In this paper I consider the role of freedom in the justification of prohibitions on discrimination. As a case study, I focus mainly on U.S. constitutional and employment law and, in particular, restrictions on sex-stereotyping. I present a new argument that freedom can play at least some important role in justifying these restrictions. Not just any freedom, I claim: the Millian freedom to challenge existing stereotypes and contribute to social change. This ‘social change account’, I argue, can be (...) a useful supplement to the existing theories where their explanations run out. It also draws support from familiar liberal justifications for speech and other liberties, and provides an attractive role for the courts. (shrink)

Over the last decade, philosophers of education have begun taking a renewed interest in Rousseau’s educational thought. This is a welcome development as his ideas are rich with educational insights. His philosophy is not without its flaws, however. One significant flaw is his educational project for females, which is sexist in the highest degree. Rousseau argues that females should be taught to “please men…and make [men’s] lives agreeable and sweet.” The question becomes how could Rousseau make such strident claims, (...) especially in light of his far more insightful ideas concerning the education of males. This paper attempts to make sense of Rousseau’s ideas on the education of females. While I maintain that Rousseau’s project for Sophie ought to be rejected, I argue that we should try to understand how this otherwise insightful thinker could make such surprising claims. Is it a bizarre inconsistency in his philosophical reasoning or an expression of his unabashed misogyny, as so many have claimed? I argue that it is neither. Rather, it is a product of his conception of human happiness and his belief in the irreducible role human sexual relations has in achieving and prolonging that happiness. For Rousseau, sex, love and happiness are inextricably connected, and he believes that men and women will be happiest when they inhabit certain sex roles—not because sex roles are valuable in themselves, but because only through them can either men or women hope to be happy. Most mathematical models used to examine the role of different stages of human immunodeficiency virus infection unrealistically assume that HIV is transmitted through one-off contacts or that transmission rates are the same between males and females. We sought to examine whether inferences from previous models are robust to the relaxation of those unrealistic assumptions. We developed a model of HIV transmissions through sexual partnerships assuming that sexual partnerships have variable duration, sexual partnerships are concurrent, and the male-to-female transmission rate (...) is higher than the female-to-male transmission rate, with a focus on the third assumption. Assuming a higher rate for male-to-female than female-to-male transmissions decreases the overall transmission of HIV but increases the equilibrium fraction of transmissions during primary HIV infection in long-term partnerships, compared to the case where transmission rates are assumed to be symmetric between males an females. Previous modeling studies that assume symmetric transmission rates between males and females may have overestimated the overall spread of HIV, but underestimated the relative contribution of PHI. To make robust inferences on the role of different stages of HIV infection in the sexual spread of HIV, models should take into account that transmission rates may be asymmetric by sex. (shrink)

We look to mitonuclear ecology and the phenomenon of Mother’s Curse to argue that the sex of parents and offspring among populations of eukaryotic organisms, as well as the mitochondrial genome, ought to be taken into account in the conceptualization of evolutionary fitness. Subsequently, we show how characterizations of fitness considered by philosophers that do not take sex and the mitochondrial genome into account may suffer. Last, we reflect on the debate regarding the fundamentality of trait versus organism fitness and (...) gesture at the idea that the former lies at the conceptual basis of evolutionary theory. In ____Bodies That Matter,__ Judith Butler further develops her distinctive theory of gender by examining the workings of power at the most "material" dimensions of sex and sexuality. Deepening the inquiries she began in _Gender_ _Trouble,_ Butler offers an original reformulation of the materiality of bodies, examining how the power of heterosexual hegemony forms the "matter" of bodies, sex, and gender. Butler argues that power operates to constrain "sex" from the start, delimiting what counts as a viable sex. This paper explores the psychological phenomena of sex stereotypes and their consequences for the occurrence of sex discrimination in work settings. Differential conceptions of the attributes of women and men are shown to extend to women and men managers, and the lack of fit model is used to explain how stereotypes about women can detrimentally affect their career progress. Commonly-occurring organizational conditions which facilitate the use of stereotypes in personnel decision making are identified and, lastly, data are provided demonstrating the (...) way in which affirmative action programs and practices can act to promote the stereotyping of women suggesting, that rather than being a remedy for sex discrimination, such programs might in fact be another contributor to the problem. Conclusions focus on the importance of attending to the role sex stereotypes play in hindering women's career progress when procedures to combat sex discrimination in organizations are designed and implemented. How are ‘philosophy’ and ‘gender’ implicated? Throughout history, philosophers—mostly men, though with more women among their number than is sometimes supposed—have often sought to specify and justify the proper roles of women and men, and to explore the political consequences of sexual difference. The last forty years, however, have seen a dramatic explosion of critical thinking about how philosophy is a gendered discipline; there has also been an abundance of philosophical work that uses gender as a central analytic (...) category. In particular, feminist philosophy has become established as a major field of inquiry, and it is now complemented by related emerging areas, including the philosophy of race and the philosophy of sex and love. Laura Hengehold presents a new, Deleuzian reading of Simone de Beauvoir's phenomenology, the place of recognition in The Second Sex, the philosophical issues in her novels, the important role of her student diaries and her early interest in Bergson and Leibniz.

I offer an account of sexual ethics, and thus of an education in sexual morality, that tries to make some sense of how a view of consent as central to those ethics might be combined with an education in certain virtues. I do so by exploring what some see as the shortcomings of a standard of consent, namely, how it can deal with instances of prima facie bad sex. I consider and reject various attempts to show that consensuality is sufficient (...) for morally good sex. I then show how a needed supplement to the standard of consent can appeal to a broader view of why consent matters. This in turn connects to those personal and interpersonal virtues that the 2019 Department of Education guidance on relationships and sex education suggests should be taught. Finally, I provide an account of why more than consensuality is needed in the case of sex. In short, I insist on the critical importance of consent but supplement the standard of consent by an appeal to why consent matters and does so especially in the case of sex. (shrink)

The concept of biological sex guides research, clinical practice, science funding policy, and contemporary political discourse. Despite some substantive differences, all existing candidate philosophical accounts of sex assume its legitimacy as a biological concept. Here, we challenge this view. We argue against realism about biological sex, and that eliminating biological sex from large swaths of biological theory and practice may be preferable compared to conventionalist or fictionalist anti-realisms. There are serious social and epistemic costs to using “biological sex” in place (...) of more specific alternatives. Because of this, biologists and philosophers of science should consider eliminativism about the concept of biological sex. Biological sex eliminativism is worth taking seriously, and it can play important roles in philosophical debate and biological practice, even for those who remain skeptical. The methodological consequences of biological sex eliminativism are compatible with best practices for inquiry in the biological and biomedical sciences, with inclusive approaches to the study of sex and gender, and with feminist philosophical and methodological recommendations. Taking eliminativism seriously reveals important disagreement about the work that a concept of biological sex should do, and imposes a contrastive burden on would-be rivals. (shrink)

In this essay, I want to identify an invidious bias that is embedded in much research into sex differences. I shall argue that bias against women is endemic in any such research programme that fails to take account at every stage of women's social inequality. It is primarily because its view of the relation between sexual difference and sexual inequality is too simplistic that much sex differences research rationalizes and so perpetuates women's subordination.

Although one could think that philosophy of love plays a minor role (...) in The Second Sex, this paper argues that for Beauvoir the transformation of heterosexual love may well be the main way to convert oppression in emancipation at the individual level. Beauvoir’s philosophy of love is this crucial to link her analysis of women’s oppression with her proposing paths towards emancipation. (shrink)

Morag Buchan explores Plato's writings to argue his notions of the inferior female and the superior male. While Plato appears to allow women equal opportunity and participation of political life in the Ideal State in The Republic , his motivation rests on masculine ideals. Women in Plato's Political Theory examines issues (...) including women's relationship to men, to reproduction, to rational thought and politics in Plato's work, and addresses more generally the problem of sexual identity in philosophy. In “Analyzing COVID-19 Sex Difference Claims: The Harvard GenderSci Lab,” Marion Boulicault and Sarah Richardson summarize some of the groundbreaking work that they’re doing at the Harvard GenderSci Lab. Since March 2020, their lab has been analyzing, interrogating, and critiquing sex essentialist explanations of COVID-19 outcome disparities that are fairly ubiquitous in news media. Using interdisciplinary tools from feminist philosophy, science studies, and critical public health, they work collaboratively with two goals: (i) to critically examine COVID-19 sex difference research (...) and (ii) to explore and elevate the role of social variables in driving biological disparities. They argue that in public health research, media, and messaging, data on sex disparities must be contextualized both to avoid reinforcing harmful sex essentialist assumptions and also to help the public understand the complex ways in which social factors influence these patterns. They argue that within the context of COVID-19, doing so can both clarify risks and save lives. Their contribution to this issue describes their methods and shares some of their findings. (shrink)

Challenges Beauvoir's self-portrait and argues that she was a philosopher in her own right.

Autonomy is fundamental to liberalism. But autonomous individuals often choose to do things that harm themselves or undermine their equality. In particular, women often choose to participate in practices of sexual inequality—cosmetic surgery, gendered patterns of work and childcare, makeup, restrictive clothing, or the sexual subordination required by membership in certain religious groups. In this book, Clare Chambers argues that this predicament poses a fundamental challenge to many existing liberal and multicultural theories that dominate contemporary political philosophy. Chambers argues (...) that a theory of justice cannot ignore the influence of culture and the role it plays in shaping choices. If cultures shape choices, it is problematic to use those choices as the measure of the justice of the culture. Drawing upon feminist critiques of gender inequality and poststructuralist theories of social construction, she argues that we should accept some of the multicultural claims about the importance of culture in shaping our actions and identities, but that we should reach the opposite normative conclusion to that of multiculturalists and many liberals. Rather than using the idea of social construction to justify cultural respect or protection, we should use it to ground a critical stance toward cultural norms. “Female sexual dysfunction” is the type of contested disease that has sparked concern about the role of the pharmaceutical industry in medical science. Many policies have been proposed to manage industry influence without carefully evaluating whether the proposed policies would be successful. We consider a proposal for incorporating citizen stakeholders into scientific research and show, via a detailed case study of the pharmaceutical regulation of flibanserin, that such programs can be co-opted. I consider Kant’s use of claims about “nature’s ends” in his arguments to establish maxims of homosexual sex, masturbation, and bestiality as constituting “unnatural” sexual vices, which are contrary to one’s duties to oneself as an animal and moral being. I argue, first, that the formula of humanity is the principle best suited for understanding duties to oneself as an animal and moral being; and second, that although natural teleology is relevant to some degree in specifying these duties, it cannot (...) play a sufficiently robust role to establish Kant’s conclusion. I also discuss what the formula of humanity (along with warranted attention to natural teleology) suggests about the morality of homosexual sex, masturbation, and bestiality. (shrink)

In this article, I explore a new reason in favor of precollegiate philosophy: It could help narrow the persistent gender disparity within the discipline. I catalog some of the most widely endorsed explanations for the underrepresentation of women in philosophy and argue that, on each hypothesized explanation, precollegiate philosophy instruction could help improve our discipline's gender balance. Explanations I consider include stereotype threat, gendered philosophical intuitions, inhospitable disciplinary environment, lack of same-sex role models for women students (...) in philosophy, and conflicting “schemas” for philosophy and femininity. I argue that, insofar as some combination of these hypothesized explanations accounts for some portion of the underrepresentation of women in philosophy, those of us concerned to make things better have reason to participate in and promote efforts to share philosophy with younger students. In my work I argue that sexual differences in the brain seem to shape the ideological gulf between the respective social groups each side represents. And most significantly, it is the male sex hormone testosterone that is the primary hormone affecting our sexual evolution. Not only does testosterone fuel the passion for reproduction and play a critical role in the length of human lives, it is an integral component to the mechanism of human civilization—its triumphs and its tragedies. In (...) order to understand the forces that drive the life cycles of human cultures and form the engine of history, it is important to look at the most fundamental building blocks of human neuroscience. Our hormones are the impetus for our history. Hormones regulate and control the way the human mind perceives the world and forms social organizations and political order accordingly. To understand Hegel’s concept of Sittlichkeit (ethical life) and the role that love and marriage play in it, we must understand his concept of recognition. It is a mistake, however, to think as some do that mutual recognition between equals is sufficient for Sittlichkeit. Rather, for Hegel, the more significant and powerful the recognizer, the more real the recognized. Ultimately recognition must come from spirit (Geist). Understanding this will allow us to see, despite Hegel, that he can capture, better (...) than other theorists, many of the central concerns of contemporary same-sex marriage proponents and help provide them a philosophical underpinning. Neuroscience research examining sex/gender differences aims to explain behavioral differences between men and women in terms of differences in their brains. Historically, this research has used ad hoc methods and has been conducted explicitly in order to show that prevailing gender roles were dictated by biology. I examine contemporary fMRI research on sex/gender differences in emotion processing and argue that it, too, both uses problematic methods and, in doing so, reinforces gender stereotypes.

I argue that same-sex divorce presents a different kind of potential constraint to the agency of persons pursuing the dissolution of their marriage; a constraint upon one’s counterstory and the reconstitution of one’s personal identity. The dialectic within the paper mirrors the movements that I have had to make as I have sought to constitute and reconstitute myself throughout my divorce process. Beginning from a juridical perspective, I examine how the constraints on same-sex divorce present constraints on one’s agency that (...) are antithetical to the spirit of a liberal democratic conception of freedom of movement. I then explore the role of narrative in my self-(re)constitution, as well as the limits of the narrative and counterstories, when the institutional framework of the State fails to acknowledge the change in my State-sanctioned personal relationship. I end by arguing that this view from the law ignores the ways in which we relationally constitute ourselves, and in so doing covers over the harms done to persons that find themselves in a married-yet-not state of limbo. The role of Alfred Kinsey, America's most influential sexologist, in the cultural revolution of sex and gender during the past fifty years remains as unquestionable as it has been controversial. This admiring biography argues that Kinsey also qualifies as an authentic great man of science in the tradition of Darwin. Kinsey's expert authority was recently challenged by James Jones, who claimed in his 1997 biography that Kinsey's terrible personal secrets—homosexuality and masochism—plagued his life and ruined his science. Jonathan Gathorne‐Hardy (...) sets out to repair Kinsey's reputation by defending him against this “Kenneth Starr school of biography” . The author seeks to rescue Kinsey's achievement from the stigmatizing charge that it was flawed because it subordinated science to subjectivity.Gathorne‐Hardy emphasizes Kinsey's methodological creativity and his interviewing genius. During his early career, when he worked on gall wasps, Kinsey's science developed as a practice of scrupulous collection, observation, and documentation. Even in graduate school, he was dubbed “get a million Kinsey,” and his belief in sheer quantity—as well as quantification—was just as apparent when he turned his attention to human sexuality. In 1938 Kinsey taught a course on marriage at Indiana University, where he spent his entire working life. Limited to married or engaged students and faculty, the course covered reproductive physiology, contraception, and a host of other sexual topics in explicit detail. Kinsey also used the course to gather data about his students' sex lives. The thousands of sexual histories collected at the Institute for Sex Research in later years—7,985 by Kinsey alone—attest to his scientific commitment to behavior as the only legitimate basis for a science of sex.The behavioral unit of analysis chosen by Kinsey was the orgasm—or “outlet,” as Kinsey called it. Because it was countable, the theory went, it was objective. Kinsey's ethic of measurement resulted in interviews involving at least 350 standard questions, whose answers were recorded in a custom code designed to fit on a single sheet of paper divided into 287 squares. Among the ironies of Kinsey's method was the fact that his sex histories measured linguistic rather than sexual behavior. What Kinsey actually compiled was a huge cache of stories, not direct observations of sexual behavior. Kinsey, who gathered more sexual stories than any other person alive, systematically aimed to eradicate all quirks and complexities in order to produce a statistical portrait of population‐wide behavior. Meanings might be historically important, but numbers, not narratives, would yield truth. The easy use of “human males” and “human females” in the titles of Kinsey's famous reports suggests how universal his scientific claims were—and also how devoid of temporal and cultural particularity.The resulting conception of human sexual nature is probably best represented in Kinsey's six‐point scale, where behavioral possibilities ranged from exclusively homosexual at one pole to exclusively heterosexual at the other. Diversity emerged as the premier fact about sexual behavior. While this placed men and women uncomfortably close to their primate cousins on an evolutionary map, making human sexual exceptionalism objectively unsustainable, it also produced a reformist sensibility that rooted its demand for toleration in the powerful evidence of natural facts. It is difficult to overstate how shocking Kinsey's picture of polymorphous sexuality was in a culture devoted to either/or binaries and prone to harsh judgments about deviation from norms. Kinsey's contribution was to point out the gap between ideology and behavior . That lots of people did lots of things at odds with professed sexual morality was, for some, a welcome relief and call to revolution. For others, it was a reason to hate Kinsey and blame him for changes in the realm of gender and sexuality already well under way by midcentury.No biographies can save scientific heroes from the fatal charge that their methods and findings were bound up in their lives, or they would not be biographies worth reading. This attests to the stubborn endurance of the psychoanalytic paradigm. Kinsey despised Freud for passing off philosophy as science. Yet because of the conventions of post‐Freudian biography, Gathorne‐Hardy must explore exactly those dimensions of Kinsey's life and character that Freud embraced but that Kinsey himself would never have admitted into the precincts of science. Kinsey's wife Clara was a confidant and supporter from the start. Their loving marriage was also an open marriage. Mac was a participant‐observer in the world of sex research. She had a series of affairs with Kinsey's colleagues and even changed the bedsheets during energetic sessions of sexual cinematography that took place in the attic of their home. Yet the Kinseys also shielded their children from their own unorthodox sexual practices.This biography concludes by suggesting that Kinsey died tragically in 1957, convinced that his enemies had the upper hand. Kinsey was wrong. The diversity he championed has become a theoretical staple in the human and life sciences as well as a practical goal in social policies related to gender, race, and sexuality. This paper offers a reading of Todd Solondz Happiness (1998) in relation to Lacan’s notion of sexual difference. It argues that both the film and theorist present a ‘logic’ of sexuality and sexual difference which seems to owe much to Hegel’s master-slave dialectic but that in the end owes more to Kojève’s (mis)reading than to Hegel himself. It outlines the usefulness of an expanded notion of the dialectic to understand sexual difference through the inclusion of the Hegelian figures of the (...) stoic, the sceptic and the unhappy consciousness. It also suggest that the priority of identity and non-identity to dialectic logic has been obscured by this focus on the master-slave relationship and that an analysis of the role of the autoerotic develops modes of sexual similarity and difference that cuts across heteronormative gender lines. The anxiety both Lacan and the film seem to suffer with regard to autoerotic is then used to critique their sexual conservatism and their prescriptive rather than descriptive representation of sexual relationships. Elisabeth Badinter est une philosophe controversée, dont les prises de positions provoquent souvent des polémiques. Très influencée par Simone de Beauvoir, elle a consacré d'importantes études historiques au 18e siècle français et au Siècle des Lumières, faisant renaître des figures féminines trop méconnues : Madame d'Epinay, qui eut avec Rousseau une amitié plutôt orageuse, Madame du Châtelet, qui fut la maîtresse de Voltaire. Elle fait revivre l'oeuvre philosophique et littéraire de ces grandes femmes, trop souvent éclipsée par les grands hommes (...) qui ont croisé leur vie. Mais c'est surtout sur la question du féminisme qu'Elisabeth Badinter s'est fait connaître du grand public. Paradoxalement, après avoir été vilipendée comme "archéo-féministe" (en particulier après L'Amour en plus, 1980) elle s'est vue aussi dénoncée (après son essai Fausse route) comme antiféministe. Dans Fausse route, 2003, elle s'oppose à une dérive de certains mouvements féministes qui ont promu une victimisation de la femme et exalté la différence hommes/femmes. Dans son dernier livre, Le conflit, La femme et la mère, (2010, Flammarion), elle dénonce une régression continue de la condition féminine depuis les années 80, constatant que la maternité tend de plus en plus à définir unilatéralement et "naturellement" la femme. Elle défend, aux côtés de son mari Robert Badinter, un humanisme rationaliste qui met l'accent sur la ressemblance entre les hommes et les femmes (particulièrement dans L'un est l'autre, 1986) et, généralement, sur la ressemblance entre tous les êtres humains.
