On the contrary it is meant as an ontological category, in order to say our belonging to a common nature. From this point of view he proposes a sensible way to understanding the others, based on a bodily closeness and sharing.But, with references to the current debate, the text suggests that in the reflections of the French phenomenologist it is possible to find a not subjectively centered paradigm for understandig empathy – that is a paradigm which does not always presuppose a subjective projection of my sensibility on that of the other ones. It can rather both consist in a common, prepersonal feeling, costituting the background of our conscious sensitivities, and proceed from the other human being to me, so that I often feel and understand myself by differing from the other individuals, who impose themselves on my senses and on my words. Within the traditional conception of communication, the subjects involved in the communicative process are divided into emitter and receiver of the message, analogous to the mechanism of transmission and regulation between machines, which is called cybernetics, to which the communicative process between living beings is assimilated (Habermas & McCarthy, 1984; Shannon & Weaver, 1998; Wiener, 2019). According to this theory, the person capable of communicating can only be equated to a target, to be considered in the unidirectional transmission of information. (...) Consequently, “good communication” is considered exclusively from an economic and utilitarian point of view, so that “good” communication is that which effectively transmits a message and obtains the maximum result with the minimum of effort. Recent discussions in the philosophy of biology have brought into question some fundamental assumptions regarding evolutionary processes, natural selection in particular. Some authors argue that natural selection is nothing but a population-level, statistical consequence of lower-level events (Matthen and Ariew [2002]; Walsh et al. [2002]). On this view, natural selection itself does not involve forces. Other authors reject this purely statistical, population-level account for an individual-level, causal account of natural selection (Bouchard and Rosenberg [2004]). I argue that each of these (...) positions is right in one way, but wrong in another; natural selection indeed takes place at the level of populations, but it is a causal process nonetheless. In Law one of the main contexts for the idea of Acts is in Speech Acts which have become a major aspect of the philosophy of Language in the twentieth century; to Peirce, as the «father» of modern Semiotics, all thought is action, and thought has meaning to the extent that it has consequences in the world. Agency in law is inseparable (...) from the idea of a Legal Actor, and refers to powers which are conferred by a Principal upon a representator to a Third Party. Legal Agents are mediators in law as signs are mediators of interpreted meaning in semiotic theory and semiotic processes. Cet essai reconstruit les principales étapes de la confrontation de Ricœur avec la dialectique de Hegel, depuis ses premières notes manuscrites sur « Hegel et la négativité » jusqu’à l’essai de 1975, « Le lieu de la dialectique ». L’objectif que l’on vise est triple. Il s’agit tout d’abord de reconstruire dans sa genèse l’effort ricœurien de « régionalisation » de la dialectique hégélienne, dont les raisons ne peuvent pas être réduites à un refus générique des effets de totalisation systématique (...) de l’identification hégélienne entre négation et médiation. Le deuxième objectif est la mise en relève des raisons exogènes et endogènes qui sous-tendent l’élargissement et le déplacement que le lieu de la dialectique hégélienne subit, suite à la greffe ricœurienne de l’herméneutique sur la phénoménologie. Enfin, on vise à déterminer la place variable que la dialectique hégélienne occupe par rapport aux autres « dialectiques » qui nourrissent le style dialectique de la philosophie de Ricœur, de la « dialectique » du paradoxe de Kierkegaard et de la dialectique des cinq genres du Sophiste – telles qu’il les interprète – à la dialectique nabertienne entre acte et signes. This paper focuses on value, which I shall provisionally define as the experiential aspect of normativity. That there is an experiential aspect of normativity is a main claim of classical phenomenology. This paper aims to provide some evidence for this claim. I shall first discuss the current state of knowledge concerning normative properties and the dilemma of normative supervenience. We shall then devote ourselves to an exercise in visual and emotional exploration, accompanied by a phenomenological analysis of value, which will (...) allow us to spell out what appears to be wrong with all the competing proposed non-phenomenological solutions to the dilemma. I shall finally outline a phenomenological way out of the dilemma, thereby indicating the path to a full-fledged phenomenological axiology. (shrink)

Even if Peirce were well understood and there existed· general agreement among Peirce scholars on what he meant by his semiotics, or philosophy of signs, the undertaking of this book-wliich intends to establish a theoretical foundation for a new approach to understanding the interrelations of law, economics, and politics against referent systems of value-would be a risky venture. But since such general agreement on Peirce's work is lacking, one's sense of adventure in ideas requires further qualification. Indeed, the proverbial nerve (...) for failure must in any case be attendant. If one succeeds, one has introduced for further inquiry the strong possibility that should our social systems of law, economics, and politics---our means of interpersonal transaction as a whole-be understood against the theoretical back ground of a dynamic, "motion-picture" universe that is continually becoming, that is infinitely developing and changing in response to genuinely novel elements that emerge as existents, then the basic concepts of rights, resources, and reality take on new dimensions of meaning in correspondence with n-dimensional, infinite value judgments or truth-like beliefs which one holds. If such a view, as Peirce maintained, were possible and tenable not only for philosophy but as the basis for action and interaction in the world of human experience and practical affairs, one would readily say that risk taking is a small price for the realization of such possibility. Biologists studying ecology and evolution use the term “population” in many different ways. Yet little philosophical analysis of the concept has been done, either by biologists or philosophers, in contrast to the voluminous literature on the concept of “species.” This is in spite of the fact that “population” is arguably a far more central concept in ecological and evolutionary studies than “species” is. The fact that such a central concept has been employed in so many different ways is potentially problematic (...) for the reason that inconsistent usages (especially when the usage has not been made explicit) might lead to false controversies in which disputants are simply talking past one another. However, the inconsistent usages are not the only, or even the most important reason to examine the concept. If any set of organisms is legitimately called a “population,” selection and drift processes become purely arbitrary, too. Moreover, key ecological variables, such as abundance and distribution, depend on a nonarbitrary way of identifying populations. I sketch the beginnings of a population concept, drawing inspiration from the Ghiselin-Hull individuality thesis, and show why some alternative approaches are nonstarters. (shrink)

Genetic drift (variously called “random drift”, “random genetic drift”, or sometimes just “drift”) has been a source of ongoing controversy within the philosophy of biology and evolutionary biology communities, to the extent that even the question of what drift is has become controversial. There seems to be agreement that drift is a chance (or probabilistic or statistical) element within population genetics and within evolutionary biology more generally, and that the term “random” isn’t invoking indeterminism or any technical mathematical meaning, but (...) that’s about where agreement ends. Yet genetic drift models are a staple topic in population genetics textbooks and research, with genetic drift described as one of the main factors of evolution alongside selection, mutation, and migration. Some claim that genetic drift has played a major role in evolution (particularly molecular evolution), while others claim it to be minor. This article examines these and other controversies. -/- In order to break through the logjam of competing definitions of drift, this entry begins with a brief history of the concept, before examining various philosophical claims about the proper characterization of drift and whether it can be distinguished from natural selection; the relation of drift to debates over statisticalism; whether drift can be detected empirically and if so, how; and the proper understanding of drift as a model and as a (purported) law. The latter half of the twentieth century has been marked by debates in evolutionary biology over the relative significance of natural selection and random drift: the so-called “neutralist/selectionist” debates. Yet John Beatty has argued that it is difficult, if not impossible, to distinguish the concept of random drift from the concept of natural selection, a claim that has been accepted by many philosophers of biology. If this claim is correct, then the neutralist/selectionist debates seem at best futile, and at worst, (...) meaningless. I reexamine the issues that Beatty raises, and argue that random drift and natural selection, conceived as processes, can be distinguished from one another. (shrink)

At the time of the fragile Weimar Republic, when the crisis of parliamentary democracy was accompanied by a “frightening massification of life” and of public opinion, Scheler posed a challenge: How to achieve a cultural and spiritual transformation that can contribute to a true rebirth of Germany and Europe? If this renaissance is to be achieved, Germany and Europe must be examined as a whole, and the ideas underlying their institutions must be renewed. Cosmopolitanism and the age of integration – (...) for example the integration of rationalism, which has traditionally characterized Europe, and irrationalism, of which the “revolt of pulsions” is, according to Scheler, an eloquent testimony – impose this renewal. Against this backdrop, this paper examines the possible “costs and benefits” of a Freudian-inspired sublimation from a Schelerian perspective, with particular attention to the problem of Bildung. Recent research has shown that, although still on a limited scale, the teaching of business ethics in UK higher education has been increasing in recent years. This paper reports on a postal questionnaire survey conducted to investigate the extent to which ethical issues are covered in the teaching of management accounting in higher education. The principal findings are that the majority of management accounting lecturers in the British Isles do not incorporate ethics. About a third of the respondents to the (...) survey do address ethical issues, although about half of those say they do so only implicitly. Various factors underlying the findings and prospects for the future are discussed. (shrink)

This paper aims to illustrate one of the primary goals of the philosophy of biology⎯namely, the examination of central concepts in biological theory and practice⎯through an analysis of the concepts of population and metapopulation in evolutionary biology and ecology. I will first provide a brief background for my analysis, followed by a characterization of my proposed concepts: the causal interactionist concepts of population and metapopulation. I will then illustrate how the concepts apply to six cases that differ in their population (...) structure; this analysis will also serve to flesh out and defend the concepts a bit more. To explain the menstrual cycle and menopause, human biologists during the past several decades have developed new models of the evolutionary origins and maintenance of female reproductive patterns that address both ultimate and proximate causation. Hypotheses proposed for these processes generally offer explanations for menstruation or for menopause, but not for both; ultimately, these explanations must be integrated. Reviewing current explanations, this paper offers an energetics-based evolutionary rationale compatible with past adaptations of Homo sapiens and with ecological patterns in small-scale, (...) preindustrial social systems in which food resources vary and sometimes are scarce. El artículo analiza cómo la revista Medicina e Morale ha afrontado en su historia el tema de la ética en la experimentación clínica, que representa una parte muy amplia y compleja de la bioética y también de la deontología médica. Los aspectos que esta temática comprende son ya numerosos y la literatura producida ingentísima. La ética de la experimentación ha recibido particular impulso y atención a continuación de diversas experimentaciones no éticas que han turbado profundamente la opinión pública y hecho (...) necesario una fuerte reconsideración en el ámbito de la investigación clínica. En general, de los años 60's a los años 80's del siglo XX, ha prevalecido en la literatura un intenso empeño e interés en la elaboración de los principios de referencia y en la reflexión teórica relativa a varias cuestiones . De los años 90 en adelante se ha en cambio intensificado -probablemente por las exigencias nacidas en seno de los Comités de ética que precisamente en aquel período han iniciado a difundirse masivamentela elaboración de códigos, reglamentos, líneas-guía que han orientado el desarrollo de la disciplina más en sentido de procedimiento y con un acercamiento ético-deontológico. En particular, Medicina e Morale, ha estado siempre en estas temáticas, desde los inicios de su historia, constituyendo una voz original en el debate, además que un instrumento de difusión de documentos nacionales y sobre todo internacionales. La Revista ha representado, sobre todo en los últimos treinta años, un verdadero punto de referencia a nivel nacional y en algunos casos también internacional, proponiendo a veces orientaciones originales, que han sido luego acogidas en el ámbito de líneas-guía y de normativas.The article deals with how the journal Medicina e Morale has faced ethics in clinical trials, which represents a very large and complex bioethical issue, but also deontological one. This area comprises many questions and the literature is huge. It has risen after unethical clinical trials that have shocked the public and have produced a big rethinking about it. In general, from the '60s to the '80s of the XXth century, an intense commitment and interest have prevailed on the elaboration of the reference principies and on theoretical reflection on various issues, such as informed consent, the ethical significance of clinical research, the protection of vulnerable people, the risk acceptability). Since the '90s onwards the development of codes, regulations, guidelines -that have guided the development of the discipline in a procedural and also deontological sense- has increased, probably due to the large diffusion of ethics committees. Particularly, the journal "Medicina e Morale" has always been present on these issues, since the beginning of its history, creating an original voice in the debate, as well as a dissemination tool of national and especially international documentabon. The journal has been, especially in the last thirty years, a real national, and sometimes international, be nchmark, offering original suggestions which are then accepted in guidelines and regulations. Stubley (1960–2017)Roberta LambIt is dusk in the desert—that bewitching hour when the intensity of today’s unrelenting heat suddenly lifts with the hint of a breeze and a promise of darkness. Worn and weary with dust trailing my every movement, I am inexorably drawn forward by the distant sounds of drums and community. I am curious to see what lies ahead, but for one brief (...) minute I look back from where I have come. A single window penetrates the gloom. It opens on a small room, cluttered with mementos celebrating a long history of great artistry. I feel the weight of this history, even at this distance; but what captures my attention is the music making in the only uncluttered corner of the room where four musicians are poring over a recently discovered score of a late Beethoven string quartet. While the music making appears to be motivated and bound by the score, it is as if the musicians are searching for something that lies beyond the score. At times, the searching seems to question the shape or presence of a particular note or melodic motive; other times, it appears to be a quest for “the work,” the string quartet written by Beethoven. As I continue to eavesdrop, I am struck by the way in which the searching in both instances ultimately seems to evolve into a question of ensemble. It is as if the musicians are not only trying to discover the music implied by [End Page 203]the score notations, but also trying to find themselves, trying to get a sense of who they are in relationship to this music. It is a phenomenon that I have encountered frequently in my travels, and I wonder, as the sounds in the distance reenter my consciousness, why of all possibilities the window of my mind opened on this particular room.1Thus, Eleanor V. Stubley began a moving evocation of body, sound, and shifting identities in philosophical argument. It remains my favorite opening of any philosophical essay I have ever read, even though her skill and artistry grew immensely in the subsequent nineteen years. To be honest, the connection with this particular essay comes from my bond with Eleanor at a particular time and particular place, when each of us was establishing our career in a recognized university. We shared a lot through extensive phone calls and my visits to Montreal. While Eleanor was able to travel, we also shared conference spaces together, when I often functioned as her advocate as well as her friend. As I re-read this essay and the others, I remember fondly particular conversations where we discussed ideas and feelings about music, teaching, and life. We shared our health challenges and their effects on our lives and work. We talked about being female in the academy; she shared issues around disability; I around homophobia. I see sources in the endnotes for this essay resulting from those conversations and the ideas Eleanor worked out as we chatted. I find similar memories in her other philosophical essays. I am happy to have contributed to the thinking that came out of this heady time. We were slaying dragons!Eleanor (and I must be personal because we were friends) contributed an original and strongly philosophical base to music education within a handful of articles. She never wrote the book she intended in those earlier years. Instead, she refocused her career outside of music education, partly because she realized she had much to say, do, and create within a limited lifespan and partly because music education did not have room for such brilliance and creativity. In fact, music education gave Eleanor a not so gentle shove. She worked nearly all of the last two decades of her life in the departments of musicology and performance. In addition, she served McGill’s students as Associate Dean of Graduate Studies. She knew she had no time to slay music education’s dragons. Even so, Eleanor continued to contribute philosophical columns to the Canadian Music Educator. She wrote regularly for volumes 42–44 (2001–2003) and intermittently before and after those years. In this paper I analyze David Kaplan’s essay “Opacity”. In “Opacity” Kaplan attempts to dismiss Quine’s concerns about quantification across intensional (modal and intentional) operators. I argue that Kaplan succeeds in showing that quantification across intensional operators is logically coherent and that quantified modal logic is strictly speaking not committed to essentialism. However, I also argue that this is not in and of itself sufficient to support Kaplan’s more ambitious attempt to move beyond purely logical results and provide unified, uncontroversial (...) interpretations of both “believes” and “necessarily”. In the paper I raise several questions about the subject matter of logic and the role of semantics, with special focus on singular propositions. (shrink)

The purpose of this paper is to consider Dewey’s influence on American artistic culture between the nineteen-twenties and the nineteen-fifties by focusing on the social and political implications of his approach to art in terms of experience. This entails recapturing, in a concise form, the impact of Dewey’s thought on the development of the Federal Art Project and on Abstract Expressionism. On the basis of the pragmatist assumption that the soundness of a theoretical proposal is to be measured according to (...) its capacity to meet the difficulties arising in our everyday interactions, the present paper systematically examines the theoretical implications of Dewey’s aesthetics in the light of the historical consequences of a specific cultural policy. Dewey’s conception of art and aesthetic experience appears to have made a decisive contribution by providing new opportunities to enjoy the arts and by widely promoting practices with the potential to be aesthetically satisfying. Dewey’s ideas actually led to an undermining of the hierarchy between the fine arts and crafts, between popular culture and design, etc. More problematic are their connections with questions of cultural identity and of art market. Dewey’s influence on the Abstract Expressionists is evident in the way it shifted the artistic focus from art objects toward the experiential dimensions of artistic practices. Some problems regard the accessibility of this kind of works for a general audience and a certain reinforcement of the conception of the artist as creative genius, included the related interpretation of artistic creation as extreme subjective expression.
