similar trials can relative probabilities be measured; and so on. The epistemology of objective chances can in this way be worked out from the dynamics. its curious features are thus explained. But one aspect of chance set-ups seems to resist this subsuming of chancing to branching: how is it that chance involves uncertainty? And if that is not possible, on Everettian lines, then the whole project is doomed. I argue that in fact there is no difficulty in making sense of uncertainty in the face of branching. Contrary to initial impressions, the unitary formalism is consistent with a well-defined notion of self-locating uncertainty. It is also consistent without: the mathematics under-determines the metaphysics in these respects. (shrink)

In this article I compare Ryle's notion of a thick description with Williams' notion of a thick concept so as to illuminate our understanding of both. In doing so I suggest lines of thought that show us that the notion of 'evaluation' in play in many people's writings should be broadened. Doing so will help to lessen the credibility of separationist notions of thick concepts.

This book takes Hollywood's disaster movies and their codified versions of natural disaster, post-apocalyptic survival, and extra-terrestrial threat as the starting point for an analytical trajectory toward new understandings of how cinema shapes and informs our conceptions of disaster and catastrophe. This book examines a range of films from distinct regional and industrial contexts: Hollywood, indie movies, different kinds of documentaries, and auteurist-realist cinema. Moving across and beyond critical and industrial categories that inform thinking about cinema, it contends that different (...) approaches to film style can push us to imagine disaster in distinct ways, with distinct ethical connotations. The nature of experience has been held to be a major reason for accepting the A-theory of time. I argue, however, that experience does not favour the A-theory over the B-theory; and that even if the A-theory were true it would not be possible to perceive the passage of time. The main argument for this draws on the constraint that a satisfactory theory of perception must explain why phenomenal characters map uniquely onto perceived worldly features. Thus, if passage is perceived, (...) it must be explained what makes one phenomenal character rather than another a perception of passage; and it must also be explained why that phenomenal character is a perception of passage rather than of some other feature of the world. I argue that no such explanation can be given, and consequently that passage cannot be perceived. I conclude that the A-theory is rendered unintelligible, and should therefore be rejected. (shrink)

This volume has its roots in two recent developments within mainstream analytic epistemology: a growing recognition over the past two or three decades of the active and social nature of our epistemic lives; and, more recently still, the increasing appreciation of the various ways in which the epistemic practices of individuals and societies can, and often do, go wrong. The theoretical analysis of these breakdowns in epistemic practice, along with the various harms and wrongs that follow as a consequence, constitutes (...) an approach to epistemology that we refer to as non-ideal epistemology. In this introductory chapter we introduce and contextualise the ten essays that comprise this volume, situating them within four broad sub-fields: vice epistemology, epistemic injustice, inter-personal epistemic practices, and applied epistemology. The prospect of dangerous climate change requires Humanity to limit the emission of greenhouse gases. This in turn raises the question of how the permission to emit greenhouse gases should be distributed and among whom. In this article the author criticises three principles of distributive justice that have often been advanced in this context. He also argues that the predominantly statist way in which the question is framed occludes some morally relevant considerations. The latter part of the article turns from (...) critique and advances a new way of addressing the problem. In particular, first, it proposes four key theses that should guide our normative analysis; and, second, it outlines how these four theses can be realised in practice. (shrink)

Children have special duties to their parents: there are things that we ought to do for our parents, but not for just anyone. Three competing accounts of filial duty appear in the literature: the debt theory, the gratitude theory and the friendship theory. Each is unsatisfactory: each tries to assimilate the moral relationship between parent and child to some independently understood conception of duty, but this relationship is different in structure and content from any that we are likely to share (...) with anyone apart from a parent. A more promising account will concentrate on what is unique about the parent-child relationship. I articulate and defend the 'special goods theory', according to which filial duties arise from the distinctive kinds of goods that healthy parent-child relationships typically involve. (shrink)

Interventions that are designed to stem plagiarism do not always override the motivation of individuals to cheat and, therefore, may not diminish misconduct. To inform more effective approaches, we conducted a systematic review to clarify the psychological causes of plagiarism. This review of 83 empirical papers showed that a specific blend of circumstances may foster plagiarism: an emphasis on competition and success rather than development and cooperation coupled with impaired resilience, limited confidence, impulsive tendencies, and biased cognitions. In this paper we argue that the consensus around normative standards for the ethics of research in clinical trials, strongly influenced by the Declaration of Helsinki, is perceived from various quarters as too conservative and potentially restrictive of research that is seen as urgent and necessary. We examine this problem from the perspective of various challengers who argue for alternative approaches to what ought or ought not to be permitted. Key themes within this analysis will examine these claims and argue (...) they have implications for the interests of the research subject, research governance and regulation. Using our work with TREAT-NMD, the neuromuscular clinical trials network, we posit that there is a place for advancing the discourse of moral rights and moral duties in the context of research, especially from the perspective of patients and their families, and for including the politics of patient activism and empowerment. At the same time we remain vigilant to the danger that the therapeutic misconception and other serious vulnerabilities for the patient population in clinical trials, are at risk of being overlooked. Holton has drawn attention to a new semantic universal, according to which no natural language has contrafactive attitude verbs. Because factives are universal across natural languages, Holton’s universal is part of a major asymmetry between factive and contrafactive attitude verbs. We previously proposed that this asymmetry arises partly because the meaning of contrafactives is significantly harder to learn than that of factives. Here we extend our work by describing an additional computational experiment that further supports our hypothesis.

Gopal Sreenivasan’s “hybrid theory” states that a moral duty is directed toward an individual because her interests justify the assignment of control over the duty. An alternative “plain theory” states that the individual’s interests justify the duty itself. I argue that a strong moral status constraint explains Sreenivasan’s instrumentalization objection to a Razian plain theory but that his own model violates this constraint. I suggest how both approaches can be reformulated to satisfy the constraint, and I argue that a reformulated (...) plain theory can also avoid an insufficiency objection. Love—unconditional, selfless, unchanging, sincere, and totally accepting—is worshipped today as the West's only universal religion. To challenge it is one of our few remaining taboos. In this pathbreaking and superbly written book, philosopher Simon May does just that, dissecting our resilient ruling ideas of love and showing how they are the product of a long and powerful cultural heritage. Tracing over 2,500 years of human thought and history, May shows how our ideal of love developed from its Hebraic and (...) In considering the debate about the meaning of ‘disease’, the positions are generally presented as falling into two categories: naturalist, e.g., Boorse, and normativist, e.g., Engelhardt and many others. This division is too coarse, and obscures much of what is going on in this debate. I therefore propose that accounts of the meaning of ‘disease’ be assessed according to Hare’s (1997) taxonomy of evaluative terms. Such an analysis will allow us to better understand both individual positions and their inter-relationships. Most (...) importantly, it will show that it is unlikely that there is a single unique disease-concept at issue. Rather, different authors are, for the most part, considering different concepts. The first section examines Laclau's theory that the contest between universalism and particularism provides much of the philosophical background to political and social struggle, taking up the important place accorded to, amongst others, Hegel and Lacan in Laclau's work. There are generally two controversial issues over Kant's solution to the free will problem. One is over whether he is a compatibilist or an incompatibilist and the other is over whether his solution is a success. In this paper, I will argue, regarding the first controversy, that “compatibilist” and “incompatibilist” are not the right terms to describe Kant for his unique views on freedom and determinism; but that of the two, incompatibilist is the more accurate description. Regarding the second controversy, (...) I will argue that Kant's solution to the free will problem is not a success because his effort in making the effects of freedom part of the field of appearance has made his solution incoherent and ambiguous. Despite this, I argue that Kant's attempt to solve the free will problem is groundbreaking because he at least has separated freedom from the dominance of determinism. (shrink)

The proposal that there is an illusion of conscious will has been supported by findings that priming of stimulus location in a task requiring judgements of action-authorship can enhance participants’ experience of agency. We attempted to replicate findings from the ‘Wheel of Fortune’ task [Aarts, H., Custers, R., & Wegner, D. M. . On the inference of personal authorship: enhancing experienced agency by priming effect information. Consciousness and Cognition, 14, 439–458]. We also examined participants’ performance on this task in relation (...) to self-reported passivity experiences and hallucination-proneness. We found a significant effect of priming, with primes being found to increase the experience of agency. An interaction between gender and priming was also found, with priming enhancing feelings of agency in women but not in men. There were no significant correlations between levels of self-reported passivity experiences or hallucination-proneness and participants’ susceptibility to the priming effect on ratings of agency. Implications of these findings are discussed with regard to a prominent model of passivity experiences. (shrink)

Although the therapeutic misconception (TM) has been well described over a period of approximately 20 years, there has been disagreement about its implications for informed consent to research. In this paper we review some of the history and debate over the ethical implications of TM but also bring a new perspective to those debates. Drawing upon our experience of working in the context of translational research for rare childhood diseases such as Duchenne muscular dystrophy, we consider the ethical and legal (...) implications of the TM for parental consent to research. In this situation, it is potentially the parent who is vulnerable to TM. In our analysis we not only consider the context of informed consent for research but also the wider environment in which the value of research is promoted, more broadly through the media but also more specifically through the communication strategies of patient organizations. All dissemination about developments in research for health runs the risk of portraying an overly optimistic view of the promise of biotechnological solutions and has the potential to encourage a ‘collective’ TM. In this paper we consider the challenge that TM presents to parents as well as explore the ethical and legal responsibilities of researchers to ensure an appropriately informed consent: compatible with a hopeful disposition of parents who consent for the their children whilst avoiding a blind and misleading optimism. Adorno studied an extraordinary range of subjects during his lifetime – from dialectical logic and the syntax of poetry to newspaper astrology columns and the Hollywood studio system – and he left a significant mark on each of the many disciplines in which he worked. His philosophically sophisticated rethinking of Marxian materialism has been central to much (...) European and American social theory in the latter half of the twentieth century and his studies of mass culture, radio and television were foundational documents for the discipline of cultural studies. This collection charts the most important moments in the international reception of Adorno's thinking, covering the wide range of disciplines his studies touched upon, including literary criticism, musicology, aesthetics, epistemology and metaphysics. There is also a great deal of important scholarship and commentary on Adorno in German that remains untranslated into English. Sustainability as a narrative has mainstreamed, but practice is stuck in the ‘valley of death,’ with exemplary business action to internalize social and environmental externalities remaining ad hoc and small scale. Civil regulation has had significant impacts, but appears unable to act as a driver of systemic change. Addressing change at the system level requires the evolution of corporate governance away from intensive towards an extensive accountability, embedded within a ‘public fiduciary.’ Such a shift in fiduciary arrangements is needed to (...) institutionalize and leverage the growing involvement of the state in economic and industrial practice through direct enterprise ownership, the increasing importance of sovereign wealth funds and national development banks, and the significance of public-private partnerships. This re-emergence of the role of the state in economic governance will underpin the next generation of corporate responsibility, framed largely by an international political economy led by major emerging economies.
