InThe Matter of Capital, Christopher Nealon offers a distinctive revisionary account of American poetry written in the wake of the ideological retreats of Ezra Pound and W.H. Can he choose one of the bundles, there seemingly being nothing to incline him one way or the other? If he can, the second puzzle — pertaining to rational choice — arises. For Sartre, shame is not an ethical but an ontological experience. With this in mind, the article examines the philosophical connection between shame and ambiguity through analysis of the experiences of abortion and the Nazi Occupation. The article demonstrates how Beauvoir develops Sartre's ontological notion of shame into an ethical philosophy of ambiguity as a result of wartime experiences. It demonstrates how encounters with shame, abortion, ambiguity and Occupation life in Beauvoir's 1945 novel Le sang des autres elucidate and are (...) developed by Sartre and Beauvoir's philosophies of shame and ambiguity. The paper proposes that Sartre's and Beauvoir's thought was shaped by living through the Nazi Occupation and reveals how the memory of wartime shame is activated in contemporary ethical dilemmas in later literary works of both writers. ABSTRACTComparative effectiveness studies, referred to here as “usual-care” trials, seek to compare current medical practices for the same medical condition. Such studies are presumed to be safe and involve only minimal risks. However, that presumption may be flawed if the trial design contains “unusual” care, resulting in potential risks to subjects and inaccurately informed consent. Three case studies described here did not rely on clinical evidence to ascertain contemporaneous practice. As a result, the investigators drew inaccurate conclusions, misinformed research participants, (...) and subjects’ safety was compromised. Before approving usual-care protocols, IRBs and scientific review committees should evaluate the quality and completeness of information documenting usual-care practices. Guidance from governmental oversight agencies regarding evidence-based documentation of current clinical practice could prevent similar occurrences in future usual-care trials. Accurate information is necessary to ensure that trials comply with government regulations that require minimizing research risks to subjects and accurate informed consent documents. (shrink)

It is possible that a fair coin tossed infinitely many times will always land heads. So the probability of such a sequence of outcomes should, intuitively, be positive, albeit miniscule: 0 probability ought to be reserved for impossible events. And, furthermore, since the tosses are independent and the probability of heads (and tails) on a single toss is half, all sequences are equiprobable. According to conciliatory views about peer disagreement, both peers must accord their disagreeing peer some weight, and move towards him. Non‐conciliatory views allow one peer, the one who responded correctly to the evidence, to remain steadfast. In this paper, I consider the suggestion that it may be rational for both disagreeing peers to hold steadfastly to their opinion. Rhodes seeks to defend her ‘conclusion that everyday ethics and medical ethics [are] incompatible’.1 She challenges ‘views that medical ethics is nothing more than common morality applied to clinical matters’ (Rhodes, p2).1 Beauchamp and Childress explicate the term ‘common morality’ at length.2 Nowhere do they claim that medical ethics is ‘nothing more than common morality applied to clinical matters’. Here is what they do say: “The origin of the norms of the common morality is no different in principle from the (...) origin of the norms of a particular morality for a medical or other profession … The primary difference is that the common morality has authority in all communities, whereas particular moralities are authoritative only for specific groups” (Beauchamp and Childress, p8).2 This critique discusses the seven examples Rhodes uses to illustrate her main point: that common morality and medical ethics are radically different. I contend that common morality accounts for the purported differences she cites. In ordinary life, people can simply mind their own business, whereas physicians have a duty to act in their professional setting. A recent ontological variant of Cramer’s Transactional Interpretation, called “Possibilist Transactional Interpretation” or PTI, is extended to the relativistic domain. The present interpretation clarifies the concept of ‘absorption,’ which plays a crucial role in TI (and in PTI). In particular, in the relativistic domain, coupling amplitudes between fields are interpreted as amplitudes for the generation of confirmation waves (CW) by a potential absorber in response to offer waves (OW), whereas in the nonrelativistic context CW are taken as generated with certainty. It is pointed out that solving the measurement problem requires venturing into the relativistic domain in which emissions and absorptions take place; nonrelativistic quantum mechanics only applies to quanta considered as ‘already in existence’ (i.e., ‘free quanta’), and therefore cannot fully account for the phenomenon of measurement, in which quanta are tied to sources and sinks. Citizenship and its education is again gaining importance in many countries. This paper uses England as its primary example to develop a Habermasian perspective on this issue. The statutory requirements for citizenship education in England imply that significant attention be given to the moral and social development of the learner over time, to the active engagement of the learner in community and to the knowledge skills and understanding necessary for political action. This paper sets out a theoretical framework that offers (...) a perspective on learning suitable for these far-reaching aims. We argue that schools need to shift from the currently dominant discourse of accountability to incorporate a discourse of care in order to make room for an effective and appropriate pedagogy for citizenship. Habermas’s social theory gives us a theoretical framework that properly locates schools within the lifeworld as part of civil society. Schools should therefore attend to hermeneutical and emancipatory concerns, not only to strategic interests. We put these in the context of Habermas’s social theory to paint an alternative vision learning for citizenship education which is based in developing the dispositions, values and attitudes necessary for lifelong learning with a view to developing ongoing communicative action. Locke often writes that our knowledge is the perception of the agreement or disagreement of ideas. For example, he refers to “our Knowledge consisting in the perception of the Agreement, or Disagreement of any two Ideas” in the second chapter of the Essay's book on knowledge. Similarly, at the beginning of this book he characterizes knowledge as “the perception of the connexion and agreement, or disagreement and repugnancy of any of our Ideas”. Since commentators remark on this formula so frequently, (...) one would expect that major questions about its interpretation would have been settled long ago. But not so. Controversy still prevails about Locke's intent, and especially about his assumption that the knowledge of the existence of real things counts as an instance of the perception of the agreement or disagreement of ideas.Scholars have put forward two sorts of problems about the attempted assimilation of knowledge of real existence to Locke's formula. Auditory spatial awareness is a prism that reveals a culture's attitudes toward hearing and space. There are very few philosophical issues which are so intimately associated with one single philosopher as is the problem of induction with Hume. This paper argues against this received opinion. It shows that Hume was neither the first to think induction problematic, nor the originator of the argument he adduced in support of the (sceptical) position. It then explains his (more modest) contribution. Its primary concern, however, is not historical. Lifelong learning is something which one does for oneself that no one else can do for one: it is a public and personal human activity, rather than private or individualistic. One of the features of the education system is the paucity of a language for learning as process and participative experience. Personalised learning requires a sense of the worth-whileness of 'being a learner' - a virtue in the 21st century. A sense of one's own worth as a person is essential (...) to understanding one's identity as a learner. Research suggests the human capacity to learn can be understood as a form of consciousness which is characterised by particular values, attitudes and dispositions, with a lateral and a temporal connectivity. This 'consciousness' has several dimensions which are all related to becoming a person, with a learning identity. They also enable the learner to become aware of and appropriate what is of worth and map onto the sorts of core values that learning communities espouse. Awareness of self and of one's own worth as a person is a necessary condition for 'becoming a learner' and for identifying and engaging with 'what is of worth'. Furthermore, a sense of self as a learner is formed in relationship, and understood as one learns to tell one's own story, as a participant in the conversation of the learning community. Character is the way in which we refer to that quality of personhood in which there is rooted the capacity to change and learn over time. (shrink)

The aim of this article is to analyse the internal mechanisms of corporate governance (board of directors and ownership structure), which influence voluntary disclosure of intangibles. The results appear to corroborate the view that an increase in institutional investor shareholding has a negative effect on voluntary disclosure, supporting the hypothesis of entrenchment, whereas an excessive ownership by institutional investors may have adverse effects on strategic disclosure decisions. The results also indicate that an increase in the number of members of the (...) board to up to 15 has a beneficial effect on the disclosure of intangibles. However, as this number increases, the effect inverts and becomes adverse to improving the capacity for supervision and control in the decision-making process regarding the voluntary disclosure of intangibles. The findings endorse the recommendation of the most of the Corporate Governance Codes regarding an advisable maximum of 15 members on a board to ensure its effectiveness and internal cohesion. I offer an interpretation of John Locke’s account of persons and personal identity that gives full credit to Locke’s claim that “person” is a forensic term, sheds new light on the relation between Locke’s characterizations of a person in sections 9 and 26, and explains how Locke links his moral and legal account of personhood to his account of personal identity in terms of sameness of consciousness. I show that Locke’s claim that sameness of consciousness is necessary for personal identity (...) depends on two components: first, his particular moral and legal conception of a person and, second, his particular understanding of the conditions of just accountability for past actions. Had Locke given a different account of personhood, or thought differently about the conditions of just accountability, he might have given a nonpsychological account of personal identity. (shrink)

This paper analyses the topic of representation since the point of view of ethnomethodology and sociology of scientific knowledge. It starts out by discussing the “standard image of representation” and the constructivist proposition of that image. Then, a case of study is presented to suggest how practices for collecting and analyzing forensic evidence in criminal law, can contribute to understand representational adequacy. The aim of this paper is to think differently about representantion considering how it is produced, managed and deconstructed. (...) Professor Elder has, I believe, misunderstood my position on the ontology of individuals, for I am not any kind of stage theorist. I do indeed believe, however, that there is a sense in which many different things can be in the same place at once, though it is not a sense in which “thing” is a count noun. To explain this, I briefly describe what I call “substances”, a category that includes both individuals and real kinds.

Distributive justice relies on metaphors about spatial distribution. Modelling cross-temporal relations on cross-spatial relations in this way obscures how earlier groups become the later ones. Procedural justice metaphors rely on metaphors of contract and thereby on impartial reasoning. Their dominance is already problematic in the case of contemporary relations, but is even more so in the case of relations across time, where the conditions for later parties are controlled and created by earlier ones. Future generations should not be thought of (...) as a distinct group living at a different temporal “location,” but as who we will become. Thus, the frame of “justice” is much less appropriate for our relations to them than the frame of “care”. (shrink)

La Fenomenología de Husserl resulta un marco filosófico completo para elucidar significados en terminología científica enfatizando el carácter a priori de conceptos fundacionales, su aspecto contingente (lenguaje), intersubjetividad, sujeto transcendental y epojé. En tal sentido, soportar las (...) nociones fundacionales en física bajo las categorías universales Extensión-Cambio de Neelamkavil contribuye al ideal husserliano. Aún no se llega a una imagen adecuada de las intricadas relaciones entre Filosofía y Ciencia. Sin embargo, los hallazgos científicos de Moser-Britt (2014) soportan posiciones kantianas y husserlianas en torno a los términos a priori que fundamentan las teorías físicas. Como consecuencia, los resultados han despertado el interés de filósofos y científicos hacia las ideas husserlianas en tanto terminología lingüística y comprensión aprioricista del mundo. De esta forma, dentro del estado actual del arte, P. Berghofer y H. Wiltsche (2018) abordan el rol de fenomenología en Filosofía de la Física; mientras J. Drummond (2019) en "Husserl: German Perspectives" analiza el rol de la fenomenología en Ciencia. R. Neelamkavil (2018) da cuenta de un nuevo conjunto de categorías en física que comulgan con las ideas de Husserl. La comprensión de los términos Masa y Campo en física, se aborda el estudio de H. Grelland "Husserl, Einstein y Weyl and Concepts of Space, Time and Space-Time" y H. Weyl, "Space, Matter and Time". Un análisis metalingüísitico entre términos científicos y fenomenológicos no se ha realizado aún. Congo Style presents a postcolonial approach to discussing the visual culture of two now-notorious regimes: King Leopold II's Congo Colony and the state sites of Mobutu Sese Seko's totalitarian Zaïre. Readers are brought into the living remains of sites once made up of ambitious modernist architecture and art in Kinshasa, Democratic Republic of the Congo. From the total artworks of Art Nouveau to the aggrandizing sites of post-independence Kinshasa, Congo Style investigates the experiential qualities of man-made environments intended to entertain, (...) delight, seduce and impress. In her study of visual culture, Ruth Sacks sets out to reinstate the compelling wonder of nationalist architecture from Kinshasa's post-independence era, such as the Tower of the Exchange (1974), Gécamines Tower (1977), and the artworks and exhibitions that accompanied them. While exploring post-independence nation-building, this book examines how the underlying ideology of Belgian Art Nouveau, a celebrated movement in Belgium, led to the dominating early colonial settler buildings of the ABC Hotels (circa 1908-13). Congo Style combines Sacks's practice as a visual artist and her academic scholarship to provide an original study of early colonial and independence-era modernist sites in their African context. As research into identity in the information society gets into its stride, with contributions from many scholarly disciplines such as technology, social sciences, the humanities and the law, a moment of intellectual stocktaking seems appropriate. This article seeks to provide a roadmap of research currently undertaken in the field of identity and identity management showing how the area is developing and how disparate contributions relate to each other. Five different perspectives are proposed through which work in the identity field can (...) be seen: tensions, themes, application areas, research focus and disciplinary approaches and taken together they provide a comprehensive overview of the intellectual territory currently being tilled by academia on this subject. This attempt at a coherent overview is offered in the spirit of debate and discussion, and the authors invite criticism, development and improvement. Another purpose of this paper is to provide an introduction to the range and type of research that the new journal Identity in the Information Society will publish, giving researchers working in the field a clearer idea of the scope of multidisciplinary study that is envisaged. It has been argued that 'causes' of action and 'reasons' for acting represent incompatible conceptual categories. This paper examines the alleged incompatibility between these concepts and attempts to show that not only are 'reason' explanations compatible with causal explanations but also that it is plausible to construe the former as a species of the latter. Providing reasons often aids in the search for relevant causal factors, And causal explanations are more systematic than corresponding reason explanations.

: The Advisory Committee on Human Radiation Experiments experienced some disagreements among its members in the course of its work. An epistemological controversy over the nature and degree of evidence required to draw ethical conclusions pervaded the committee's deliberations. Other disagreements involved the proper role of a governmental advisory committee and the question of when it is appropriate to notify people that they were unknowing subjects of radiation experiments.
