Gesellschaftskritik, or social philosophy that aims to provide firm criticism of pathological social practices, requires normatively grounded evaluative principles. In this article, we assess different possibilities for such principles with focus on a model that takes specific patterns of intersubjective interaction as its point of reference. We argue that in order to understand the full significance of this ‘intersubjective turn’ for social philosophy, and to strengthen the normative foundation of social philosophy, we need to distinguish several levels of intersubjectivity and, (...) in particular, focus on the somewhat neglected level of primary intersubjectivity. The article will discuss the account of primary intersubjectivity in Honneth’s work. We show that Honneth’s account runs into difficulties, and drawing on recent findings in developmental psychology, we suggest a rethinking of elementary recognition in terms of ‘affective proximity’. This both renders the account less susceptible to criticism and provides a normative perspective that can effortlessly enter into interdisciplinary collaboration. (shrink)

I review a variety of theories that attempt to explain how young infants are able to pass spontaneous false belief tests, and then ask whether any of these approaches can explain the 3-year-olds' failure on standard, elicited FB tests. I argue that some of these approaches fail to provide adequate explanations, and I defend an embodied enactive approach that I think does a better job. The primary reason 3-year-olds fail at the elicited FB tests is not due to language problems, (...) the complexity of the situation, or the number of perspectives involved, but because the saliency of the second-person interaction with the experimenter takes precedence over the third-person task. At the 2022 Clinical Ethics Unconference, the authors perceived a significant lack of racial and ethnic diversity, which was consistent with their experiences in other clinical ethics settings. As a result, they convened a working group to address the pervasive lack of diversity present in the field of clinical ethics and to propose strategies to increase the representation of people from racial and ethnic minority populations. This article identifies the harms associated with the lack of diversity in the healthcare setting (...) and translates these to the field of clinical ethics. The article then proposes a framework that may be used to help diversify the field of clinical ethics. Specifically, the authors identify existing barriers to appropriate diversity, actionable steps to increase diversity, and tools the field can utilize to systematically assess its progress with respect to achieving diversity. In this chapter I focus on the relationship between embodied intersubjective interactions and the kind of spaces that shape and are shaped by such interactions. After clarifying some of the theoretical background involved in questions about social cognition, I review several empirical studies that suggest that social interactions and social relations can change our perceptions of the reachable space around us, as well as the more distant space beyond our immediate reach. These perceptions operate within the framework of material culture (...) and impact our experience of space as it is organized by cultural artifacts and practices. In this respect, the analysis provided by Material Engagement Theory helps us understand the role of material arrangements as they define affordances for action and interaction, correlated to transformations from individual body-schematic processes to intercorporeal processes in joint action. These same processes can be carried over into discussions of space and place as experienced on the larger stages of social-cultural activities. (shrink)

In this analysis of the ethical dimensions of doctors’ participation in macroallocation we set out to understand the skills they use, how they are acquired, and how they influence performance of the role. Using the principles of grounded moral analysis, we conducted a semi-structured interview study with Australian doctors engaged in macroallocation. We found that they performed expertise as argument, bringing together phronetic and rhetorical skills founded on communication, strategic thinking, finance, and health data. They had made significant, purposeful efforts (...) to gain skills for the role. Our findings challenge common assumptions about doctors’ preferences in argumentation, and reveal an unexpected commitment to practical reason. Using the ethics of Paul Ricoeur in our analysis enabled us to identify the moral meaning of doctors’ skills and learning. We concluded that Ricoeur’s ethics offers an empirically grounded matrix for ethical analysis of the doctor’s role in macroallocation that may help to establish norms for procedure. (shrink)

I argue that Axel Honneth, reappropriated Colwyn Trevarthen's distinction between primary and secondary intersubjectivity,into his critical social theory. How the concept of primary intersubjectivity gets re-incorporated, or indeed, re-cognized in Honneth’s conception of recognition, however, is a complex issue that Iexplore in this essay. It is linked to questions not only about child development, but also about whether one should understand recognition in terms of a summons, following Fichte, or in terms of a struggle, as Honneth, following Hegel, suggests, or (...) in terms of a gift, as Ricoeur, following Hénaff suggests. Caribbeanists working on the Francophone Caribbean within the Anglophone academy are perhaps particularly well placed to bring into focus the linguistic and cultural losses of the dislocations and relocations of High Capitalism. Although our object of study should facilitate critical insights into the fundamental linguistic and cultural indifference and irresponsibility of capitalist extraction models and into what is at stake politically and ethically in contemporary versions of those profiteering models, the commercialist reductionism currently formatting not just our own pulverized academic (...) universe, but the entire globe over which it has by now comprehensively spread, surely works against any such truly critical positioning. : The articles in this special issue cover a lot of ground, from very specific scientific questions about the nature of movement and development, to very large questions about ontological framing. My comments here are meant to highlight some important issues found in these articles and to offer some clarifications.

In response to Robert Young's critical comments concerning Hermeneutics and Education I clarify two issues. First, I suggest that a more detailed account of interpretation and learning could be developed in a hermeneutically informed cognitive psychology. This would be an account that escapes the textual model of silent reading construed as private mental experience, and that acknowledges the social and communicative dimensions of understanding. Second, in contrast to Young's view, I contend that phronesis is not reducible to a set of (...) inner thought processes and that it has a role to play even in a critical social theory of education. There is a disproportionate number of complaints about social workers in England to the Health and Care Professionals Council (HCPC) as compared with the other health care professionals regulated by HCPC. This paper discusses findings from interviews and focus groups that formed part of a mixed methods study that aimed to find out the reasons for complaints and the strategies that may reduce complaints. Four themes were identified: social work as an evolving profession; social work involves challenging practice; social work (...) takes place in a pressurised environment; and public perceptions and expectations of social work are often negative and unrealistic. Findings highlight explanations that focus on organisational culture and public responses to social workers’ control functions. We argue that, at a time of change for the profession, there is a need for public education regarding the role and function of social workers and for regulators to have more proactive engagement with registrants and employers. There has been little previous research regarding the effectiveness of ethics education interventions for residential care‐givers. The Researching Interventions to Promote Ethics in social care project responded to the question: Which is the most effective ethics education intervention for care‐givers in residential social care? A pragmatic cluster trial explored the impact of three ethics education interventions for: (a) interactive face‐to‐face ethics teaching; (b) reflective ethics discussion groups; and (c) an immersive simulation experience. There was also a control arm (d). 144 (...) trial participants were recruited from 39 residential care homes for older people in southern England. Change scores compared across intervention arms showed a significant reduction in work‐related moral stress in the teaching arm compared with control group (p =.03); there were no significant differences between control and intervention arms in change scores for moral sensitivity, interpersonal reactivity (empathy) or ethical leadership. Qualitative data themes were as follows: ethical care; care challenges; and ethical care inhibitors. Overall findings stimulate reflection on the value of three different ethics education interventions and the most appropriate means to evaluate their impact. Findings suggest the complexity and diverse nature of ethical competence in care. We suggest a way forward for research evaluating ethics education. (shrink)

The following analysis demonstrates that G.H. Mead's understanding of human speech is remarkably consistent with today's interdisciplinary field that studies speech as a natural behavior with an evolutionary history. Mead seems to have captured major empirical and theoretical insights more than half a century before the contemporary field began to take shape. In that field the framework known as “Tinbergen's Four Questions,” developed in ecology to study naturally occurring behavior in nonhuman animals, has been an effective organizing framework for research (...) on human speech. It is used in this paper to organize the comparison of Mead with contemporary scholars. The analysis concludes that Mead was, in a sense, “beyond” the Four Questions by recognizing the limitations of reductionist methods in understanding the nature of conscious phenomena, especially language. Mead's socially situated model of the nature of human speech makes him relevant to today's field where some see an undervaluation of the treatment of language as a social process. (shrink)

This article is part of a Symposium that examines the legal and policy issues raised by the Schwarzenegger bobblehead doll litigation, in which a Hollywood star-turned-governor sued under California's right of publicity laws and under federal copyright law to stop a small Ohio company from selling a bobblehead doll depicting Schwarzenegger in a business suit, with a bandolier of bullets, and brandishing an assault rifle. The article contends that defendants' unauthorized use of the Schwarzenegger image on dolls and their accompanying (...) packaging was permissible as First Amendment-protected free speech under California's right of publicity laws and also constituted fair use under federal copyright law. The article rejects the argument that a First Amendment defense to plaintiff's right of publicity claims was unavailable because a bobblehead doll is not a "traditional" medium of expression for ideas. The article recognizes that overly expansive assertions of rights of publicity and other intellectual property rights threaten to stifle creative expression and diminish the cultural commons. The article also calls for clearer and more consistent recognition of defenses to right of publicity claims, particularly for cases where a defendant's unauthorized appropriation of another's image or likeness is for purposes of caricature, parody, or satire¿especially where the image is that of a politician. It concludes that the settlement of the Schwarzenegger bobblehead doll case illustrates how "strategic" assertions of even objectively non-meritorious rights of publicity can allow powerful plaintiffs to censor unflattering depictions of them and to unduly expand intellectual property rights without full adjudication on the merits of such claims.This insight is critical, because while other scholars have suggested that the "over-protection" of intellectual property rights (including rights of publicity) has a deleterious effect on freedom of expression and the public domain, these criticisms focus almost exclusively on published appellate cases. Yet, as this article reminds us, most cases settle and never become litigated cases, much less published appellate decisions. And most disputes - including intellectual property disputes - never result in formal litigation in the first instance. As with most other areas of the civil disputing process, intellectual property disputes are processed in the "shadow of the law", where repeat players have strategic advantages to shape the outcomes of disputes in their favor. Thus, if we want to know whether intellectual property rights are over-protected, we need to know what happens (and why) in the shadow of intellectual property law. This insight is the basis for the author's empirical research-in-progress focusing on "strategic intellectual property enforcement" by owners of trademarks, copyrights, and patents, including enforcement that never results in litigation and is thus under the radar of what most legal scholars in this area of law examine. This study seeks to understand how underlying professional values may affect sustainable redevelopment outcomes. It considers the process by which a variety of professionals: engineers, scientists, designers, planners, architects and financial analysts, develop a professional norm of sustainability as they sustainably redevelop contaminated brownfield sites. Employees and associates of a private equity firm managing a portfolio of brownfield sites across North America and Western Europe were interviewed and resultant data were analyzed using grounded theory methodology. I focus on the sense of ownership and ask whether this experience is some­thing over and above one’s bodily experiences, or something intrinsic to them. I consider liberal, deflationary, and phenomenological accounts of the sense of ownership, and I offer an enactive or action-oriented account that takes the sense of ownership to be intrinsic to the phenomenal background and our various bodily senses, including the sense of agency.
