This Commentary investigates ethical issues surrounding the US government’s attempt to partner with a private company to produce a new low-cost ventilator as part of its pandemic preparation plans. I argue that firms have distinct duties with respect to such public-private partnerships. In contrast to approaches that analyze these duties in terms of an “implicit morality” of the market, I analyze them in terms of democratically authorized plans regarding how to structure the market.

The “question of reasonable compliance” concerns how business firms should comply with morally reasonable laws that have been democratically enacted. This article argues that, out of respect for the governing authority of democratic citizens, firms should comply with the law in accordance with legislators’ normative expectations of compliance. It defends this view against arguments from the legal, economic and business ethics literatures that focus on the contentious nature of democracy and the competitive nature of the market. In response this (...) article argues that these adversarial features of democracy and capitalism do not limit the ability of democratic legislatures to set normative expectations of market actors, nor the duty of firms to comply with them. The ‘limits of markets’ debate broadly concerns the question of when it is (im)permissible to have a market in some good. Markets can be of tremendous benefit to society, but many have felt that certain goods should not be for sale (e.g., sex, kidneys, bombs). Their sale is argued to be corrupting, exploitative, or to express a form of disrespect. InMarkets without Limits, Jason Brennan and Peter Jaworski have recently argued to the contrary: For any good, as long as (...) it is permissible to give it for free, then it is permissible to give it for money. Their thesis has led to a number of engaging objections, and I leverage recent work on the nature of feasibility within political philosophy to offer a new challenge.I argue that feasibility offers a constraint on which markets can be permissibly implemented. Though it may be possible to create a morally acceptable version of an otherwise repugnant market, some of these markets may be infeasible, and so we are not permitted to implement them. After laying out this challenge, I consider several replies. They concern the relevance of feasibility, and whether any markets really are infeasible. This provides an opportunity to explore the dangers of pursuing the infeasible and with markets generally. I conclude by considering what might lead us to pursue these markets despite their infeasibility, or how knowledge of infeasibility may prove useful regardless. (shrink)

This paper begins with a brief review of evidence for migration to the relatively affluent city of Rome during the earlier Empire. Then it is suggested that most slaves coming to Rome at this time originated in the Greek East and that these slaves were volunteers not forcible captives. Slavery by contract made it possible for individuals to overcome credit constraints limiting their ability to borrow to finance training and migration. This view is tested by examining literary, epigraphic and archaeological (...) evidence to decide whether slave markets in the Greek East (at Acmonia, Ephesus, Magnesia on Meander, Thyatira and Delos) and in Rome itself were suitable for processing „dangerous merchandise“ (= forcible captives). The totality of the evidence suggests they were not. Near Easterners conveyed through local and Roman slave markets were probably willing self-sellers seeking economic advancement. A new, positive, light is cast on the role of slave dealers who profited from reallocating labor power from less to more productive uses. (shrink)

In defense of his Market Failures Approach to business ethics Joseph Heath relies on an understanding of business as essentially oriented towards competition and profit maximization. In these remarks I defend an alternative understanding of business that is centered on the creation of valuable goods and services. It is preferable because it: (a) creates less pressure to take advantage of vulnerable stakeholders, (b) can readily recognize “beyond compliance” norms that do not relate to efficiency, (c) provides a more meaningful (...) framework for people who work in and with corporations, (d) may mitigate negative moral impacts outside the market, and (e) better captures the range of what actually counts as business activity. Most business ethicists maintain that corporate actors are subject to a variety of moral obligations. However, there is a persistent and underappreciated concern that the competitive pressures of the market somehow provide corporate actors with a far-reaching excuse from meeting these obligations. Here, we assess this concern. Blending resources from the history of philosophy and strategic management, we demonstrate the assumptions required for and limits of this excuse. Applying the idea of ‘the state of nature’ from Thomas Hobbes, we (...) suggest that corporate actors would be excused from duties if complying with them threatened their vital interests. We show how this excuse is not available for most individuals within firms; instead, it is an excuse perhaps available to firms themselves, but only given substantive assumptions about corporate personhood. For those willing to make these assumptions, we apply the competitive advantage construct to delimit the scope of this excuse. We suggest that firms are excused from fulfilling an obligation when complying leads to a competitive disadvantage, as this imperils the firm’s vital interests. After revealing why this excuse does not generalize, we conclude by considering when we should reform the market to avoid the legitimacy of this excuse. (shrink)

The core of this article is a comparative analysis of the double movement of the late nineteenth and early twentieth century with the double movement of the late twentieth and early twenty-first century. In both periods the movement toward allegedly self-regulating markets called forth a countermovement of protection. Nevertheless, important differences exist due, first, to differences in the nature of the hegemonic state and, second, to the greater role of subordinate forces in constraining the movement toward self-regulating markets in the (...) late twentieth century. The unprecedented rise and fall in silver's price during 1979 and 1980 resulted in charges against the Hunt brothers of Dallas of monopolization and market manipulation, charges which led to a lengthy trial. This book focuses on the economic analysis used at this trial. Drawing upon interviews with the judge, jury, attorneys and expert witnesses, it investigates the elusive definition of manipulation in sophisticated markets, the difficulties of interpreting statistical evidence, the imprecision in calculating damages, the hidden assumptions (...) behind inferences concerning intent, and the hazards introduced when economic analysis enters complex litigation. The author concludes that these problems induce courtroom procedures to oversimplify the economic analysis and cause the law on market manipulation to be created retroactively. Yet the failure lies not with the legal institutions but with the futures exchanges who had not developed in advance the rules to minimize large-scale trading during the unusual price moves. The complexity of population ageing effect is a significant challenge at a regional and local level. Adaptation activities require the cooperation of local governments, business entities and non-governmental organizations. The article describes the dimensions of interventions, typology of “shrinking regions” and two initiatives: Regions for All Ages and SEN@ER - Silver Economy Network of European Regions. In addition, essay discusses the dilemmas of creating special regional strategies with their implementation factors and barriers in the construction of silver economies. (...) There is a phenomenon which has from of old and in a peculiar degree attracted the attention of social philosophers and practical economists, the fact of certain commodities (these being in advanced civilizations coined pieces of gold and silver, together subsequently with documents representing those coins) becoming universally acceptable media of exchange. It is obvious even to the most ordinary intelligence, that a commodity should be given up by its owner in exchange for another more useful to him. But (...) that every economic unit in a nation should be ready to exchange his goods for little metal disks apparently useless as such, or for documents representing the latter, is a procedure so opposed to the ordinary course of things, that we cannot well wonder if even a distinguished thinker like Savigny finds it downright 'mysterious.' It must not be supposed that the form of coin, or document, employed as current money, constitutes the enigma in this phenomenon. We may look away from these forms and go back to earlier stages of economic development, or indeed to what still obtains in countries here and there, where we find the precious metals in a uncoined state serving as the medium of exchange, and even certain other commodities, cattle, skins, cubes of tea, slabs of salt, cowrie shells, etc.; still we are confronted by this phenomenon, still we have to explain why it is that the economic man is ready to accept a certain kind of commodity, even if he does not need it, or if his need of it is already supplied, in exchange for all the goods he has brought to market, while it is none the less what he needs that he consults in the first instance, with respect to the goods he intends to acquire in the course of his transactions. And hence there runs, from the first essays of reflective contemplation of a social phenomena down to our own times, an uninterrupted chain of disquisitions upon the nature and specific qualities of money in its relation to all that constitutes traffic.. It is only now, with the rise of digitalization and the near-obsolescence of traditional technology, that we are becoming fully aware of the distinctive character of analogue photography. This owl-of-Minerva-like appreciation of the analogue has prompted photographic art practices that mine the medium for its specificity. Indeed, one could argue that analogue photography has only recently become a medium in the fullest sense of the term, for it is only when artists refuse to switch over to digital photographic technologies that (...) the question of what constitutes analogue photography as a medium is self-consciously posed. While the benefits of digitalization—in terms of accessibility, dissemination, speed, and efficiency—are universally acknowledged, some people are also beginning to reflect on what is being lost in this great technological revolution. In this context, artists' use of analogue film and the revival of early photographic techniques should be regarded as timely interventions, although these may strike some as anachronistic. This essay does not attempt an ontological inquiry into the essential nature of the analogue; rather, it is an effort to articulate something about the meaning of analogue photography as an artistic medium for contemporary artists by paying close attention to its meaning and stakes for particular artists. Instead of presenting a general survey, I want to consider the work of just two artists, Zoe Leonard and Tacita Dean, both of whose work is concerned with what is being lost. As Leonard put it: “New technology is usually pitched to us as an improvement. … But progress is always an exchange. We gain something, we give something else up. I'm interested in looking at some of what we are losing.”1 Tellingly, both artists have produced exhibitions simply called Analogue. Leonard gave the title to a large project she did between 1998 and 2009 consisting of 412 silver gelatin and c-prints of local shop fronts in lower Manhattan and poor market stalls around the world.2 Dean used it for a 2006 retrospective exhibition of her films, photographs, and drawings. The paper contrasts the economic, ethical, and organizational differences in the U.S. and Europe, as well as the differences in governance and leadership between U.S. and European managers, and how these differences impact decision-making and governance of U.S. and European businesses. In addition, the paper explores and contrasts select ethical and cultural issues between managers on both sides of the Atlantic. It is the authors' view that on both sides of the Atlantic we embrace the call for more ethics in (...) our lives and we expect it from our business leaders and our business dealings. However, in the markets we consistently have seen a short-term orientation of corporate outcomes. It is hoped that there will be a silver lining to the current economic crisis that will help move us away from this position which makes things like ethics, long-term virtues, fairness, all nice to talk about but somewhat estranged from the realities that are practiced in businesses. It remains to be seen if U.S. organizations, business schools and business leaders will change this current position more rapidly than in Europe. The authors are confident, however, that businesses and governments on both sides of the Atlantic will make all efforts for a pronounced transition to integrate ethics into the real strategic thrusts of conducting business. Using an eighth-century copy of the 60-fascicle Flower Ornament Sutra as a case study, this article examines the transformation of a Buddhist scripture into an aesthetic object in early modern Japan. On the 14th day of the second month, 1667, a fire decimated Nigatsudo at Todaiji (Nara prefecture) along with most of the sacred objects within. Clerics salvaged partially burnt scrolls of an eighth-century Flower Ornament Sutra done in silver ink on indigo-dyed paper. The scrolls were restored ten years (...) later, but by the first half of the eighteenth century, part of the set left the temple and began circulating in the art market as collectable calligraphy fragments, later known as the “Nigatsudo burnt sutra” (Nigatsudo yakegyo). This study traces the curious shift in the attribution of Nigatsudo yakegyo’s calligrapher that took place in the eighteenth century to consider how the burn marks impacted the transformation of this scripture from a devotional text into a collectable artefact. I argue that the curious switch in attribution occurred adhering to the popular imagination of the calligraphers, as well as the distinct role certain fragments played within the early-modern calligraphy collecting culture. It appears likely that at its peak the classical economy was almost as large as that of Western Europe during the Industrial Revolution. The following review of the archeological and document evidence indicates that three events occurring in the first half of the first millennium BC trigger the emergence of a specialized and integrated classical economy after 500 BC: (i) growth in demand for silver as a medium of exchange in economies in the Near East; (ii) technical breakthroughs in (...) hull construction and sailing rig in merchant shipping of the late Bronze Age; (iii) perfection of ferrous metallurgy into the European hinterland. This last event raised agricultural productivity to a level capable of supporting the occupational specialization needed to sustain a vigorous trading economy. To these initial causes may be added the diffusion of alphabetic writing. While it did not create opportunities for long-distance trade, the diffusion of writing supplied the means of responding on a scale large enough economically to matter. (shrink)

Population ageing is one of the key processes affecting the development of European Union countries. The aim of this paper is an indication of the possibility of collective action against this challenge at the regional level. Article describe assumptions and recommendations for strategic management which taking into account the cooperation of entities from public sector (local governments), market sector (business) and social sector (NGOs). Closer analyses will be conducted on two examples of initiatives from European Union: the Regions for (...) Medieval coin plays an essential role in the imagined history of money: it figures as the primal "commodity money" — a natural medium, spontaneously adopted by parties in exchange who converge upon a metal like silver to represent the value of other goods. As a natural medium with a price objectively established through trade, commodity money appears to offer an independent means of measure in the market. But as the history offered here reveals, medieval money was nothing like (...) its imagined alternative. England’s early coin became a medium when the government began to spend and tax in that unit of account, took coin as a mode of payment, and allowed it to be transferred between people in the meantime. Individuals participated in the arrangement, paying for coin in exchange for the unique quality — liquidity — that set money apart from a commodity. That quality was orchestrated by the very channels that brought public and private together in the project of making a medium. In fact, insofar as the English equated money with the commodity it contained, they engineered instability into the heart of their medium. Depreciating coin — diluting its commodity content — offered a cure. It also confirmed that coin had never been the "commodity money" imagined in later accounts. Coin was, instead, a constitutional medium, one that related the government to its participants and thus helped to configure the world it appeared merely to measure. (shrink)

Celem artykułu jest przybliżenie koncepcji solidarności pokoleń w kontekście wyzwań procesu starzenia się ludności na początku XXI wieku. Utrzymanie pozbawionych konfliktów relacji pokoleniowych jest kwestią wymagającą wspólnych interwencji podmiotów publicznych, komercyjnych i pozarządowych. Dlatego też w opracowaniu, po omówieniu znaczeń pojęcia pokolenie i typów relacji międzypokoleniowych, zostaną wskazane modele polityki relacji międzypokoleniowych. Opis uwzględnia działania na poziomie międzynarodowym, krajowym oraz regionalnym i lokalnym. W dalszej części analizie poddane zostaną główne założenia działań na rzecz solidarności pokoleniowej z wybranych dokumentów projektu cywilizacyjnego (...) "Polska 2030. Trzecia fala nowoczesności". Podsumowanie obejmie rekomendacje praktyczne i badawcze w zakresie polityki rodzinnej i rynku pracy. * The aim of this article is to introduce a concept of "solidarity of generations" in the context of challenges of population ageing at the beginning of the XXI century. Maintaining relationships without generational conflict is a matter requiring joint intervention of public, market and social sectors entities. After the discussion of generation meaning and types of relationships between generations, intergenerational policies models were identified. The description included activities at the international, national, regional and local levels. Later in the article activities assumptions for the solidarity of generations included in the selected documents of civilization project "Poland 2030. The Third Wave of Modernity" were critically analyzed of the main approaches. Conclusions provided recommendations for practical action and further research. (shrink)

Gerald Dworkin has argued that it is inconsistent with the proper ends of medicine for a physician to participate in an execution by lethal injection. He does this by proposing a principle by which we are to judge whether an action is consistent with the proper ends of medicine. I argue: (a) that this principle, if valid, does not show that it is inconsistent with the proper ends of medicine for a physician to participate in an execution by lethal injection; (...) and (b) that this principle is not valid, and this is because it mistakenly views the promotion of patient autonomy as one of the proper ends of medicine. Rather, I propose, we should view respect for a patient's autonomy as a constraint on the pursuit of the proper ends of medicine, rather than as one of the proper ends itself. With this revised understanding of the proper ends of medicine, we can conclude that it is inconsistent with the proper ends of medicine for a physician to participate in an execution by lethal injection. We take ourselves to be able to omit to perform certain actions and to be at times responsible for these omissions. Moreover, omissions seem to have effects and to be manifestations of our agency. So, it is natural to think that omissions must be events. However, very few people writing on this topic have been willing to argue that omissions are events. Such a view is taken to face three significant challenges: (i) omissions are thought to be somehow problematically negative, (...) (ii) it is unclear where the event of an omission would be located, and (iii) if we accept any omissions as events, it seems like there would be far too much causation involving them. In this paper, I develop a novel view of omissions as events and as actions that provides answers to these challenges. (shrink)

Whether the food movement is most likely to transform the food system through ‘alternative’ or ‘oppositional’ initiatives has been the focus of considerable scholarly debate. Alternative initiatives are widespread but risk reinforcing the conventional food system by supporting neoliberal discourse and governance mechanisms, including localism, consumer choice, entrepreneurialism and self-help. While oppositional initiatives such as political advocacy have the potential for system-wide change, the current neoliberal political and ideological context dominant in Canada poses difficulties for initiatives that explicitly oppose the (...) conventional food system. As such, some argue that the food movement requires convergence between alternative and oppositional initiatives. In this paper, we investigate convergence using survey results from 143 food movement organizations in four Canadian provinces. Results based on cluster analysis and descriptive statistics on organizational discourse, activities and visions of sustainable food systems demonstrate convergence around neoliberal discourse and governance mechanisms. Localism and consumer education characteristics are particularly prominent, with a majority of respondents describing their organizations as ‘local’, engaging in consumer education activities, and stating the importance of consumer education activities, indicating convergence around alternative, rather than oppositional, initiatives. While convergence around these discourse and strategies may limit the transformative potential of the food system when interpreted as neoliberalisation of the movement, such a reading does not demonstrate their full potential, as survey results also indicate trends of transformative visions of change and political engagement, particularly at the municipal level. This research demonstrates that the movement can work simultaneously within, and opposed to, the conventional food system, and provides understanding of both neoliberal leanings and the politics of the possible of the food movement. The problem of the time of a killing concerns exactly when and where to locate our actions. It is a problem for many of our actions beyond killing, and there are versions of the problem that can be raised no matter where your theory locates actions in particular. To answer the problem, I claim that we should be guided to the referent of ‘the killing’ by examining the definition of ‘to kill.’ Once we have the correct definition, we can see (...) that there are several candidate events that might be the referent of ‘the killing,’ but that the definition does not determine which of them is the referent. So, I argue that it is indeterminate or vague which event is ‘the killing.’ This solution is general across many action verbs, appeals to a minimally controversial type of vagueness, avoids the unintuitive results of views that determinately locate killings, and is compatible with different views about the location of actions. In the concluding section, I show how appealing to vagueness is distinct from and superior to appealing to ambiguity. (shrink)

The potential power of predictive genetic testing as a risk regulator is impressive. By identifying asymptomatic individuals who are at risk of becoming ill, predictive genetic testing may enable those individuals to take prophylactic measures. As new therapies become available, the usefulness of genetic testing undoubtedly will increase. Further, when a person's family medical history indicates a propensity towards a particular genetic disease, a negative test result may open up otherwise denied opportunities by showing that this person has not inherited (...) suspect genes. In the latter type of case, a negative test result may reassure the individual that pursuing a particular course of action is worthwhile, or may convince prospective employers that the individual will be a serviceable employee. Liberalism welcomes diversity in substantive ideas of the good but not in the process whereby these ideas are formed. Ideas of the good acquire weight on the presumption that each is a person's own, formed independently. But people differ in their capacities to conceptualize. Some, appropriately characterized as cerebral, are proficient in and profoundly involved with conceptualizing. Others, labeled cognitively disabled, range from individuals with mild limitations to those so unable to express themselves that we cannot be sure whether their (...) behavior is mediated by concepts at all. Constricted cognitive capacities have been thought to prevent participation in the prescribed process for forming personalized ideas of the good. So liberal theory, when formulating principles and practices of justice, often disregards cognitively disabled peoples' perspectives. We put aside metaphysically driven notions about personhood and show how interpersonal processes of “prosthetic” thinking (different from surrogacy) can satisfy liberalism's standards, positioning cognitively disabled individuals as fully participating subjects of justice. The distinction between sense and nonsense is central to Wittgenstein's philosophy. It is at the basis of his conception of philosophy as a struggle against illusions of sense generated by misunderstandings of the logic of our language. Moreover, it informs the notions of “grammar” and “logical syntax”, whose investigation serves to clear up those misunderstandings. This Element contrasts two exegetical approaches: one grounding charges of nonsensicality in a theory of sense specifying criteria that are external to the linguistic performance under (...) indictment; and one rejecting any such theory. The former pursues the idea of a nonsensicality test; the latter holds that illusions of sense can only be overcome from within, through the very capacity of which they constitute defective exercises. The Element connects the two approaches to opposite understandings of Wittgenstein's conception of language, and defends a version of the second approach. (shrink)

Computer-supported collaborative learning has a history of being interdisciplinary from its conception. Its beginnings have included computer scientists, psychologists, cognitive scientists, and educational researchers. These collaborations have been fruitful but have also posed challenges. This article builds on the authors’ extensive review of the CSCL literature to examine the nature of interdisciplinary collaboration in CSCL research as well as an interdisciplinary CSCL workshop. Using a corpus of more than 700 CSCL articles, we reported an updated analysis for the theories and (...) methods used in CSCL research. In addition, bibliometric analyses examined journals that publish CSCL research and are cited by CSCL research. CSCL research is published in journals that are aligned with interdisciplinary research with large contributions from educational research followed by technology related fields and social sciences. The contributions from domain knowledge journals are relatively weak. These analyses revealed disciplinary influences and uptakes of CSCL research and how they might differ across CSCL research clusters. Lastly, we provide a case example of a CSCL workshop to further demonstrate the interdisciplinary nature of the field. Through these analyses we aim to characterize the benefits and challenges of interdisciplinary collaboration in CSCL research. Interdisciplinarity has helped CSCL research to adopt multiple theories and methods to understand CSCL. While cultivating diversity, we also need to be mindful that research outcomes are exchanged and appropriated actively across participating disciplines so that our understanding of CSCL rises above individual disciplines. This article examines the way that for-profit businesses should take into account the interests of the citizens in the liberal democratic societies in which they operate. I will show how a contractualist version of stakeholder theory identifies the relevant moral interests of both shareholders and citizen stakeholders, and provides a method for giving their interests appropriate consideration. These include (1) the interests that individuals have with respect to private property, (2) the interests citizens have in receiving equitable consideration in the (...) political process, and (3) citizens' interests which give them the collective right to determine the legal and economic structure of their societies. Using this contractualist analysis, I argue that corporations should consciously take into account the interests of citizen stakeholders when there is no other social mechanism for protecting their interests as citizens.
