The concept of the three domains of reality is widely used in empirical critical realist research. However, there has been little scrutiny of how the domains are conceptualized and what they contribute to critical realism and how they should be applied in empirical research. This paper involves four arguments. First, Tom Fryer and Cristián Navarrete argue that the three domains of reality are redundant, confusing, and unsupported by Bhaskar’s theorizing. Second, Dave Elder-Vass argues that the three domains schema embodies (...) a distinction between the actual and the non-actual real. Regardless of whether we call them domains we need to retain this distinction. Third, Tobin Nellhaus argues that there are several reasons to uphold the three domains, but ‘the empirical’ is flawed and must be enfolded within a more encompassing theory. Fourth, Ruth Groff argues that the metaphor of ontological stratification is a problem when readers take it literally, often misconstruing the actual metaphysical content that it is meant to capture. In this study we compared the ethical attitudes of a group of experienced, predominantly female, registered nurses (n = 67) with those of a group of final year, mixed sex, medical students (n = 125). The purpose was to determine the basis of differences in attitudes that could lead to ethical disagreements between these two groups when they came to work together. A questionnaire developed to explore ethical attitudes was administered and the responses of the two groups were compared using (...) t-tests. Because of the preponderance of females among the nurses an analysis of variance of the gender-adjusted scores for each group was also carried out. On comparing the responses, the nurses differed significantly from the medical students in a number of ethical domains. A potential source of conflict between these two groups is that the nurses were inclined to adopt the perspective of patients but the medical students identified with their profession. When corrected for the effects of gender, the differences persisted, indicating that it was discipline that determined the differences. We recommend that students of nursing and medicine receive ethics education together, and that more open dialogue between doctors and nurses with respect to their different ethical viewpoints is needed in the work setting. This article will be of interest to educators of students of medicine and nursing, as well as to doctors and nurses who are eager to improve their professional relations and thereby improve patient care. In ‘Of Sensory Systems and the “Aboutness” of Mental States’, Kathleen Akins (1996) argues against what she calls ‘the traditional view’ about sensory systems, according to which they are detectors of features in the environment outside the organism. As an antidote, she considers the case of thermoreception, a system whose sensors send signals about how things stand with themselves and their immediate dermal surround (a ‘narcissistic’ sensory system); and she closes by suggesting that the signals from many sensory systems may (...) not in any familiar sense be about anything at all. Her presentation of the issues, however, overlooks resources available to ‘the traditional view’—or so I shall argue. Akins’s own thumbnail sketch of what is wrong with the traditional view is that it asks, concerning a given sensory system, ‘what is it detecting?’, when we should instead be asking ‘what is it doing?’ (352). Her point is that on the traditional view the function of a sensory system—what it's ‘for’—is to detect or indicate (values of) features of the outside environment. But at least on one version of the traditional view—namely Ruth Millikan’s—this would never be the sole or main proper function of a sensory system. (Akins does not list Millikan as a traditionalist, but Millikan fits squarely Akins’s description of them, since she believes in a naturalistic theory of aboutness and thinks it should begin with the senses.) For Millikan (1989, 1993), the proper function of a sensory system is in the first instance enabling behavioural systems—in the simplest case, motor routines—to perform their proper function. This they do, roughly, by switching on and steering the behavioural routines. Where features of the outside environment come in is as Normal (= assumed-by-the-design) conditions for the successful performance of the sensory system's proper function. That is, the only strategy for switching on and steering that is simple enough for evolution to have hit upon it, and reliable enough for evolution to have liked it, is a strategy which gears the steering to (values of) features of the outside environment. But as soon as one starts fleshing out the details of this story, one notices that they are probably quite different in the case of thermoreception from how they are with ‘distance’ senses such as vision and olfaction--a point which Akins overlooks.. Professor Elder has, I believe, misunderstood my position on the ontology of individuals, for I am not any kind of stage theorist. I do indeed believe, however, that there is a sense in which many different things can be in the same place at once, though it is not a sense in which “thing” is a count noun. To explain this, I briefly describe what I call “substances”, a category that includes both individuals and real kinds.

Jorgensen Indiana University, BloomingtonIn this symposium, I first briefly respond to Randall Allsup's piece, "Extraordinary Rendition: On Politics, Music, and Circular Meanings" with some general remarks on the distinctions between fundamentalism and liberalism, and internationalism, nationalism, and localism, and the importance of exercising judgment in order to find a middle ground between (...) extreme positions. Against this backdrop, I reflect on the songs we need to teach the nation to sing and, as a case in point, consider the National Anthem Project launched by the MENC—The National Association for Music Education. I suggest that at the very least the "Star-Spangled Banner" ought not be the only song to teach the nation at this time and it is important to carefully consider which songs we ought to teach the nation. And I propose that music teachers need to take a measured approach that eschews fundamentalism, rampant militarism, and excessive patriotism, embraces musically the tensions between internationalism, nationalism, and localism, and expresses a sensitive world-view through the choice of songs that cultivate and express liberal and democratic ideals and foster peace internationally.1Allsup's attention to the political character of research reminds us of the important consequences of any activity in the public and private spheres. Our endeavors as researchers are inherently ethical and have political consequences because as music teachers, we act on behalf of what John Dewey terms "the public."2 Dewey's "public" arises out of the need for social activities to be collectively organized, especially given the presence of the young, the poor, the ill, the elderly, the needy, and those who are otherwise dependent on others. Politics concerns the organization and governance of the public, that is the collective activities on behalf of society. For Dewey, educational activity cannot escape being ethical and political (construed positively) by the very fact of its undertaking on behalf of a public in the phenomenal world.3My understanding of fundamentalism is that it is, by definition, antithetical to liberalism. Whereas liberalism embraces surprise, entertains the possibility of doubt, and includes the "responsibility to choose,"4 fundamentalism is closed-minded and refuses to be surprised or to doubt the certainty of beliefs that have been accepted. Israel Scheffler notes that there is a safety in dogmatism in which one does not need to face the unsettlement of surprise that one might be wrong and one's beliefs mistaken.5 This quality of fallibility and openness to the possibility of surprise renders a liberal democracy fragile. Without cultivating [End Page 150] capacities and dispositions to open-mindedness and critical thought and action on the part of all the citizens of the democracy, it is open to being high-jacked by closed-mindedness and fundamentalism and thereby subject to dictatorial action on the part of those who seize political power.6 In difficult times, certainty may seem to be safer than open-mindedness that weighs possibilities and thinks through the complexities with which the public must deal. As Paul Woodford argues, if music education is to serve the interests of liberalism, it must likewise cultivate critical thinking and I add the caveat, as a means of defeating fundamentalism and literalism that would destroy liberal democracy.7Liberalism depends on the assertion of certain universal principles of ethical conduct. Seyla Benhabib's reconstruction of universals in what she terms her "post-Enlightenment project of interactive universalism" takes account of important postmodern, feminist, and communitarian insights and understands universals as "interactive not legislative, cognizant of gender difference not gender blind, contextually sensitive and not situation indifferent."8 In this frame, it is only possible to sustain liberalism on the assumption of action that takes for granted that others ought to agree with one and act in such-and-such ways. Whether these principles are referred to as "commonalities" or "universals" in the Benhabibian sense, one appeals to certain propositions on which ethical and political action should be predicated... This paper is a reply to the discussions of Ruth Groff, Dave Elder-Vass, Daniel Little, and Petri Ylikoski of Tuukka Kaidesoja : Naturalizing Critical Realist Social Ontology.

When thinking about the intersection of care and Christian bioethics, it is helpful to follow closely the account of Ruth, who turned away from security and walked alongside her grieving mother-in-law to Bethlehem. Remembering Ruth may help one to heed Professor Kaveny?s summoning of Christians to remember ?the Order of Widows? and the church?s historic calling to bring ?the almanahinto its center rather than pushing her to its margins.? Disabled, elderly and terminally ill people often seem, at least (...) implicitly, expendable. By hearing the scriptural account of Jesus? steadfast great-grandmother, readers may recall another way. One may read Ruth?s care for Naomi as a performative, prophetic act of faith. Ruth?s faithful resolve, when set next to Orpah?s prudent way, challenges the notion that a bioethic of care is innately feminine, and may further call women and men corporately to participate in a kind of care that is strenuous work. My thanks to Cathleen Kaveny for allowing me to play off the title of her insightful essay. Over the past decade, investments in agricultural and food technology startups have grown to previously unknown dimensions. Mushrooming agri-food tech startups that promise to solve critical issues in the agri-food system through technological innovation are increasingly perceived as an attractive new investment opportunity for venture capitalists and investors. This paper investigates how digital agri-food technologies are narrated, constructed, and promoted for financial investment. Through qualitative content analysis of agri-food tech industry reports, articles, and commentaries we trace the logic, rationales, and (...) narratives of this most recent investment rush, and reveal its immanent techno-finance fixes. We conceptualize the agri-food imaginaries produced within the agri-food tech discourse as financialized imaginaries, and argue that they are specifically tailored to construct, incentivize, and legitimize this new agri-food tech space for financial investment. In their attempt to raise money from investors, venture capital firms further fuel this development by discursively creating an ‘agri-food tech investment rush’—similar to the land and gold rushes of the past. Investments in agri-food tech startups, however, are presented to investors as both a profitable investment opportunity as well as a moral obligation, allowing for food production to cope with neo-malthusian and environmental threats. This paper contributes to our understanding of digitization as a socio-technical project, which includes the active envisioning and promotion of desirable agri-food futures. (shrink)

'Social construction' is a central metaphor in contemporary social science, yet it is used and understood in widely divergent and indeed conflicting ways by different thinkers. Most commonly, it is seen as radically opposed to realist social theory. Dave Elder-Vass argues that social scientists should be both realists and social constructionists and that coherent versions of these ways of thinking are entirely compatible with each other. This book seeks to transform prevailing understandings of the relationship between realism and constructionism. (...) It offers a thorough ontological analysis of the phenomena of language, discourse, culture and knowledge, and shows how this justifies a realist version of social constructionism. In doing so, however, it also develops an analysis of these phenomena that is significant in its own right. (shrink)

Most contemporary metaphysicians are sceptical about the reality of familiar objects such as dogs and trees, people and desks, cells and stars. They prefer an ontology of the spatially tiny or temporally tiny. Tiny microparticles 'dog-wise arranged' explain the appearance, they say, that there are dogs; microparticles obeying microphysics collectively cause anything that a baseball appears to cause; temporal stages collectively sustain the illusion of enduring objects that persist across changes. Crawford L. Elder argues that all such attempts to (...) 'explain away' familiar objects project downwards, onto the tiny entities, structures and features of familiar objects themselves. He contends that sceptical metaphysicians are thus employing shadows of familiar objects, while denying that the entities which cast those shadows really exist. He argues that the shadows are indeed really there, because their sources - familiar objects - are mind-independently real. (shrink)

“Congealing” is a word that evokes senses of unpleasantness where perhaps something inviting had once been. It also implies that things are becoming less fluid and more rigid. As we began organizing ETHICOMP 2018, we wanted a theme that reflected the impact of technologies on human cultures, practices and lives. Our initial draft of the theme was “Creating, Changing, and Congealing Ways of Life with Technologies.” And while we were eventually persuaded to use a more congenial way of putting the (...) idea (it became “Creating, Changing, and Coalescing Ways of Life with Technologies”), in some ways, it remains true for us that “congealing,” and its connotations of something less pleasant, gets at the original idea. As we incorporate technologies into our practices, much attention is paid to how they change our ways of doing things. But technologies can also help ways of life set-up and harden like yesterday’s leftovers – not appealing, yet difficult to budge and sometimes quite unhealthy. Once a particular process is built around a piece of technology, it can become entrenched and increasingly difficult to change. For a historical example, consider how difficult it was to adapt records and software on the eve of the 21st century in response to the so-called “Y2K” problem. In early software development, efficient use of memory was an important design consideration. It had become a standard practice to use a 2-digit field for the year, which would roll to from “99” to “00” in the year 2000, causing problems for datedependent functions. Technologies can also reflect and reinforce existing cultural tendencies. For a recent example, consider the human resources software created by Amazon that used its existing hiring data to train a machine-learning system to rate applicants. The resulting system turned out to be biased against women applicants, downranking resumes that included the word “woman” or “women’s.” Amazon ended up scrapping the project altogether. Because of these kinds of effects, we wanted to encourage people to think beyond well-worn paradigms like “technologies are disruptive” to consider other kinds of effects they can have. As it happened, the imagery of “congealing” proved distasteful enough that the steering committee opted for a more neutral term. But even with the less-dramatic wording the conference ended up attracting a rich and diverse range of papers that examined technological issues from a variety of angles, exactly as we had hoped. Various emerging technologies, from social robotics to social media, appeal to our desire for social interactions, while avoiding some of the risks and costs of face-to-face human interaction. But can they offer us real friendship? In this book, Alexis Elder outlines a theory of friendship drawing on Aristotle and contemporary work on social ontology, and then uses it to evaluate the real value of social robotics and emerging social technologies. In the first part of the book Elder develops (...) a robust and rigorous ontology of friendship: what it is, how it functions, what harms it, and how it relates to familiar ethical and philosophical questions about character, value, and well-being. In Part II she applies this ontology to emerging trends in social robotics and human-robot interaction, including robotic companions for lonely seniors, therapeutic robots used to teach social skills to children on the autism spectrum, and companionate robots currently being developed for consumer markets. Elder articulates the moral hazards presented by these robots, while at the same time acknowledging their real and measurable benefits. In the final section she shifts her focus to connections between real people, especially those enabled by social media. Arguing against critics who have charged that these new communication technologies are weakening our social connections, Elder explores ways in which text messaging, video chats, Facebook, and Snapchat are enabling us to develop, sustain, and enrich our friendship in new and meaningful ways. Why does #RepealedThe8th matter for feminist legal studies? The answers seem obvious in one sense. Feminism has long constituted itself through the struggle for sexual and reproductive justice, and Irish feminism has contributed a significant ‘legal win’ with the landslide vote of approval for lifting abortion restrictions in the referendum on the 25th May 2018. That win comes at a global moment when populist legal engagement is doing significant damage in countries that regard themselves as world leaders, and beyond. #RepealedThe8th (...) offers Ireland, and the world, the actuality that the popular vote, and everything that contributes to it, could be something else. Repeal shows how legal tools like the vote may be made into an expression of care for reproductive lives. This expression is important in recognizing pregnant people as knowing agents who are best placed to decide, and in seeking to do justice to those who contribute to everyday reproductive life. But repeal, like the many who brought it into being, has multiple meanings. #RepealedThe8th matters because it is a moving process of socio-legal translation, which draws on a collective energy, ‘repeal energy’, to turn the travesty that was the Eighth Amendment and all it represents into a search for the rest of reproductive life. In opening up the meaning of the vote, much like feminists elsewhere have opened up the meaning of the strike, Irish feminists have turned public mourning over past mistreatment into a series of reproductive connections. This is not a strategy that can be rolled out. Figuring out #RepealedThe8th will take many tellings. Rather we need to give repeal, and repealers, room to breathe and rest. We need to feel our way through repeal’s production of legal change so that this success is not reduced to some generic transferable set of legal instructions. I begin by reflecting on repeal as a process of feminist socio-legal translation, which shows us how legal change comes about through the motivation of collective joy, the mourning of damaged and lost lives, the sharing of legal knowledge, and the claiming of the rest of reproductive life. Rather than the art of putting forward logically valid arguments leading to Truth, argumentation is here viewed as the use of verbal means ensuring an agreement on what can be considered reasonable by a given group, on a more or less controversial matter. What is acceptable and plausible is always coconstructed by subjects engaging in verbal interaction. It is the dynamism of this exchange, realized not only in natural language, but also in a specific cultural framework, that has to be (...) accounted for. From this perspective, it is not enough to reconstruct patterns of reasoning. As logos is by definition both Reason and Language, abstract schemata have to be examined in their verbal realization in a given situation of discourse. Such an approach to arguments allows for a “thick” description taking into account their discursive and communicational aspects, as well as argumentation’s constitutive dialogism and its inscription in a set of common representations, opinions and beliefs (a doxa). This approach, exemplified by the analysis of a short text on stock options borrowed from the French newspaper Libération, is an attempt at establishing a dialogue between disciplines like argumentation theories, rhetorical criticism and discourse analysis. The Society of Professional Journalists' (SPJ) Code of Ethics divides the institutional duties of a journalist into four main categories, designed to capture the essence of what it means to be a good journalist: seek truth and report it, minimize harm, act independently, and be accountable. Clark Kent being Superman first and reporter second means his reporting suffers. He does pretty well with respect to the section of the code that concerns treating “sources, subjects and colleagues as human beings deserving (...) of respect. Clark Kent's dual life and the choices he makes as Superman keep him from meeting the minimum standards of journalistic ethics. Journalists are charged with revealing “unethical practices of journalists and the news media” and abiding “by the same high standards to which they hold others.”. (shrink)

A prominent feature of late nineteenth-century psychology was its intense preoccupation with precision. Precision was at once an ideal and an argument: the quest for precision helped psychology to establish its status as a mature science, sharing a characteristic concern with the natural sciences. We will analyse how psychologists set out to produce precision in 'mental chronometry', the measurement of the duration of psychological processes. In his Leipzig laboratory, Wundt inaugurated an elaborate research programme on mental chronometry. We will look (...) at the problem of calibration of experimental apparatus and will describe the intricate material, literary, and social technologies involved in the manufacture of precision. First, we shall discuss some of the technical problems involved in the measurement of ever shorter time-spans. Next, the Cattell-Berger experiments will help us to argue against the received view that all the precision went into the hardware, and practically none into the social organization of experimentation. Experimenters made deliberate efforts to bring themselves and their subjects under a regime of control and calibration similar to that which reigned over the experimental machinery. In Leipzig psychology, the particular blend of material and social technology resulted in a specific object of study: the generalized mind. We will then show that the distribution of precision in experimental psychology outside Leipzig demanded a concerted effort of instruments, texts, and people. It will appear that the forceful attempts to produce precision and uniformity had some rather paradoxical consequences. (shrink)

This is a brief reply to the roundtable entitled ‘Does critical realism need the concept of three domains of reality?’ in which Dave Elder-Vass, Tom Fryer, Ruth Porter Groff, Cristián Navarrete and...

Pervasive though it is in modern life, the concept of self‐esteem is often viewed with distrust. This paper departs from an idea that was recently aired by Richard Smith: that we might be better off without this concept. The meaning of self‐esteem is explored within four ‘homes’: the self‐help industry, social science, therapy and education. It is suggested that the first two use a ‘simple’ concept of self‐esteem that indeed we are better off without. This concept eliminates the distinction between (...) truthfulness and delusion, and relies on a chimera of quantifiability. The much richer concept of situated self‐esteem is explored, and it is argued that low self‐esteem in children should command the attention of educators. Teachers should address this through education and communication, and reject the idea of boosting self‐esteem through a content‐free curriculum. (shrink)

This editorial explains the themes of the forthcoming FLaK seminar and how those themes draw on the collective and individual contributions of the articles, interviews and commentaries presented in this issue. At FLaK, we propose to think with others about the kind of ‘kitchen table’ that FLS might provide into the future. How might feminist legal studies—the approach and the journal—best use its food, equipment, techniques, time, space, mood, energy and commitment? How shall FLS scholars and associates make the most (...) of what we have in a room that can sometimes be confining and confusing, yet also exciting and sustaining? How do others engage with the processes and products of our kitchen table? In considering these issues and more, we propose to draw reflexively on feminist legacies of praxis, internationalism and openness, as we stock up and critically reflect on decolonizing techniques, legal know-how, protest and publishing practices. This is a comparison of graduate students attitudes in Spain and the United States on the issue of universal versus relativist ethics. The findings show agreement on fundamental universal values across cultures but differences in responses to behavioral ethics within the context of entrepreneurial dilemmas.

Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the different (...) ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

Published in Vienna in 1936, _The Authoritarian State_ by Eric Voegelin has remained virtually unknown to the public until now. Sales of the German edition were halted following the Nazi invasion of Austria in 1938, and the entire printing was later destroyed by wartime bombing. In this volume, Voegelin offers a critical examination of the most prominent European theories of state and constitutional law of the period while providing a political and historical analysis of the Austrian situation. He discusses the (...) dismissal of Parliament in 1933, the civil war, the murder of Federal Chancellor Dollfuss, the adoption of the "Authoritarian Constitution" of 1934, and the predicament of being sandwiched between Hitler and Mussolini. A radical critique of Hans Kelsen's pure theory of law lies at the heart of this work, marking Voegelin's definitive departure from Neo-Kantian epistemology. For the first time, Voegelin elaborates on the important distinction between theoretical concepts and political symbols as a basis for explaining the nontheoretical and speculative character of ideologies, both left and right. He shows that _total_ and _authoritarian_ are symbols of ideological self-interpretation that have no theoretical value, a distinction basic to his later work in _The New Science of Politics._ Available for the first time in English, _The Authoritarian State_ is a valuable addition to the Voegelin canon and to the field of intellectual history in general. The goal of this article is to explore how a social justice framework can help illuminate the role that consent should play in health and science policy. In the first section, we set the stage for our inquiry with the important case of Henrietta Lacks. Without her knowledge or consent, or that of her family, Mrs. Lacks’s cells gave rise to an enormous advance in biomedical science—the first immortal human cell line, or HeLa cells.

In the current research landscape, there are increasing demands for research to be innovative and cutting-edge. At the same time, concerns are voiced that as a consequence of neoliberal regimes of research governance, innovative research becomes impeded. In this paper, I suggest that to gain a better understanding of these dynamics, it is indispensable to scrutinise current demands for innovativeness as a distinct way of ascribing worth to research. Drawing on interviews and focus groups produced in a close collaboration with (...) three research groups from the crop and soil sciences, I develop the notion of a project-innovation regime of valuation that can be traced in the sphere of research. In this evaluative framework, it is considered valuable to constantly re-invent oneself and take ‘first steps’ instead of ‘just’ following up on previous findings. Subsequently, I describe how these demands for innovativeness relate to and often clash with other regimes of valuation that matter for researchers’ practices. I show that valuations of innovativeness are in many ways bound to those of productivity and competitiveness, but that these two regimes are nevertheless sometimes in tension with each other, creating a complicated double bind for researchers. Moreover, I highlight that also the project-innovation regime as such is not always in line with what researchers considered as a valuable progress of knowledge, especially because it entails a de-valuation of certain kinds of long-term epistemic agendas. I show that prevailing pushes for innovativeness seem to be based on a rather short-sighted temporal imaginary of scientific progress that is hardly grounded in the complex realities of research practices, and that they can reshape epistemic practices in potentially problematic ways. This paper takes a sideways look at the controversial topic of educational assessment, raising the question: what place should the success/failure distinction have in an effective and humane educational system? Though the experience of failure may undermine the self-esteem that is conducive to learning, its possibility is clearly important educationally. Instead of asking whether teachers should be truthful about children’s achievements or dishonestly promote their self-esteem, we need to recognise a certain logical indeterminacy about what young children can do. Given (...) this, it is reasonable to presume in favour of many of their capacities rather than against them, for this is how children develop the confidence to act. This includes the confidence to fail as well as the confidence to succeed. It is argued that both are crucial for learning. (shrink)

Citizenship and its education is again gaining importance in many countries. This paper uses England as its primary example to develop a Habermasian perspective on this issue. The statutory requirements for citizenship education in England imply that significant attention be given to the moral and social development of the learner over time, to the active engagement of the learner in community and to the knowledge skills and understanding necessary for political action. This paper sets out a theoretical framework that offers (...) a perspective on learning suitable for these far-reaching aims. We argue that schools need to shift from the currently dominant discourse of accountability to incorporate a discourse of care in order to make room for an effective and appropriate pedagogy for citizenship. Habermas’s social theory gives us a theoretical framework that properly locates schools within the lifeworld as part of civil society. Schools should therefore attend to hermeneutical and emancipatory concerns, not only to strategic interests. We put these in the context of Habermas’s social theory to paint an alternative vision learning for citizenship education which is based in developing the dispositions, values and attitudes necessary for lifelong learning with a view to developing ongoing communicative action. Other examples María Fernanda Olarte-Sierra and Tania Pérez-Bustos 159 studied how care, and associated practices such as transnational care chains, are feminized and precarious—involving an ethos embodied by those who actively work to maintain or preserve another’s life. Feminists have focused on the politics of care embedded in invisible jobs related to aesthetics, domestic work, child and elder care, and sexual activities and see all these tasks as related to the reproduction of life and culture.2 Central to this conceptualization of care is the understanding that these jobs are typically women’s work. There is a common association between this care and notions of “motherhood” as it relates to values such as compassion, love, and respect, which have been constructed as universally feminine. However, the main goal of feminist studies of care has been to deconstruct this association, particularly because it is imbued with the white, wealthy, heteronormative ideal of femininity that underlies a gendered division of labor. The reality is that class, race, nation, and gender determine who cares for whom, whether or not labor is paid, and to what extent care is exploitative. One strand of recent research problematizes both valorizing and criticizing care practices on the grounds that they are based on a rather homogeneous understanding of the feminine. Since the last issue of Feminist Legal Studies, we editorial board members have had lots of conversations about comfort, displacement and alienation. As we developed the programme for #FLaK2016 we thought about it as a kind of pulling ourselves out of our comfort zone, if academic events and journals ever have a comfort zone. Drawing on a mix of feminist live performance methods and a science and technology studies-type curiosity for objects of experimentation, we tried out a kitchen table method (...) of hosting a live research conversation with activists, artists and academics over two days. But we had not fully anticipated the way that the Brexit result would contribute to and complicate discomfort. A fuller analysis of FLaK awaits a later moment, but here we pick out this one aspect of our gathering—feelings of discomfort – as they animate the contributions to this issue in interesting ways. Epistemologists have traditionally been concerned with two issues: the justification of particular beliefs or sets of beliefs, and claims to knowledge. I propose to examine the relative import of these questions by comparing the gravity of the threat posed by two sceptics: one who questions the justifiability of our beliefs, and one who doubts our knowledge claims.

The aim of this article is to analyse the opinions of journalists and citizens regarding the interdependence of public media and the official sources of political power in Spain. Little research of this kind has been done in the Spanish context. Journalists and citizens representing four Spanish regions?Catalonia, Madrid, the Basque Country, and Andalusia?were questioned about their opinions regarding this interdependency. The methodology used in this research is based on quantitative techniques (surveys) and qualitative techniques (in-depth interviews and focus groups). (...) The results prove that the opinions of journalists differ from those of citizens for the majority of questions asked. Citizens are more inclined to follow directions from official sources than are journalists. The geographical background of the respondents proved to be a significant factor in terms of variation in answers. Journalists from Catalonia and the Basque country are much more reluctant to follow government directives on issues of counter terrorism or in cases of national emergency. (shrink)

The universalist argument that all children should be educated in inclusive mainstream schools, irrespective of their difficulties or disabilities, is traced to the claims that special schools and disability ‘labels’ are inherently humiliating, and that no decent society tolerates inherently humiliating institutions. I ask whether there is a sound reason for a child to feel humiliated by special schools/disability ‘labels’ as such, and find none. Empirically, some do and some do not find these humiliating, and it is argued that the (...) failure to address the multiple ‘realities’ of disability and learning difficulty is responsible for the policy impasse in this area. Feminists witness legal worlds as they observe, document and share nothing less than the reproduction of life itself. The world of the abortion trail, where people and things move across borders to change life’s reproduction, has generated a rich variety of legal sources, figures and objects for feminist witnessing. In watching how feminist activists improvise with sources, figures and objects of legal consciousness on the abortion trail, this article seeks to contribute to critical understanding of a plurality of witnessing practice, (...) particularly as it emerges in diaspora space. Focusing on Murphy’s concept of immodest witnessing, with its attention to bodies, protocols and apparatuses as constituents of knowledge, the article thinks with the diasporic feminist performance group, Speaking of I.M.E.L.D.A., about how they used self-examination, collaboration and knowledge-sharing on the trail to repeal Ireland’s 8th Amendment. The article argues that their improvisation with legal consciousness of reproductive choice enacts ‘cheeky witnessing’. Cheeky witnessing has three dynamics as a method of observation. First, it is messy and irreverent in innovating with names to display the mixed genealogies of feminist knowledge. Second, cheeky witnessing generates novel subject-figures who make connections between different reproductive labourers as observers of the trail in diaspora space. Third, cheeky witnessing places funny objects, knickers in this instance, so as to join up particular public locations and make them more, if unevenly, comfortable for sexual and reproductive bodies. Cheeky witnessing shows us how committed and partial practices play a role in speaking across interests and experiences, in stretching the legal imagination and in sustaining the everyday grind of making a better world. The logical system Hyperproof and the computer implementation of it--both created by Jon Barwise and John Etchemendy--present a radical new approach to modeling and teaching about reasoning. Hyperproof is a heterogeneous proof system that uses both sentences and diagrams as steps in proofs. This dissertation addresses important logical, philosophical, and pedagogical issues that Hyperproof raises. We formalize the syntax and semantics of Hyperproof, show that the major inference rules are valid, and give completeness results for four subsystems of Hyperproof. We (...) address philosophical issues raised by the logical analysis, including the importance of the presence of homomorphism between diagrams and the worlds they represent. We also apply the constructivist educational philosophy to create a detailed explanation of how to teach analytic reasoning with Hyperproof, and we discuss how Hyperproof can be augmented to teach about reasoning with different types of domains.
