A recent Massachusetts bill seeks to incentivize living organ donation among the state’s incarcerated population by offering volunteers reduced sentences. While the incentive has been removed from the bill, the bill remains controversial. This essay argues that insofar as carceral conditions unduly motivate incarcerated people to participate, living organ donation in prison remains a morally hazardous initiative. The essay suggests that the pervasiveness of medical neglect in Massachusetts prisons not only makes organ donation unsafe but it also implicitly renders the (...) lives of those outside of prison more valuable than those inside. This falls short of Catholic teaching on human dignity. Drawing from the history of medical experimentation in US prisons, the essay posits how the state might unduly influence incarcerated people to become living donors by preying on their moral sentiments. In such instances, the self-gift of organ donation can be understood as a kind of exploited or coerced kenosis. (shrink)

We characterize, more precisely than before, what Rawls calls the “analytical” method of drawing up a list of basic liberties. This method employs one or more general conditions that, under any just social order whatever, putative entitlements must meet for them to be among the basic liberties encompassed, within some just social order, by Rawls’s first principle of justice (i.e., the liberty principle). We argue that the general conditions that feature in Rawls’s own account of the analytical method, which employ (...) the notion of necessity, are too stringent. They ultimately fail to deliver as basic certain particular liberties that should be encompassed within any fully adequate scheme of liberties. To address this under-generation problem, we provide an amended general condition. This replaces Rawls’s necessity condition with a probabilistic condition and it appeals to the standard liberal prohibition on arbitrary coercion by the state. We defend our new approach both as apt to feature in applications of the analytical method and as adequately grounded in justice as fairness as Rawls articulates the theory’s fundamental ideas. A summary of the philosophical literature on trust.

The power of new medical technologies, the cultural authority of physicians, and the gendered power dynamics of many patient-physician relationships can all inhibit women's reproductive freedom. Often these factors interfere with women's ability to trust themselves to choose and act in ways that are consistent with their own goals and values. In this book Carolyn McLeod introduces to the reproductive ethics literature the idea that in reproductive health care women's self-trust can be undermined in ways that threaten their autonomy. (...) Understanding the importance of self-trust for autonomy, McLeod argues, is crucial to understanding the limits on women's reproductive freedom. -/- McLeod brings feminist insights in philosophical moral psychology to reproductive ethics, and to health-care ethics more broadly. She identifies the social environments in which self-trust is formed and encouraged. She also shows how women's experiences of reproductive health care can enrich our understanding of self-trust and autonomy as philosophical concepts. The book's theoretical components are grounded in women's concrete experiences. The cases discussed, which involve miscarriage, infertility treatment, and prenatal diagnosis, show that what many women feel toward themselves in reproductive contexts is analogous to what we feel toward others when we trust or distrust them. -/- McLeod also discusses what health-care providers can do to minimize the barriers to women's self-trust in reproductive health care, and why they have a duty to do so as part of their larger duty to respect patient autonomy. In Political Theology the "Modern Way": The Case of Jacques Almain (d. 1515), Shaun Retallick provides the first monograph on this late medieval philosopher-theologian and conciliarist, and his thought. He demonstrates that Almain's political theology, of which ecclesiology is a sub-discipline, is strongly impacted by the Via moderna. At the heart of his political theology is the individual and his or her will. Yet, the individual is rarely viewed in isolation from others; there is a strong emphasis on community (...) and on the religious and secular bodies through which it is realized. But these bodies, including the Church, are understood in collectivist rather than corporatist terms, which tends to a quite radical form of conciliarism. (shrink)

Sentimental Rules is an ambitious and highly interdisciplinary work, which proposes and defends a new theory about the nature and evolution of moral judgment. In it, philosopher Shaun Nichols develops the theory that emotions play a critical role in both the psychological and the cultural underpinnings of basic moral judgment. Nichols argues that our norms prohibiting the harming of others are fundamentally associated with our emotional responses to those harms, and that such 'sentimental rules' enjoy an advantage in cultural (...) evolution, which partly explains the success of certain moral norms. This has sweeping and exciting implications for philosophical ethics. Nichols builds on an explosion of recent intriguing experimental work in psychology on our capacity for moral judgment and shows how this empirical work has broad import for enduring philosophical problems. The result is an account that illuminates fundamental questions about the character of moral emotions and the role of sentiment and reason in how we make our moral judgments. The fungal cell wall is a dynamic structure that protects the cell from changes in osmotic pressure and other environmental stresses, while allowing the fungal cell to interact with its environment. The structure and biosynthesis of a fungal cell wall is unique to the fungi, and is therefore an excellent target for the development of anti‐fungal drugs. The structure of the fungal cell wall and the drugs that target its biosynthesis are reviewed. Based on studies in a number of fungi, (...) the cell wall has been shown to be primarily composed of chitin, glucans, mannans and glycoproteins. The biosynthesis of the various components of the fungal cell wall and the importance of the components in the formation of a functional cell wall, as revealed through mutational analyses, are discussed. There is strong evidence that the chitin, glucans and glycoproteins are covalently cross‐linked together and that the cross‐linking is a dynamic process that occurs extracellularly. Using a longitudinal case study design, we have tracked the recovery of motor function following severe traumatic brain injury (TBI) through a multimodal neuroimaging approach. In 2006, Canadian Soldier Captain (retired) Trevor Greene (TG) was attacked with an axe to the head while on tour in Afghanistan. TG continues intensive daily rehabilitation, which recently included the integration of physical therapy (PT) with neuromodulation using translingual neurostimulation (TLNS) to facilitate neuroplasticity. Recent findings with PT+TLNS demonstrated that recovery of motor function occurred (...) beyond conventional time limits, currently extending past 14-years post-injury. To investigate whether PT+TLNS similarly resulted in associated cognitive function improvements, we examined event-related potentials (ERPs) with the brain vital signs framework. In parallel with motor function improvements, brain vital signs detected significant increases in basic attention (as measured by P300 response amplitude) and cognitive processing (as measured by contextual N400 response amplitude). These objective cognitive improvements corresponded with TG’s self-reported improvements, including a noteworthy and consistent reduction in ongoing symptoms of post-traumatic stress disorder (PTSD). The findings provide valuable insight into the potential importance of non-invasive neuromodulation in cognitive rehabilitation, in addition to initial indications for physical rehabilitation. Educational pressures such as challenging workload, demanding deadlines and competitiveness among undergraduate dental students erode academic integrity in clinical training. The implementation of honour codes have been associated with the reduction in academic dishonesty.An action research was undertaken to investigate and foster academic integrity through creative pedagogical strategies and the implementation of an honour code within the undergraduate dental programme.Students reported the honour code as relevant and it encouraged the five investigated fundamental values of academic integrity. The students also favoured (...) the annual implementation of the honour code. The creative pedagogical strategy facilitated a change in perception on academic integrity in the clinical scenarios sessions. Most students showed changes in perception of academic integrity. The majority of students’ narratives/responses were positive and the emerging subthemes also espoused the five out of the six ICAI fundamental values of academic integrity. Students indicated the need for inclusion of academic integrity education within the curriculum. They felt that staff also should be guided by an academic integrity policy.Implementation of an honour code coupled with creative pedagogical strategies helped to foster understanding and appreciation for academic integrity. Conversely the honour code implementation was more effective due to the use of supportive creative pedagogical strategies on academic integrity. This new introduction by Shaun Gallagher gives students and philosophers not only an excellent concise overview of the state of the field and contemporary debates, but a novel way of addressing the subject by looking at the ways in which phenomenology is useful to the disciplines it applies to. Gallagher retrieves the central insights made by the classic phenomenological philosophers (Husserl, Heidegger, Merleau-Ponty, Sartre, and others), updates some of these insights in innovative ways, and shows how they directly relate (...) to ongoing debates in philosophy and psychology. Accounts of phenomenological methods, and the concepts of intentionality, temporality, embodiment, action, self, and our ability to understand other people are integrated into a coherent contemporary statement that shows why phenomenology is still an active and vital philosophical approach. Each chapter begins with a discussion of the classic analyses and then goes on to show their relevance to contemporary debates in philosophy about embodied, enactive and extended approaches to our understanding of human experience. Despite being a common phenomenon with significant consequences on our everyday life, strikes (and direct actions in general) are still relatively undertheorized in the philosophical literature. Our paper has a specific focus that is best encapsulated in a question: What is the relationship between liberalism and the right to strike? Liberalism’s cornerstone is the idea that rights and liberties of individuals are of supreme political importance. Rights and liberties, however, are not created equal. The basic liberties are those that are (...) so politically important that legal restrictions upon them are unjustified unless to protect other basic liberties within an overall scheme of liberties, such as under a bill of rights. So, our question becomes: Is the right to strike a basic liberty? Two ongoing disputes are relevant here. The ‘older’ debate concerns the status of economic liberties and their relation to the right to strike. We will focus on a ‘newer’ discussion because it poses a challenge to liberalism itself. Namely, some ‘radical’ critics of liberalism (Gourevitch, Raekstad and Rossi) have argued that there are rights that involve coercing others, exercised during strikes or engagement in other direct action, that do not qualify as liberal basic liberties and that can sometimes take normative precedence over the liberal basic liberties. This criticism, if correct, defeats liberalism. Notice, though: since the weighing of different particular basic liberties against each other in an overall scheme of liberty is integral to high liberalism, the genuine threat that the radical critique poses stems not from the second conjunct (which its proponents have defended) but from its first (which they have merely assumed). For, if (contrary to what the radical work assumes) the right to engage in coercive strike action is a liberal basic liberty then it can, at least in principle, win out over other basic liberties, within an overall scheme of liberties, in situations of prima facie moral conflict. Raekstad and Rossi extend the radical critique, beyond the case of coercive strikes, to other forms of direct action (outside of industrial disputes) that have avowedly moral or political goals. These could include workplace occupations, street blockades, hacktivism, counter-economics, tax resistance and more. In the paper we argue that the ‘radicals’ are not entitled to the assumption that the right to strike is not a liberal basic liberty. Moreover, we suggest, high liberalism has the resources to accommodate not only a general right to engage in non-coercive strike action, but also the right to engage in some forms of coercive direct action, whether as part of an industrial dispute or not. More precisely, we show that liberalism has the resources to accommodate not only (i) a general right to engage in non-coercive strike action, but also (ii) the right to engage in some forms of coercive direct action, whether (iii) as part of an industrial dispute or (iv) not. The authors examine several issues in teaching phenomenology (1) to advanced researchers who are doing qualitative research using phenomenological interview methods in disciplines such as psychology, nursing, or education, and (2) to advanced researchers in the cognitive neurosciences. In these contexts, the term “teaching” needs to be taken in a general and nondidactic way. In the case of the first group, it involves guiding doctoral students in their conception and design of a qualitative methodology that is properly phenomenological. In the (...) case of the second, it is more concerned with explaining the relevance of phenomenology to an audience of experimental scientists via conference presentations or published papers. In both cases, however, the challenge is to make clear to the relevant audience what phenomenology is and how it can relate to what they are doing. (shrink)

Shaun Gallagher, Lillian and Morrie Moss Professor of Excellence in Philosophy at the University of Memphis, discusses the results of a neurophenomenological study in which a research team used simulation to replicate experiences of astronauts during space travel. Many astronauts described deeply aesthetic, spiritual, or religious experiences of awe and wonder. Gallagher also discusses how using an approach that incorporated neuroscience, hermeneutics, phenomenology, psychology, heart rate, and phenomenological interviews allowed him to replicate the specific experiences in a significant number (...) of subjects. In a detailed examination of Quine's Two Dogmas of Empiricism, I argue that Quine fails to make the case that there are no analytical truths in ordinary language. Drawing on admissions he makes with regard to definitions and languages' relationship to pragmatic considerations, and an examination of his arguments concerning the interdefinability of the terms `synonymous', and `analytic', I argue that analytic truths exist as deducible consequences of the various uses to which language or sub-languages are put.

In this collection a panel of distinguished political philosophers critically explore the intellectual legacy of Rawls.

In this paper we consider the importance of trust, in the context of economic institutions, and specifically with respect to questions about market mechanisms and the role of social interactions. We review recent advances in institutional economics closely tied to developments in philosophy of mind and cognitive science, involving extended and enactive cognition. We argue that the analysis of different conceptions of institutional mind extension, in Denzau and North’s shared mental models, Clark’s extended mind, and a more enactive approach that (...) emphasizes the importance of social interaction and personal relationships, can benefit from Kathrine Hawley’s distinction between reliability and trust. Institutional arrangements based solely on the reliability of impersonal mechanisms can lead to a variety of social pathologies and, at the extreme, a form of cognitive atrophy, all of which can undermine the sustainability of institutions. Even if trust comes with risks and some degree of unpredictability, it turns out to be a necessary glue-like ingredient in the constitution of social institutions. (shrink)

The debate concerning truth in Classical Chinese philosophy has for the most part avoided the possibility that pluralist theories of truth were part of the classical philosophical framework. I argue that the Eastern Han philosopher Wang Chong (c. 25-100 CE) can be profitably read as endorsing a kind of pluralism about truth grounded in the concept of shi 實 , or “actuality”. In my exploration of this view, I explain how it offers a different account of the truth of moral (...) and non-moral statements, while still retaining the univocality of the concept of truth (that is, that the concept amounts to more than the expression of a disjunction of various truth properties), by connecting shi with normative and descriptive facts about how humans appraise statements. In addition to providing insight into pluralist views of truth in early China, the unique pluralist view implicit in Wang’s work can help solve problems with contemporary pluralist theories of truth.  . This is a reply to discussions by Robert Kane, Kelly McCormick, and Manuel Vargas of Shaun Nichols, Bound: Essays on Free Will and Responsibility.

A new scholarly movement of sorts emerged during the early Han period, associated with the acceptance of certain commentaries (zhuan 傳) on the classic history Chunqiu 春秋 (Spring and Autumn Annals) and related texts, written and complied in the" new script" of Han scholars recompiling early materials. The texts and ideas associated with this movement (although there have long been questions as to just how much of an actual intellectual movement this was) are largely syncretic and constructive in nature. The (...) central text of this" New Text Confucianism," the Gongyang 公羊 commentary on the Chunqiu, was more concerned with offering explanations of what scholars took to be the inherent deeper meanings of the Chunqiu than with reconstruction of early understandings of the text (although proponents certainly also thought that these meanings were inherent in the texts, rather than added or read into them by later thinkers). One way of understanding the" New Text" movement is as a constructive and syncretic response to the modern use of ancient texts during the Han, and as a way to revitalize and systematize the ideas in earlier texts (although the authors of the Gongyang and its proponents in the Han certainly saw the text as expressing the core messages of the Chunqiu, rather than creating their own). The creative and syncretic nature of the" New Text" movement was opposed to what one may see as the historicism of the" Old Text" movement taken as associated with the Zuo 左 commentary and supposed ancient texts advocated by Liu Xin 劉歆 (50 BCE–23 CE). ¹ Later philosophers criticized what they took to be the speculative …. Philosophical perspective of Adi-Granth, Sikh canon.

The meaningful consideration of cultural practices, values and beliefs is a necessary component in the effective translation of advancements in neuroscience to clinical practice and public discourse. Society’s immense investment in biomedical science and technology, in conjunction with an increasingly diverse socio-cultural landscape, necessitates the study of how potential discoveries in neurodegenerative diseases such as Alzheimer disease are perceived and utilized across cultures. Building on the work of neuroscientists, ethicists and philosophers, we argue that the growing field of neuroethics provides (...) a pragmatic and constructive pathway to guide advancements in neuroscience in a manner that is culturally nuanced and relevant. Here we review a case study of one issue in culturally oriented neuroscience research where it is evident that traditional research ethics must be broadened and the values and needs of diverse populations considered for meaningful and relevant research practices. A global approach to neuroethics has the potential to furnish critical engagement with cultural considerations of advancements in neuroscience. (shrink)

Despite the relative ease and regularity with which it is used by policymakers and the functional role that it often plays in the policy development process, the concept of reasonableness has essentially been overlooked by public policy scholars in their analysis of the factors influencing the development of public policy. However, the maintenance of the analytical status quo is likely to prove increasingly difficult. As the issues that governments must address become increasingly complicated and controversial and it becomes correspondingly more (...) difficult to identify easily or clearly the most appropriate response to associated problems, policymakers will inevitably be forced to place greater reliance on the concept of reasonableness as the final court of appeal when seeking to determine the attractiveness and acceptability of policy decisions. Accordingly, it seems ‘reasonable’ to suggest that greater, explicit consideration be given to the concept of reasonableness and the role it does and should play in the development of public policy. This article simultaneously offers both a brief overview of the current situation with respect to the meaningful consideration of the concept of reasonableness by public policy scholars and practitioners and a preliminary argument for a reconsideration of the analytical status quo. Absolute needs (as against instrumental needs) are independent of the ends, goals and purposes of personal agents. Against the view that the only needs are instrumental needs, David Wiggins and Garrett Thomson have defended absolute needs on the grounds that the verb ‘need’ has instrumental and absolute senses. While remaining neutral about it, this article does not adopt that approach. Instead, it suggests that there are absolute biological needs. The absolute nature of these needs is defended by appeal to: their (...) objectivity (as against mind-dependence); the universality of the phenomenon of needing across the plant and animal kingdoms; the impossibility that biological needs depend wholly upon the exercise of the abilities characteristic of personal agency; the contention that the possession of biological needs is prior to the possession of the abilities characteristic of personal agency. Finally, three philosophical usages of ‘normative’ are distinguished. On two of these, to describe a phenomenon or claim as ‘normative’ is to describe it as value-dependent. A description of a phenomenon or claim as ‘normative’ in the third sense does not entail such value-dependency, though it leaves open the possibility that value depends upon the phenomenon or upon the truth of the claim. It is argued that while survival needs (or claims about them) may well be normative in this third sense, they are normative in neither of the first two. Thus, the idea of absolute need is not inherently normative in either of the first two senses. (shrink)

Some stem cell researchers believe that it is easier to derive human embryonic stem cells from fresh rather than frozen embryos and they have had in vitro fertilization (IVF) clinicians invite their infertility patients to donate their fresh embryos for research use. These embryos include those that are deemed 'suitable for transfer' (i.e. to the woman's uterus) and those deemed unsuitable in this regard. This paper focuses on fresh embryos deemed suitable for transfer - hereafter 'fresh embryos'- which IVF patients (...) have good reason not to donate. We explain why donating them to research is not in the self-interests specifically of female IVF patients. Next, we consider the other-regarding interests of these patients and conclude that while fresh embryo donation may serve those interests, it does so at unnecessary cost to patients' self-interests. Lastly, we review some of the potential barriers to the autonomous donation of fresh embryos to research and highlight the risk that female IVF patients invited to donate these embryos will misunderstand key aspects of the donation decision, be coerced to donate, or be exploited in the consent process. On the basis of our analysis, we conclude that patients should not be asked to donate their fresh embryos to stem cell research. (shrink)

We argue that Maclaurin and Dyke's recent critique of non-naturalistic metaphysics suffers from difficulties analogous to those that caused trouble for earlier positivist critiques of metaphysics. Maclaurin and Dyke say that a theory is naturalistic iff it has observable consequences. Depending on the details of this criterion, either no theory counts as naturalistic or every theory does.

The process of adopting a child is “not for the faint of heart.” This is what we were told the first time we, as a couple, began this process. Part of the challenge lies in fulfilling the licensing requirements for adoption, which, beyond the usual home study, can include mandatory participation in parenting classes. The question naturally arises for many people who are subjected to these requirements whether they are morally justified. We tackle this question in this paper. In our (...) view, while strong reasons exist in favour of licensing adoptive parents, these reasons support the licensing not only of adoptive parents, but of all or some subset of so-called “natural” parents as well. We therefore conclude that the status quo with respect to parental licensing, according to which only adoptive parents need to be licensed, is morally unjustified. (shrink)
