El artículo explora las relaciones entre el derecho, la democracia y el imperativo del trato igual, deteniéndose en el desarrollo de nociones como “comunidad política”, “actos políticos” o “derechos”, y proponiendo un entendimiento específico de los “derechos democráticos” en cuyo contexto el derecho de igual acceso a la protección judicial juega un papel crucial. El análisis combina exploraciones en el plano del lenguaje jurídico dogmático con acometidas filosóficas, filológicas, históricas y sociopolíticas, en consonancia con la idea de que las fuentes (...) históricas son las coordenadas que rodean la experiencia jurídica y el juego democrático. This article establishes an analysis of the first contributions and the importance of the Critical and Positivist theories of accounting in Latin America over the years, through the study of scientific articles by recognized accounting experts from different countries on the theories.. Also, carry out a bibliographic examination of criticism and positivism applied to accounting, resulting in the correlation of concepts focused on accounting in Latin America. The type of research is descriptive with a qualitative approach with the purpose of (...) developing a discussion of the Critical and Positivist theories of accounting in Latin America. Obtaining a greater scope to understand that this social science is immersed in two currents that are based on the fact that knowledge is obtained through practice and can be verified through scientific methods, establishing the importance of understanding the contributions that the critical and positivist theory in the field of accounting science. The aim of this study is to assess the knowledge, attitudes and experiences of Spanish nurses in relation to euthanasia and physician-assisted suicide. In an online questionnaire completed by 390 nurses from Andalusia, 59.1% adequately identified a euthanasia situation and 64.1% a situation involving physician-assisted suicide. Around 69% were aware that both practices were illegal in Spain, while 21.4% had received requests for euthanasia and a further 7.8% for assisted suicide. A total of 22.6% believed that cases of euthanasia had (...) occurred in Spain and 11.4% believed the same for assisted suicide. There was greater support (70%) for legalisation of euthanasia than for assisted suicide (65%), combined with a greater predisposition towards carrying out euthanasia (54%), if it were to be legalised, than participating in assisted suicide (47.3%). Nurses in Andalusia should be offered more education about issues pertaining to the end of life, and extensive research into this area should be undertaken. (shrink)

Este artículo analiza los diálogos posibles entre el pensamiento de Giorgio Agamben y la novela _Frankenstein_ de Mary Shelley. Así, el filósofo italiano describe aspectos centrales que indagan los modos en que el biopoder captura la nuda vida. En efecto, a través del concepto de _máquina_ –la antropológica, el lenguaje y la gubernamental– se describen los dispositivos capaces de volver la potencia de vida a los cálculos del poder. Por otro lado, _Frankenstein_ construye una serie de escenas en la que (...) la voz de la Cosa interpela a su creador, Víctor Frankenstein, en una dimensión ética por su negligencia y falta de cuidado. La interpelación se dirige a un personaje pero, tomando los términos de Agamben, Víctor Frankenstein forma parte de una maquinaria mayor de la que él mismo termina siendo víctima. La ficción explicita además la falla de la maquinaria biopolítica por cuanto su protagonista se afirma en la vida procurando hallar sentidos posibles de existencia. (shrink)

Even in mathematical logic the proposition as an arbitrary technical device can be eliminated and replaced by the constative. The items of experience of the external world—objects, properties, relationships, and the like— are processed in consciousness on the basis of a situational demand that defines the situational context which in turn elicits a particular constatival attitude. The output of this mental processing is the appropriate pragmatic constatival response that generally is publicly communicated.

In the context of medical ethics, how can the concept of informed consent be effectively implemented in a traditional society such as Japan? If the need for more openness and transparency is not felt in the practice of medicine and welfare, the clients must remain under the spell of paternalistic data. Patients and health-care professionals other than doctors are taken to be "responsible for what they do but not to be accountable for their conduct" because they do not participate in (...) a decision-making process. I explore the possibility of the concept's full implementation against the particularists' and communitarian ethicists' effort to reject the universal nature of the concept. (shrink)

In treatises or advanced textbooks on theoretical physics, it is apparent that the way mathematics is used is very different from what is to be found in books of mathematics. There is, for example, no close connection between books on analysis, on the one hand, and any classical textbook in quantum mechanics, for example, Schiff, [11], or quite recent books, for example Ryder, [10], on quantum field theory. The differences run a good deal deeper than the fact that the books (...) on theoretical physics are not written in the definition-theorem-proof style characteristic of pure mathematics. Although a good many propositions are proved in the books on physics, there are almost with exception no existential proofs, and consequently there is no really serious systematic use of quantifiers. Another important characteristic is the free use of infinitesimals. In fact, most results would not lose anything, from a physicist's point of view, by leaving them in approximate form, i.e., instead of strict equalities or inequalities, using equalities or inequalities only up to an infinitesimal.The discrepancy between the way mathematics is ordinarily done in theoretical physics and the way it is built up from a foundational standpoint in any of the standard modern views raises the question of whether it might be possible to construct quite directly a rigorous foundation that reflects a significant part of this standard practice in theoretical physics. Other parts of standard practice in physics, for example, the use of physically intuitive but nonrigorous arguments, are not present in our system. (shrink)

In tracing historically the development of Filipino philosophy as traditionally conceived, the author discovered that the early Filipino philosophers were Enlightenment thinkers. This was the direct consequence of the Filipino colonial experience and the explanation why the trajectory of Filipino philosophy is basically Western in orientation.

This article addresses the critique of the modern conception of history and time through a reading of Hannah Arendt. Arendt’s work provides an alternative to the thought with universal pretensions that has dominated the panorama of modernity. She thinks the historical through contradiction and gives a place to human experience next to facts. In thinking the event Arendt shows the insufficiency of the modern chronological appropriation of the past and the limits of using theory as a given framework of interpretation. (...) Understanding the historical event is to challenge the chronology assumed in our forms of understanding and representing the real. Her work blurs the tacit boundary that lurks in modern forms of representation between a ‘dynamic’ present and a ‘congealed’ past. Arendt’s thinking provides a critique of the modern notions of time and history as of the use of theory as a fixed framework of interpretation. (shrink)

Philosophy is here viewed broadly as a label or name that transcends the quarrels of diverse philosophical schools which attempt to exclude one another from this label. It is argued that philosophy emerges from one’s culture as it does not exist in a vacuum; it emerges from the people’s experiences of joy and pain, doubt and certainty, and so on. It is manifested in a person’s reflections of the time, locally or globally, or in the people’s language, songs, myths, riddles, (...) and the like. Though embedded in one’s culture, it can be disembedded from that culture by an ethnophilosopher or by a historian/scholar of philosophy. Once disembedded, philosophy may turn around and try to critique that culture in order to refine it. (shrink)

This volume studies a fundamental element of Montesquieu’s argumentative architecture that is most apparent in his De l’Esprit des Lois: the problem of giving order to, and establishing a network of consistent explanations of political, social and cultural diversity. Following a thorough and careful analysis of his writings, the volume approaches this subject by observing the use of the information sources available to Montesquieu, the relationships between them, and the judgments he expresses. The book examines some of Montesquieu’s essential theoretical (...) contributions, such as the idea of despotism, and the connection between politics, society and religion, on the basis of his reflections on the variety of mainly non-European societies and cultures. It demonstrates a number of possible inconsistencies and unresolved questions in Montesquieu’s argumentation. One of the main subjects of the book is the consideration of geographical context as an essential element for elaborating uniform criteria of political analysis. The book collects contributions concerning Montesquieu’s reflections on China, Tartary, Japan, India, America, Russia, and the Islamic world, and, building on this earlier research, it shows the importance of Montesquieu’s thought and explains the reason for his longstanding influence. John Dewey’s stay in Tokyo in early 1919 coincided with the height of the social movement calling for parliamentary democracy in Japan. His lectures at Tokyo Imperial University offered a new way of viewing the world and human actions that emphasizes the importance of communication and the growth of democratic personality. Those who expected to hear from him something else were disillusioned. But the disillusionment was mutual. Dewey was disillusioned by the Japanese intellectuals whose affection for European philosophy led them (...) to an uncritical acceptance of the emperor system and Japan’s imperialism abroad. His criticism toward the Japanese intellectuals grew severe as he saw the Japanese aggression while he was on the continent. Dewey’s lecture on democracy left some impact on a few of intellectuals who modified their view of person’s actions that was eventually to be crashed when Japan fell into the all-out war-making. A propósito de esta disciplina filosófica, su justificación y su vigencia, se presentan algunas críticas hechas a esta tradición de pensamiento desde la filosofía posmoderna y contemporánea, las cuales han puesto de presente entre nosotros algunos pensadores colombianos.
