When heterogeneous players make strategic investment decisions in multi-stage contests, they might conserve resources in a current contest to spend more in a subsequent contest, if the degree of heterogeneity in the current contest is sufficiently large. We confirm these predictions using data from German professional soccer, in which players are subject to a one-match ban if they accumulate five yellow cards. Players with four yellow cards facing the risk of being suspended for the next match are less likely to (...) be fielded when the heterogeneity in the current match increases and more likely to receive a fifth yellow card in the current match when heterogeneity in the next match increases or heterogeneity in the next match but one decreases. Recent calls to address racism in bioethics reflect a sense of urgency to mitigate the lethal effects of a lack of action. While the field was catalyzed largely in response to pivotal events deeply rooted in racism and other structures of oppression embedded in research and health care, it has failed to center racial justice in its scholarship, pedagogy, advocacy, and practice, and neglected to integrate anti-racism as a central consideration. Academic bioethics programs play a key role in determining the (...) field’s norms and practices, including methodologies, funding priorities, and professional networks that bear on equity, inclusion, and epistemic justice. This article describes recommendations from the Racial Equity, Diversity, and Inclusion (REDI) Task Force commissioned by the Association of Bioethics Program Directors to prioritize and strengthen anti-racist practices in bioethics programmatic endeavors and to evaluate and develop specific goals to advance REDI. James articulates and defends a Spinozist view of the interplay between poetry and philosophy: philosophy has an ineliminably poetic content, and poetry is an aid and support to philosophy. In this piece, I juxtapose James’s Spinozist schema with another schema available within Spinoza’s historical milieu. In Ibn Tufayl’s view, rather than poetry being an aid to philosophy, poetry opens to a world of experience that even the best philosophy cannot grasp. For flat-footed philosophers who think that philosophy can in principle (...) have the last word on everything, poetics might give an approximate indication of a kind of experience that lies beyond it. Do moral appraisals shape judgments of intentionality? A traditional view is that individuals first evaluate whether an action has been carried out intentionally. Then they use this evaluation as input for their moral judgments. Recent studies, however, have shown that individuals’ moral appraisals can also influence their intentionality attributions. They attribute intentionality to the negative side effect of a given action, but not to the positive side effect of the same action. In three experiments, we show that this asymmetry is (...) a robust effect that critically depends on the agent’s beliefs. The asymmetry is reduced when agents are described as not knowing that their action can bring about side effects, and is eliminated when they are deemed to hold a false belief about the consequences of their actions. This paper is aimed at understanding one central aspect of Bolzano's views on deductive knowledge: what it means for a proposition and for a term to be known a priori. I argue that, for Bolzano, a priori knowledge is knowledge by virtue of meaning and that Bolzano has substantial views about meaning and what it is to know the latter. In particular, Bolzano believes that meaning is determined by implicit definition, i.e. the fundamental propositions in a deductive system. I go (...) into some detail in presenting and discussing Bolzano's views on grounding, a priori knowledge and implicit definition. I explain why other aspects of Bolzano's theory and, in particular, his peculiar understanding of analyticity and the related notion of Ableitbarkeit might, as it has invariably in the past, mislead one to believe that Bolzano lacks a significant account oï a priori knowledge. The place of man in Darwin's development of a theory of transmutation has been obscured by his manner of disclosure. Comparing the 1837–1839 period to his entire career as a theorist suggests that it was Darwin's practice to present himself and his work only before the most select scientific audiences, and then in accordance with their expectations. The negative implications of this rule for his publication on man are clear enough: finding no general invitation in science to publish as a (...) theorist and no contemporary scientific audience for the sorts of inquiries he was making on man, he was silent, at least until such time as he could publish on the strength of reputation alone. Now, with the availability of manuscripts from the early period, what was once hidden stands revealed. It is clear from Darwin's notebooks that man played a dual role in the formation of his theory: as a zoological species to be incorporated into the theory and as the primary vehicle for the study of behavior. On the first score, integrating man into the theory provoked Darwin to break with the traditional view of man's place in nature and to reject a major element in the scientific notion of progressive development. On the second score, the study of behavior led Darwin outside natural history and thence, unexpectedly, to Malthus and natural selection.One is left with the certainty that the subject of man was a central element in Darwin's formulation of his species theory. To an extent, then, the public judgment of Darwin was right all along, for the public had always sensed that Darwin spoke to a larger audience than that formed around science. On the basis of new evidence, we can add that Darwin drew from that larger audience as well. There are of course ironies to this conclusion: that Darwin the professional drew so heavily from fields where he was the amateur, that as a transparent man his inner life should prove so at odds with the manner in which he presented himself, and that his arrival at a strong sense of himself—the revolutionary “I” of his notebooks—should occur just as he stepped beyond science to engage the general culture. But when one considers the inherent difficulties of Darwin's subject and the magnitude of his claims respecting man, these ironies are perhaps not surprising at all but those of a kind which might be anticipated. In this paper, we present a Lacanian perspective on football, while notably fathoming its normative dimension. Starting with a defining imperative, the prohibition against ‘handling’ or touching the ball with your hands, diverging football historically from rugby, we will subsequently focus our attention on the role of the foot, the eye (notably the eyes of the audience) and the ‘object a’ (in the context of gender). Against this backdrop, we will address pressing issues such as the troubled position of the (...) referee (as an ‘impossible profession’), the commercialisation of football, and the rising tides of violence, match—fixing and other instances of systemic deviance. As we will argue, football exemplifies modern sport as an arena defined by prohibitions and desire, by inclusion and exclusion, by purity and abuse, culminating in recent challenges involved in gender trouble. Symbolical practices, like modern football, are based on in- and exclusion. Instead of more regulations and dichotomies, we advocate careful attention to the delicate art of handling desire in practice. (shrink)

Some have suggested that Jon Stewart of The Daily Show with Jon Stewart (TDS) and Stephen Colbert of The Colbert Report (TCR) represent a new kind of journalist. We propose, rather, that Stewart and Colbert are imitators who do not fully inhabit the role of journalist. They are interesting because sometimes they do a better job performing the functions of journalism than journalists themselves. However, Stewart and Colbert do not share journalists' moral commitments. Therefore, their performances are neither motivated nor (...) constrained by these commitments. Using a virtue theory framework, we suggest that this distinction between journalists and their imitators is morally significant because it implies differences in the kinds of excellence these moral agents are pursuing in their work. Rather than evaluating the work of Colbert and Stewart in the role of journalists, we propose analyzing their contributions to media ethics in the role of media critics. (shrink)

In attempting to improve ethical decision-making in business organizations, researchers have developed models of ethical decision-making processes. Most of these models do not include a role for law in ethical decision-making, or if law is mentioned, it is set as a boundary constraint, exogenous to the decision process. However, many decision models in business ethics are based on cognitive moral development theory, in which the law is thought to be the external referent of individuals at the level of cognitive development (...) that most people have achieved. Other theoretical bases of ethical decision models, social learning, and experientialism, also imply a role for law that is rarely made explicit. Law is a more important aspect of ethical decision-process models than it appears to be in the models. This paper will derive explicit roles for the law from the cognition, experientialism, and social learning theories that are used to build ethical decision-making models for business behavior. Sex and the City (1998-2004), The Sopranos (1999-2007), Six Feet Under (2001-2005), Entourage (2004-2011), and The Wire (2002-2008) were series that have changed our way of seeing the world, as well as the social status of these singular works, which have often been neglected on account of their mass-market appeal. After a short period during which it seemed as though the channel might be overtaken by other networks (AMC with Mad Men, 2007-2015 and Breaking Bad, 2008-2013), HBO regained its control of the series culture with Girls (2012-2017) and Game of Thrones (2011-) – two series that are really unlike all others. However, I am discussing Game of Thrones (G oT) here, because you do not have to be a fan of medieval fantasy, bloody fights, dragons, or soft porn; you do not need to love the sagas of George R.R. The capacity to treat pain has never been greater; but, as you will read in the articles that follow, the problem of undertreated and neglected pain in the United States persists. Deep-seated perceptions and practices undergird this strong and well-documented pattern of neglect. Among the reasons frequently noted for the inadequacy of treatment for pain, however, is that the legal system actually penalizes effective interventions to relieve pain while it leaves neglect of pain unthreatened. It is the mission of the (...) American Society of Law, Medicine & Ethics to explore areas, such as this one, where developments in medicine directly encounter the law and, in turn, create ethical issues for clinicians, regulators, patients, and lawyers.This special issue of the Journal of Law, Medicine & Ethics is part of a multi-year project in which ASLME, with the wonderful support of the Mayday Fund, has worked to address legal and regulatory barriers to effective pain relief. Taking the Kipling archive as its point of reference, this article considers the claims involved in the idea of a literary archive (with its appeals to authority, intention, origin, propri ety). In view of the continuing fascination with the details and events of Kipling's life (the interweaving of his public and private self, and (...) especially his connections with India and with Imperialism, and with Indian and English worlds and values), what does the history of Kipling's archive tell us, and how is this related to the location and repression of cultural anxieties (and, in particular, to notions of nation and national character). From the unacknowledged use of a quotation from 'If' in an advertisement for a patent tonic in 1919 to the appear ance of Kipling as hypertext in the 1997 Microsoft Word advertisement in the Sunday Supplements, which or whose 'Kipling' is in question in the iconicity of the continuing and contemporary representations of him. As in Derrida's description of De Man, Kipling is now a ghost of the culture. (shrink)

Should journalists resist business constraints they perceive as a threat to their professional integrity? This article suggests that the answer, at least sometimes, is yes. But in choosing a resistance strategy, journalists should not consider the "take this job and shove it" stance as the only option with moral integrity-or even as the best ethical option. This article develops a model of resistance strategies using the experiences of journalists at one newspaper to illustrate the range of options available for resisting (...) business constraints within a news organization. The types of strategies identified vary along the ethical dimensions of (a) consideration of organizational, as well as professional, goals; and (b) openness with regard to journalists' preference for professional goals. Human-eyelid conditioning was the principal source of information on Pavlovian conditioning, especially human, in the 1950s and 1960s, but it suffered a sharp decline in productivity, beginning in the late 1960s. The present article treats the decline as a case study with potential implications concerning the survival contingencies of research specialties. We make use of questionnaire data from eyelid-conditioning researchers and examine a variety of publication, topic-of-investigation, and institutional data to identify the major factors in the decline of human-eyelid conditioning.

The use of robots had already been proven to encourage the promotion of social interaction and skills lacking in children with Autism Spectrum Disorders, who typically have difficulties in recognizing facial expressions and emotions. The main goal of this research is to study the influence of a humanoid robot to develop socio-emotional skills in children with ASD. The children’s performance in game scenarios aiming to develop facial expressions recognition skills is presented. Along the sessions, children who performed the game scenarios (...) with the robot and the experimenter had a significantly better performance than the children who performed the game scenarios without the robot. The main conclusions of this research support that a humanoid robot is a useful tool to develop socio-emotional skills in the intervention of children with ASD, due to the engagement and positive learning outcome observed. By combining a flanker task and a cuing task into a single paradigm, the authors assessed the effects of orienting and alerting on conflict resolution and explored how normal aging and Alzheimer’s disease (AD) modulate these attentional functions. Orienting failed to enhance conflict resolution; alerting was most beneficial for trials without conflict, as if acting on response criterion rather than on information processing. Alerting cues were most effective in the older groups— healthy aging and AD. Conflict resolution was impaired only (...) in AD. Orienting remained unchanged across groups. This has been our experience since 1996, when the first of now four special issues of this journal focused on legal, regulatory, ethical, professional, and financial issues in medical treatment for pain.With the generous and steadfast support of the Mayday Fund, the American Society (...) of Law, Medicine & Ethics has generated a significant body of scholarship published in the Journal of Law, Medicine & Ethics. This research has proven absolutely essential in changing public policy to support better care for those who suffer pain.Over these years, the Mayday Project at ASLME has tackled many of the real and perceived barriers to effective pain relief. Three important decisions that the board of directors made are:1. the approval of a new publication agreement with the University (...) of Hawai'i Press (UHP) that journal co-editors Thomas Cattoi and Kristin Largen and treasurer John Sheveland spent many hours working out with UHP's staff,2. the creation of a new standing committee: Oral History and Archives. It will record long-time members's memories of their involvement with society and collect photos and documents pertinent to the society's history,3. the decision to hold an online board meeting before AAR's annual meeting to complete as much routine annual business as possible so that our once-a-year, face-to-face time together can be devoted to more in-depth planning and problem-solving and spending more time listening to, and learning from, each other.Three other highlights of this year's meeting were: (i) honoring long-time interreligious peacemaker Thich Nhat Hahn at our Saturday morning session, (ii) listening to Won Buddhists describe their interreligious peacemaking practices at our Saturday afternoon session, and (iii) committing ourselves as a board to be more faithful in following the practices of the founders of the society by setting aside more time to foster interreligious peace not only through careful scholarship but also through caring friendships.In its early decades, the society spent much of its time and income hosting multiday international conferences that provided much more time for developing friendships and learning from each other than our board meetings and paper sessions at AAR have provided. We have sometimes planned field trips to local temples or churches or dinners at restaurants, but these "extra programs" were always an ad hoc add-on. This article focuses on the complex ways in which artistic innovation and creativity have been fostered by the experience of living in late apartheid and post-apartheid society. It argues that contemporary South African artists, film-makers and performers have developed highly inventive formal and conceptual vocabularies in their effort to negotiate the ever-changing landscape of contradictory and sometimes irreconcilable realities they encounter on a daily basis, often attaining major international acclaim in the process. Blurring the boundaries between long-established artistic genres, and (...) challenging racial, sexual and other stereotypes, they have refused to abandon the hope of achieving the ideals of a renewal and respacialization of the current socio-cultural landscape. Many of them have done so against the odds of vociferous opprobrium from state officials and legal challenges by the ANC, which in recent years has questioned the right to freedom of expression of a number of artists. This Agenda 2050 piece is a call to action for management scholars to follow the lead of business associations, foundations, and businesses in studying and understanding the transformative change needed to bring about a more equitable and flourishing world for all living beings—including humans and other‐than‐humans. These entities advocate for a significant paradigm shift in how business is practiced as a way of responding to ‘polycrisis’—the interrelated set of civilization‐threatening crises that includes climate change, social inequality, and biodiversity loss. Yet (...) management scholars lag behind business discourse with issues of sustainability and ecological flourishing, adapting to the type of leadership needed for the future, and understanding the need for system change. We provide four keystone pathways to help scholars shape future discourse in business scholarship, practice, and curricula: 1) structural changes to management education, 2) piloting social impact, 3) development of regenerative business models, and 4) moral, legal, and financial cases for action. This introduction takes recent agricultural protests and Francisco Goya’s famous painting of a revolting peasant, _No harás nada con clamar_ (“You won’t get anywhere by shouting,” c. 1816–1820), as a starting point to discuss pivotal moments in the history of agricultural protest and reflect on recurrent aesthetic tendencies of artistic manifestations of revolt. Its main points of focus are the various global protest cultures of the present in their socio-political, ecological, economic, and aesthetic contexts, including their differences and internal ambivalences. The introduction traces different and recurring aspects of the political imaginary of agriculture from the early-modern peasant wars and 19th-century agricultural realism to the (re-)medialized images and gestures of the 20th century and the present. The Virginia School's economics of natural equals makes consent critical for policy. Democracy is understood as government by discussion, not majority rule. The claim of efficiency unsupported by consent, as common in orthodox economics, appeals to social hierarchy. Politics becomes an act of exchange among equals where the economist is only entitled to offer advice to citizens, not to dictators. The foundation of natural equality and consent explains the common themes of James Buchanan and John Rawls as well as Ronald (...) Coase and the Fabian socialists. What orthodox economics treats as efficient racial discrimination violates the fair chance entitlement to which people consent in a market economy. The importance of replication stressed by Gordon Tullock, developing themes from Karl Popper, is another expression of natural equality since the foresight of replication induces care into research. The impetus for this special issue comes less from conventional debates in philosophical aesthetics itself and instead from one area of recent work on ethics. More specifically, our turn to aesthetics has been inspired by a rich conversation that has emerged in recent years between anthropology and philosophy on the idea and importance of the ordinary. Oftentimes, the ordinary continues “to be treated as a residual category of routine and repetition punctuated by the disruptions of the event.” Many similarly continue (...) to think of ethics as principally concerned with rules and their infringement, as a domain constituted by judgements made some distance from the everyday.But this new body of work has powerfully questioned these assumptions. Veena Das explains that ordinary ethics by contrast examines “What is it that blocks our ability to see the everyday and hence to imagine the ethical as inhering in the quotidian rather than standing out and announcing its presence though dramatic enactments of moral breakdown or heroic achievement.” In this sense, she writes, it “allows us also to think of the unethical as growing within the forms of life that people inhabit – it is, thus, not a matter of eliciting opinions about what behavior is considered ethical or unethical, or of cataloguing cultural practices on which we can bring judgment from an objective, distant position but rather of seeing how forms of life grow particular dispositions.” As these debates continue to develop, we began to see a further need for thinking about the possibility of ordinary aesthetics, a field which though intimately tied up with ethics, merits its own inquiry. We now know by 3 months of age, infants have already begun to forge a link between language and core cognition. This precocious link, which unfolds dynamically over development, may indeed offer an entry point for acquiring higher-order, abstract conceptual and representational capacities.
