In late December 1998, Renada Daniel-Patterson's father offered to donate a kidney to his daughter and ignited a controversy in the bioethics community. Renada had been born with only one kidney, which began to fail early in her childhood. At age 6, Renada had to receive dialysis three times a week. She was unable to attend school or venture very far from home. This pattern continued until Renada was 13, when Mr. Patterson called from prison to offer her his kidney. (...) Renada was surprised to hear from her father, who was serving 12 years at California State Prison for burglary and drug convictions. Mr. Patterson was determined to be a compatible donor, and the family proceeded with the transplant operation. As a result of this surgery, Renada was able to live the life of a healthy girl for 2 years. Because the medication to prevent rejection of the transplanted organ made her feel ill and bloated and caused her to develop a hump on her back, Renada gradually began to skip doses. As a result, her donated kidney began to fail. It was under these circumstances that David Patterson offered to donate his second kidney to his daughter in 1998. (shrink)

In this article I seek to explain Hegel’s significance to contemporary meta-ethics, in particular to Kantian constructivism. I argue that in the master–slave dialectic in the Phenomenology of Spirit , Hegel shows that self-consciousness and intersubjectivity arise at the same time. This point, I argue, shows that there is no problem with taking other people’s reasons to motivate us since reflection on our aims is necessarily also reflection on the needs of those around us. I further explore Hegel’s contribution to (...) the debate about internal and external reasons. I end by arguing that we should understand reasons as historically constructed in the sense that who counts as an intrinsic bearer of value changes over time. I thus argue that the struggle for recognition is in fact the beginning of the long march toward the idea of recognition and the Kantian kingdom of ends. This march, however, is driven by the need to overcome injustice as it is instantiated at the beginning of history by the master’s absolute domination of the slave. (shrink)

Prefaces was the last of four books by Søren Kierkegaard to appear within two weeks in June 1844. Three Upbuilding Discourses and Philosophical Fragments were published first, followed by The Concept of Anxiety and its companion--published on the same day--the comically ironic Prefaces. Presented as a set of prefaces without a book to follow, this work is a satire on literary life in nineteenth-century Copenhagen, a lampoon of Danish Hegelianism, and a prefiguring of Kierkegaard's final collision with Danish Christendom. Shortly (...) after publishing Prefaces, Kierkegaard began to prepare Writing Sampler as a sequel. Writing Sampler considers the same themes taken up in Prefaces but in yet a more ironical and satirical vein. Although Writing Sampler remained unpublished during his lifetime, it is presented here as Kierkegaard originally envisioned it, in the company of Prefaces. (shrink)

This collection of articles by top scholars offers fresh interpretations of Mill's ideas about happiness, moral obligation, justice, and rights. Applying contemporary philosophical insights, the articles challenge the conventional readings of Mill, and, in the process, contribute to a deeper understanding of utilitarian theory as well as the complexity of moral life.

In "mind-Body identity, Privacy and categories" richard rorty set forth a new form of the identity theory of the mind, (called the 'disappearance' version) in which he suggested that instead of identifying sensations with neural events, Sensations might be eliminated. Using an illustration of rorty's I show that 'pain' cannot come to refer to a brain process for neural events are neither pleasant nor unpleasant. For 'pain' to refer to something unpleasant, We would have to give 'brain process' the connotation (...) of unpleasantness. But to do this would be to identify the brain process with the sensation of pain--I.E., To return to the older identity theory. (shrink)

Besides having an impact on individual thinkers, Swedenborg's ideas worked their way into the various social reform traditions that vitalized the American landscape during the nineteenth and early-twentieth centuries. His concept of usefulness, best (...) demonstrated in the competing worldviews of the nation's liberal and conservative traditions, involved a commitment made by Swedenborgians, New Church members, and others to energize the nation and its people by envisaging the possibility of a much-desired Universal Human. In this essay, the author analyses Berkeley’s conformity and inference argument against Locke’s theory of percep tion. Both arguments are not as decisive as traditionally has been perceived and fail to engage in Locke’s actual position. The main reason for this is that Berkeley does not see that Locke’s position is compatible with the non-inferential nature of perceptual knowledge.

That death has ever been a problem to man is attested as far back as we can trace our species in the archaeological record—indeed, it seems to have been a problem even for that immediate precursor of homo sapiens, the so-called Neanderthal Man; for he buried his dead.

In this lecture Justice Breyer examines three classical criticisms of constitutional judicial review. Those criticisms say that a grant to unelected judges of the power to set aside legislation as contrary to a written constitution leads to judicial decision-making that is (a) undemocratic, (b) subjective, and impractical. Justice Breyer describes features of the constitutional decision-making that do not dictate results in individual cases, but none the less hold the judges' 'subjective' will in check. He also describes necessary judicial efforts to (...) focus upon considerations of administrative practicality. The description seeks, not to refute the criticisms in their entirety, but to help evaluate the extent to which those criticisms militate against the adoption of a system of constitutional judicial review. The present study investigates whether people can infer the preferences of others from spontaneous facial expressions alone. We utilize a paradigm that unobtrusively records people's natural facial reactions to relatively mundane stimuli while they simultaneously report which ones they find more appealing. Videos were then presented to perceivers who attempted to infer the choices of the target individuals—thereby linking perceiver inferences to objective outcomes. Perceivers demonstrated above-chance ability to infer target preferences across four different stimulus categories: people (attractiveness), cartoons (humor), (...) paintings (decorative appeal), and animals (cuteness). While perceivers' subjective ratings of expressivity varied somewhat between targets, these ratings did not predict the relative “readability” of the targets. The findings suggest that noncommunicative, natural facial behavior by itself suffices for certain types interpersonal prediction, even in low-emotional contexts. (shrink)

Recently, the view that anger is bad, even wrong, to feel and express has gained popularity. Philosophers like Martha Nussbaum and Derk Pereboom posit that anger is fundamentally tied to a desire for retribution, which they argue is immoral, counterproductive, and irrational. Thus, they argue, we should try our best to stop ourselves from feeling and expressing anger whenever it arises. I argue that anger is not inherently retributive, and that feeling and expressing anger are sometimes the most adaptive response (...) to unfairness in one’s environment. I draw on robust psychological literature to characterize the dangers of overregulating anger in terms of the practical, psychological, and humanitarian costs associated with not feeling and expressing anger. In the appropriate contexts, anger is crucial to prepare people to communicate disapproval, motivate necessary confrontation, and change wrongdoers’ harmful behaviors. Thus, the functions of anger are not focused on getting even for past events, but rather on protecting individuals from future harm. Importantly, the overregulation of anger is likely to cause the most harm to individuals and communities that experience routine unfairness, thereby reinforcing social injustices. By adopting a functionalist perspective of emotions, we can shift our focus away from policing experiences of anger and toward enhancing its functional qualities through thoughtful reflection on the sources of people’s anger and resolutions for that anger. The debate about health care rationing has now been running for several decades but there are still people who publicly deny that rationing of health care has to take place, or that health care rationing could be ethically justifiable. In many countries we have also had politicians who have refused to allow the “R” word to pass their lips.
