In After the Rights Revolution, Cass Sunstein confronts the “Chicago” intellectual tradition on the effects of government regulation. While recognizing the many failures of regulation, Sunstein argues that most regulation serves a potentially useful purpose and that the courts can be relied on to correct the worst regulatory failures. He offers a dizzying array of prescriptions to ensure this outcome, many of which would appear to run afoul of clear congressional intent. In a more recent book, Breaking the Vicious Circle, (...) Stephen Breyer offers a different diagnosis. He sees health‐safety‐environmental regulation as essentially out of control because of the “vicious circle” created by irrational and ineffective government responses to the public's concern about the risk of exposure to carcinogens. Breyer does not believe that this vicious circle of excessive and irrational regulation can be broken by the courts. Instead, he suggests the creation of an elite bureaucratic corps with the mission of proposing more effective and less costly approaches to controlling threats to human health. (shrink)

A Theology in Outline: Can These Bones Live? began with an undergraduate course taught by Robert W. Jenson at Princeton University in the spring of 2008. Based on a series of twenty-three course lectures, it offers a concise and accessible overview of Christian theology while retaining the atmosphere of Jenson's classroom. Much as does Jenson's Systematic Theology, A Theology in Outline treats a standard sequence of doctrines in Christian theology--God, Trinity, creation, humanity, sin, salvation, church, among others. However, its (...) organizing principle and leitmotiv are less traditional. Reflecting his recent interest in theological interpretation of scripture, Jenson frames the whole of Christian theology as a response to the question posed to the prophet Ezekiel: "Son of man, can these bones live?" For Jenson, to ask this question is to ask whether Christian theology itself is a pile of dead bones. Can the story that God lives with his people be told today? From first to last the chapters of this book proceed under the impelling pressure of this question. They thus comprise a single sequence of illustrative conversations for the purpose of introducing beginners to Christian theology. (shrink)

David Rosenthal and Fred Dretske agree that creature consciousness should be used to give a reductive explanation of state consciousness. They disagree, however, over what type of creature consciousness will do the job. Rosenthal, defending a higher-order thought account, argues that higher-order creature consciousness is what is needed. Dretske, defending a first-order account, argues that first-order creature consciousness is what is needed. I attempt to advance this debate by presenting a case for a third creature-conscious account of state consciousness. what (...) I call the same-order account. I show that bydefining a conscious mental state as a mental state whose possessor is conscious of what it represents, we are offered a unique creature-conscious account of state consciousness that avoids some of the problems that have plagued both the HOT and FO accounts. Since its inception as a topic of inquiry, mirror-self-recognition has usually been explained by two models: one, initiated by Guillaume, proposes that mirror-self-recognition depends upon kinesthetic-visual matching, and the other, initiated by Gallup, that self-recognition depends upon a self-concept. These two models are examined historically and conceptually. This examination suggests that the kinesthetic-visual matching model is conceptually coherent and makes reasonable and accurate predictions; and that the self-concept model is conceptually incoherent and makes inaccurate predictions from premises which are themselves (...) inaccurate. From a theoretical standpoint, the kinesthetic-visual matching model is the better explanation of self-recognition. (shrink)

This paper examines contemporary attempts to explicate the explanatory role of mathematics in the physical sciences. Most such approaches involve developing so-called mapping accounts of the relationships between the physical world and mathematical structures. The paper argues that the use of idealizations in physical theorizing poses serious difficulties for such mapping accounts. A new approach to the applicability of mathematics is proposed.

In this essay, I set forth a view of humans as creatures living at once in two worlds: the world of nature and the world of culture. I explore some of the tensions and paradoxes entailed by this position, as weIl as the implications for ethics, both interhuman and environmental. I also critique the distortions entailed by ethical stances which draw too heavily on one polarity or the other without taking sufficient account of the discontinuities between them.

Since the discovery of the first man‐ape, many have assumed that the earliest humans were hunters and that this was associated with a “killer instinct.” The myth of “man the hunter” was repeated in the 1960s in anthropology texts and popular literature. In the 1970s it was adopted by sociobiologists to explain human nature. “Man the hunter” is used to explain not only human biology but also human morality. The morals described, however, often reflect ancient beliefs and appear to be (...) new ways of justifying old morality codes. The newest version of this myth is presented in a recent book, Demonic Males. I will discuss various accounts of this myth and the evidence used to justify them, and will specifically critique the arguments presented in Demonic Males. (shrink)

While 4E cognitive science is fundamentally committed to recognising the importance of the environment in making sense of cognition, its interest in the role of artefacts seems to be one of its least developed dimensions. Yet the role of artefacts in human cognition and agency is central to the sorts of beings we are. Internet technology is influencing and being incorporated into a wide variety of our cognitive processes. Yet the dominant way of viewing these changes sees technology as an (...) outside force “impacting” on our minds. Within this context, Material Engagement Theory seems well poised to help make sense of our cognitive involvement with the Internet as MET is precisely concerned with grasping the role of material culture in human cognition. This paper explores some of the resources MET provides to think through the effects the internet is having on human agency. This paper uses MET as a starting point for examining the way Internet technology can be involved with human agency, both to the provide a much needed and more adequate theorization of these phenomena, but also to illustrate ways in which the consideration of artefacts can be given a more central and adequate place within the 4E cognitive sciences. Profiles of art education in nineteen countries around the world by citizens or longtime residents of those countries comprise the core of this book. Guidelines for the cross-cultural study of art education are presented by the editors in a general introduction and three part introductions, and also by contributing specialists. The nineteen national profiles, with accompanying examples of children's artwork, make up the largest section of the book, Part II. The three chapters in Part I review research that has identified, (...) on one hand, certain universal characteristics of children's artwork attributable to common human stages of development, and, on the other hand, certain differing and unique cultural influences. The need for further research on this distinction is emphasized. Contributors to Part I are Elliot W. Eisner, William Ives and Howard Gardner, and Marjorie and Brent Wilson. The three chapters in Part III discuss three major problems in art education: the use of museum visits, the worldwide attempt to establish valid tests of teacher and pupil proficiency in art, and the design of sound and useful cross-cultural research. This paper looks at emergence in physical theories and argues that an appropriate way to understand socalled “emergent protectorates” is via the explanatory apparatus of the renormalization group. It is argued that mathematical singularities play a crucial role in our understanding of at least some well-defined emergent features of the world.
