Later reprinted by Deborah Charles Publications (and not available from Amazon), this book expounds and comments on the application of Greimasian semiotics to a legal text, as found in the article by Greimas and Landowski in Greimas, Sémiotique et Sciences Sociales (1976), compares this with the semiotic presuppositions of Hart, Dworkin, MacCormick and Kelsen, and offers my own analysis of the implications of such semiotic analysis for legal theory, including some more recent radical non-positivist accounts.

According to Greimas, the semiotic square is far more than a heuristic for semantic and literary analysis. It represents the generative “deep structure” of human culture and cognition which “define the fundamental mode of existence of an individual or of a society, and subsequently the conditions of existence of semiotic objects” (Greimas & Rastier 1968: 48). The potential truth of this hypothesis, much less the conditions and implications of taking it seriously (as a truth claim), have received little attention in (...) the literature. In response, this paper traces the history and development of the logical square of opposition from Aristotle to Greimas and beyond, to propose that the relations modelled in these diagrams are embodied relations rooted in gestalt memories of kinesthesia and proprioception from which we derive basic structural awareness of opposition and contrast such as verticality, bilaterality, transversality, markedness and analogy. To make this argument, the paper draws on findings in the phenomenology of movement (Sheets-Johnstone 2011a, 2011b, 2012, Pelkey 2014), recent developments in the analysis of logical opposition (Beziau & Payette 2008), recent scholarship in (post)Greimasian semiotics (Corso 2014, Broden 2000) and prescient insights from Greimas himself (esp. 1968, 1984). The argument of the paper is further supported through a visual and textual content analysis of a popular music video, both to highlight relationships between the semiotic square and mundane cultural ideologies and to show how these relationships might be traced to the marked symmetries of bodily movement. In addition to illustrating the enduring relevance of Greimasean thought, the paper further illustrates the neglected relevance that embodied chiasmus holds for developments in anthropology, linguistics and the other cognitive sciences. The article presents an account of the visual relations created by garments through their plastic formants, examining the role played by form, material, and composition in creating body hierarchies that produce prescribed behaviors between different subjects. The work dissects the concept of thematic role from Greimasian theory, investigating the manners in which an eighteenth-century wedding dress presents the chaining of programs governing materials, garments, and the body in the production of narrative interactions between subjects. The work utilizes a combination (...) of Greimas’ method with the Visual Semiotics continued by Floch and Oliveira, as well as Hammad’s Semiotics of Space which permit the exam of optical relations created in the body through its clothing – relations that can be read as manifesting values that are both historically and socially determined, or in the act of apprehension of an object. The eighteenth century provides a type of “original” case, whose results are pertinent to a broader study of the relations between body and dress: the work concludes with the understanding that Fashion changes through the transit of values and roles invested in the body and dress – a set of changes closely linked to the construction of social roles. This review examines Eduardo C. Bittar’s _Semiotics_, _Law & Art_, exploring how visual culture and semiotics intersect with law to reveal the symbolic layers of justice and authority. Drawing from multiple disciplines—including visual arts, theatre, and architecture—Bittar positions justice as a semiotic inquiry. He critiques modern legal positivism and advocates for a culturally embedded understanding of law, utilizing semiotic approaches like Greimasian analysis. The book is divided into two parts: foundational theory and its application in visual media. While Bittar’s interdisciplinary approach enriches the field of visual jurisprudence, the lack of empirical engagement is noted as a limitation. Future research integrating empirical studies could validate his claims and emphasize the importance of cultural narratives in shaping legal consciousness. This article is partly an exercise in academic autobiography, seeking to make sense of the different ways in which I have applied semiotics to secular law on the one hand, Jewish law on the other. The very fact that it can be applied to both shows that its claims are methodological. But it also indicates a possible reformulation of the semiotic issues in philosophical terms: we may view the relationship between the semantic and pragmatic levels in terms of the (...) relationship/balance between certainty/truth (the semantic level) on the one hand and trust (the pragmatic level) on the other. What may distinguish the secular and religious systems is the manner in the issue of trust is be ideologically concealed. (shrink)

The aim of this article is to tackle the sociosemiotic strategies through which the relation between power and visibility is articulated in today’s metropolitan São Paulo. Drawing on the theoretical-methodological framework of Greimasian and post-Greimasian semiotics, the following hypotheses are put forth: (1) contemporary São Paulo is characterized by a true visual hypertrophy, which manifests itself, all at once, in both its architectural and mediatic landscapes; (2) in São Paulo, power is hypervisible and apparently transparent; (3) the (...) excess of images, gazes, and perspectives produces, in São Paulo, dense and wide areas of topological, mediatic, and social invisibility; (4) the predominant visibility in São Paulo can be qualified as a “populist” visibility. Based on these assumptions, this article intends to contribute to the consolidation of a critical debate on the visual matrices of power and on social processes of exclusion and inclusion currently in place in global metropolises. Likewise, it is intended to contribute to the elaboration of a theoretical-methodological framework capable of understanding and addressing the complexity of the phenomena that characterize such debate. This paper analyses “A Message to America,” the 2014 ISIS video that presents the beheading of American photojournalist James Foley. This short film served as a model for the more than 200 graphically violent videos posted online by the terrorist group before the fall of the caliphate in 2019. The main objective of this research is to question the truth-value of violent ISIS videos and to advocate a critical approach to them. To this end, four key issues need to be (...) explored: the quality of the videos; their status as art, documentary, or propaganda; their target audiences; and the purpose of the message being conveyed to each of those audiences. To deconstruct the mechanisms employed by the constructed fallacy of this video and critically expose its literal and metaphorical meaning, we use textual analysis, the methodological tool developed in Greimasian semiotics. The results reveal a carefully planned text with a clearly recognizable narrative structure (crime and punishment). This video is a propaganda documentary that makes use of the tools of fiction to stage a real event: Foley dies, but his death is not shown on camera; it is only staged. Targeting two different audiences, an implicit Muslim viewer, and an explicit Western viewer, the text can be interpreted as a crossing of gazes between East and West. (shrink)

In this paper, changes in the status and nature of one case from the Family Court of England and Wales will be discussed. The changes cover two aspects of the case. Firstly, the shift from a civil action – a standard family court case concerning the break-up of a relationship and its effect on the children born from the relationship – to a quasi-criminal case in which contempt of court plays the central role; this will be discussed from a (...) class='Hi'>Greimasian perspective. Secondly, the case is accompanied by types of silence – from the textual silence of private proceedings in the Family Court to the conversational silence in the form of one of the protagonists’ right of silence.
