Veissière et al. must sacrifice explanatory realism and precision in order to develop a unified formal model. Drawing on examples from cognitive archeology, we argue that this makes it difficult for them to derive the kinds of testable predictions that would allow them to resolve debates over the nature of human social cognition and cultural acquisition.

Doctors occasionally make diagnoses in strangers outside of formal medical settings by using the medical skill of visual inspection, such as noticing signs of melanoma or the symptoms of hyperthyroidism. This may cause considerable moral unease and doubts on the side of the diagnosing physician. Such encounters force physicians to consider whether or not to intervene by introducing themselves to the stranger and offering an unsolicited medical opinion despite the absence of a formal doctor-patient relationship. A small body of literature (...) has addressed the topic of the unsolicited medical opinion, often with a primary focus on practical advice. This article seeks to establish an ethical-theoretical basis for physicians' ethical obligation to offer an unsolicited medical opinion when they make a diagnosis by visual inspection in a stranger outside of the formal medical context. Using a utilitarian approach, it is argued that, if it is in the physicians' power to prevent a possible loss of well-being, without thereby sacrificing anything of equal value, physicians have an ethical obligation to intervene. Im Zuge des „empirical turn“ der Medizin- und Bioethik ist von verschiedenen Autoren in den vergangenen Jahren die Idee einer „evidenzbasierten Ethik“ diskutiert worden. Die Analogie zwischen evidenzbasierter Medizin und „evidenzbasierter Ethik“ soll in diesem Beitrag kritisch diskutiert und dabei gezeigt werden, dass der Ausdruck „evidenzbasierte Ethik“ irreführend ist. Zentraler Ausgangspunkt der Kritik ist die unterschiedliche Bedeutung, die empirische Informationen für das medizinisch-klinische Urteil zum einen und das ethische Urteil in der Medizin zum anderen haben. Im medizinisch-klinischen Urteil können mit (...) Hilfe empirischer Informationen hypothetische Handlungsnormen generiert werden, welche auf den der Medizin inhärenten Zwecksetzungen basieren. Bei Fragen der Ethik in der Medizin hingegen sind die Handlungsziele selbst Gegenstand des Urteils; diese aber können allein aus empirischem Wissen heraus nicht zureichend bestimmt werden. Die Diskussion um die Möglichkeit einer „evidenzbasierten Ethik“ eröffnet weiterhin aufschlussreiche Perspektiven in Bezug auf empirische Forschung und den Umgang mit empirischen Informationen in der Angewandten Ethik und das Aufgabenfeld der Medizinethik. We study L∞κ-freeness in the variety of Boolean algebras. It is shown that some of the theorems on L∞κ-free algebras which are known to hold in varieties such as groups, abelian groups etc. are also true for Boolean algebras. But we also investigate properties such as the ccc of L∞κ-free Boolean algebras which have no counterpart in the varieties above.

Negation is a cornerstone of human language and one of the few universals found in all languages. Without negation, neither categorization nor efficient communication would be possible. Languages, however, differ remarkably in how they express negation. It is yet widely unknown how the way negation is marked influences the acquisition process of first language learners. Here, we investigate whether universal or language-specific cues are more relevant for the acquisition process. We test to what extent frequency and salience features (morphosyntactic boundedness, (...) position of the negation marker, allomorphy) influence the acquisition of negation. We use naturalistic longitudinal data from 17 children (age 24–36 months) learning nine typologically maximally diverse languages spoken in very diverse cultural contexts ranging from western urban to subsistence farming: Chintang, English, Indonesian, Japanese, Qaqet, Russian, Sesotho, Turkish, and Yucatec Mayan. Distributional analyses show that the amount and type of input of negation that children hear vary considerably across cultures. Despite significant differences in the input that children receive, we observe a universal pattern in the acquisition of negation: Children transition from relatively easy and salient free negators to less salient bound negator morphemes in their use of negation. Our results show that frequency and morphosyntactic boundedness explain the development of flexibility in the acquisition of negation across all of the nine languages. We further find that the developmental path is shaped by the interaction between frequency and language-specific parameters of salience that are contingent on grammatical features of negation marking in different languages, such as the position of the negation marker and allomorphic variation. Our language-specific findings highlight cross-linguistic variation, which reflects cross-cultural differences in the amount of input of negative utterances children receive. Taken together, this study provides cross-linguistic evidence for the acquisition of negation and emphasizes the interplay of universal and language-specific factors in the acquisition process. The auditory system is able to recognize auditory objects and is thought to form predictive models of them even though the acoustic information arriving at our ears is often imperfect, intermixed, or distorted. We investigated implicit regularity extraction for acoustically intact versus disrupted six-tone sound patterns via event-related potentials. In an exact-repetition condition, identical patterns were repeated; in two distorted-repetition conditions, one randomly chosen segment in each sound pattern was replaced either by white noise or by a wrong pitch. In (...) a roving-standard paradigm, sound patterns were repeated 1–12 times in a row before a new pattern occurred. The participants were not informed about the roving rule and had to detect rarely occurring loudness changes. Behavioral detectability of pattern changes was assessed in a subsequent behavioral task. Pattern changes elicited mismatch negativity and P3a, and were behaviorally detected above the chance level in all conditions, suggesting that the auditory system extracts regularities despite distortions in the acoustic input. However, MMN and P3a amplitude were decreased by distortions. At the level of MMN, both types of distortions caused similar impairments, suggesting that auditory regularity extraction is largely determined by the stimulus statistics of matching information. At the level of P3a, wrong-pitch distortions caused larger decreases than white-noise distortions. Wrong-pitch distortions likely prevented the engagement of restoration mechanisms and the segregation of disrupted from true pattern segments, causing stronger informational interference with the relevant pattern information. Recent philosophical work on children and childhood has revealed many new questions concerning minors’ rights. This special issue of Moral Philosophy and Politics offers new contributions to the topics of paternalism, the nature of the right to parent and children’s voting. It also contains articles about the so far less explored questions of adolescents’ parental rights, minors’ rights against the harms of parental imprisonment, and their right to veto their own parents’ decision to relocate.

Abstractp53 has a determinant role in cancer prevention and is among the most studied proteins in the world. The majority of studies devoted to this protein are carried out in cell lines because they are easy to use and have naturally emerged as the main research tool in laboratories. However, the p53 pathway is commonly deregulated in cancer cells, from which the experimental cell lines are generally derived. The fact that the pathway is deregulated challenges the relevance of using cancer‐derived (...) cell lines to study wild‐type p53 activities, or, in a broader sense, to study any normal cellular process. In the present article, we identify and discuss a number of limitations of cell lines using examples related to p53. Finally, we point out the general limitations of cell lines and propose solutions as alternatives to these cells. (shrink)

The au pair program in general is still known as a form of cultural exchange program and a good possibility for young women to spend a year abroad, although it has undergone great changes during the last 10 years. This article argues that due to different socio-economic and cultural processes in Western postindustrial societies as well as in the eastern and southern parts of the world the au pair program is becoming a form of domestic work with quite similar working (...) and living conditions to that of live-in migrant domestic workers. This article which is based on two empirical studies on the globalizing au pair business in Eastern and Western Europe as well in the United States looks into the motivations and expectations, the living conditions and interactions between the au pairs and the employer families and contrasts these findings with the discourse of the au pair agencies still advertising au pair as a form of cultural exchange. In doing so the paper can show that it is the still dominant image of au-pair as a cultural exchange program (disarticulating the work aspect) that leaves the young au pair women even more vulnerable to exploitation: ‘big sisters’ are the best domestic servants. This article draws attention to the racialized economization of the private sphere and care work, the inherent traps and exploitative features of this very specific work place. (shrink)

Giorgia Pozzi’s feature article1 on the risks of testimonial injustice when using automated prediction drug monitoring programmes (PDMPs) turns the spotlight on a pressing and well-known clinical problem: physicians’ challenges to predict patient behaviour, so that treatment decisions can be made based on this information, despite any fallibility. Currently, as one possible way to improve prognostic assessments of patient behaviour, Machine Learning-driven clinical decision support systems (ML-CDSS) are being developed and deployed. To make her point, Pozzi discusses ML-CDSSs that are (...) supposed to deliver physicians an accurate estimation of the likelihood of narcotic, sedative and stimulant opioid misuse by a given patient (like, e.g., ‘NarxCare’). Regarding cases of deviating assessment between human evaluators and automated systems, the medico-ethical discussion has so far mainly focused on disagreement between clinicians and Machine Learning (ML) algorithms,2 for example in ‘second opinions’ that have been reconstructed as disagreements between physician testimony and ML-CDSS testimony.3 Examples such as those of PDMPs, by contrast, draw attention to situations in which patient testimony potentially contradicts ML-CDSS testimony. Pozzi examines decision-making situations in which ML-CDSS testimony factually overrides the testimony of the person affected. On peut considérer que ce qui se produit dans le travail familial thérapeutique avec une famille dans une institution donnée est révélateur du fonctionnement de la famille tel que cette dernière le projette sur l’institution. Mais ce qui se passe dans cette thérapie peut aussi refléter le fonctionnement de l’institution à ce moment précis : ce qui se vit dans l’institution a souvent des répercussions sur les prises en charge thérapeutiques.

A myriad of sensations inform and direct us when we engage with the environment. To understand their influence on the development of our habitus it is important to focus on unifying processes in sensing. This approach allows us to include phenomena that elude a rather narrow view that focuses on each of the five discrete senses in isolation. One of the central questions addressed in this volume is whether there is something like a sensual habitus, and if there is, how (...) it can be defined. This is especially done by exploring the formation and habituation of the senses in and by a culturally shaped habitat. Two key concepts, Synaesthesia and Kinaesthetics, are addressed as essential components for an understanding of the interface of habitat and the rich and multisensory experience of a perceiving subject. At a Berlin-based conference Synaesthesia and Kinaesthetics, scholars from various disciplines gathered to discuss these issues. In bringing together the outcome of these discussions, this book gives new insights into the key phenomena of sensory integration and synaesthetic experiences, it enriches the perspectives on sensually embedded interaction and its habituation, and it expands this interdisciplinary inquiry to questions about the cultures of sensory habitus. Health care decision making for patients without decisional capacity is ethically and legally challenging. Advance directives (living wills) have proved to be of limited usefulness in clinical practice. Therefore, academic attention should focus more on substitute decision making by the next of kin. In this article, we comparatively analyse the legal approaches to substitute medical decision making in England and Germany. Based on the current ethico-legal discourse in both countries, three aspects of substitute decision making will be highlighted: (1) Should (...) there be a legally predefined order of relatives who serve as health care proxies? (2) What should be the respective roles and decisional powers of patient-appointed versus court-appointed substitute decision-makers? (3) Which criteria should be determined by law to guide substitute decision-makers? (shrink)

Die Einführung der Fallpauschalen-basierten Finanzierung der Krankenhäuser ist ein erneuter Versuch, die Kosten in diesem Bereich zu reduzieren. Folge dieses Anreizsystems ist u. a. eine deutliche Verkürzung der Verweildauer der Patienten im Krankenhaus. Das wiederum führt zu durchschnittlich kränkeren Patienten und einer deutlichen Arbeitsverdichtung für alle. Vor diesem Hintergrund wird anhand empirischer Daten die Situation der Pflege mit drastischen Einschränkungen beschrieben und es werden Hypothesen zur Begründung aufgestellt. Daran knüpft sich die Frage, welche Art der Versorgung die Patienten mit kürzer (...) werdender Verweildauer und immer häufiger auftretenden chronischen Krankheiten neben der ärztlichen Therapie benötigen. Dies baut auf der Theorie der Aufgaben zur Krankheitsbewältigung auf, die Patienten befähigen sollen, mit Krankheiten in ihrem eigenen Sinne umgehen zu können. Die Kernaufgaben der Pflege werden hier mit dem Ziel der forcierten Förderung der Entlassungsfähigkeit verbunden mit einem Empowerment der Patienten verknüpft. Organisatorisch bietet sich als Lösung der Einsatz von Primary Nurses an. Die derzeitige Situation in der Pflege widerspricht den genannten Sollvorstellungen diametral. Im Sinne einer sicheren und effektiven Versorgung von Patienten im Krankenhaus muss der Pflegedienst inhaltlich völlig anders aufgestellt und mit weiteren Kompetenzen ausgestattet werden. (shrink)

Recent behavioral experiments, along with imaging experiments and neuropsychological studies appear to support the hypothesis that emotions play a causal or constitutive role in moral judgment. Those who resist this hypothesis tend to suggest that affective mechanisms are better suited to play a modulatory role in moral cognition. But I argue that claims about the role of emotion in moral cognition frame the debate in ways that divert attention away from other plausible hypotheses. I suggest that the available data may (...) be more plausibly explained by appeal to predictive and evaluative mechanisms, which are neither wholly affective nor straightforwardly cognitive. By recognizing this fact, we can begin to see why questions about the role of emotion in moral psychology are likely to be empirically misguided. (shrink)

In this paper, I argue that recent research on episodic memory supports a limited defense of the phenomena that Daniel Wegner has termed transactive memory. Building on psychological and neurological research, targeting both individual and shared memory, I argue that individuals can collaboratively work to construct shared episodic memories. In some cases, this yields memories that are distributed across multiple individuals instead of being housed in individual brains.

Papers in experimental philosophy rarely offer an account of what it would take to reveal a philosophically significant effect. In part, this is because experimental philosophers tend to pay insufficient attention to the hierarchy of models that would be required to justify interpretations of their data; as a result, some of their most exciting claims fail as explanations. But this does not impugn experimental philosophy. My aim is to show that experimental philosophy could be made more successful by developing, articulating, (...) and advancing plausible models of the data that are collected and the analyses that are employed. This book develops a novel approach to distributed cognition and collective intentionality. It is argued that collective mentality should be only be posited where specialized subroutines are integrated in a way that yields skillful, goal-directed behavior that is sensitive to concerns that are relevant to a group as such.
