It is often supposed that in order to refute the view that laws of nature are necessary truths it is sufficient to appeal to Hume's argument from the conceivability of to the possibility of their being false. But while Hume's argument does present the necessitarian with insuperable difficulties it needs to be made clear just what these are. The mere appeal to Hume is quite insufficient for what he says can be interpreted in more than one way. And if it (...) constitutes an argument rather than a mere assertion Kneale has given reason to suppose that it is at least not obviously valid. The upshot of this article is that Hume's argument may be seen as a direct challenge to the notion that there could be propositions whose modal value is necessarily "opaque to the human intellect". Gottfried Wilhelm Leibniz (1646-1716) was one of the seventeenth century's most important thinkers. A philosopher, mathematician and scientist, his work is comparable in scope and importance only to that of Newton and Descartes. His work dominated German philosophy until Kant, and was revived in the early part of this century when his important work on logic was re-discovered. This four volume set contains 97 of the most important essays ever written about Leibniz's work. The aim of this article is to demonstrate the respects in which private schools are unfair, and why they pose a threat to the well-being of not only those who are excluded on financial grounds, but to democratic equality and social cohesion in general. The shortcomings associated with relying on a form of educational provision that is merely ‘adequate’ are rendered explicit, and the article concludes with a consideration of a variety of measures that might go some way towards nullifying (...) the harmful effects of private schools, the objections to which are sufficiently strong as to warrant a prima facie case for the abolition of such schools. Among theories which fit all of our data, we prefer the simpler over the more complex. Why? Surely not merely for practical convenience or aesthetic pleasure. But how could we be justified in this preference without knowing in advance that the world is more likely to be simple than complex? And isn’t this a rather extravagant a priori assumption to make? I want to suggest some steps we can take toward reducing this embarrassment, by showing that the assumption which supports (...) favouring simplicity is far more modest than it first seems. (shrink)

Efforts to bring science into early 19th century breeding practices in Central Europe, organised from Brno, the Hapsburg city in which Mendel would later turn breeding experiments into a body of timeless theory, are here considered as a significant prelude to the great discovery. During those years prior to Mendel's arrival in Brno, enlightened breeders were seeking ways to regulate the process of heredity, which they viewed as a force to be controlled. Many were specialising in sheep breeding for the (...) benefit of the local wool industry while others were showing an interest in commercial plants, especially fruit trees and vines, and later cereals. Breeders explained their problems in regulating heredity in terms of climatic influences disruption due to crossing sports or saltations. Practical experience led them to the concepts of 'inheritance capacity' and the 'mutual elective affinity' of parents. The former was seen to differ among individuals and also among traits; the latter was proposed as a means of adding strength to heredity. The breeders came to recognise that traits might be hidden and yet transmitted as a 'potential' to future generations. They also grew to understand that heredity would be strengthened when a quality was 'fixed' within a lineage by 'pure blood relations.' Continued selection of the desired quality might then lead to 'a higher perfection.' But the ultimate 'physiological' question about breeding, 'what is inherited and how?,' found no answer. Major figures in this development included Abbot Napp, the one who asked this question and who was due to receive Mendel into the monastery in 1843, and Professor Diebl whose lectures on agriculture and natural science at the Brno Philosophical Institute Mendel would attend in 1846. Here we analyse their progress in theorizing about breeding up until about 1840. In discussing this development, we refer to certain international contacts, especially with respect to information transfer and scientific education, within the wider context of the late Enlightenment. Cognitive and rational assessments of competence do not fully capture the way in which individuals normally make decisions. Human beings have always used stories to explain their experiences and values. Narrative ethics should be used to understand the perspective in context of a patient whose competence is in question, and so avoid a destructive clash. Psychiatry and professionals within it also have a narrative that may join with that of science, but there is no special privilege for these narratives unless (...) survival is at stake. The narrative approach should be used to try to make different stories compatible. This article examines the background to this approach, and indicates some ways in which it could be used in the specific cases addressed in the series. (shrink)

The obligation to inform and obtain the consent of human subjects is axiomatic in social and medical research. Yet educational researchers are often reluctant to inform their subjects: class teachers and headteachers, for example, are often used as gatekeepers, and investigators sometimes do not so much seek consent as assume it. This chapter discusses the principle of informed consent, in particular that of children. It proposes guidelines for gatekeepers who may be called upon to authorise research and to grant to (...) investigators access to children in their care. (shrink)

Ethical codes have been widely put in place by professional associations, universities and other organizations. They observe common standards and procedures which are applied and adapted to local or specialist needs. The early codes such as that of Nuremberg exclusively addressed the rights of participants. This article detects a shift in emphasis. The argument relies on a distinction between morality and ethics and it is contended that ethical codes legitimize kinds of practice that are morally unprincipled. In modern formulations of (...) research ethics there is a tendency to abdicate responsibility for the protection of rights and interests and to pass it from researchers to participants or subjects. The concern is rather more for the security of investigators than for that of participants. It is recognized that codes are here to stay but suggestions are made to recover the spirit of Nuremberg. Among other interesting proposals, Juan Comesaña’s _Being Rational and Being Right_ makes a challenging case that one’s evidence can include falsehoods. I explore some ways in which we might have to rethink the roles that evidence can play in inquiry if we accept this claim. It turns out that Comesaña’s position lends itself to the conclusion that while false evidence is possible and not even terribly uncommon, I can be rationally sure that I don’t currently have any and perhaps also (...) that I won’t get any, and (absent certain evidence to the contrary) you are not afflicted with any either. This conclusion might seem too good to be true. I finish by raising a puzzle about one of the main motivations for Comesaña’s view. (shrink)

Health professionals do not always have the luxury of making “right” choices. This article introduces the “devil's choice” as a metaphor to describe medical choices that arise in circumstances where all the available options are both unwanted and perverse. Using the devil's choice, the paper criticizes the principle of double effect and provides a re-interpretation of the conventional legal and ethical account of symptom relief in palliative care.

Neither secular moral theory nor religious ethics have had much place for persons in need of constant physical help and cognitive support, nor for those who provide care for them. Writing as the father of a fourteen-year-old daughter with multiple disabilities, I will explore some of moral issues that arise here, both from the point of view of the disabled child and from that of the child's caretaker(s).

In chapter two, perfectionism is rejected and an alternative ideal utilitarian Objective List theory is set out. In chapter three, it is argued that prudential rationality requires maximization and temporal neutrality. The aggregation and incommensurability of values is discussed. In (...) chapter four, it is argued that value alone gives rise to grounding reasons for action; the only values are prudential values; we are required to be personally as well as temporally neutral; moral rationality is maximizing. A problem arising when a certain form of incommensurability is combined with the notion of maximizing expected utility is examined. In chapter five, an intrapersonally indirect form of moral theory is defended. ;In the second, practical part of the thesis, the theory developed in the first part is applied to two moral problems: vegetarianism and future generations. In chapter six, the conclusion is that utilitarianism requires us to eat non-intensively-reared meat and to abstain from intensively reared meat. In chapter seven, population problems arising from Derek Parfit's work are considered in the light of the theory. (shrink)

We study game-theoretic models of human evolution to analyze fundamentals of human nature. Rival-claimants games represent common situations in which animals can avoid conflict over valuable resources by mutually recognizing asymmetric claiming rights. Unlike social-dilemma games, rival-claimants games have multiple equilibria which create a rational role for communication, and so they may be good models for the role of language in human evolution. Many social animals avoid conflict by dominance rankings, but intelligence and language allow mutual recognition of more complex (...) norms for determining political rank or economic ownership. Sophisticated forms of economic ownership could become more advantageous when bipedalism allowed adaptation of hands for manufacturing useful objects. Cultural norms for claiming rights could develop and persist across generations in communities where the young have an innate interest in learning from their elders about when one can appropriately claim desirable objects. Then competition across communities would favor cultures where claiming rights are earned by prosocial behavior, such as contributions to public goods. With the development of larger societies in which many local communities share a common culture, individuals would prefer to interact with strangers who identifiably share this culture, because shared cultural principles reduce risks of conflict in rival-claimants games.
