Background: The concept of conscientious objection is well described; however, because of its nature, little is known about real experiences of nursing professionals who apply objections in their practice. Extended roles in nursing indicate that clinical and value-based dilemmas are becoming increasingly common. In addition, the migration trends of the nursing workforce have increased the need for the mutual understanding of culturally based assumptions on aspects of health care delivery. Aim: To present (a) the arguments for and against conscientious objection (...) in nursing practice, (b) a description of current regulations and practice regarding conscientious objection in nursing in Poland and the United Kingdom, and (c) to offer a balanced view regarding the application of conscientious objection in clinical nursing practice. Design: Discussion paper. Ethical considerations: Ethical guidelines has been followed at each stage of this study. Findings: Strong arguments exist both for and against conscientious objection in nursing which are underpinned by empirical research from across Europe. Arguments against conscientious objection relate less to it as a concept, but rather in regard to organisational aspects of its application and different mechanisms which could be introduced in order to reach the balance between professional and patient’s rights. Discussion and conclusion: Debate regarding conscientious objection is vivid, and there is consensus that the right to objection among nurses is an important, acknowledged part of nursing practice. Regulation in the United Kingdom is limited to reproductive health, while in Poland, there are no specific procedures to which nurses can apply an objection. The same obligations of those who express conscientious objection apply in both countries, including the requirement to share information with a line manager, the patient, documentation of the objection and necessity to indicate the possibility of receiving care from other nurses. Using Poland and the United Kingdom as case study countries, this article offers a balanced view regarding the application of conscientious objection in clinical nursing practice. (shrink)

This book critically reviews all principal contributions to the American animal rights debate by activists, campaigners, academics, and lawyers, while placing animal rights in context with other related and competing movements.

Ronit Stahl and Ezekiel Emanuel have recently issued a stark challenge to conscience protections in medical law and ethics. Their argument is flawed, however. They misrepresent the nature and relevance of conscientious protection in the military, misinterpret the scope of consent tendered by modern medical professionals, and offer no reason to think either that conscientious objection harms patient well-being or that such harm should solely determine the permissibility of conscientious objection. Moreover, and most fundamentally, Stahl and Emanuel do not recognize (...) that conscience protections promote moral integrity, a basic aspect of human well-being that justifies protective action. It is now more than half a century since I first began thinking about issues of free will. The libertarian views of free will I developed over this long period have been much debated and have been refined and further developed in response to the critical literature. The goal of this book is to provide an overview of recent developments of my views along with responses to the latest critical literature on them over the past twenty-five years since the publication (...) of my book, The Significance of Free Will (OUP, 1996). Chapters 1-5 present an overview of my current view with the recent additions and alterations to it defended in greater detail. Chapters 6-10 include critical examinations of influential views of many philosophers in the past twenty-five years who have defended alternative views of free will and moral responsibility, including prominent defenders of competing libertarian views, prominent defenders of compatibilist views, free will skeptical views, revisionist views, illusionist views, and others. The goal of these chapters is not merely to criticize these views, but to show what I believe they get right and what aspects of many of them can be accommodated in the libertarian view of free will I defend here. In the final chapter 11, I relate the view of free will of earlier chapters to ethical views I have developed in other works over this same period and to the philosophy of religion, including Eastern religions (Hinduism, Buddhism) as well as theistic traditions (Judaism, Christianity, and Islam). In a recent paper in this journal, “How should libertarians conceive of the location and role of indeterminism?” Christopher Evan Franklin critically examines my libertarian view of free will and attempts to improve upon it. He says that while Kane's influential [view] offers many important advances in the development of a defensible libertarian theory of free will and moral responsibility … [he made] “two crucial mistakes in formulating libertarianism” – one about the location of indeterminism, the other about its (...) role – “both of which have helped fan the flame of the luck argument”. In this paper, I respond to Franklin's criticisms, arguing that, so far from making it significantly more difficult to answer objections about luck and control, as he claims, giving indeterminism the location and role I do makes it possible to answer such objections and many other related objections to libertarian free will. In a recent article, Director makes the case that many individuals with bipolar disorder have the capacity to consent to many decisions while acutely manic, even when those decisions are out of character and cause harm. Referring to recent qualitative evidence, I argue that Director overlooks a key mechanism of manic incapacity, an inflexible experience of the future that impairs one’s ability to value. Without attention to the illness-specific experience of decision-making, capacity assessments risk false negatives in people with mania.

How can we register the participation of a range of elements, extending beyond the human subject, in the production of HIV events? In the context of proposals around biomedical prevention, there is a growing awareness of the need to find ways of responding to complexity, as everywhere new combinations of treatment, behavior, drugs, norms, meanings and devices are coming into encounter with one another, or are set to come into encounter with one another, with a range of unpredictable effects. In (...) this paper I consider the operation of various framing devices that attribute responsibility and causation with regard to HIV events. I propose that we need to sharpen our analytic focus on what these devices do, their performativity—that is, their full range of worldly implications and effects. My primary examples are the criminal law and the randomized control trial. I argue that these institutions operate as framing devices: They attribute responsibility for HIV events and externalize other elements and effects in the process. Drawing on recent work in science and technology studies as well as queer theory, I set out an analytic frame that marks out a new role for HIV social research. Attentiveness to the performative effects of these devices is crucial, I suggest, if we want better to address the global HIV epidemic. (shrink)

This article examines how the formation of markets in bottled water has relied on assembling a particular subject: the subject of hydration. The discourse of hydration is a conspicuous feature of efforts to market bottled water, allowing companies to appeal to scientifically framed principles and ideas of health in order to position the product as an essential component in self-health and healthy lifestyles. Alongside related principles, such as the ‘8 × 8 rule’, hydration has done much to establish new practices (...) of water drinking and consumption in which the consumer appears to be always at risk of dehydration and must engage in practices of ‘frequent sipping’. This article traces the emergence of the concept of hydration from its origins in exercise science and explores its circulation, contemporary uses and purchase. I argue that the appeal to biomedical languages and concepts found in the discourse of hydration connects with much broader ways of conceiving and acting upon the self that have become prevalent in contemporary society – what Rose and Novas call ‘biological citizenship’ – indicating how the ensemble of hydration participates in wider-ranging transformations in forms of rule. The story of hydration reveals how biomedical techniques of the self can be made to double up as ‘market devices’ by offering specific procedures for assessing the self and calculating the body’s needs. In order to grasp these developments, I position the health sciences, and health and fitness in particular, as a potent site of popular culture in which bodies learn to be affected by the procedures of scientific experiment. A critical grasp of this context is best enabled, I argue, by situating the producers and consumers of scientific principles and commercial products as embodied and looking at their interconnection in processes of emergence. Through these means, we can begin to develop a fully materialized account of the question: how have we become so thirsty? (shrink)

The popularity of Deleuze and Guattari is an undeniable precedent in current theoretical exchanges, and it could be stated without much contention that one's theoretical positioning must at some point deal with the salient conceptual offerings of Deleuze and Guattari, especially their double-opus, Anti-Oedipus and A Thousand Plateaus wherein a wealth of critique abounds. However, the significant trends concerning Deleuze and Guattari ‘scholarship’ may be jeopardised by the use of certain conceptual themes and methods in their work that are distorted (...) and employed by big business looking to secure their legacies of power by means of a control mechanism that looks to subjugate an entire world by means of ‘globalitarianism’. Our aim here will be to use McDonald's Corporation as an example of how the theoretical offerings of Deleuze and Guattari have been indirectly and hastily deployed for corporate ends, how these attempts are counter-Deleuzian, and to answer at least one of Žižek's criticisms against Deleuze. Hearing Double is an extended meditation on the jazz standard that brings together both musical analysis and philosophical analysis to offer a novel theory of musical works. Rather than focus on works of classical music, which has been the main focus of most Anglophone philosophy of music, Hearing Double focuses on "jazz standards" and attempts to theorize what makes them ontologically and historically specific and important. In this theory, standards are understood to emerge from networks of musical performances. Part I (...) describes the ontology of these musical networks by considering two musical processes, "replication" and "nomination," and their interaction. Part II discusses the historical conditions that encouraged standards to emerge. These conditions promoted an auditory culture where new songs were expected to circulate in ever-changing performances and arrangements. By weaving together ontological theory and auditory cultural history, Hearing Double challenges conventional understandings of the jazz repertoire, and opens up a new method for understanding the history, purpose, meaning, and aesthetics of jazz standards. Drawing both on cultural-historical activity theory and on a dialogical approach to discourse, this article expands a method of analysis developed by Engeström & Sannino to capture discursive manifestations of contradictions in an activity system. The data consist of recorded meetings of an interprofessional team working with persons living with both a mental handicap and psychiatric disorders. The mission of this team is to coordinate socio-educative and psychiatric work. A sequence taken from one of these meetings was submitted to a (...) step-by-step discourse analysis and examined how the participants negotiated and managed the obstacles met with in their daily work. The analysis showed how an initial obstacle presented as a conflict was gradually turned into a critical conflict and finally into a dilemma between two rules: professional confidentiality and transparency towards the patient. It showed how the participants collectively coped with this dilemma, and came to define it as a problem related to work organisation, and not only to interpersonal relationships. The study shows the importance of discourse processes in collaborative work and in fostering professional learning and focus upon discourse processes through which team members deal with obstacles in their daily work and to provide a fine-grained analysis of systemic contradictions. Consider the following principle: (LP) If an action is undetermined at a time t, then its happening rather than not happening at t would be a matter of chance or luck, and so it could not be a free and responsible action. This principle (which we may call the luck principle, or simply LP) is false, as I shall explain shortly. Yet it seems true.

This second edition of The Oxford Handbook of Free Will is intended to be a sourcebook and guide to current work on free will and related subjects.

The aim of this paper is to respond to recent discussion of, and objections to, the libertarian view of free will I have developed in many works over the past four decades. The issues discussed all have a bearing on the central question of how one might make sense of a traditional free will requiring indeterminism in the light of modern science. This task involves, among other things, avoiding all traditional libertarian appeals to unusual forms of agency or causation that (...) cannot be accounted for by ordinary modes of explanation familiar to the natural and human sciences. Doing this, I argue, requires piecing together a “complex tapestry” of ideas and arguments that involve rethinking many traditional assumptions about free will. The paper also argues that one cannot get to the heart of historical debates about free will without distinguishing different kinds of freedom, different senses of will, and different notions of control, among other distinctions. I especially focus here on different notions of freedom and control that are necessary to make sense of free will. (shrink)

Over the past five decades, I have been developing a distinctive view of free will according to which it requires that agents be to some degree ultimately responsible for the formation of their own wills. To act ‘of one's own free will’ in this sense is to act ‘from a will’ that is to some extent ‘of one's own free making’. A free will of this ultimate kind has been under attack in the modern era as obscure and unintelligible. In (...) this paper, I discuss the arguments for such a view and compare it to other contemporary views of free will and action. I then address criticisms that such a non‐determinist free will cannot be made intelligible or reconciled with modern science, does not allow sufficient agent control, reduces to mere chance or luck or randomness, leads to various regresses, or fails to account for moral responsibility, among other criticisms. This Open Access book (see link to Taylor & Francis below) critically examines the recent discussions of powers and powers-based accounts of causation. The author then develops an original view of powers-based causation that aims to be compatible with the theories and findings of natural science. Recently, there has been a dramatic revival of realist approaches to properties and causation, which focus on the relevance of Aristotelian metaphysics and the notion of powers for a scientifically informed view of causation. Ingthorsson argues that one central feature of powers-based accounts of causation is arguably incompatible with what is today recognised as fact in the sciences, notably that all interactions are thoroughly reciprocal. Ingthorsson’s powerful particulars view of powers-based causation accommodates for the reciprocity of interactions. It also draws out the consequences of that view for the issue of causal necessity and offers a way to understand the constitution and persistence of compound objects as causal phenomena. Furthermore, Ingthorsson argues that compound entities, so understood, are just as much processes as they are substances. A Powerful Particulars View of Causation will be of great interest to scholars and advanced students working in metaphysics, philosophy of science, and neo-Aristotelian philosophy, while also being accessible for a general audience. Penser l'humain : la part africaine est une investigation philosophique sur des objets aussi variés que les mythes et les cosmogonies ; la conception et l'organisation de l'espace-temps ; la nature et la (...) fonction du savoir ; l'idéologie et le pouvoir ; le sacré et le profane ; l'idée de nombre et les spéculations sur ses usages. La recherche d'une unité aux discours portant sur ces différents objets trouve sa justification dans un avant-propos intitulé "La part africaine", formulation d'une problématique dont l'auteur s'emploie à dissiper les ambiguïtés et les équivoques pour mieux en souligner l'intérêt. McTaggart’s argument for the unreality of time, first published in 1908, set the agenda for 20th-century philosophy of time. Yet there is very little agreement on what it actually says—nobody agrees with the conclusion, but still everybody finds something important in it. This book presents the first critical overview of the last century of debate on what is popularly called "McTaggart’s Paradox". Scholars have long assumed that McTaggart’s argument stands alone and does not rely on any contentious ontological principles. The (...) author demonstrates that these assumptions are incorrect—McTaggart himself explicitly claimed his argument to be dependent on the ontological principles that form the basis of his idealist metaphysics. The result is that scholars have proceeded to understand the argument on the basis of their own metaphysical assumptions, duly arriving at very different interpretations. This book offers an alternative reading of McTaggart’s argument, and at the same time explains why other commentators arrive at their mutually incompatible interpretations. It will be of interest to students and scholars with an interest in the philosophy of time and other areas of contemporary metaphysics. (shrink)

It is often said that politics is an amoral realm of power and interest in which moral judgment is irrelevant. In this book, by contrast, John Kane argues that people's positive moral judgments of political actors and institutions provide leaders with an important resource, which he christens 'moral capital'. Negative judgements cause a loss of moral capital which jeopardizes legitimacy and political survival. Studies of several historical and contemporary leaders - Lincoln, de Gaulle, Mandela, Aung San Suu Kyi - (...) illustrate the significance of moral capital for political legitimation, mobilizing support, and the creation of strategic opportunities. In the book's final section, Kane applies his arguments to the American presidency from Kennedy to Clinton. He argues that a moral crisis has afflicted the nation at its mythical heart and has been refracted through and enacted within its central institutions, eroding the moral capital of government and people and undermining the nation's morale.
