Physicians and patients rely on medical journals as trusted sources of medical information. Unfortunately, in multiple instances conflicts of interest have undermined the credibility of the medical literature.The primary sources of conflict of interest at medical journals are authors, reviewers, editors, and journals. Consider these examples.

Different types of consent are used to obtain human biospecimens for future research. This variation has resulted in confusion regarding what research is permitted, inadvertent constraints on future research, and research proceeding without consent. The National Institutes of Health Clinical Center's Department of Bioethics held a workshop to consider the ethical acceptability of addressing these concerns by using broad consent for future research on stored biospecimens. Multiple bioethics scholars, who have written on these issues, discussed the reasons for consent, the (...) range of consent strategies, and gaps in our understanding, and concluded with a proposal for broad initial consent coupled with oversight and, when feasible, ongoing provision of information to donors. This article describes areas of agreement and areas that need more research and dialogue. Although informed consent is important in clinical research, questions persist regarding when it is necessary, what it requires, and how it should be obtained. The standard view in research ethics is that the function of informed consent is to respect individual autonomy. However, consent processes are multidimensional and serve other ethical functions as well. These functions deserve particular attention when barriers to consent exist. We argue that consent serves seven ethically important and conceptually distinct functions. The first four functions pertain (...) principally to individual participants: (1) providing transparency; (2) allowing control and authorization; (3) promoting concordance with participants' values; and (4) protecting and promoting welfare interests. Three other functions are systemic or policy focused: (5) promoting trust; (6) satisfying regulatory requirements; and (7) promoting integrity in research. Reframing consent around these functions can guide approaches to consent that are context sensitive and that maximize achievable goals. (shrink)

In the debate between positivism and non-positivism the argument from relativism plays a pivotal role. The argument from relativism, as put forward, for instance, by Hans Kelsen, says, first, that a necessary connection between law and morality presupposes the existence of absolute, objective, or necessary moral elements, and, second, that no such absolute, objective, or necessary moral elements exist. My reply to this is that absolute, objective, or necessary moral elements do exist, for human rights exist, and human rights exist because they are justifiable. (shrink)

Kant says there is a duty to exit the state of nature, to enter into a civil state. He says this is a duty of right, not a duty of virtue. The article discusses the argument he gives to support this view, as well as the contemporary discussion on the relationship between this duty of right and the categorical imperative. The discussion is full of implications. Particularly significant is the view of the Kantian state emerging from it, which challenges the (...) conventional account: instead of a state designed to protect pre-existing individual property rights, property rights are seen as something resulting from the very constitution of the state. Así, por una parte, se ofrece una interrogación acerca de la manera en que se practica la teoría del derecho en el mundo anglosajón y en el continental europeo, lo cual conduce a poner en cuestión su pretensión de universalidad. Por otra parte se analiza y discute el estatus y la pertinencia de ciertas teorías del derecho, como la (...) del legal origins theory, que afirman la superioridad del common law sobre el resto de las culturas jurídicas. This article gives a brief analysis of the concept of aesthetic profundity, and gives examples of its deployment in European Romanticism, and in various important works of Indian, Chinese and Japanese aesthetic theory. It is srgued that the idea of profundity is most readily deployed in the context of metaphysics which regard the real as having a non-obvious but inexhaustible depth. This is a case of a major logical similarity between European and oriental aesthetic beliefs.

Adequate treatment of pain is essential to alleviate suffering, yet studies show that patients with terminal or serious illness receive inadequate pain relief. In the case of terminally ill patients, adequate palliation of pain may be likely to reduce requests for physician-assisted suicide. This issue of the journal addresses barriers to effective pain relief and suggests how treatment of pain can be improved. The last half of Leviathan is designed to refute these claims in detail, and this refutation is not merely tacked onto the first parts but is a logical extension of them. The argument for escaping the state of nature is that only through obedience to a (...) common power can man escape the likelihood of an early death. Once that common power is established, and so long as it can carry out its protective function, obedience to it is obligatory. When a man enters civil society, the only right he retains is to defend himself against physical death, and consequently, the only time he is entitled to disobey the sovereign is when the sovereign directly threatens him. Thus excuses for rebellion are reduced to an absolute minimum. In McNeiily's formalization however, the concept of a man's death must be replaced by the formal concept of the frustration of all one's desires. And so "whatevvr [a man] regards as the complete frustration of all his desires... he will be entitled to resist, even if such resistance puts him at war with others, including lawful authority" (p. 193). Now the incredible range of things men have believed essential to avoiding the frustration of all their desires is amply testified to in the history of religious warfare. And clearly, under this formalized interpretation, men would be entitled to rebel over the form of baptism, church government, ministerial costume, prayer, or anything else if they are convinced it is essential to their salvation. It takes little knowledge of history to see that Hobbes's espousing of a theory with such consequences has a low degree of probability indeed. Hobbes complains in Leviathan of Scriptural exegetes who "by casting atoms of Scripture, as dust before men's eyes, make everything more obscure than it is." Rather, he claims, it is "not bare words, but the scope of the writer, that giveth the true light by which any writing is to be interpreted; and they that insist upon single texts, without considering the main design, can derive nothing from them clearly'" (E. W., III, 602). This last would be too harsh to apply to McNeiity's work generally, for his "atoms" are for the most part of considerable worth in themselves. ABSTRACT The question of whether Wittgenstein was a liberal philosopher has received less attention than the question of whether he was a conservative philosopher but, as Robert Greenleaf Brice has recently argued, there are hints of liberalism in some of his remarks, and some philosophers, like Richard Eldridge, have argued that a kind of liberalism follows from Wittgenstein’s later philosophy. Richard Rorty has also drawn liberal conclusions from a philosophical viewpoint which draws on Wittgenstein’s work and Alice Crary has (...) suggested that the lessons learned from her own interpretation of Wittgenstein are “reflected in forms of social life that embody the ideals of liberal democracy”. Here I will argue both that Wittgenstein was not a liberal and that his philosophy does not imply a liberal viewpoint. The authors discussed here do not demonstrate that any broad ideological conclusions fol-low from Wittgenstein’s philosophical remarks. -/- RESUMEN La pregunta si Wittgenstein fue un filósofo liberal ha recibido menos atención que la de si fue un filósofo conservador, pero, como Robert Greenleaf Brice ha defendido recientemente, hay muchos indicios de liberalismo en algunas de sus observaciones, y algunos filó-sofos, como Richard Eldridge, han sostenido que hay un cierto tipo de liberalismo que se sigue de la filosofía de su última etapa. Resumen: El discurso de la economía ha transitado por una tensión entre pertenecer a una Ciencia Social y presentar rasgos prototípicos de una Ciencia Básica. Ahora bien, evidenciar esta hibridez desafía a los investigadores del lenguaje, sobre todo si estos textos son parte de la formación de un economista. Particularmente, el Informe de Política Monetaria no ha sido estudiado desde el punto de vista lingüístico, por lo que se busca observar, en un corpus de 45 textos, si el género IPOM (...) evidencia dicha tensión discursiva de la disciplina. Para lograr ese objetivo, se ha optado por una metodología basada en dos dimensiones: Contexto de Producción y Organización Retórico-Funcional. Tras el análisis, los hallazgos del corpus IPOM-2013 integradamente muestran que el género IPOM efectivamente evidencia dicha tensión con rasgos más características de la CB como es el uso de recursos matemáticos y, por otro lado, rasgos de la CS, asociados a la modalización del discurso en su macromovida central.: The discourse of economy has gone by a constant tension between belonging to a Social Science and present prototypical features of a Basic Science. However, evidence this hybridity poses a challenge for researchers of language, especially if these texts are part of the training of an economist. In particular, the Monetary Policy Report has not been studied from the linguistic point of view. In this context, this research search to answer the question whether the gender IPOM evidences such discursive tension of the discipline. To achieve this objective, it has opted for a methodology based on 2 dimensions: Production Context and Rhetorical-Functional Organization. After the analysis, the findings Integrally shows that the IPOM genre effectively demonstrates this tension with features more characteristic of the BS such as the use of mathematical resources and, on the other hand, SC traits, mainly associated to the modalization of the discourse in its central macromove. This book is the first to approach Jacques Rancière’s work from a legal perspective. A former student of Louis Althusser, Rancière is one of the most important contemporary French philosophers of recent decades: offering an original and path-breaking way to think politics, democracy and aesthetics. Rancière’s work has received wide and increasing critical attention, but no study exists so far that reflects on the wider implications of Rancière for law and for socio-legal studies. Although Rancière does not pay much specific (...) attention to law—and there is a strong temptation to identify law with what he terms the "police order"—much of Rancière’s historical work highlights the creative potential of law and legal language. Indeed, he repeatedly offers powerful instances of what Robert Cover labelled _jurisgenesis, _of norm-generation, with important legal implications and ramifications. So, rather than excavate the Rancièrean corpus for isolated statements about the law, this volume reverses such a method and asks: what would a Rancière-inspired legal theory look like? Bringing together specialists and scholars in different areas of law, critical theory and philosophy, this rethinking of law and socio-legal studies _through_ Rancière provides an original and important engagement with a range of contemporary legal topics, including constituent power, constitutional interpretation, the judicialization of politics, legal subjectivity, conflicts, human rights, the nomos of modernity, globalization, and the sensory configurations of law. Este estudio de relaciones médico-paciente en Mexico involucró entrevistas realizadas a 1700 pacientes inmediatamente de.\pués de salir de su consulta clínica. Se llevó a cabo entre los años 2004-05 en León, More ha, Guanajuato y en Charleston, West Virginia, USA. Los propósitos fueron: 1) establecer un base de datos como punto de referencia para investigaciones futuras en instituciones del cuidado de la salud con referencia a la comunicación médico-paciente, a la satisfacción de los pacientes y al consentimiento infórmado y, 2) (...) hacer una comparación entre las relaciones medico-paciente en Mexico y los Estados Unidos de America. Hicimos varias conclusiones sobre la comunicación médico-paciente, participación del paciente en decisiones con respecto a su cuidado de salud y el ambiente social de la consulta médica. Ofi-ecemos los datos y los cuestionarios completos por internet a cualquier investigador interesado para estudios futuros de acuerdo con sus propios intereses. Además, encontramos que no huho ninguna diferencia importante en las relaciones médico-pacientes con respecto al consentimiento infórmado y la satisfáccián del paciente entre México y los EEUU. China es el mayor desafío económico de Europa. La aspiración de China por el dominio geopolítico, económico y tecnológico está tensionando gravemente sus relaciones con Europa, que se encuentran en una clara trayectoria descendente. Las posiciones se han endurecido por ambas partes, con China volviéndose económicamente hacia adentro y la Unión Europea etiquetando a China como un competidor total, con limitadas áreas para el compromiso. El enfoque de China es a largo plazo y estratégico, explotando las divisiones internas de la (...) UE y la débil cooperación transatlántica con Estados Unidos. A China le gustaría tener acceso a tecnologías avanzadas con posibles aplicaciones militares, y ha adquirido puertos europeos y otras infraestructuras estratégicas. A través de la Iniciativa de la Franja y la Ruta, se ha convertido en el mayor acreedor bilateral del mundo. En último término, China busca revisar la arquitectura económica internacional y “reescribir las reglas del juego”. La respuesta de Europa no ha estado bien coordinada, ha sido a corto plazo y fragmentaria, lo que refleja las divisiones internas en la Unión. Para responder eficazmente al desafío de China, Europa necesita superar los intereses nacionales, cooperar con sus aliados y actuar más estratégicamente. (shrink)

An influence that was sometimes hidden and always controversial. This work highlights the importance of this influence regarding thought on politics, law and natural (...) rights. A constitutionalist understanding of political power, the recognition and promotion of innate rights and the necessary subjection of rulers to the law, all form part of the important legacy of these scholastic doctors for European intellectual heritage.
