Speech act theory seems to provide a promising avenue for the analysis of the functional organization of argument. The theory, however, might be taken to suggest that arguments are a homogenous class of speech act with a specifiable illocutionary force and a single set of felicity conditions. This suggestion confuses the analysis of the meaning of speech act verbs with the analysis of the pragmatic structure of actual language use. Suggesting that arguments are conveyed through a homogeneous class of linguistic (...) action overlooks the way in which the context of activity and the form of expression organize the argumentative functions performed in using language. An alternative speech act analysis would treat folk terminology as a heuristic entry point into the development of a technical analysis of the myriad argumentative functions and structures to be found in natural language use. This would lead to a thorough-going pragmatic analysis of the rational and functional design of speech acts in argumentation. (shrink)

An obstacle to abortion exists in the form of abortion ‘counselling’ that discourages women from terminating their pregnancies. This counselling involves providing information about the procedure that tends to create feelings of guilt, anxiety and strong emotional reactions to the recognizable form of a human fetus. Instances of such counselling that involve false or misleading information are clearly unethical and do not prompt much philosophical reflection, but the prospect of truthful abortion counselling draws attention to a delicate issue for healthcare (...) professionals seeking to respect patient autonomy. This is the fact that even accurate information about abortion procedures can have intimidating effects on women seeking to terminate a pregnancy. Consequently, a dilemma arises regarding the information that one ought to provide to patients considering an abortion: on the one hand, the mere offering of certain types of information can lead to intimidation; on the other hand, withholding information that some patients would consider relevant to their decision-making is objectionably paternalistic on any standard account of the physician-patient relationship. This is an unsettling conclusion for the possibility of setting fixed professional guidelines regarding the counselling offered to women who are considering abortion. Thus, abortion ought to be viewed as an illuminating example of a procedure for which the process of securing informed consent ought to be highly context-sensitive and responsive to the needs of each individual patient. This result underscores the need for health care professionals to cultivate trusting relationships with patients and to develop finely tuned powers of practical judgment. (shrink)

In this paper I challenge the notion that a healthy and resilient coral is (in all cases) a fast‐growing coral, and by inference, that a reef characterised by a fast trajectory toward high coral cover is necessarily a healthy and resilient reef. Instead, I explain how emerging evidence links fast skeletal extension rates with elevated coral‐algae (symbiotic) respiration rates, most‐often mediated by nutrient‐enlarged symbiont populations and/or rising sea temperatures. Elevated respiration rates can act to reduce the autotrophic capacity (photosynthesis:respiration ratio) (...) of the symbiosis. This restricts the capacity of the coral host to build and maintain sufficient energy reserves (e.g. lipids) needed to sustain essential homeostatic functions, including sexual reproduction and biophysical stress resistance. Moreover, it explains the somewhat paradoxical scenario, whereby at the ecological instant before the reef‐building capacity of the symbiosis is lost, a reef can look visually at its best and be accreting CaCO3 at its maximum. ABSTRACT: In written work and a lecture at the 2008 Congress of the Humanities and Social Sciences that was co-sponsored by the Canadian Philosophical Association, Margaret Somerville has claimed that allowing same-sex marriage is unethical because doing so violates the inherently procreative function of marriage and thereby undermines the rights and duties that exist between children and their biological parents. In my paper, I offer five reasons for thinking that Somerville’s argument for this conclusion is unpersuasive. In each case her (...) argument either begs important questions about same-sex marriage or else relies on insufficient evidence to justify excluding a vulnerable minority group from participating in a state-sponsored social institution. RÉSUMÉ: Dans ses écrits ainsi que dans une conférence prononcée en 2008 au Congrès de la Fédération canadienne des sciences humaines, coparainnée par l’Association Canadienne de Philosophie, Margaret Somerville a prétendu que les mariages entre personnes de même sexe sont éthiquement inacceptables parce qu’ils violent la fonction primordiale du mariage, à savoir la procréation, et qu’ainsi ils portent atteinte aux droits et responsabilités qui lient les enfants et leurs parents biologiques. The enormous scale of the available information and products on the Internet has necessitated the development of algorithms that intermediate between options and human users. These algorithms attempt to provide the user with relevant information. In doing so, the algorithms may incur potential negative consequences stemming from the need to select items about which it is uncertain to obtain information about users versus the need to select items about which it is certain to secure high ratings. This tension is an (...) instance of the exploration–exploitation trade‐off in the context of recommender systems. Because humans are in this interaction loop, the long‐term trade‐off behavior depends on human variability. Our goal is to characterize the trade‐off behavior as a function of human variability fundamental to such human–algorithm interaction. To tackle the characterization, we first introduce a unifying model that smoothly transitions between active learning and recommending relevant information. The unifying model gives us access to a continuum of algorithms along the exploration–exploitation trade‐off. We then present two experiments to measure the trade‐off behavior under two very different levels of human variability. The experimental results inform a thorough simulation study in which we modeled and varied human variability systematically over a wide rage. The main result is that exploration–exploitation trade‐off grows in severity as human variability increases, but there exists a regime of low variability where algorithms balanced in exploration and exploitation can largely overcome the trade‐off. In the wake of colonial fragmentation and genocide, Indigenous ‘Khoisan resurgence’ movements in South Africa have mobilised subversive forms of authenticity, including heteroglossic and inventive translanguaging from fragments of Khoekhoegowab. In our analysis of video ethnographic texts produced in collaboration with the Gamtkwa Khoisan Council (GKC) in Hankey, the birthplace of Sarah Baartman, we explore how memory, language politics, and environmental activism are interwoven in acts of linguistic citizenship that constitute the ‘rememorying’ of a history that has remained persistently obscured. We argue that rememorying advances a politics of reminding which counters the Rainbow Nation’s institutionalised politics of forgetting, as well as anthropological accounts that consider Indigenous activist invocations of history as merely ‘therapeutic’. Through an engagement with the memory activism of the GKC, we identify how reconstructing word-histories, reliving historical traumas, retelling histories of sites of memory, seeing oneself mirrored in one’s ancestors, and the nexus of land, memory, and time form the basis for shared meaning-making, bringing impetus, focus, and intergenerational continuity to struggles for environmental and land justice. While there is a growing literature on “dark traits” (i.e., socially aversive traits), there has been a lack of integration with the burgeoning research literature on positive traits and fulfilling and growth-oriented outcomes in life. To help move the field toward greater integration, we contrasted the nomological network of the Dark Triad (a well-studied cluster of socially aversive traits) with the nomological network of the Light Triad, measured by the 12-item Light Triad Scale (LTS). The LTS is a first draft (...) measure of a loving and beneficent orientation toward others (“everyday saints”) that consists of three facets: Kantianism (treating people as ends unto themselves), Humanism (valuing the dignity and worth of each individual), and Faith in Humanity (believing in the fundamental goodness of humans). Across four demographically diverse samples (N = 1,518), the LTS demonstrated excellent reliability and validity, predicting life satisfaction and a wide range of growth-oriented and self-transcendent outcomes above and beyond existing measures of personality. In contrast, the Dark Triad was negatively associated with life satisfaction and growth-oriented outcomes, and showed stronger linkages to selfish, exploitative, aggressive, and socially aversive outcomes. Social epidemiology has made a powerful case that health determined not just by individual-level factors such as our genetic make-up, access to medical services, or lifestyle choices, but also by social conditions, including the economy, law, and culture. Indeed, at the level of populations, evidence suggests that these “structural” factors are the predominant influences on health. Legal scholars in public health, including those in the health and human rights movement, have contended that human rights, laws, and legal practices are powerfully (...) linked to health. Social epidemiology and health-oriented legal scholarship are complementary in their focus and their research needs. Legal scholarship has identified plausible ways in which legal and human rights factors could be influencing health, but empirical evidence has been limited. (shrink)

While the United Nations Principles of Responsible Management Education are a very positive development in the horizon of management education over the last decade, there are still many significant challenges for engaging the mind of the manager in ways that will foster the values of PRME and the UN Global Compact. Responsible management education must address three foundational challenges in business education if it is to actualize the aspirations of PRME: it must confront the cognitional myth that knowing is like (...) looking, it must move beyond mere analysis to systems thinking, and it must transition from a values-neutral stance to a values-driven stance. Using Developing Sustainable Strategies, an MBA practicum in the Sustainable Management Concentration at DePaul University’s Kellstadt Graduate School of Business as a case study, this article identifies the ways in which Pragmatic Inquiry can address these challenges. The method of Pragmatic Inquiry prepares students to become responsible managers, to develop sustainable strategies, and to be creators of shared value. Built from the philosophical foundations of American pragmatism and Bernard Lonergan’s critical realism, Pragmatic Inquiry is an effective method and pedagogy for responsible management education. In this paper, we examine the intersection of existentialism and management, in particular to illustrate how existential thought offers three key insights to the pragmatic world of work and applied act of management: (1) Existentialism places a primacy upon the individual and the existential self that is continually being formed within the workplace. (2) Existentialism allows for a coherent examination of individual and organisational-level decision making and ethics as an integral part of the philosophy. Sound propagation within certain non-relativistic condensed matter models obeys a relativistic wave equation despite such systems admitting entirely non-relativistic descriptions. A natural question that arises upon consideration of this is, “do devices exist that will experience the relativity in these systems?” We describe a thought experiment in which ‘acoustic observers’ possess devices called sound clocks that can be connected to form chains. Careful investigation shows that appropriately constructed chains of stationary and moving sound clocks are perceived by observers on the (...) other chain as undergoing the relativistic phenomena of length contraction and time dilation by the Lorentz factor, \, with \ the speed of sound. Sound clocks within moving chains actually tick less frequently than stationary ones and must be separated by a shorter distance than when stationary to satisfy simultaneity conditions. Stationary sound clocks appear to be length contracted and time dilated to moving observers due to their misunderstanding of their own state of motion with respect to the laboratory. Observers restricted to using sound clocks describe a universe kinematically consistent with the theory of special relativity, despite the preferred frame of their universe in the laboratory. Such devices show promise in further probing analogue relativity models, for example in investigating phenomena that require careful consideration of the proper time elapsed for observers. (shrink)

Argumentation occurs through and as communicative activity. Communication is organized by pragmatic principles of expression and interpretation. Grice’s theory of conversational implicature provides a model for how people use rational principles to manage the ways in which they reason to representations of arguments, and not just reason from those representations. These principles are systematic biases that make possible reasonable decision-making and intersubjective understandings in the first place; but they also make possible all manner of errors and abuses. Assessing social risks has proven difficult for IRBs. We undertook a novel effort to empirically investigate social risks before an HIV prevention trial among drug users in Thailand and China. The assessment investigated whether law, policies and enforcement strategies would place research subjects at significantly elevated risk of arrest, incarceration, physical harm, breach of confidentiality, or loss of access to health care relative to drug users not participating in the research. The study validated the investigator's concern that drug users were (...) subject to serious social risks in the site localities, but also suggested that participation in research posed little or no marginal increase in risk and might even have a protective effect. Our experience shows that it is feasible to inform IRB deliberations with actual data on social risks, but also raises the question of whether and when such research is an appropriate use of scare research resources. Stroud Department of Philosophy Temple University Indian philosophy has often been described as radically different in nature than Western philosophy due to its frequent use of narrative structure. By employing poetic elements in their use of language, such texts attempt to convey deep metaphysical (...) truths and philosophical positions about reality that are in many cases quite different from Western ideas (Babbili 1997). Often, these ways of conveying truths are an integral part of that truth. One particularly useful form is narrative, taking instantiations such as a dialogue between characters. Philosophical dialogues such as the Bhagavad Gita and the Astavakra Gita (also known as the Astavakra Samhita ) use a portrayed conversation involving a guru or deity to convey didactic lessons and values to the receptive audience, both ancient and modern. As texts such as the Bhagavad Gita gain in popularity and circulation in the Western world (Minor 1982; Paine 1998; Sharpe 1985), philosophical and rhetorical inquiry must be extended to explain how these texts function in an argumentative philosophical context.Stroud (2002a, 2002b) has advanced the idea that such ancient Indian narratives argue through the use of contradictions and conflicting value structures;1 he labels such texts as multivalent narratives since their use of contradictory value structures compel audience members to reconstruct the narrative's message and allow for the acceptance of novel views. Multivalent narratives are to be distinguished from polysemic narratives (Fiske 1986) in that the latter concern different audience members finding a preferred position from the ambiguous story. Polysemic narratives involve the difference in meaning of the same story to different auditors. Condit criticizes this notion of polysemic narratives and advances her own concept of polyvalent narratives. The concept of a polyvalent narrative involves different auditors understanding the same story in similar ways, but differing in how they evaluate its message. Condit's research with a popular television [End Page 42] show and two students from radically different backgrounds on abortion finds that they understood what occurred in a very similar fashion; they differed in that they "disagree[d] about the valuation of those denotations to such a degree that they produce[d] noticeably different interpretations" (1989, 106). Thus, the auditors differ as to their response to a certain story and how it treats their own cherished values. Stroud (2002a) provides a thorough justification as to why the concepts of polysemic and polyvalent narratives do not capture what can be called multivalent narratives. The important factor in distinguishing these three concepts is that the third involves contradictions at the level of values within a text and the reader's necessitated activity of trying to synthesize or reconcile such contradictions. It is this activity that is the hallmark of multivalent narratives.This employment of multivalent narrative offers a challenge to familiar Western conceptions of argumentative discourse and demands further investigation. This study explores the ways a particular text, the Astavakra Gita, argues its philosophical positions to its audience of potential "pupils."2 Using the insights provided by theories of narrative and reader-response theory, I will argue that this text advances its claims not through overt syllogism or validity claim redemption, but through textual indeterminacy between the audience's disposition and the foregrounded theme of non-individuation in the text. This tension, increased by certain textual devices, results in consistency building by the audience, which enables the transcendence of these two viewpoints (reader and text); it is this experience, not claim, that the Astavakra Gita seems to be advancing to any given audience.In order to explore this interpretation of this text and its argumentative relationship to an audience, insights from both literary studies and rhetorical theory must be used in laying a foundation. In this paper, I explore several privacy issues as they arise with respect to the divine/human relationship. First, in section 1, I discuss the notion of privacy in a general way. Section 2 is devoted to the claim that privacy involves control over information about oneself. In section 3, I summarize the arguments offered recently by Margaret Falls-Corbitt and F. Michael McLain for the conclusion that God respects the privacy of human persons by refraining from knowing certain things about them. (...) We are grateful to Jongsma et al 1 for their interest in our article analysing the case of ‘Mrs A’, a Dutch woman with Alzheimer’s disease who received euthanasia based on her advance euthanasia directive.2 Their commentary criticises two elements of our analysis. First, the authors believe our reasons for doubting that Mrs A had the capacity to write and revise an AED rely on ‘partial’ empirical data and rest on normative errors. Second, they use two of our statements to (...) suggest we must endorse some implausible claims, for example, that ‘… in all situations and for all people, current well-being should always take precedence over all other values’. Jongsma et al assert: ‘Miller et al argue that people with dementia are impaired to make decisions.’ This casts our probabilistic claim about Mrs A’s capacity as an absolute claim about persons with dementia in general. It also implies we are using an outdated diagnosis-based view of capacity. The accusation then becomes explicit : > … several empirical studies have shown that patients with dementia are able to actively participate in qualitative studies and can respond to open questions in a meaningful way,[2-8] as well that they are able to complete an advance directive in the early phases of dementia.[9, 10] One can therefore not simply conclude on the basis of the diagnosis of dementia …. This paper addresses issues of agency and self-identity on the basis of a phenomenology of embodiment. It considers a tension in accounts of embodiment between, on the one hand, the body as the locus of subjectivity, lived experience, and agency, and, on the other hand, the body as constructed, as the site where discursive regimes of power are inscribed. In exploring this tension I consider Frantz Fanon’s and Sarah Ahmed’s phenomenological accounts of racism to illustrate the ways in which social (...) power and violence come to be implicated in these conflicts within our embodied identities. I also consider Foucauldian “power” in relation to Merleau-Ponty’s concept of “institution.” I argue that only the phenomenological concept of institution, by drawing our attention to the ambiguities of lived embodiment, succeeds in offering us resources for thinking about the interplay between passivity and agency in the life of the subject, and, in particular, about a form of agency not wholly reducible to the effects of power. This chapter discusses natural theology in the early modern period. It demonstrates that early modern natural theology was a contested arena, in which a number of different standpoints might be justified based on the history of classical or Christian thought; that those different positions reflected disagreements about how one should read the evidence of nature, and what weight one should give to the Bible and to reason as lights to guide one in doing; and that natural theology had an important (...) and changing role to play in the Aristotelian curriculum that dominated the universities of Western Europe until at least the late seventeenth century. The chapter then considers successful late seventeenth- and early eighteenth-century natural theologies that were written by theologians, followed by discussions of revolutions in knowledge and natural philosophy, and the impact of Descartes and Newton. Here we offer short responses to those articles by members ofBusiness Ethics Quarterly’s editorial board and editorial team.

Certification schemes and labels such as the Forest Stewardship Council, Fairtrade, and Rainforest Alliance are market-based mechanisms designed to harness consumer power in economically developed countries to influence companies to improve the economic, social and environmental welfare of producers, workers and communities in economically developing countries. However, consumers are largely not convinced that certification schemes are acting in the interests of developing countries, because consumers have different understandings of the ethics of global trade. Drawing on the results of six semi-structured (...) focus groups comprising 58 consumers and an online panel-based survey of 1014 respondents, this study tests the central assumption underlying these schemes that consumers are motivated to hold companies responsible for unethical behaviour. Most consumers hold sceptical, and at times, conflicting views in terms of how they perceive the root causes of the problems, possible solutions and ethical trade beneficiaries. This study contributes to the nascent literature on political consumerism, by highlighting an under-theorised and contradictory challenge for certification schemes. Political consumers are required to recognise the complexities of ethical trade while believing that the simple act of purchasing their labelled products is effective. In this book Joan Wallach Scott discusses the role history has played as an arbiter of right and wrong and of those who claim to act in its name-- "in the name of history." Scott investigates three different instances in which repudiation of the past was conceived as a way to a better future: the International Military Tribunal at Nuremberg in 1946, the South African Truth and Reconciliation Commission in 1996, and the ongoing movement for reparations for slavery (...) in the United States. Scott shows how in these cases history was not only used to explain the past but to produce a particular future. Yet both past and future were subject to the political realities of their time and defined in terms of moral absolutes, often leading to deep contradictions. These three instances demonstrate that history is not an impartial truth, rather its very meaning is constructed by those who act in its name. (shrink)

Throughout his career Paul Ramsey returned repeatedly to the seminal works of Augustine to clarify both the foundations of Christian moral thought and its application to problems of social ethics. The paper argues that in the course of developing his own thought Ramsey moved from merely using the insights of Augustine to a genuinely Augustinian theological position, balancing the pastoral responsibilities of the theologian to the community with the demand for faithfulness to the integrity of the Christian tradition. In the debate over Spanish treatment of the natives of the New World, both sides regularly invoked Aristotle on natural slaves. This paper argues that the interpretation of the Spanish Dominican Domingo de Soto displays a greater understanding of Aristotle and the Aristotelian tradition of justice than that of Juan Gines de Sepúlveda, the Spanish Humanist. The paper goes on to argue that it is the humanist tradition itself that disposes Sepúlveda to misconstrue Aristotle and the tradition of political justice.

Toward the end of Hume's Dialogues concerning Natural Religion , Philo catalogues the ‘frivolous observances’, ‘rapturous ecstasies’ and ‘bigotted credulity’ of ‘vulgar superstition’, concluding that ‘true religion, I allow, has no such pernicious consequences: But we must treat of religion, as it has com monly been found in the world’ . This would be a mild enough sort of caveat were it not nigh on impossible to determine exactly what counts as true religion, and how it figures in Hume's argument. (...) Typically, answers to this puzzle have required identifying the positions of the discussants, and then arguing that one of them represents Hume's views. ABSTRACT In his published work, Levinas only mentions metaphor for the sake of dismissing its relevance to his ethics of transcendence. Metaphor is aligned with the poetic imagery and the rhetorical devices that weave together an ontology of immanence, whereas transcendence is said to occur through an immediate encounter with the other. But Levinas's unpublished lecture “La Métaphore” is of interest precisely because it troubles this distinction through the notion of a “metaphorical transcendence.” Although Levinas abandons this terminology after his (...) lecture, this article suggests that an implicit, but unavowed, operation of metaphor persists in the guise of his ethics of substitution.
