This volume aims to contextualize the development and reception of Husserl’s transcendental-phenomenological idealism by placing him in dialogue with his most important interlocutors – his mentors, peers, and students. Husserl’s “turn” to idealism and the ensuing reaction to Ideas I resulted in a schism between the early members of the phenomenological movement. The division between the realist and the transcendental phenomenologists is often portrayed as a sharp one, with the realists naively and dogmatically rejecting all of Husserl’s written work after (...) the Logical Investigations. However, this understanding of the trajectory of the phenomenological movement ignores the extensive and intricate contours of the idealism-realism debate. In addition to helping us better interpret Husserl’s attempts to defend his idealism, reconsidering the idealism-realism debate elucidates the relationship and differences between Husserl's phenomenology and the broader landscape of early 20th century German philosophy, particularly the Munich phenomenologists and the Neo-Kantians. The contributions to this volume reconsider many of the early interpretations and critiques of Husserl, inviting readers to assess the merits of the arguments put forward by his critics while also shedding new light on their so-called “misunderstandings” of his idealism. Clear and careful thinking is an indispensable aid in the pursuit of answers to the difficult ethical question faced by clinicians, patients, and families. In this issue of The Journal of Medicine and Philosophy devoted to issues in clinical ethics, the authors engage in this enterprise by reflecting on morally good medical decision making, conscientious objection, presumed consent in organ donation, the permissibility of surrogate decision making, and the failure of legislative limits on the scope of euthanasia in Belgium.

Can the view that medical science is more important than the individual properly persuade recruitment to trials? This paper considers the nature and interests of the person and their relationships to the concepts of science and society; and analyses a conception of value used to balance the interests of science and research subjects. The implications of arguments opposing the primacy of the individual are set out to indicate their implausibility; while the primacy principle is described to show its necessity in (...) any moral society. Finally, the importance of fully informed consent to participate is explained with the requirement that the individual human life provide the criteria of moral value for human life. (shrink)

This paper investigates what “free-range” eggs are available for sale in supermarkets in Australia, what “free-range” means on product labelling, and what alternative “free-range” offers to cage production. The paper concludes that most of the “free-range” eggs currently available in supermarkets do not address animal welfare, environmental sustainability, and public health concerns but, rather, seek to drive down consumer expectations of what these issues mean by balancing them against commercial interests. This suits both supermarkets and egg producers because it does (...) not challenge dominant industrial-scale egg production and the profits associated with it. A serious approach to free-range would confront these arrangements, and this means it may be impossible to truthfully label many of the “free-range” eggs currently available in the dominant supermarkets as free-range. In their paper ’Too much medicine: not enough trust?' Zoë Fritz and Richard Holton explore the connection between trust and overtreatment and overinvestigation. Whilst their paper is insightful, here I argue that much more could be made of a doctor’s (mis)trust and how this exacerbates overtreatment and overinvestigation. By taking Fritz and Holton’s view of trust as having ‘our best interests at heart’ as my starting point, I argue that doctor’s do not always trust that patients or the system has (...) their interests at heart and so use overtreatment and overinvestigation to protect themselves. I also point to the tensions created by a lack of trust on the doctor’s part as a focal point for much needed sustained ethical analysis. (shrink)

This paper focuses on the REC and its political context to clarify the process of ethical review. The examples initially considered are taken from a Research Ethics Review editorial to develop the social explanation of the membership and function of a research ethics committee. It is suggested that the management and administration of medical matters are not always best understood solely in medical terms. The conclusion of the paper is that the larger political relationships determine the membership and function of (...) the research ethics committee. The REC is defined as the political mechanism for formally socializing medical research and its lay members as similarly socializing the REC. (shrink)

This paper seeks to clarify the process of ethical review primarily through a consideration of the lay member's role; it considers some of the conventional accounts of the role and portrays weaknesses in them. Its positive account places the ethical review service in a wide political context allowing the definition of lay member as a politically-positioned individual in the REC with the function of formally representing the public standards of morality in the medical research context.

It is not clear whether breast cancer screening is a public health intervention or an individual clinical service. The question is important because the concepts best suited for ethical reasoning in public health might be different to the concepts commonly employed in biomedical ethics. We consider it likely that breast screening has elements of a public health intervention and used an empirical ethics approach to explore this further. If breast screening has public health characteristics, it is probable that policy and (...) practice experts will employ socially embedded concepts when reasoning about it. We gathered data on whether and how these concepts existed in the discussion and reasoning of Australian breast screening experts. We found that experts employed these concepts when talking about the purpose and practices of breast screening, and the behaviour of breast screening professionals and consumers. Experts gave varied judgements about breast screening based on reasoning with these concepts, considering it to be more or less successful in contributing to the public interest and in incorporating socially embedded concepts into its operational agenda. Our findings are compatible with breast screening having public health characteristics. We advocate for the incorporation of socially embedded concepts in breast screening policy and practice. Why were the Vestals virgins? An explanation drawing on anthropological studies of witchcraft and the work of Giovannini, Girard, and Douglas allows a partial solution to this and three other puzzles: 1) their unique legal status; 2) their murder at moments of political crisis; 3) the odd details of those murders. The untouched body of the Vestal Virgin is a metonymy for the untouched city of Rome. Her unique legal status frees her from all family ties so that she can (...) incarnate the collective. Thus, in times of crisis, she serves as a pharmakos/pharmakon. Equally, Roman society reveals a deep fear of witchcraft directed at its own matrons. Danger to the urbs is warded off by the punishment of women, both Vestals and wives, and the foundation of public cults of chastity with admonitory and apotropaic functions. A series of incidents over a thousand-year span reveals a world view deeply rooted in sympathetic magic, where the women embody the state and their inviolability is objectified as the inviolability of the community. This paper clarifies certain issues raised by Wendell Stephenson ( The Journal of Medicine and Philosophy 18: 375–388, 1993) about research programs and animal care practices at the Oregon Regional Primate Research Center. It also responds to Stephenson's critique of the National Institute of Health's Guide for the Care and Use of Laboratory Animals . It identifies utilitarianism as the ethical theory underlying Stephenson's critique. Arguing that such an ethical theory is unworkable in addressing concerns about biomedical research and the (...) use of animals, the paper defends the Guide's reliance on a wider tradition of ethical theories. ABSTRACTIn 1651, Alexander Ross published an attack on Thomas Browne's Pseudodoxia Epidemica, Bacon's Natural History and William Harvey's De generatione. Ross's work, Arcana Microcosmi, defended Aristotelian natural philosophy against the ‘new philosophy’ that figures like Bacon, Harvey and Browne represented. Though Ross's attacks on these authors make up no more than half of the treatise’s contents, the book’s paratextual materials emphasise scientific debate. While Ross's authorial approach advocates reading exclusively ancient authorities for the sake of glossing and transmitting their knowledge (...) to a wider public, in order to argue against the new philosophy Ross must engage with its textual production. Furthermore, his works advertise their focus on Bacon, Harvey and Browne, which would have attracted a readership drawn to new scientific approaches to knowledge formation. Ross's polemic represents an effort to model his devotion to ancient authority while also generating a reading public that would resist the new approach to reading that the new philosophy proposed. This article’s subject is the theory and practice of ‘regional survey’, the method of social and environmental study associated with Scottish thinker Patrick Geddes (1854–1932). Despite being overlooked or dismissed in most accounts of early 20th-century social science, regional survey had a wide influence on the development of the nascent disciplines of anthropology, sociology, and human geography. Emerging from late 19th-century field biology, the regional survey came to typify a methodological moment in the natural and social sciences that favoured the (...) holistic analysis of geographically delimited areas. By the interwar period, the kinds of projects that went under its name can clearly be seen as forerunners of the post-Second World War tradition of community studies. Additionally, in its self-presentation as a civic, participatory exercise, the regional survey can be read as a form of popular autoethnography that contrasts with other, more familiar social-scientific ventures in the first half of the 20th century, and defies the dichotomy between ‘gentlemanly’ and ‘technical’ modes of social science. As a result, this article argues, the regional survey provides an alternative point of departure for thinking about the origins and development of the modern social sciences in Britain. (shrink)

My fellow panelists and I are generally searching for what Robert C. Neville calls a "high road around modernism," a road that leads out of the modernist morass while avoiding the pitfalls of Euro-style postmodernism. We seek a way toward genuine community, and toward the kind of meaningful individualism that can exist in such communities. We stake quite a lot on the Roycean model of community as perhaps the most promising path on this "high road." In the next twenty minutes, (...) I propose to do three things.[1] The first is to outline C. S. Peirce's model of the working scientific community, which he proposed as an alternative to the Cartesian-modernist model of scientific investigation. The second is to identify the ways in which Josiah Royce developed and extended Peirce's original model to apply to other communities--particularly religious communities. Finally, I want to draw attention to some possible problems with such extensions of the basic Peircean model of scientific community. (shrink)

It is widely assumed that there exist certain objects which can in no way be distinguished from each other, unless by their location in space or other reference-system. Some of these are, in a broad sense, 'empirical objects', such as electrons. Their case would seem to be similar to that of certain mathematical 'objects', such as the minimum set of manifolds defining the dimensionality of an R -space. It is therefore at first sight surprising that there exists no branch of (...) mathematics, in which a third parity-relation, besides equality and inequality, is admitted; for this would seem to furnish an appropriate model for application to such instances as these. I hope, in this work, to show that such a mathematics in feasible, and could have useful applications if only in a limited field. The concept of what I here call 'indistinguishability' is not unknown in logic, albeit much neglected. It is mentioned, for example, by F. P. Ramsey [1] who criticizes Whitehead and Russell [2] for defining 'identity' in such a way as to make indistinguishables identical. But, so far as I can discover, no one has made any systematic attempt to open up the territory which lies behind these ideas. What we find, on doing so, is a body of mathematics, offering only a limited prospect of practical usefulness, but which on the theoretical side presents a strong challenge to conventional ideas. Discussions of quantum mechanics often loosely claim that time evolution logically must be unitary, in order for the probabilistic interpretation of the amplitudes of the state vector to make sense at all times. We discuss from first principles whether this claim is true: if we assume only that the time-evolution operator is linear, then does the stronger requirement that it be unitary follow from the other axioms of quantum mechanics? The answer is subtle. We discuss two mathematically distinct but physically (...) equivalent formulations of the axioms of quantum mechanics, and consider generalizing each to postulate only that time evolution is linear. Within one formulation, the unitarity of time evolution follows logically from the other axioms – but within the other formulation, it does not. Allowing the time-evolution operator to be (a priori) arbitrarily linear does not change the physical observables in one formulation of quantum mechanics, but changes the other formulation to a distinct (internally consistent) physical theory that allows new phenomenology like (e.g.) faster-than-light communication. Therefore, the unitarity of time evolution is arguably better thought of as a logically independent and experimentally falsifiable axiom of quantum mechanics, not as a tautological consequence of the other axioms. The Supreme Court ended its last term by making unconstitutional a choice Brown v. Board of Education once required - the voluntary, and race conscious, pursuit of integration - to little public outcry. As a society, we continue to find comfort in segregation. This Article argues that this acceptance is wrong, both educationally and constitutionally. It does so through the lens of teacher segregation, a topic all but ignored in the current literature. The first step of this argument is demonstrating, (...) by an original empirical study, the segregation of teachers, thereby proving a more profound school segregation than is generally recognized. The second step establishes, through an extensive review of the existing social science literature, that the typical minority student benefits from integration because it ensures a fundamental resource - experienced teachers. Lastly, the inherent inequality of segregation should have constitutional implications. While the Rehnquist Court utilized an interest balancing approach to the Equal Protection clause and recognized the constitutional harms of segregation, the Roberts Court has begun to minimize the Equal Protection to concern only capitalizing individual treatment and has erred in creating a "constitutional chill" toward the value of integration.
