When the New Organon appeared in 1620, part of a six-part programme of scientific inquiry entitled 'The Great Renewal of Learning', Francis Bacon was at the high point of his political career, and his ambitious work was groundbreaking in its attempt to give formal philosophical shape to a new and rapidly emerging experimentally-based science. Bacon combines theoretical scientific epistemology with examples from applied science, examining phenomena as various as magnetism, gravity, and the ebb and flow of the tides, and anticipating (...) later experimental work by Robert Boyle and others. His work challenges the entire edifice of the philosophy and learning of his time, and has left its mark on all subsequent philosophical discussions of scientific method. This volume presents a new translation of the text into modern English by Michael Silverthorne, and an introduction by Lisa Jardine that sets the work in the context of Bacon's scientific and philosophical activities. This second festschrift for Robert Sokolowski brings together papers given in April 2000 at a colloquium on the occasion of his sixty-fifth birthday. In contrast with the first festschrift in honor of his sixtieth birthday, which was mostly phenomenological philosophy, the present collection is mostly phenomenological theology.

The austere simplicity of Zen rock gardens is also an allusive and elusive one, as the two enjoyable essays that (...) comprise Reading Zen in the Rocks — The Japanese Dry Landscape Garden eloquently indicate. More so than the phenomena they describe, these essays appeal to a wide audience, and they read easily, invitingly, and informatively. In this textual performance, the French art-historian, François Berthier, stands side-by-side with the Scottish philosopher of comparative East-West studies, Graham Parkes, to provide a textual and visual presentation that intends, via an appropriate complementarity of content, to introduce the karesansui (dry landscape) style of Japanese garden to the general reader. Parkes — a masterful and accomplished translator — renders into English, Berthier's 1989 work, Le jardin du Ryoanji — Lire le Zen dans les pierres [The Garden of Ryoanji — Reading Zen in the Rocks], and fills some philosophical gaps with his own equal-length [End Page 112] essay, "The Role of Rock in the Japanese Dry Landscape Garden." Though judiciously focused to achieve expository economy, the two essays jointly provide a handy introduction to the complicated artistic, philosophic, religious, and cultural phenomenon popularly known as the "Zen rock garden."As a distinguishing landscape-architectural feature of many Zen monasteries in Japan and abroad, the karesansui garden reinforces the contemplative religious atmosphere and, as the frequent photographs of meditating monks quietly positioned in their rock gardens tend to suggest, they guide the perceiver into the calm and earthy mentality typical of Zen Buddhism. Berthier notes, accordingly, that the gardens provide "an image of the [Buddhistically interpreted] universe in its most condensed form" in which people can discern their "true faces" (p. 6). Ideally, one could contemplate a Zen garden and, if one were equipped with the proper background in Zen training, be stimulated to experience a Zen Buddhist enlightenment.Such are the immediate expectations elicited from a book whose cover depicts a Zen monk contemplating an expanse of bare gravel, and which sets the title word "Zen" in large letters over the monk's back. It comes as a surprise, then, that there is far less pure Zen in these essays than one would anticipate from this English-language presentation of Berthier's book. In the French version, as can be seen above, the word "Zen" appears only in the book's subtitle, and the Zen-specific anticipations are more submerged as a result.It would be an overstatement to identify the phrase "Zen rock garden" as a misnomer, but Berthier and Parkes implicitly demonstrate that the karesansui style of Japanese garden is not an exclusively Zen phenomenon, but is intimately linked with Chinese Daoism, Shintoism, not to mention versions of Buddhism that historically precede, and are significantly different from, Zen Buddhism. Perhaps unintentionally, this book raises the question, "What measure of Zen, in fact, do the paradigmatic "Zen" rock gardens such as the garden at Ryoanji (c. 1500, in Kyoto, and the archetype of Japanese dry landscape gardens) embody?"We can approach this question by considering the meaning of the Japanese word, "karesansui," which Parkes translates accurately as "dry landscape." The title of the book announces that the subject is "the Japanese dry landscape garden," but it is important to recall (as one learns briefly in the final pages) the further linguistic resonances of the prefix "kare." What does not emerge through in the usual translation of "kare" as "dry," is the added association to the English term "withered," for one would translate, for instance, the Japanese terms "kare kusa," "kare ashi," "kare giku," and "kareha," as "withered grass," "withered reed," "withered chrysanthemums," and "withered leaves," respectively. According to the Free Will Explanation of a traditional view of hell, human freedom explains why some people are in hell. It also explains hell’s punishment and finality: persons in hell have freely developed moral vices that are their own punishment and that make repentance psychologically impossible. So, even though God continues to desire reconciliation with persons in hell, damned persons do not want reconciliation with God. But this moral vice explanation of hell’s finality is implausible. I argue that God (...) can and would make direct or indirect alterations in their character to give them new motivational reasons that re-enable their freedom to repent. Subsequently, I argue that it is probable that each damned person will be saved eventually, because there is a potential infinity of opportunities for free repentance. Thus, if the Free Will Explanation’s descriptions of hell and divine love are correct, it is highly probable that each person in hell escapes to heaven. (shrink)

The article considers two different interpretations of the reason model of precedent pioneered by John Horty. On a plausible interpretation of the reason model, past cases provide reasons to prioritize reasons favouring the same outcome as a past case over reasons favouring the opposing outcome. Here I consider the merits of this approach to the role of precedent in legal reasoning in comparison with a closely related view favoured by some legal theorists, according to which past cases provide reasons for (...) undercutting (or ‘excluding’) reasons favouring the opposing outcome. After embedding both accounts within a general default logic, I note some important differences between the two approaches that emerge as a result of plausible distinctions between rebutting and undercutting defeat in formal models of legal reasoning. These differences stem from the ‘preference independence’ of undercutting defeat. Undercutting reasons succeed in defeating opposing reasons irrespective of their relative strength. As a result, the two accounts differ in their account of the way in which precedents constrain judicial reasoning. I conclude by suggesting that the two approaches can be integrated within a single model, in which the distinction between undercutting and rebutting defeat is used to account for the distinction between strict and persuasive forms of precedential constraint. Various cases of conjoined twinning have been presented as problems for the animalist view that we are animals. In some actual and possible cases of human dicephalus that have been discussed in the literature, it is arguable that there are two persons but only one human animal. It is also tempting to believe that there are two persons and one animal in possible instances of craniopagus parasiticus that have been described. Here it is argued that the animalist can admit that (...) these are cases in which human persons are not animals, without forfeiting the title “animalist.” It is also shown that this is not only an option but also a well-motivated and plausible option for the animalist. Seeing this requires getting clear on what the word “we” should be thought to include in the animalist's claim that we are animals. Here animalism is defended against twinning objections by figuring out how to view the scope of the animalist's identity claim. (shrink)

An Artificial Intelligence algorithm trained on data that reflect racial biases may yield racially biased outputs, even if the algorithm on its own is unbiased. For example, algorithms used to schedule medical appointments in the USA predict that Black patients are at a higher risk of no-show than non-Black patients, though technically accurate given existing data that prediction results in Black patients being overwhelmingly scheduled in appointment slots that cause longer wait times than non-Black patients. This perpetuates racial inequity, in (...) this case lesser access to medical care. This gives rise to one type of Accuracy-Fairness trade-off: preserve the efficiency offered by using AI to schedule appointments or discard that efficiency in order to avoid perpetuating ethno-racial disparities. Similar trade-offs arise in a range of AI applications including others in medicine, as well as in education, judicial systems, and public security, among others. This article presents a framework for addressing such trade-offs where Machine Learning and Optimization components of the algorithm are decoupled. Applied to medical appointment scheduling, our framework articulates four approaches intervening in different ways on different components of the algorithm. Each yields specific results, in one case preserving accuracy comparable to the current state-of-the-art while eliminating the disparity. (shrink)

A striking feature of atrocities, as seen in genocides, civil wars or violence against certain racial and ethnic groups, is the attempt to dehumanize – to deny and strip human beings of their humanity. Yet the very nature of dehumanization remains relatively poorly understood. Taken together, Sections 145 and 63 of the Mental Health Act 1983 provide for treatment without consent of physical illness ancillary to the mental disorder with which a patient presents. On a daily basis, clinicians make both the decision that the Act’s authority can be applied to their patient’s case, and that it should be applied. But in the unusual circumstances where there is uncertainty as to the applicability of the MHA to the ancillary treatment of physical illness, the assistance (...) of a court may be sought. In so doing, the law may justify compulsion but never prescribes it; the clinician is presented with authority that he or she could use but is left to decide whether it should be employed. This paper explores how the clinical question is set before the court, and whether the distinction between symptom, manifestation and consequence is sufficiently understood. This has important consequences in the context of self-neglect and its close cousin self-harm: the question whether the relevant ailment was attributable to or exacerbated by neglect or self- inflicted harm will determine whether compulsion under the MHA is applicable; and furthermore, whether or not compulsion is clinically acceptable. This paper revisits one of the least understood elements of Derrida’s corpus: his sustained critique of Lacan’s conception of the letter operative in the unconscious. Showing where and how this critique has been misconstrued, the paper demonstrates that the ultimate significance of Derrida’s intervention lies in how it brings forward the uncritical conception of heterogeneity found in Lacan. In this way, Derrida’s engagement with Lacan, from ‘Positions’ all the way up to the late seminars on The Beast and the Sovereign, (...) sheds crucial light on how the core ‘ultra-transcendental’ structures of deconstruction are to be understood. Individuals do not have a right to participate in clinical trials. But, they do have a right against being denied participation for inappropriate reasons. Despite the widespread endorsement of these two claims, there has been little discussion regarding which conditions for participation in clinical trials are appropriate and which are inappropriate. The present manuscript attempts to address this gap in the literature. We first describe and then argue against the claim that conditions on enrollment or continued participation are appropriate only (...) when they are needed to answer the scientific question(s) posed by the trial. We then offer an alternative view according to which the appropriateness of conditions depends on whether they help to satisfy the ethical requirements of clinical research. Because these requirements include social value, the present view implies that promoting social value is an acceptable reason to impose conditions on research participation. With this in mind, we explain why it is not coercive to require potential participants to accept conditions on enrollment that promote a trial's social value, even when the participants find those conditions unwelcome. We conclude by evaluating the present proposal's implications for the common practice of requiring participants to agree to the possible use of their leftover biospecimens in a broad range of future research. We argue, contra current regulatory policy, that this practice can be acceptable even when the present trial offers participants the prospect of clinical benefit and the samples are being reserved for future research that is unrelated to the present trial. Artificial intelligence (AI) systems have demonstrated impressive performance across a variety of clinical tasks. However, notoriously, sometimes these systems are 'black boxes'. The initial response in the literature was a demand for 'explainable AI'. However, recently, several authors have suggested that making AI more explainable or 'interpretable' is likely to be at the cost of the accuracy of these systems and that prioritising interpretability in medical AI may constitute a 'lethal prejudice'. In this paper, we defend the value of interpretability (...) in the context of the use of AI in medicine. Clinicians may prefer interpretable systems over more accurate black boxes, which in turn is sufficient to give designers of AI reason to prefer more interpretable systems in order to ensure that AI is adopted and its benefits realised. Moreover, clinicians may be justified in this preference. Achieving the downstream benefits from AI is critically dependent on how the outputs of these systems are interpreted by physicians and patients. A preference for the use of highly accurate black box AI systems, over less accurate but more interpretable systems , may itself constitute a form of lethal prejudice that may diminish the benefits of AI to - and perhaps even harm - patients. What is the relation of politics to theory? Theories make political claims, theorists make political critiques, and academics use theory in the pursuit of institutional ends: theory is not only about politics but is itself a political practice.

In approaching the future, i.e. in planning projects and decision-making, the role of both affective and non-affective factors is considerable. But given that affectivity is not a homogeneous realm and that it is difficult, if not impossible, to isolate the affective and non-affective elements of a description, anticipation can be hardly described as purely affective, and, on the other, it is necessary to consider what kind or level of the hierarchical realm of affectivity is involved in the anticipation move. In 1763, the young James Boswell left Great Britain for a 'Grand Tour' of the Continent. The tour was a tradition among British and Scottish youths; by visiting the great historical sites, especially those of Roman and Greek antiquity, they would complete the studies they had begun at universities back home. Boswell's tour, however, was different: he was less concerned with the ruins of the past than the thinkers of the present. In particular, he was eager to question the leading (...) figures of the Enlightenment on matters of faith and God--of particular importance to Boswell, who had been raised in the dour and dire atmosphere of the Church of Scotland. In his remarkable conversations with figures like Voltaire, Rousseau, and Hume, we see a man struggling with the claims of reason and needs of faith--a struggle that remains very much our own 250 years later. Agriculture’s dominant focus is feeding the human population. From an ethical perspective, this is clearly very positive, but it does not absolve agriculture from critical, ethical examination of the totality of agriculture’s effects. To earn the public’s ongoing support, agriculture must be trusted to vigilantly examine its full range of effects and be sure they align with the highest ethical values. Agriculture’s record is enviable in the science and technology associated with its primary ethical concern, but we need to do (...) more to address the broader ethical issues that are the public’s increasing concern. The entire agricultural community needs to become engaged in the discussion. The classroom offers an effective starting place. Yet, curricular offerings are rarely available at public universities. Opportunity for ethics study should become a key component of agricultural education. (shrink)

It is critical to our form of democracy in the U.S. that citizens become active participants.
