There can be little doubt that, over the last decade or so, the work of Carl Schmitt has emerged as a central point of reference, in both positive and negative terms, for many debates within contemporary political theory. ExcerptCarl Schmitt (1888–1985) is known as the most consequential German legal and political mind of the twentieth century.1 Many crimes of the Nazi regime found support in his conceptual justifications, and Schmitt is called the “Crown Jurist” of the Third Reich with good reason. Historians, political scientists, and sociologists must grapple with the author in order to understand the course of totalitarianism in modernity. Whether literary historians should do so is far less settled, though he was fascinated by (...) their object of study. His writings on literary topics are said to reveal much about Schmitt’s person, politics, and period, but little about literature itself.2 This explains why his “Don Quijote und das Publikum” (“Don Quixote and the Public”), published in the arts and cultural journal Die Rheinlande in 1912, was almost unknown in literary studies for a century.3 Schmitt’s text on the novel by Miguel de Cervantes has not been reprinted, and until recently it had not been translated from the original German. Size has a role too. At under two thousand words, the text has probably escaped notice due to its small scale.4 Recent English and Italian translations in major humanistic journals may signal the end of its obscurity though.5 “Don Quixote and the Public” is at the door of literary studies. Many studies have deduced subterranean dialogues between Hannah Arendt and Carl Schmitt from indirect evidence. This article uses new evidence from marginalia in Arendt’s copy of Nomos of the Earth and finds that she formed, but never published, an incisive critique of Schmitt’s geopolitics. Through an analysis of Arendt’s comments on the topics of soil, conquest, and contract, I show that Arendt deemed Schmitt’s theory to be imperialist and in contradiction with itself. Her reading of (...) class='Hi'>Schmitt prompts important new questions regarding the scholarly use of Schmitt’s conception of nomos as a tool of critique against American empire in the post-9/11 era. The marginalia also suggests, against past scholarship, that Arendt thought justice should play a central role in politics. I propose that we look to Arendt’s own conception of nomos, which she developed later, in order to form an alternative geopolitics. Although the modern age is often described as the age of democratic revolutions, the subject of popular foundings has not captured the imagination of contemporary political thought. Most of the time, democratic theory and political science treat as the object of their inquiry normal politics, institutionalized power, and consolidated democracies. The aim of Andreas Kalyvas' study is to show why it is important for democratic theory to rethink the question of its beginnings. Is there a founding unique to democracies? Can (...) a democracy be democratically established? What are the implications of expanding democratic politics in light of the question of whether and how to address democracy's beginnings? This article addresses Eric L. Santner’s claim that “there is more political theology in everyday life than we might have ever thought” by analyzing the “theologico-political problem” in the work of three prominent twentieth-century political thinkers—Carl Schmitt, Leo Strauss, and Hannah Arendt. Schmitt, Strauss, and Arendt share a preoccupation with the crisis of modern political liberalism and confront the theologico-political problem in a similar spirit: although their responses differ dramatically, their individual accounts dwell on the absence of (...) incontestable principles in modern society that can justify life-in-common and the persistence of the political order. Their writings thus engage with the question of the place of “the absolute” in the political realm. In particular, Arendt’s indirect approach to the theologico-political problem is crucial to understanding the radicality of a political world in which traditional certainties can no longer be re-established. The theoretical trajectory I present suggests that the dispersion of political theology in everyday life has a specific corollary: modern politics operates within the tragic and paradoxical nature of its unstable and common origins that cannot be incorporated in exceptionalist versions of the body politic. We can pinpoint almost to the day the moment at which Hannah Arendt became a political theorist, and we can name with precision the experiences that made her one. Born in 1906, she had led a substantially apolitical life until Hitler gained power and she fled Germany in 1933. In Paris, she became an activist, busy in Jewish refugee affairs but with little time for abstract reflection. It reconstructs these arguments in her corpus, especially her book "On Revolution," and argues that this dimension of her work may have been a response to Carl Schmitt (and is in any event now usefully read in such a way). The purpose of the study is the hermeneutic reconstruction of the political in the original concepts of K. Schmitt and H. Arendt. The scientific novelty lies in the analysis of the approaches of K. Schmitt and H. Arendt to the identification of the essence of the political. As a result, the differences between the theoretical approaches of K. Schmitt and H. Arendt were revealed, which correlate with each other according to the principle of complementarity. According to K. (...) Schmitt, in the era of modernity there is a monopolization of politics by the state, which acquires an external character and is implemented in the space of international relations. H. Arendt considers the political as the quintessence of active life, which is carried out by free people, first in the space of the ancient polis, and in later times – in other formats of publicity. One of the big problems of the philosophy of politics is the regard of violence and conflict, both of them presented through a double critical perspective: On one hand, violence is considered to be in the base of politics and represents an unbeatable phenomenon, besides being its starting point and condition. On the other hand, violence is considered a dissolving element of the political domain. This piece of writing is focused on the central thesis proposed by Schmitt and Arendt (...) upon violence: as a condition and dissolution of politics respectively. The confrontation of Schmitt´s and Arendt’s positions expresses a dilemma that serves as a starting point: assuming violence as a condition and axis of the political life, or stating the exclusion of theoretical reflections upon violence as a core element in this political space. Thus, it is possible to postulate that the solution is in assuming violence as a fact of political life and overcoming it through dialogue and discourse of the political society. (shrink)

The notion of biopolitical sovereignty and the theory of the state of exception are perspectives derived from Carl Schmitt’s thought and Michel Foucault’s writings that have been popularized by critical political theorists like Giorgio Agamben and Michael Hardt and Antonio Negri of late. This article argues that these perspectives are not sufficient analytical points of departure for a critique of the contemporary politics of terror, violence and war marked by a growing global exploitation of bodies, tightened management of life, (...) and endless and unpredictable abusive force. To better capture the singularity of our present condition of violence, war and terror, a supplementation of Schmitt’s and Foucault’s approaches by way of Hannah Arendt’s language of political action and agonistic engagement is useful. By bringing Arendt’s language of political agony to bear on contemporary biopolitical debates and discourses, we wish to revisit common practices of war and terror as matters of ‘agonal sovereignty’. ‘Agonal sovereignty’ allows us to peer into the ‘abyss of total violence’ that manifests itself after sovereign decisionism and biopolitical modalities of power have taken over the everyday conduct of political affairs. The institution of crimes against humanity at Nuremberg in 1945 was an event which marked the birth of cosmopolitan law as a social reality. Cosmopolitan law has existed as an abstract idea at least since the writings of Kant in the late eighteenth century, but Nuremberg turned the notion of humanity from a merely regulative idea into a substantial entity. Crimes against humanity differ significantly from the traditional categories of international law: war crimes and crimes against peace. While the latter (...) generally treats states as subjects of right and upholds the principle of national sovereignty, the former treats individuals as subjects of right and encroaches on national sovereignty. I focus here on the writings of Hannah Arendt on the Nuremberg trials, the Eichmann trial and the actuality of crimes against humanity perpetrated in totalitarian regimes. I explore her relation to the optimistic and naive cosmopolitanism of Karl Jaspers, as well as to the two prevailing forms of critical thought: the cynical realism towards the law adopted by many of the defendants, including Carl Schmitt, and the deconstructive attitude to humanism and technology adopted by Martin Heidegger. I maintain that Arendt's rugged cosmopolitanism, tested against its critics, remains exceptionally revealing on the issue of crimes against humanity now that this issue has re-emerged, after many years of silence, as arguably the most important question of our own day. It seems that the first two decades of the twenty first century demonstrate political mythology to be still functioning in the political life of the West. In this context, it is interesting to view the recent publications of Hans Blumenberg’s Nachlass: Präfiguration and Rigorismus der Wahrheit, as they reveal unpredicted complications for the interpretation of his philosophy of myth as well as of his political stances. They also evoke some more general questions concerning the role of myth in our contemporary (...) political life. The aim of this article is to present the paradoxes connected with the posthumously published Blumenberg critique of Hannah Arendt and to situate it in the wider context of twentieth century political thought, specifically the work of Sorel, Schmitt, Rosenberg and Cassirer. The aim of the article is to outline and compare the way that Carl Schmitt and Hannah Arendt understand the spheree of politics as well as analyse the concepts of power and freedom connected with their theories. Both Schmitt and Arendt criticise liberal democracy for its “neutrality” and counterpoise it with their own understanding of political action. Especially Schmitt who understand such action as a conflict between friends and enemies. The concept of the pre-political, which fits with the »liberal« vocabulary, has its origin in two political thinkers, who, following very different political and normative conceptions, contributed to the radical questioning of rationalistic and teleological concepts of politics. In his 1935 treatise on divine sovereignty, the Jewish philosopher Martin Buber introduced the idea of an 'anarchic soul of theocracy.' A decade before, the German jurist Carl Schmitt had coined the term 'political theology' in order to designate the Christian theological foundations of modern sovereignty and legal order. In a specular and opposite gesture, Buber argued that the covenant at Sinai established YHWH as the King of the Israelites and simultaneously promulgated the principle that no human being could (...) become sovereign over this people. In so doing, Buber offered an interpretation of Jewish theocracy that is both republican and anarchic. Republican because, by pivoting on the idea that democracy is a function of a people's fidelity to a prophetic higher law, theocracy displaces the central role of the human sovereign. Anarchic because this divine law is saturated with the messianic aim to put an end to relations of domination between peoples. In this book I show that this republican and anarchic articulation of the discourse of political theology characterises the development of Jewish political theology in the 20th century from Hermann Cohen to Hannah Arendt. Both G.F.W. Hegel and Carl Schmitt took seriously the problem of political sovereignty entailed by liberal political theories. In Dictatorship (1919) and Political Theology (1922), Schmitt rejects liberal political theories that argue for the immediate unity of democracy and legality i.e., popular sovereignty, because he thinks they cannot secure political sovereignty. In the Philosophy of Right, Hegel denounces popular sovereignty for similar reasons. Yet given Schmitt’s negative assessment of Hegel their positions are seldom related to one another. (...) I argue in this paper that Schmitt’s analysis of liberal political theories is similar to Hegel’s analysis of Rousseau’s liberal ideas. I contend, however, that Schmitt’s solution, which collapses the distinction between the executive and the legislative power in favor of the former, fails to secure political sovereignty. Contrary to Schmitt, Hegel conceives of the liberal predicament as a basic determination of any political state that rests on the division of the legislative and executive power. Hegel argues that the constitutional monarchy is a genuine instantiation of political sovereignty that can maintain not only the division of these powers, but also their unity. In this regard, I argue that Hegel’s conception of the division of powers provides a more convincing theory of the problem afflicting modern states than Schmitt’s and at least deserves to be taken more seriously by critics of Schmitt’s solution such as Hannah Arendt, Leo Strauss, Jurgen Habermas, Andreas Kalyvas and Chantal Mouffe. The Challenge of the Exception is the key that unlocked the ideas of Carl Schmitt, a leading political theorist and jurist who influenced the thoughts of, among others, Hannah Arendt, Carl Joachim Friedrich, Otto Kirchheimer, Hans Morgenthau, Franz Neumann, and Leo Strauss. Professor Schwab clearly articulates Schmitt's key concepts and relates their centrality to politics and the state, to the political theory of liberalism, democracy and authoritarianism, and to international relations. When Schwab treats Schmitt's interpretations of (...) constitutional questions, for example, he shows how political theory in Germany is inextricably linked with constitutional law, legal theory, and the country's history. Not content to merely deal with Schmitt's profound contributions to twentieth-century thought, Schwab devotes considerable space to the unconscionable compromises that he made with the Third Reich. This, however, failed to help him become the political and legal theorist of Hitler's Germany. Schwab shows how the new Schmitt was suspect from the beginning and, by 1936, Schmitt the hunter had become Schmitt the hunted. But Goethe soon noticed that as the prosecutor spoke the man kept the bottle lying on its side, its sands inert, and whenever the defense began to speak the man would turn the bottle upright and restart its sand flow. When the state spoke, time stopped. The defense, however, was subject to time.The story accords well with the views of state sovereignty propounded by Carl Schmitt, who identifies sovereignty as such with the power to legally suspend law for a time by declaring a state of exception. For Schmitt, as for Giorgio Agamben, who works in his wake, the state of exception is that paradoxical situation in which the law is legally suspended by sovereign power. The ensuing condition is one in which we—or, rather, sovereign powers—are neither subject to law nor free of it but rather both, since the state of exception is itself a legal condition of alegality. Recently legal theorists have pointed out that whereas members of their profession often assume that post-war scholarship had broken with the past completely, political theorists have paid far more attention to questions of influences and continuities in their discipline. This also holds regarding the legacy of Carl Schmitt whose case both as a jurist and political writer is particularly pressing not only for intellectual historians, but also for discussants across a broad range of fields in law and political science. (...) It is in this context that my paper examines Hannah Arendt's immediate critique of the Declaration of Universal Human Rights in 1948. I will juxtapose Schmitt's and Arendt's critiques, arguing that these display more than superficial parallels and yet conflict in their basic contentions. This paper offers a critical analysis of the role of political theology in contemporary political praxis and theory. In particular, it examines the idea that a retrieval of politico-theological thinking can counter what some theorists describe as the disorienting effects of ‘postmodern relativism’. With a focus on the United States, the paper first shows that the political landscape there attests to an excessive political theology that is ‘messianic’ in structure and that carries markedly Schmittian traits on the level of its (...) content as it detaches decision-making from prudential and ethical concerns. Subsequently, it argues that the fact that ‘new political theology’ in its currently dominant (messianic, decisionist, and conflictual) form is incompatible with cornerstones of what Hannah Arendt defines as ‘real democracy’ does not preclude a different return to conceptual resources provided by the politico-theological tradition: This productive alternative is elaborated with the help of Arendt’s reinterpretation of two notions central to Schmitt’s discourse, sovereignty and the miracle. We live in a time when we are overwhelmed with talk and images of violence. Whether on television, the internet, films or the video screen, we can’t escape representations of actual or fictional violence - another murder, another killing spree in a high school or movie theatre, another action movie filled with images of violence. Our age could well be called “The Age of Violence” because representations of real or imagined violence, sometimes fused together, are pervasive. But what do we (...) mean by violence? What can violence achieve? Are there limits to violence and, if so, what are they? In this new book Richard Bernstein seeks to answer these questions by examining the work of five figures who have thought deeply about violence - Carl Schmitt, Walter Benjamin, Hannah Arendt, Frantz Fanon, and Jan Assmann. He shows that we have much to learn from their work about the meaning of violence in our times. Through the critical examination of their writings he also brings out the limits of violence. There are compelling reasons to commit ourselves to non-violence, and yet at the same time we have to acknowledge that there are exceptional circumstances in which violence can be justified. Bernstein argues that there can be no general criteria for determining when violence is justified. The only plausible way of dealing with this issue is to cultivate publics in which there is free and open discussion and in which individuals are committed to listen to one other: when public debate withers, there is nothing to prevent the triumph of murderous violence. The conceptual history of politics in post-WWII (West-) Germany is connected to the history of academic political science. From the Bundestag plenary debates (beginning in September 1949) both the controversies on the political science itself and the contributors of both contemporary scholars and the ‘classics’ of the understanding of politics can be studied. The digitalisation of parliamentary debates opens up new chances for conceptual research in this regard. The article studies the conceptual commitments in the use of the discipline titles (...) (Politikwissenschaft, Politische Wissenschaft, Politologie, Politikforschung, Politische Theorie, also political science) and actors (Politologe, Politikprofessor, Politstudent etc), and looks at who is mentioned in debates, for example, political scientists in early West Germany (Dolf Sternberger, Theodor Eschenburg, Wilhelm Hennis), and political theorists (Max Weber, Carl Schmitt, Hannah Arendt), Formulae from Weber’s Politik als Beruf seem to be most frequently evoked in the Bundestag. Hannah Arendt's existential, republican concept of politics spurned Carl Schmitt's idea that enmity constituted the essence of the political. Famously, she isolated the political sphere from social conflict, sovereign regimes, and the realm of military violence. While some critics are now interested in applying Arendt's more abstract political ideas to international affairs, it has not been acknowledged that her original reconceptualization of politics was in fact driven by her analysis of global war, and in particular, the startling new (...) challenges raised by nuclear warfare. Arendt's early, unpublished manuscript on the nature of politics contains important reflections on the nature of war and empire. Surprisingly, these reflections tentatively explore the relationship between war and political freedom. A close reading of this work on war can help explain both her later, more radical non-violent concept of political action, and the difficulties she faced integrating her existential republicanism within the global context of conflict in the Cold War. This essay goes beyond the dominant conception of constituent power developed by Emmanuel Sieyès and Carl Schmitt by excavating an alternative through the practices of twentieth-century workers’ councils and the interpretations of council democracy by Cornelius Castoriadis and Hannah Arendt. Interpreters of the constituent power often agree on its fundamentally antagonistic relation to constituted power, hereby making constituent politics a momentary experience, which cannot be sustained in constituted politics. Council democracy, instead, discloses a modality of politics, which bridges (...) the gap between constituent power and political form in order to provide institutional means through which the spirit of revolution can survive the founding moment. With this alternative concept of council democratic constituent power, this essay contributes to radical democratic theory by stipulating ways in which institutions can be rethought radically democratic as a way in which constituent power (creativity, novelty, freedom) can be institutionally approximated and continually reexperienced. Jessica Dubow’s In Exile – working through Hannah Arendt, Walter Benjamin and Franz Rosenzweig – reads Judaic thought from the Exodus as exile. With Rosenzweig, she understands this as pitting the (Judaic) singular of faith against the (Greek) universal of reason. This ‘bad universal’ was Hegel’s state, which Dubow also sees as Carl Schmitt’s state. Dubow sees this as it were universal of dominance in today’s Israeli state, against which she pits the singular of exilic thought.

It first analyzes constitutionalism in the light of political modernity. Indicating that political power grounded by constitutions is omnipotent, complementing and completing constitutionalism, the paper contends that an omnipotent constitutional ordering is anything but an unleashed Leviathan. It is argued that constitutional omnipotence is framed and thus constrained by a constitutional (...) nomos, the matrix of which is a dual delimitation of boundaries, generational, and jurisdictional. The notion of the "impolitical" developed in this volume draws its meaning from the exhaustion of modernity's political categories, which have become incapable of giving voice to any genuinely radical perspective. The impolitical is not the opposite of the political but rather its outer limit: the border from which we might glimpse a trajectory away from all forms of political theology and the depoliticizing tendencies of a completed modernity. The book's reconstruction of the impolitical lineage-which is anything but uniform-begins with (...) the extreme conclusions reached by Carl Schmitt and Romano Guardini in their reflections on the political and then moves through a series of encounters between several great twentieth-century texts: from Hannah Arendt's On Revolution to Hermann Broch's The Death of Virgil, to Elias Canetti's Crowds and Power; from Simone Weil's The Need for Roots to Georges Bataille's Sovereignty to Ernst Junger's An der Zeitmauer. Telles sont les conséquences politiques que doit tirer aujourd'hui ta philosophie, si du moins elle ne se contente pas, avec ta pensée contemporaine depuis Kierkegaard, de poser l'existence ; de surcroît elle pose l'inconscient qui en est le principe. Car ta seule affirmation de l'existence a voué la philosophie à une contradiction radicale incarnée dans ce penseur si problématique qu'est Carl Schmitt. Et elle a débouché, à travers le projet de révolution anticapitaliste, sur tes horreurs du totalitarisme lumineusement décrites par Hannah Arendt. There is much disagreement among many commentators of Hannah Arendt's work about whether her contributions to politics and philosophy contain a clandestine version of decisionism or, by contrast, represent an explicit attempt to break away from the elements of voluntarism, arbitrariness, and irrationality, which are considered to be inherent to any theory of the decision. Despite the many disagreements that set apart these two interpretations of Arendt, however, there is a common presupposition that both share. They are in agreement (...) concerning the decision: it is a threat and a vice, intrinsically dangerous and potentially totalitarian in nature, which ought to be expelled from any theory of politics with a normative content. As a result, the terms of the debate pertain solely to whether Arendt was a (crypto-) decisionist and not to the nature and evaluation of the decision as such. This paper argues, contrary to Arendt's critics, that although elements of a theory of the decision can be found scattered throughout many of her writings, she was nonetheless unswerving in her opposition to decisionism. But unlike her defenders, it also argues that had Arendt built on these elements to elaborate a systematic theory of the decision, she would have avoided many of the flaws and inconsistencies that plague her concept of politics. Sociability and Its Enemies contributes both to contemporary studies of political theory and to discourse on postwar Germany by reconstructing the arguments concerning the nature and value of sociability as a form of interaction and interconnection particular to modern bourgeois society. Jakob Norberg argues that the writings of Hannah Arendt, Jürgen Habermas, Carl Schmitt, and the historian Reinhart Koselleck present conflicting responses to a hitherto neglected question or point of contention: whether bourgeois sociability should serve as a therapeutic (...) practice and politically relevant ideal for postwar Germany. Authority is often defined as legitimate power, and contrasted to pure power. In the case of legitimate authority, compliance is voluntary and based on a belief in the right of the authority to demand compliance. In the case of pure power, compliance to the demands of the powerful is based on fear of consequences or self‐interest. But beyond this, there is considerable disagreement and variation of usage. Because legitimacy is a concept from monarchic rule, deriving from the right of the (...) legitimately born heir to rule as monarch, authors as diverse as Hannah Arendt and Carl Schmitt have argued that it is not applicable to modern politics. But it is nevertheless commonly applied, even in ordinary political discussion, to many situations, such as voluntary compliance to taxation, that go far beyond the original meaning. (shrink)

Appealing to the original meaning of the Greek term nomos, Hannah Arendt claims that a bounded legal space is constitutive for political community. Can this seemingly anachronistic claim be substantiated in the conceptually strong sense that every polity - the Greek city-state as much as a hypothetical world state - must constitute itself as a nomos? It is argued that whereas Arendt falls short of justifying this claim, a reflexive reading of nomos can do the trick: the space of (...) political community is necessarily bounded because no polity is imaginable that does not raise a claim to an inside as the community’s own space. A world state, were it ever to be founded, would globalize nomos, not suppress it. Whence the political problem: how does a polity deal with its outside? This problem is particularly pressing because Carl Schmitt’s defense of nomos radically challenges Arendt’s position. A reinterpretation of her analyses of the foundation of a political community suggests how the representational structure of a politics of boundaries parries Schmitt’s challenge. (shrink)
