On September 9, 2013, diplomats and civil society activists gathered in a ballroom in New York to welcome Jennifer Welsh as the UN Secretary-General's new Special Adviser on the Responsibility to Protect. In her first public appearance in that role, Special Adviser Welsh explained that one of her top priorities would be “to take prevention seriously and to make it meaningful in practice.” “In the context of RtoP,” Welsh added during the discussion, “we are talking about crimes, and crimes have (...) implications in terms of how we deal with them. You'll hear me say that a lot.” Welsh's approach of treating RtoP as a principle that is primarily concerned with prevention and is firmly linked to international crimes neatly captures the evolution of RtoP since its formal acceptance by states at the 2005 UN World Summit. Paragraphs 138 to 140 of the World Summit's Outcome Document not only elevated the element of prevention to a prominent place within the principle of RtoP but also restricted the scope of RtoP to four specific crimes under international law: genocide, war crimes, ethnic cleansing, and crimes against humanity. The crime and prevention–focused version of RtoP has subsequently been defended and promoted by Secretary-General Ban Ki-moon and by UN member states. This article seeks to systematically explore some of the implications of linking RtoP to the concept of international crimes, with a particular focus on the preventive dimension of RtoP, the so-called responsibility to prevent. What, then, are the consequences of approaching the responsibility to prevent as the prevention of international crimes?In order to systematically examine this question, this article turns to literature from criminology. While the criminological perspective has so far been neglected in debates on RtoP, the prominent criminologists John Hagan and Wenona Rymond-Richmond argue vehemently that “criminology is crucially positioned to contribute understanding and direction to what the United Nations has mandated as the ‘Responsibility to Protect’ groups that are threatened with mass atrocities.” For the purpose of this article, the label “criminology” comprises domestic criminology, supranational criminology, and international criminal law. While insights from supranational criminology and international criminal law are directly applicable to international crimes, translating knowledge generated in relation to crimes at the domestic level to atrocity crimes at the international level is, of course, not without challenges. Reasoning by analogy is an important method in this regard, though given the anarchical nature of international society some analogies will inevitably be imperfect. The benefits of such an approach, if carefully employed, however, outweigh the risks. (shrink)

Mill and Carl Hempel are examined, and are used to argue against the view that explanation is merely a problem for the philosophy of science. Having established its importance for understanding knowledge in general, the book concludes with a bold and original explanation of explanation.

The link between leadership and mental health at the workplace is well established by prior research. However, most of the studies have addressed this relationship from a single-source perspective. The aim of this study was to examine how supervisor and employee ratings of health-oriented leadership correspond to each other and which sources are predictive for employee mental health. We assessed data within 99 teams containing 713 employees in 11 different companies in Southern Germany. Supervisors and their staff completed questionnaires on (...) the supervisors’ health-oriented staff-care dimensions awareness, value of health and health behavior and current mental distress. Hierarchical linear models revealed that supervisors’ self-ratings were significantly related to their employees’ ratings only on the health behavior dimension, but not on the health awareness and value of health dimensions. Also, supervisors rated themselves significantly higher on HoL compared to their employees. Employee ratings of HoL significantly predicted their own level of mental distress, whereas supervisor ratings of HoL did not predict employees’ mental distress at the team level. Supervisors’ self-ratings of HoL did not influence the relationship between employee ratings of HoL and their mental distress on an individual level. These results highlight the complex relationship between multisource assessments of HoL and employee mental health, emphasizing the importance of subjective perception for mental health. Future studies should investigate under which conditions supervisor and employee ratings correspond to each other and are predictive for mental health at the workplace. (shrink)

The idea that citizens have a right to receive information that is relevant for their suitable exercise of political rights and liberties is well established in democratic societies. However, this right has never been systematically analyzed, thus remaining a blurry concept. This article tackles this conceptual gap by conceptualizing citizens’ right to information. After reviewing previous approaches to this idea, I locate citizens’ right to information on the map of communication rights, and put forward a systematic framework for both justifying (...) and analyzing it. This framework focuses on this right’s grounds, its function, its holders, its content, and its correlative duties. Although the conceptualization offered here will be incomplete, it will be enough to distinguish the general concept of citizens’ right to information from both its specific conceptions and from the other two best-known rights of the public: freedom of information and the public’s right to know. In the field of organizational communication, the notion of autopoiesis has been mostly used to explain the mechanisms that constitute organizations in autonomous systems. In this paper we argue that to better understand the autonomy and the constitutive mechanisms of organizations we need to study the narrative processes that distinguish organization as a unity. This statement is based on two premises: first, the intrinsic relation between autopoiesis and the interpretative capacity of living beings; second, the importance of the act of (...) distinction in the sensemaking process, from which we differentiate the unity from a ground. En el campo de la comunicación organizacional, el concepto de autopoiesis se ha usado principalmente para explicar los mecanismos que constituyen las organizaciones en sistemas autónomos. El presente artículo explora la apropiación discursiva que el poder contemporáneo hace del concepto “terrorismo”. A partir de algunas indicaciones de las filosofías políticas de Platón y de Hobbes, similares en cuanto a su encomio de la violencia como herramienta del poder, se defiende que abusar del concepto “terrorismo” sirve al poder como mecanismo de autolegitimación y autoafirmación. Esto es así porque el poder, a través de sistemas doctrinales muy diseminados, presenta los actos terroristas como una muestra del hipotético estado (...) de caos total que surgiría si se modificara su actual configuración. What should be news in a democracy? This article offers a deliberative answer to this question by developing a deliberative account of newsworthiness. Drawing from the deliberative theory of democracy, I define the general criterion of deliberative newsworthiness as a mandate that commands journalists to seek, select, and report the contents that are most capable of stimulating high-quality deliberation. I then develop a two-step process through which journalists may apply this criterion. First, journalists should select the most newsworthy issues, which (...) are those that most profoundly affect (or are likely to affect) how just our society is. Second, journalists should select the most newsworthy facts and the most newsworthy arguments, both of which are to be chosen on the basis of their capacity to promote quality deliberation about the newsworthy issues. Ultimately, what should be news is a context-dependent issue that only journalists can decide, but deliberative newsworthiness is the normative criterion that journalists should follow when making these decisions – at least, if they want to produce the news that deliberative democracy needs. The article analyzes the concept of universality in Oleg Drobnitskii’s ethics. As opposed to most Soviet ethicists of the 1960s and early 1970s, Drobnitskii viewed this concept along the lines of the principle of universality presented in the moral theories of Immanuel Kant and Richard Hare. However, while they considered universality to be a feature of individual moral thinking in the forms of maxims, principles, and evaluations, Drobnitskii understood universality as the main feature of moral requirements and essentially external to (...) the moral agent, representing to her social relations and the ‘general laws of history.’ It was conceptually significant in Drobnitskii’s approach to universality that he analyzed it within the context of a more general concept of morality—as a mode of normative regulation of behavior. In this capacity, universality was presented as a characteristic of general appeal, or the general way in which a moral requirement is binding. The principle of equality is a normative correlate of universality understood in this way. Universality also characterizes judgments, whose moral adequacy is verified through the procedure of universalization. Regarding universality, Drobnitskii discussed important questions of the individualization of the universal moral requirement in the form of the moral agent’s personal task and the universality of class moral views. He tried to explain these differing, and not always interconnected, aspects of universality by appealing to certain ‘general laws of history,’ and thus offered a historicist basis of morality. This article shows that, despite this unprecedented analysis of the issue of universality, Drobnitskii did not achieve a systematic conclusion in his conceptualization of universality. Nevertheless, he was able to offer a number of significant insights, with the potential to aid our further comprehension of the phenomenon of universality and how it ought to be understood. (shrink)

This article explores the connections between David Hume's theory of prejudice, present-day theories of structural ignorance, and Hume's own racist attitudes. Charles Mills has identified certain types of ignorance, including racial ignorance, that result from social structures. Here, I argue that Hume can do something similar. Hume uses the concept of prejudice to theorize the misjudgment of someone based on their perceived membership of a certain group. Despite its seemingly individualist presentation in the Treatise, Hume's theory can, as a result (...) of his deeply social view of the mind, be expanded to account for social-structural influences on the formation of prejudices. In fact, in several places he himself develops such structural explanations. On the resulting picture, both his racism and his theory of prejudice are seen to play important roles in his philosophy. Free will, before being an object of beliefs or theories susceptible of verification, is the omnipresent supposition of our conscious life. This paper claims that this omnipresence, even though it is not enough to validate theoretically free will, entails two significant consequences. First, that free will is the essential presumption of our actions, without which they would become incomprehensible. Second, that all denial of this – a rational action in itself – presupposes that which is denied.

Body metaphors and body fables were frequently used in ancient discourse for social communities and politics. This article will examine a body fable by the Greek fabulist Babrius that has been overlooked in research so far. It shows a remarkable similarity to 1 Corinthians 12 through the use of central terms such as σῶμα and μέλος or personified speaking body parts such as an eye and head. Even if no literary direct dependence is claimed, the text, which was written at (...) about the same time as 1 Corinthians, sheds light on Paul's understanding of the body fable. It becomes apparent, however, that the rhetorical function is fundamentally different in the two texts. Whilst the body fable in Babrius reinforces hierarchical structures, Paul emphasises the equality of the various body parts. The discussion about the 'implicit ethics' of these two texts is hermeneutically embedded in the current Corona crisis and the management of the crisis in different forms of organisation and state. CONTRIBUTION: The contribution makes the overlooked Babrius Fable 134, a body fable in political context, known in New Testament scholarship. A comparison with 1 Corinthians 12 points out that despite close analogies in plot and vocabulary, the message regarding the social structure diverges radically: While Babrius propagates a reinforcement of hierarchical leadership, 1 Corinthians 12 pleads for a community based on equivalence. Happy cow messages are instances of commercial speech by the animal industry which, by action or by omission, mislead consumers about the harmful effects that the industry has for nonhuman animals, the environment, or human health. Despite their ubiquity, happy cow messages have received little philosophical scrutiny. This paper aims to call attention to this form of speech, and to make the case for its restriction. To do so we first conceptualize happy cow messages. Second, we argue that they encroach (...) upon individual autonomy in two particularly objectionable ways: by impairing our ability to behave according to our moral convictions, and by thwarting our capacity to identify and reason about our moral duties. This, we hold, grounds a pro tanto case for stricter and more comprehensive regulations of commercial speech by the animal industry. Third, and against the objection that restricting happy cow messages would violate freedom of speech, we contend that none of the most influential arguments for free speech grants them protection. Indeed, we suggest, those rationales seem to call for their restriction. Fourth, and finally, we review some possible ways to defuse the misleading potential of happy cow messages through commercial speech regulations. (shrink)

Es innegable la necesidad del uso de criterios objetivos en la asignación de asistencia mecánica respitatoria. Para ello, en la disciplina de los cuidados críticos se dispone de las herramientas soportadas en la evidencia, de gran valor práctico y como es obvio en el uso de elementos de diagnóstico y terapia, también con sus limitantes, como sucede con las limitaciones de valores predictivos de las mismas. Encuentro que el uso del concepto “preservar la mayoría de los años de vida”, por parte de Jakie Powder del Jhon Hopkins Center of Bioethic, se puede prestar a equívocos, pues podría entenderse como un intento de reducción de criterios utilitaristas para la asignación de recursos de ARM; el autor se hace cargo del tema e indica que “cabe aclarar que ‘preservar la mayoría de los años de vida’ no significa hacer un triage que excluya de la AMR a pacientes que sobrepasan una cierta edad, sino que no se incluya a pacientes cuya prolongación de la vida solo resulte precaria y penosa”. En el ámbito académico-filosófico de la disciplina de la bioética se encuentran en contradicción esencial dos visiones: la utilitarista materialista y la realista; es de difícil conciliación racional el intento de cuantificación objetiva de “calidad de vida”, pues ello conduciría a posibles decisiones injustas. Creo que es pertinente reconocer que el ejercicio práctico de la medicina se enmarca, generalmente -no solo en situación de pandemia- en un entorno de escasez de recursos. Estos, por supuesto, siempre han de asignarse dentro del marco de la racionalidad, la proporcionalidad terapéutica y la justicia, pero es pertinente reconocer que existen variables que determinan resultados fatales y que no pueden ser atribuibles a los procesos de decisión del clínico, quien no ha de ser obligado a lo imposible cuando el volumen y complejidad de las circunstancias de triage son apremiantes. Ello no deroga el imperativo racional hipocrático del respeto a la vida de todos como inspiración del quehacer”. Este escrito fue publicado por el Centro de Bioética: Persona & Familia, en su portal web, el 22 de abril de 2020.
