The ‘best interests’ standard is a highly seductive standard in English law. Not only does it appear to be fairly uncontroversial but it also presents as the most sensible, objective and ‘fair’ method of dealing with decision making on behalf of those who are perceived to be the most vulnerable within society. This article aims to provide a critical appraisal of how the standard has been applied within family law, to outline how the standard is to be applied within healthcare (...) law and, finally, to assess the relevance of the family law experience of the best interests standard to the operation of the standards as envisaged by the MCA. This article comments briefly on three specific issues in Shazia Choudhry’s paper “‘Best Interests’ What can healthcare law learn from family law?” The three issues are: (1) the implications of ‘best interests’ and ‘welfare science’ for women within the family law and the health care law context, (2) the risk of capture by the ‘welfare science’ industry, and (3) the proposal that a committee of medical experts and medical ethicists should be set up to provide reports to the (...) Court of Protection on cases brought under the Mental Capacity Act 2005 (MCA). I argue that the risk of capture by ‘welfare science’ is equally large in health care law and that a committee of the kind envisaged by Choudhry is unlikely to contribute significantly to conflict resolution under the MCA. Drawing on conservation of resources (COR) theory, this study examined the underlying mechanism through which workplace bullying (WB) affects employees’ life satisfaction via job-related anxiety and insomnia. Time-lagged data were collected at two points in time from 211 doctor interns working in various hospitals in Pakistan. Our results fully supported a proposed serial multiple-mediator model. Workplace bullying was indirectly related to life satisfaction via job-related anxiety and insomnia. This study provides evidence of a spillover effect as to how workplace bullying (...) increases employees’ job-related anxiety which in turn leads to insomnia resulting in reduced employees’ life satisfaction. The present study extends research on workplace bullying to display its theoretical as well as empirical effects on life satisfaction. It demonstrates that workplace bullying as an occupational and psychological stressor has multiple effects on employees’ life satisfaction through a serial mediation model in the context of a developing country. It further explains that workplace bullying not only affects an employee’s workplace behaviors but also extends to the employee’s overall life satisfaction. (shrink)

This study investigates the connection between following Islamic work ethics (IWE) and workplace deviance, and explores the role of perceived organizational politics as a mediator and the impact of incivility initiated by supervisors as a second-stage moderator. Data were collected via a two-wave survey of 205 professionals in various industries. Results show that those who adhere to IWE exhibit a negative link to workplace deviance, as they have less involvement in organizational politics. The study also finds that incivility initiated by (...) supervisors intensifies the positive relationship between perceived organizational politics and workplace deviance. Interestingly, the study shows that the effect of IWE in reducing workplace deviance through organizational politics is stronger when incivility is high. The findings offer valuable insights for organizations on the positive impact of adhering to IWE on reducing perceived organizational politics and workplace deviance. (shrink)

The recent review of the Unrelated Live Transplant Regulatory Authority provides administrative and statistical information regarding living donor kidney transplantation in the United Kingdom.1 However, it leaves much unsaid. For example, although the report does mention the number of live kidney donations from unrelated donors that ULTRA has approved, it fails to mention that the United Kingdom has a low live kidney donation rate compared with other European countries .2 More importantly, the report does not address the fundamental question of (...) whether the legal framework underlying ULTRA is morally justified. The legal regime in the United Kingdom proceeds on the tacit assumption that genetically unrelated donors are much more vulnerable to coercion than are related donors, and hence are more in need of protective regulation. For the purpose the sample contained 150 staff of private and public universities of Islamabad. The data collection was carried out through Minnesota Questionnaire as a tool of job satisfaction. The sampling techniques of proportional, stratified sampling was selected. The data was analyzed (...) through quantitative method by using the SPSS 21 st edition named as Statistical Package for social science. The results were reflected by using independent samples t-test. According to the study's findings the hygiene factor has significant impact on job satisfaction of participants with reference to Salary, Status, Work Conditions, Interpersonal Relationship with Subordinates and Possibility for Personal Growth besides motivational elements such as recognition and achievement. Madhav Khosla’s brilliant book, India’s Founding Moment, is self-consciously a work on the history of ideas. Nonetheless, the subtitle of India’s Founding Moment—The Constitution of a Most Surprising Democracy—implies that Khosla draws a connection between the ideas that shaped the creation of constitutional democracy in India and its endurance. In this review, I pose the question of whether the design of the Constitution can be a source of constitutional resilience against the rising threat of authoritarianism and Hindu majoritarianism.

In this paper, we have introduced such matrices that have multiple layers and clusters of layers to portray multi-dimensional data or massively dispersed information of the plithogenic universe made up of numerous subjects their attributes, and sub-attributes. The judgment of the Supreme Court of Canada in the Quebec Secession Reference has produced a torrent of public commentary. Given the fundamental issues about the relationship between law and politics raised by the judgment, what is remarkable is that that commentary has remained almost entirely in a pragmatic perspective, which asks how positive politics entered into the motivations and justifications of the Court, and looks at the results in terms of their political consequences, without deep or sustained reflection on (...) the ultimate grounds for the role the Court took upon itself, or on the normative sources of its reasoning. In this article, we explore the Quebec Secession Reference through the lens of constitutional theory. In particular, we highlight three unconventional aspects of the Court’s reasoning: (a) the supplementation of the written constitution through an explicit process of amendment-like interpretation to craft a new legal framework governing the secession of a province from Canada, (b) the vesting by the Court of substantial, if not exclusive responsibility for interpreting the constitutional rules on secession in particular situations or contexts with political organs, not the courts, and (c) the ascent by the court to abstract normativity, in articulating a normative vision of the Canadian constitutional order, whence it derived the legal framework governing secession. In addition to drawing attention to these unusual aspects of the judgment, we articulate the theoretical justifications that both explain and justify those features of the judgment, and identify issues for future discussion. The migration of constitutional ideas across jurisdictions is one of the central features of contemporary constitutional practice. The increasing use of comparative jurisprudence in interpreting constitutions is one example of this. In this 2007 book, leading figures in the study of comparative constitutionalism and comparative constitutional politics from North America, Europe and Australia discuss the dynamic processes whereby constitutional systems influence each other. For physicians, though, the specter of malpractice liability can overshadow the marvel of practicing in this era. Many physicians are working in a volatile liability environment; they face spiraling costs for malpractice insurance, have difficulties purchasing liability coverage at any price, and see record payouts in a growing number of claims against their colleagues. The present study explores the influence of challenge stressors on identity orientation directly and via thriving at work and employee investment. Drawing on the broaden–and–build theory of positive emotions, this study proposes challenge stressors as a critical predictor of identity orientation. The purpose of this article is to explore if a particular identity is salient in different contextual factors, and this study suggests that challenge stressors stimulate personal, relational, and collective identities to respond to a situation. The relationships hypothesized in (...) this study were tested using a sample of 225 employees from the banking sector of Pakistan. A time-lagged research design consisting of two waves of data collection was employed. A structural equation modeling technique was used to test the hypotheses regarding the relationship between challenge stressors and identity orientation, including the role of thriving at work and employee investment as intervening mechanisms of this relationship. Results showed that challenge stressors had a significant positive relationship with identity orientation. The results also confirmed the sequential mediation of thriving at work and employee investment in the relationship between challenge stressors and identity orientation. The findings suggest that the positive side of stress as a strength motivates employees for continued self-development. Importantly, challenge stressors enhance employees’ ability to thrive at work and, in turn, they invest in the work more and identify themselves strongly with their organization and work. (shrink)

The role of digitization and globalization have changed consumers’ online buying behaviors, specifically in the times of the COVID-19 pandemic crisis. This seriously influences the online retail industry in developing countries that are already struggling to move toward digital trading through e-business. Pakistan being a developing country is no exception, and it is, therefore, pertinent to examine factors that contribute to digital trading. Employing theories of reasoned action and the technology acceptance model, this study aims to investigate how personal innovativeness (...) and perceived usefulness impact consumers’ online purchase intentions through a serial mediational model. The data were collected through an online survey from 410 respondents. Structural Equation Modeling was used to test the proposed model. This study showed significant results for the direct effect of personal innovativeness and perceived usefulness on online purchase intentions as well as the indirect serial effect via internet browsing and attitude toward online purchasing. The study results have some important practical implications for selling firms, especially in the times of COVID-19. The study suggests that online retailers should be more responsive to the aforementioned factors to facilitate consumers to spend more time browsing, which influences consumers’ interest and intention to make online purchases. As the social distancing and lockdown approaches were implemented in Pakistan and other parts of the world, the trend toward online purchases has increased. Due to this shift in the overall purchasing behavior of consumers and the potential for strong growth in e-commerce, organizations need to consider the post-COVID situation to expand their business in an online platform for addressing the future pandemic crisis. The number of scientific publications is growing exponentially. Research articles cite other work for various reasons and, therefore, have been studied extensively to associate documents. It is argued that not all references carry the same level of importance. It is essential to understand the reason for citation, called citation intent or function. Text information can contribute well if new natural language processing techniques are applied to capture the context of text data. In this paper, we have used contextualized word embedding (...) to find the numerical representation of text features. We further investigated the performance of various machine-learning techniques on the numerical representation of text. The performance of each of the classifiers was evaluated on two state-of-the-art datasets containing the text features. In the case of the unbalanced dataset, we observed that the linear Support Vector Machine achieved 86% accuracy for the “background” class, where the training was extensive. For the rest of the classes, including “motivation,” “extension,” and “future,” the machine was trained on less than 100 records; therefore, the accuracy was only 57 to 64%. In the case of a balanced dataset, each of the classes has the same accuracy as trained on the same size of training data. Overall, SVM performed best on both of the datasets, followed by the stochastic gradient descent classifier; therefore, SVM can produce good results as text classification on top of contextual word embedding. Drinking kills a significant proportion of individuals every year, particularly in low-income communities. An impulsive differential equation system is used to explore the effectiveness of activated charcoal in detoxifying the body after methanol poisoning. Our impression of activated charcoal is shaped by the fractional dynamics of the problem, which leads to speedy and low-cost first aid. The adsorption capacity of activated charcoal is investigated using impulsive differential equations. The ABC fractional operator’s findings paint a more realistic image of first aid (...) in public and primary health centers, which can assist to reduce methanol poisoning deaths. To avoid exorbitant and extensive laboratory experiments, QSPR analysis, based on topological descriptors, is a very constructive statistical approach for analyzing the numerous physical and chemical properties of compounds. Therefore, we presented some new entropy measures which are based on the sum of the neighborhood degree of the vertices. Firstly, we made the partition of the edges of benzene derivatives which are based on the degree sum of neighboring vertices and then computed the neighborhood version of entropies. Secondly, we made (...) use of the software SPSS for developing a correlation between newly introduced entropies and the physicochemical properties of benzene derivatives. Our obtained results demonstrated that the critical temperature C T, critical pressure C P, and critical volume C V can be predicted through fifth geometric arithmetic entropy, second S K entropy, and fifth N D entropy, respectively. Other remaining physical characteristics include Gibb’s energy qℰ, log P, molar refractivity ℳℛ, and Henry’s law ℋℒ that can be predicted by using sixth N D entropy. (shrink)

In this paper, we investigate the numerical solution of the coupled fractional massive Thirring equation with the aid of He’s fractional complex transform. This study plays a significant aspect in the field of quantum physics, weakly nonlinear thrilling waves, and nonlinear optics. The main advantage of FCT is that it converts the fractional differential equation into its traditional parts and is also capable to handle the fractional order, whereas the homotopy perturbation method is employed to tackle the nonlinear terms in (...) the coupled fractional massive Thirring equation. An example is illustrated to present the efficiency and validity of the two-scale theory. The solutions are obtained in the form of series with simple and easy computations which confirm that the present approach is good in agreement and is easy to implement for such type of complex systems in science and engineering. In this analysis, we develop a new approach to investigate the semianalytical solution of the delay differential equations. Mohand transform coupled with the homotopy perturbation method is called Mohand homotopy perturbation transform method and performs the solution results in the form of series. The beauty of this approach is that it does not need to compute the values of the Lagrange multiplier as in the variational iteration method, and also, there is no need to implement the convolution theorem as in (...) the Laplace transform. The main purpose of this scheme is to reduce the less computational work and the error analysis of the problems than others studied in the literature. Some illustrated examples are interpreted to confirm the accuracy of the newly developed scheme. (shrink)
