In this paper we show how a realistic normative democratic theory can work within the constraints set by the most pessimistic empirical results about voting behaviour and elite capture of the policy process. After setting out the empirical evidence and discussing some extant responses by political theorists, we argue that the evidence produces a two-pronged challenge for democracy: an epistemic challenge concerning the quality and focus of decision-making and an oligarchic challenge concerning power concentration. To address the challenges we then (...) put forward three main normative claims, each of which is compatible with the evidence. We start with a critique of the epistocratic position commonly thought to be supported by the evidence. We then introduce a qualified critique of referenda and other forms of plebiscite, and an outline of a tribune-based system of popular control over oligarchic influence on the policy process. Our discussion points towards a renewal of democracy in a plebeian but not plebiscitarian direction: Attention to the relative power of social classes matters more than formal dispersal of power through voting. We close with some methodological reflections about the compatibility between our normative claims and the realist program in political philosophy. (shrink)

This is a collection of the key articles written by renowned Wittgenstein scholar, G.P. Baker, on Wittgenstein’s later philosophy, published posthumously. Following Baker’s death in 2002, the volume has been edited by collaborator and partner, Katherine Morris. Contains articles previously only available in other languages, and one previously unpublished paper. Completely distinct from the widely-known work Baker did with P.M.S. Hacker in the Analytical Commentary on the Philosophical Investigations.

Four years after the Panama Papers scandal, tax avoidance remains an urgent moral-political problem. Moving beyond both the academic and policy mainstream, I advocate the “democratization of tax enforcement,” by which I mean systematic efforts to make tax avoiders accountable to the judgment of ordinary citizens. Both individual oligarchs and multinational corporations have access to sophisticated tax avoidance strategies that impose significant fiscal costs on democracies and exacerbate preexisting distributive and political inequalities. Yet much contemporary tax sheltering occurs within the (...) letter of the law, rendering criminal sanctions ineffective. In response, I argue for the creation of Citizen Tax Juries, deliberative minipublics empowered to scrutinize tax avoiders, demand accountability, and facilitate concrete reforms. This proposal thus responds to the wider aspiration, within contemporary democratic theory, to secure more popular control over essential economic processes. (shrink)

ABSTRACT This essay is a critical study of Jason Brennan's Against Democracy. We make three main points. First, we argue that Brennan's proposal of a right to competent government only works if one considers the absence of government a viable proposition, something most of his opponents are not prepared to do. Second, we suggest that Brennan's account of competent decision-making is blind to forms of oligarchic power that work against the very ideals of justice and epistemic virtue that competence is (...) meant to safeguard. Third, we muster empirical evidence to argue that, in the real world, democracy is not just about making decisions and selecting policies, in which case Brennan's argument misses its mark. (shrink)

This article tackles the issue of offshore tax sheltering from the perspective of normative political realism. Tax sheltering is a pressing contemporary policy challenge, with hundreds of billions in private assets protected in offshore trusts and shell companies. Indeed, tax sheltering produces a variety of empirical dilemmas that render it a distinctive challenge for global governance. Therefore, it is crucial for normative political theorists to confront this problem. A realist approach offers three distinct advantages, elaborated in the three subsequent sections (...) of the article. First, it relaxes the theoretical burden by starting from the real practice of tax evasion rather than from an abstract theory of equality or justice. Second, this approach recognizes that sheltering is a political harm: a threat to the very maintenance of order, not just a problem of inequality or injustice. If politicians fail at such polity maintenance, realism's ethic of responsibility provides clear political reasons why they should be held accountable. Third, realism's focus on power and its acceptance of coercion open up new strategies for addressing the problem that would not be allowed by theories with a stronger emphasis on consensus. (shrink)

Social networking sites like Facebook are rapidly gaining in popularity. At the same time, they seem to present significant privacy issues for their users. We analyze two of Facebooks’s more recent features, Applications and News Feed, from the perspective enabled by Helen Nissenbaum’s treatment of privacy as “contextual integrity.” Offline, privacy is mediated by highly granular social contexts. Online contexts, including social networking sites, lack much of this granularity. These contextual gaps are at the root of many of the sites’ (...) privacy issues. Applications, which nearly invisibly shares not just a users’, but a user’s friends’ information with third parties, clearly violates standard norms of information flow. News Feed is a more complex case, because it involves not just questions of privacy, but also of program interface and of the meaning of “friendship” online. In both cases, many of the privacy issues on Facebook are primarily design issues, which could be ameliorated by an interface that made the flows of information more transparent to users. (shrink)

The accurate delineation of various forms of business organization requires a comparative analysis of their objectives, functions, and organizational structures. In particular, this paper highlights differences in managerial work between business firms and non-profits exemplified by the charitable organization. It adopts as its template the theory of the marketing firm, a depiction of the modern corporation as it responds to the imperatives of customer-oriented management, namely consumer discretion and consumer sophistication. It describes in §2 the essentials of the theory and (...) its basis in consumer behavior analysis, and outlines its unique position as the organization responsible for marketing transactions, based on objective exchange, competitive markets and prices, and the deployment of the entire marketing mix. §3 deals in greater depth with the objective, strategic functions, and organization of the marketing firm in terms of the concepts of metacontingency and bilateral contingency. §4 discusses how the marketing firm differs from charities in terms of goal separation, market-based pricing and competition, the entrepreneurial process, the pursuit of customer-oriented management, and organizational structure. Particular attention is accorded the organizational differences between marketing firms and charities, which arise as a direct consequence of the distinct patterns of contingency they entail. §5 discusses the implications of the foregoing analysis and draws appropriate conclusions. The four-principle approach to biomedical ethics is used worldwide by practitioners and researchers alike but it is rather unclear what exactly people do when they apply this approach. Ranking, specification, and balancing vary greatly among different people regarding a particular case. Thus, a sound and coherent applicability of principlism seems somewhat mysterious. What are principlists doing? The article examines the methodological strengths and weaknesses of the applicability of this approach. The most important result is that a sound and comprehensible application (...) of the four principles is additionally ensured by making use of the organizing meta-principle of common morality, which is the starting point and constraining framework of moral reasoning. No crucial experiment demonstrates that four hue categories are needed to describe color appearance. Instead, converging lines of evidence suggest that the terms red, yellow, green, and blue are sufficient and precise enough for deriving color discrimination functions and for a useful model constraining relations between color appearance and neuronal responses. Such a model need not be based on linguistic universals. Until something better is available, this holds.

Is the universe self-existent, self-sufficient, and self-organizing, or is it grounded instead in a reality that transcends space, time, matter, and energy?

CRISPR‐Cas technology accelerates development of fast, accurate, and portable diagnostic tools, typified by recent applications in COVID‐19 diagnosis. Parasitic helminths cause devastating diseases afflicting 1.5 billion people globally, representing a significant public health and economic burden, especially in developing countries. Currently available diagnostic tests for worm infection are neither sufficiently sensitive nor field‐friendly for use in low‐endemic or resource‐poor settings, leading to underestimation of true prevalence rates. Mass drug administration programs are unsustainable long‐term, and diagnostic tools – required to be (...) rapid, specific, sensitive, cost‐effective, and user‐friendly without specialized equipment and expertise – are urgently needed for rapid mapping of helminthic diseases and monitoring control programs. We describe the key features of the CRISPR‐Cas12/13 system and emphasise its potential for the development of effective tools for the diagnosis of parasitic and other neglected tropical diseases (NTDs), a key recommendation of the NTDs 2021–2030 roadmap released by the World Health Organization. Some questions are posed for van Fraassen, concerning the role and status of metaphysics in his Scientific Representation.

Wittgenstein remarked 'What we do is to bring words back from their metaphysical to their everyday use' (PI §116). On this basis, his 'later philosophy' is generally regarded as a version of 'ordinary language philosophy'. He is taken to criticize philosophers for making ('metaphysical') statements which deviate in different ways from the everyday use of some of their component expressions. I marshal textual evidence for another reading of this remark, and show that he used 'metaphysical' in a traditional way, namely, (...) to describe philosophical attempts to delineate the essence of things by establishing necessities and impossibilities. On his conception, 'everyday' simply means 'non-metaphysical' (in this precise sense). Comparisons of philosophical utterances with non-philosophical uses of words are meant to call attention to this crucial distinction. (shrink)

Substantivalists claim that spacetime enjoys an existence analogous to that of material bodies, while relationalists seek to reduce spacetime to sets of possible spatiotemporal relations. The resulting debate has been central to the philosophy of space and time since the Scientific Revolution. Recently, many philosophers of physics have turned away from the debate, claiming that it is no longer of any relevance to physics. At the same time, there has been renewed interest in the debate among physicists working on quantum (...) gravity, who claim that the conceptual problems which they face are intimately related to interpretative questions concerning general relativity . My goal is to show that the physicists are correct--there is a close relationship between the interpretative issues of classical and quantum gravity. ;In the first part of the dissertation I challenge the received view that substantivalism has a commanding advantage over relationalism on grounds internal to GR. I argue that this view is based on a misconception of the relationships between realism and substantivalism, and between empiricism and relationalism. This has led to a narrow conception of relationalism. Once this is relinquished it can be seen that none of the standard arguments in favor of substantivalism are cogent. ;In the second part of the dissertation, I consider the way in which considerations arising out of quantum gravity bear upon the substantival-relational debate. I develop a framework in which to discuss the interpretative problems of gauge theories and place GR in this context. From this perspective, I provide a taxonomy of interpretative options, and show how the hole argument arises naturally as a consequence of gauge freedom. This means that certain substantivalist interpretations of GR render the theory indeterministic. In the final chapter, I argue that, far from being a drawback, this presents an opportunity for substantivalists. Examples from quantum mechanics, quantum field theory, and quantum gravity, are used to demonstrate that the ambiguities inherent in quantization can lead to an interpretative interplay between theories. In the case of quantum gravity, this means that substantivalism and relationalism suggest, and are suggested by, distinct approaches to quantizing GR. (shrink)

This book is a radical revision of Gordon Graham "s Eight Theories of Ethics(Routledge 2004).

Psychologists have recently turned their attention to the nature of the recognition involved in judgment of familiarity. It has been suggested that, apart from judging a stimulus to be familiar when one is able to recall a context in which it was previously perceived, subjects are also able to judge that something is familiar merely on the basis of its faster perceptual processing.

This paper is about the concept of legitimacy in Ackerman's theory of constitutional moments. Ackerman's theory of the constitutional moment explains how constitutional change takes place outside of, and even in tension with, established channels of constitutional amendment. The main tool of legitimacy which Ackerman uses is popular sovereignty, to which he gives special features. Ackerman's particular conception of popular sovereignty I name hyperconsensus, and then I explore whether that is sufficient to justify deviations from Article V, as Ackerman claims. (...) I conclude, with many others, that the constitutional moment needs more justificatory work. I offer reciprocity as a corrective procedural requirement as found in Rawls's liberal principle of legitimacy. Doing so enhances the normative attractiveness of dualist democracy. (shrink)

The practice of nonphysician ethicist-consultants giving ethics advice concerning the appropriate medical treatment of patients in hospitals is a relatively recent development. Although only a minority of hospitals make substantial use of any formal ethics consulting service, the number is growing and apparently will continue to do so. Indeed, at least among urban teaching hospitals, some sort of ethics consulting service is increasingly commonplace.

To clarify Wittgenstein's status as an analytic philosopher, we must study his use of the expressions 'language', 'grammar', etc. We tend to take 'language' as an abstract mass-noun and to generalize quite specific remarks. We overlook the possibility of taking 'our grammar' to refer to our particular description of the use of words rather than to what we describe. Preserving the ambiguity of 'Sprache' between language and speech calls for a neutral translation, e.g. 'what we say'. Wittgenstein's 'descriptions of the (...) grammar of our language' are more varied and purpose-specific than usually recognized. (shrink)

The authors' aim is to provide a more complete picture of a non-anthropocentric relational ethics by addressing the failure to account for environmental justice. They argue that environmental ethics is always more than how discourses are layered over place, by situating moral agency through the body's affective repertoire of being-in-the-world. Empirical evidence for their argument is drawn from self-reflexive accounts of young Americans travelling to Ulu r u-Kata Tju t a National Park, Northern Territory, Australia as part of a study-group. A conservation principles tell us that some quantity, quality, or aspect remains constant through change. Such principles appear already in ancient and medieval natural philosophy. In one important strand of Greek cosmology, the rotatory motion of the celestial orbs is eternal and immutable. In optics, from at least the time of Euclid, the angle of reflection is equal to the angle of incidence when a ray of light is reflected. According to some versions of the medieval impetus theory of motion, (...) impetus remains in a projected body (and the associated motion persists) permanently unless the body is subject to outside interference. These examples could be multiplied. But it was in the seventeenth century that conservation principles began to play an absolutely central role in scientific theories. Each of Galileo Galilei, René Descartes, Christiaan Huygens, Gottfried Leibniz, and Isaac Newton founded his approach to physics upon the principle of inertia—that unless interfered with a body will undergo uniform rectilinear motion. A multitude of other conservation principles gained currency during the seventeenth century—some still with us, some long ago left behind. Descartes provides an interesting example of an author who attempted to derive all of his physical principles from conservation laws (Principles of Philosophy, see especially articles 36 to 42 of Part II). Descartes believed that the principles of his physics could be derived from the immutability of God, supplemented only by very weak assumptions about the existence of change in the world. He claims, in fact, that we ought to postulate the strongest conservation laws consistent with such change. These include. (shrink)

For a long time theories of history of the speculative sort have been out of favour. Accounts of the whole sweep of human history, like Hegel's, or even of more limited historical cycles, like Spengler's or Toynbee's, have been found much too grand for the workaday historian and have smacked too much of apriorism for post-positivist philosophy. Consequently, few take them seriously or treat them as more than fanciful aberrations which may serve as useful examples of how not to proceed (...) in history or philosophy. (shrink)

This paper is concerned with the interpretation of velocity eigenstates for unstable quantons, their relationship to space-like momentum eigenstates for such quantons and the explanation of Shirokov’s contracting lifetimes for such velocity eigenstates. It is an elaboration of a portion of the authors earlier study.
