Making good decisions in extremely complex and difficult processes and situations has always been both a key task as well as a challenge in the clinic and has led to a large amount of clinical, legal and ethical routines, protocols and reflections in order to guarantee fair, participatory and up-to-date pathways for clinical decision-making. Nevertheless, the complexity of processes and physical phenomena, time as well as economic constraints and not least further endeavours as well as achievements in medicine and healthcare (...) continuously raise the need to evaluate and to improve clinical decision-making. This article scrutinises if and how clinical decision-making processes are challenged by the rise of so-called artificial intelligence-driven decision support systems (AI-DSS). In a first step, this article analyses how the rise of AI-DSS will affect and transform the modes of interaction between different agents in the clinic. In a second step, we point out how these changing modes of interaction also imply shifts in the conditions of trustworthiness, epistemic challenges regarding transparency, the underlying normative concepts of agency and its embedding into concrete contexts of deployment and, finally, the consequences for (possible) ascriptions of responsibility. Third, we draw first conclusions for further steps regarding a ‘meaningful human control’ of clinical AI-DSS. (shrink)

The existence of neural correlates of consciousness (NCC) is not enough for philosophical purposes. On the other hand, there's more to NCC than meets the sceptic's eye. (I) NCC are useful for a better understanding of conscious experience, for instance: (1) NCC are helpful to explain phenomenological features of consciousness – e.g., dreaming. (2) NCC can account for phenomenological opaque facts – e.g., the temporal structure of consciousness. (3) NCC reveal properties and functions of consciousness which cannot be elucidated either (...) by introspective phenomenology or by psychological experiments alone – e.g., vision. (II) There are crucial problems and shortcomings of NCC: (1) Correlation implies neither causation nor identity. (2) There are limitations of empirical access due to the problem of other minds and the problem of self-deception, and (3) due to the restrictions provided by inter- and intraindividual variations. (4) NCC cannot be catched by neuroscience alone because of the externalistic content of representations. Therefore, NCC are not sufficient for a naturalistic theory of mind, (5) nor are they necessary because of the possibility of multiple realization. (III) Nevertheless, NCC are relevant and important for the mind-body problem: (1) NCC reveal features that are necessary at least for behavioral manifestations of human consciousness. (2) But NCC are compatible with very different proposals for a solution of the mind-body problem. This seems to be both advantageous and detrimental. (3) NCC restrict nomological identity accounts. (4) The investigation of NCC can refute empirical arguments for interactionism as a case study of John Eccles' dualistic proposals will show. (5) The discoveries of NCC cannot establish a naturalistic theory of mind alone, for which, e.g., a principle of supervenience and a further condition – and therefore philosophical arguments – are required. Ethical theories have been largely focused on finding and clarifying certain amoral principles. However fruitful the communication of moral principles for providing orientation in modern society might be, a serious omission has been made in that the problem of implementation is not addressed. Two fundamental question have neither been raised nor answered: Why should self‐interested individuals follow the proposed moral principles in their daily conduct? Are societal institutions of such a design that is in the power of the individuals to (...) follow these moral principles? It is shown in this article that an economic theory of morals does systematically address these two questions and therefore provides a firm basis for discussing the possibilities and boundaries of following the moral principles inherent in the long history of moral philosophy. Delia Graff Fara maintains that many desire ascriptions underspecify the content of the relevant agent’s desire. She argues that this is inconsistent with certain initially plausible claims about desiring, desires, and desire ascriptions. This paper defends those initially plausible claims. Part of the defense hinges on metaphysical claims about the relations among desiring, desires, and contents.

Simulations are used in very different contexts and for very different purposes. An emerging development is the possibility of using simulations to obtain a more or less representative reproduction of organs or even entire persons. Such simulations are framed and discussed using the term ‘digital twin’. This paper unpacks and scrutinises the current use of such digital twins in medicine and the ideas embedded in this practice. First, the paper maps the different types of digital twins. A special focus is (...) put on the concrete challenges inherent in the interactions between persons and their digital twin. Second, the paper addresses the questions of how far a digital twin can represent a person and what the consequences of this may be. Against the background of these two analytical steps, the paper defines first conditions for digital twins to take on an ethically justifiable form of representation. (shrink)

This paper argues that data-driven medicine gives rise to a particular normative challenge. Against the backdrop of a distinction between the good and the right, harnessing personal health data towards the development and refinement of data-driven medicine is to be welcomed from the perspective of the good. Enacting solidarity drives progress in research and clinical practice. At the same time, such acts of sharing could—especially considering current developments in big data and artificial intelligence—compromise the right by leading to injustices and (...) affecting concrete modes of individual self-determination. In order to address this potential tension, two key elements for ethical reflection on data-driven medicine are proposed: the controllability of information flows, including technical infrastructures that are conducive towards controllability, and a paradigm shift towards output-orientation in governance and policy. Many competent speakers initially judge that (i) is true and (ii) isfalse, though they know that (iii) is true. (i) Superman leaps more tallbuildings than Clark Kent. (ii) Superman leaps more tall buildings thanSuperman. (iii) Superman is identical with Clark Kent. Semanticexplanations of these intuitions say that (i) and (ii) really can differin truth-value. Pragmatic explanations deny this, and say that theintuitions are due to misleading implicatures. This paper argues thatboth explanations are incorrect. Trust is one of the big buzzwords in debates about the shaping of society, democracy, and emerging technologies. For example, one prominent idea put forward by the High‐Level Expert Group on Artificial Intelligence appointed by the European Commission is that artificial intelligence should be trustworthy. In this essay, we explore the notion of trust and argue that both proponents and critics of trustworthy AI have flawed pictures of the nature of trust. We develop an approach to understanding trust in AI (...) that does not conceive of trust merely as an accelerator for societal acceptance of AI technologies. Instead, we argue, trust is granted through leaps of faith. For this reason, trust remains precarious, fragile, and resistant to promotion through formulaic approaches. We also highlight the significance of distrust in societal deliberation, as it is relevant to trust in various and intricate ways. Among the fruitful aspects of distrust is that it enables individuals to forgo technology if desired, to constrain its power, and to exercise meaningful human control. (shrink)

I say that this is Russellianism's most notorious consequence because it is so often used to argue against the view: many philosophers think that it is obvious that (1) and (2) can differ in truth value, and so they conclude that Russellianism is false. Let's call this the Substitution Objection to Russellianism.

This chapter addresses the distinction between private and public and the difference between ‘public’ and ‘official’. Drawing on a comparative analysis of Asian cities, it looks at the ways in which the local, the national and the global levels, which serve different, sometimes contrasting, interests, are negotiated and reconciled in the city. The chapter suggests that different forms of reconciliation have brought about an alternative ‘insitutionalisation’ of the public space. Such an institutionalisation is reflected in the access to, and dissemination (...) of, information—e.g., access to the media—and, above all, in the control over the common goods. The public sphere is used to voice discontent, leading to a new definition of the ‘common good’; that is, the inclusion, or non-exclusion, of large sections of the population which, though initially marginal, can become significant in shaping urban politics. In this paper, I present a new semantics for demonstratives. Now some may think that David Kaplan (1989a,b) has already given a more than satisfactory semantics for demonstratives, and that there is no need for a new one. But I argue below that Kaplan's theory fails to describe the linguistic meanings of 'that' and other true demonstratives. My argument for this conclusion has nothing to do with cognitive value, belief sentences, or other such contentious matters in semantics and the philosophy (...) of mind. Rather, it appeals to the obvious fact that there can be true utterances of certain sentences containing several occurrences of the same demonstrative (for instance, 'That is taller than that'). My argument can be answered by making a fairly modest revision in Kaplan's theory. But I believe that the resulting revised version of Kaplan's theory ignores or distorts various important semantic features of 'that'. Thus I ultimately argue in favor of a more substantial departure from Kaplan's theory. Perhaps the most remarkable feature of the theory I favor is that it ascribes three distinct sorts of meanings to demonstratives. (shrink)

Braun's work has a strong psychological focus on the ramifications of social change--with emphasis on modernization for meeting the psychological needs of the people involved. What is unique about the work (it represents the collaboration of seven scholars in such fields as philosophy, psychology, sociology, and political science) is that it makes a serious attempt to provide a realistic and relevant framework of analysis for interpreting the way the human personality reacts to strain and pressure, including cultural and social (...) change. As societies become increasingly bureaucratic, anonymous, and materialistic, and social relationships become increasingly segmented rather than holistic, it is important to study how basic human needs are fulfilled and how personalities are molded. A structured character is a semantic value of a certain sort. Like the more familiar Kaplanian characters, structured characters determine the contents of expressions in contexts. But unlike Kaplanian characters, structured characters also have constituent structures. The semantic theories with which most of us are acquainted do not mention structured characters. But I argue in this paper that these familiar semantic theories fail to make obvious distinctions in meaning---distinctions that can be made by a theory that uses structured characters. Thus (...) In this paper, I defend a well-known theory of belief reports from an important objection. The theory is Russellianism, sometimes also called `neo-Russellianism', `Millianism', `the direct reference theory', `the "Fido"-Fido theory', or `the naive theory'. The objection concernssubstitution of co-referring names in belief sentences. Russellianism implies that any two belief sentences, that differ only in containing distinct co-referring names, express the same proposition (in any given context). In several jurisdictions, irremediable suffering from a medical condition is a legal requirement for access to assisted dying. According to the expressivist objection, allowing assisted dying for a specific group of persons, such as those with irremediable medical conditions, expresses the judgment that their lives are not worth living. While the expressivist objection has often been used to argue that assisted dying should not be legalised, I show that there is an alternative solution available to its proponents. An autonomy-based approach (...) to assisted suicide regards the provision of assisted suicide (but not euthanasia) as justified when it is autonomously requested by a person, irrespective of whether this is in her best interests. Such an approach has been put forward by a recent judgment of the German Federal Constitutional Court, which understands assisted suicide as an expression of the person’s right to a self-determined death. It does not allow for beneficence-based restrictions regarding the person’s suffering or medical diagnosis and therefore avoids the expressivist objection. I argue that on an autonomy-based approach, assisted suicide should not be understood as a medical procedure but rather as the person’s autonomous action. (shrink)

Barsalou's theory of perceptual symbol systems is considered from a metacognitive perspective. Two examples are discussed in terms of the proposed perceptual symbol theory. First, recent results in research on feeling-of-knowing judgement are used to argue for a representation of familiarity with input cues. This representation should support implicit memory. Second, the ability of maintaining a theory of other people's beliefs (theory of mind) is considered and it is suggested that a purely simulation-based view is insufficient to explain the available (...) evidence. Both examples characterize areas where Barsalou's theory would benefit from additional detail. (shrink)

Many philosophers think that the Substitution Objection decisively refutes Russellianism. This objection claims that sentences (1) and (2) can differ in truth value. Therefore, it says, the sentences express different propositions, and so Russellianism is false.

This paper begins by examining Erich Fromm’s “Manifesto and Program” written for the Socialist Party in 1959 or 1960, and addresses a simple question: Why would Fromm speak of something so apparently arcane as “prophetic messianism,” in his socialist program? When he insists that we have forgotten thatsocialism is “rooted in the spiritual tradition which came to us from prophetic messianism, the gospels, humanism, and from the enlightenment philosophers,” is this simply a literary flourish, a concession to liberalism, or religious (...) sentimentality? Part I, written by Nick Braune, answers the question by examining Fromm’ssocialist organizing commitments in the context of the late 1950s. Part II, written by Joan Braune, offers further defense of the term “prophetic messianism,” distinguishes two types of messianism, and suggests that Fromm may be attempting to address a problem in the Frankfurt School. Research in basic and clinical neuroscience of music conducted over the past decades has begun to uncover music’s high potential as a tool for rehabilitation. Advances in our understanding of how music engages parallel brain networks underpinning sensory and motor processes, arousal, reward, and affective regulation, have laid a sound neuroscientific foundation for the development of theory-driven music interventions that have been systematically tested in clinical settings. Of particular significance in the context of motor rehabilitation is the notion that musical (...) rhythms can entrain movement patterns in patients with movement-related disorders, serving as a continuous time reference that can help regulate movement timing and pace. To date, a significant number of clinical and experimental studies have tested the application of rhythm- and music-based interventions to improve motor functions following central nervous injury and/or degeneration. The goal of this review is to appraise the current state of knowledge on the effectiveness of music and rhythm to modulate movement spatiotemporal patterns and restore motor function. By organizing and providing a critical appraisal of a large body of research, we hope to provide a revised framework for future research on the effectiveness of rhythm- and music-based interventions to restore and train motor function. In the article ‘Represent Me: Please! Towards an Ethics of Digital Twins in Medicine’, I analysed and tried to better understand the main ethical challenges associated with Digital Twins. For those who are just entering the debate with this article: DT is a metaphor for a bundle of artificial intelligence driven simulation technologies that constantly, in real time and ad personam simulate single or multiple parts of the body and make predictions about future health states based on these simulations. My (...) argument addresses the need to look at the breadth of challenges through a perspective of representation. From such a take, key consequences can be drawn for the further development of such technologies, the required means of control and not least the way to think about the interaction between humans and ‘their’ simulations. I am very grateful for the subsequent suggestions, criticisms and further arguments, which have helped me to elaborate my arguments more clearly and have led to a substantial advancement of the debate and the discussion about ethical questions in dealing with DT. Jenny Blumenthal-Barby,1 Deborah Lupton,2 Jenny Krutzinna,3 Janina Loh,4 Brent Mittelstadt,5 Sven Nyholm,6 Daniel Tigard7 and Max Tretter8 have made excellent points, which, in the following, I will not be able to reply to individually and in detail. In this response, I will try to bundle the open points and questions along the comments and considerations mentioned above and attempt to outline their significance for an ethics of DT. Indexicals are linguistic expressions whose reference shifts from context to context: some paradigm examples are ‘I’, ‘here’, ‘now’, ‘today’,‘he’, ‘she’, and ‘that’. Two speakers who utter a single sentence that contains an indexical may say different things. For instance, Fred and Wilma say different things when they utter the sentence ‘I am female’. Many philosophers (following David Kaplan 1989a) hold that indexicals have two sorts of meaning. The first sort of meaning is often called ‘character’ or ‘linguistic meaning’; the second (...) sort is often called ‘content’. Using this terminology, we can say that the word ‘I’ has a single character (or linguistic meaning), but has different contents in different contexts. (shrink)

Die Studie untersucht die Entstehung der modernen Philosophiegeschichte, wie sie sich im Übergang vom Barock zur Aufklärung als philosophische Disziplin innerhalb des gelehrten Diskurses der historia literaria konstituierte. Die Auffassung, daß Philosophie ein Produkt menschlicher Verstandestätigkeit sei und mit dem Denken der Griechen beginne, erweist sich dabei als Resultat eines Traditionsbruchs, mit dem die entstehende Aufklärung sich vom christlichen Aristotelismus der Schulphilosophie sowie von den platonisch-hermetischen Spekulationen der Schwärmer und Pansophen absetzte. In der Umbruchphase zwischen Barock und Aufklärung entsteht so (...) der moderne philosophiegeschichtliche Kanon, der sich fundamental von der zuvor gültigen historischen Logik der Wissenschaftsgeschichte unterscheidet. Die Geschichte der Philosophie wird nun nicht länger als Sammelbecken unterschiedlich perfekter Ausformulierungen einer archetypischen Weisheit verstanden, sondern im Kontext der 'Entdeckung der geschichtlichen Welt' als ein kontingenter temporaler Prozeß menschlicher Wissenschaftsentwicklung begriffen. Wie es zu dieser Entdeckung der Philosophiegeschichte kam und worin ihre wissenschaftsgeschichtlichen Implikationen bestehen, ist Gegenstand der Darstellung, die gegenüber der bisherigen Forschung verstärkt die Interdependenzen zwischen theologischem, philosophischem, rechts- und literärgeschichtlichem Diskurs berücksichtigt. Women generally initiate, lead, and constitute the rank and file of environmental justice activism. However, there is little research on why there are comparatively so few men involved in these movements. Using the environmental justice movement in the Central Appalachian coalfields as a case study, we examine the ways that environmental justice activism is gendered, with a focus on how women’s and men’s identities both shape and constrain their involvement in gendered ways. The analysis relies on 20 interviews with women (...) and men grassroots activists working for environmental justice in the coalfields of Appalachia. We find that women draw on their identities as “mothers” and “Appalachians” to justify their activism, while the hegemonic masculinity of the region, which is tied to the coal industry, has the opposite effect on men, deterring their movement involvement. We explore the implications of these findings for understanding the relationship of gender to environmental justice activism. (shrink)

This paper presents a number of objections to Jeffrey King's quantificational theory of complex demonstratives. Some of these objections have to do with modality, whereas others concern attitude ascriptions. Various possible replies are considered. The debate between quantificational theorists and direct reference theorists over complex demonstratives is compared with recent debates concerning definite descriptions.

The interplay of academics and judges is highly relevant for the law-making process in civil law countries. The intention of this article is to provide a brief account of the present-day relationship between academics and judges in Italy, while also taking account of the continental historical experience. In addressing this theme, the article will take its cue from developments in England—during the past three decades—where the monologue of academics and judges has been slowly developing into an ever more intensive and (...) transparent dialogue. In den ersten zwei Jahrhunderten unserer Zeitrechnung erfuhren viele Bestimmungen jüdischer Zugehörigkeit eine Umformulierung. Eine der Neuerungen war die Entstehung der jüdischen Matrilinearität. In dem Aufsatz werden die Hintergründe dieses Wandels und ihre Auswirkungen auf das zeitgleich entstehende Christentum beschrieben, das an der Patrilinearität der antiken Gesellschaften festhielt. In einem letzten Abschnitt wird auf die Konsequenzen der modernen Reproduktionsmedizin für diese Regelwerke hingewiesen.

Vor allem die philosophische Religionskritik fokussiert sich zu oft auf die Kritik an der Annahme der Existenz Gottes. Dabei gerät aus dem Blick, dass Religionen nicht allein in Überzeugungen bestehen, sondern komplexe soziale Praktiken darstellen, die das Leben ihrer Gläubigen strukturieren, orientieren, stabilisieren und/oder irritieren. Die hier versammelten Beiträge thematisieren diesen Aspekt von Religion in Auseinandersetzung mit dem von Rahel Jaeggi konzipierten Modell einer "Kritik von Lebensformen".
