He was introduced to Zen Buddhism during World War II as an internee in a camp for enemy civilians in Kobe, Japan. Original Dwelling Place (...) is Aitken’s ninth book to explore a series of topics that accent his personal journey into Zen. He has gathered a series of essays about the texts and lineage teachers with whom he studied over the years. In the opening section, entitled “Ancestors,” he pays homage to the masters [End Page 212] who influenced his own Zen practice. He writes, “All of my guides have passed away, but they are alive in my mind and body” (p. 5). The book reflects his continuing bond with those deceased teachers who exercised a vital presence and environmental influence within his life. He shares some stories, personal insights, and legacies of some of his guides, such as Nyogen Senzaki, Soen Roshi, Blyth Sensei, and D. T. Suzuki. I found his essay on the legacy of Dwight Goddard filling in many personal details of a pioneer Western Buddhist who significantly contributed to the Americanization of Buddhism. In many ways, Aitken’s own spiritual development and Original Dwelling Place recapitulate the Americanization of Zen Buddhism, providing some important insights into that process of Buddhist acculturation.Yet Aitken does not limit his guides to twentieth-century ones. He brings alive the classical discourses and relates them to contemporary life. Throughout his essays, I was struck by how alive and dynamic Aitken’s Mahayana contemplative vision and practice are. There is a spirit of “contemplative action” that collapses the duality of meditative practice and living that discovers the truth dynamically within a matrix of open living. As a Christian practitioner of Ignatian spirituality, I found many parallels to the Jesuit ideal of being “contemplative in action.” Aitken’s essays elucidate an ongoing dynamic dialectic that fluctuates between meditative reflection and the world of experience—reminding me at times of the contemplative Trappist monk, Thomas Merton, and at other times of the Jesuit poet-activist, Daniel Berrigan.The reader garners an aesthetic sense that classical Zen texts have been an integral part of his journey and have provided him with a platform to reflect on topics such as marriage, death, the use of money, sexuality, and Zen practice. Some of his essays have a meditative quality, drawing the reader into an web of intertextuality and experience where Zen teachers and Western poets engage in a contemplative path of pleasure expressed in awareness of the everyday dewdrop world. There were moments that I envisioned reading a particular essay on retreat, for they had a meditative quality that reminded me of some the writings of Thomas Merton. Like Merton, Robert Aitken does not merely probe meditative experience but attempts to interrogate the everyday experiences of Western Buddhists from meditative awareness. Most Japanese Buddhists, he notes, are married within Shinto ceremonies, and Western Buddhists have resurrected old Buddhist marriage ceremonies seldom used by Japanese practitioners. Western Buddhist marriage ceremonies, Aitken notes, are a relatively new tradition that often blends ceremonies from The Book of Common Prayer with Buddhist rituals. He ends his short essay on marriage with final reflections on how marriage and family form a little sangha.In “Death: A Zen Buddhist Perspective,” Aitken breaks new ground by noting how Buddhists face the fact of death and find solace in impermanence. He quotes the Japanese haiku poet, Isa Kobayashi (1763–1827), grieving at the loss of his baby daughter:The dewdrop world is the dewdrop world, and yet—and yet(p. 124). The story of our lives is the story of our passions. We fall in love, we are gripped by scientific curiosity and religious fervor, we fear death and grieve for others, we humble ourselves in envy, jealousy, and resentment. In this remarkable book, Robert Solomon shares his fascination with the emotions and illuminates our passions in an exciting new way.

In this paper I offer some existential-phenomenological reflections on the interrelationships among the forms of love, loss, and human finitude. I claim that authentic Being-toward-death entails owning up not only to one’s own finitude, but also to the finitude of all those we love. Hence, authentic Being-toward-death always includes Being-toward-loss as a central constituent. Just as, existentially, we are “always dying already,” so too are we always already grieving. Death and loss are existentially equiprimordial. I extend these claims to a (...) discussion of the four forms of love identified by the ancient Greeks, contending that the nature of a loss experience will depend complexly on the forms or dimensions of love that had constituted the lost relationship. I argue that authentic solicitude can be shown to entail one of the constitutive dimensions of deep human bonding, in which we value the alterity of the other as it is manifested in his or her own distinctive affectivity, in particular, in those painful emotional states disclosive of authentic existing. The unexpected death of a child is one of the most challenging losses as it fractures survivors’ sense of parenthood and other layers of identity. Given that not all the bereaved parents who have need for support respond well to available treatments and that many have little access to further intervention or follow-up over time, online interventions featuring therapeutic writing and peer support have strong potential. In this article we explore how a group of bereaved mothers experienced the process of (...) participating in an online course in therapeutic writing for the integration of grief. Our research questions were: How do parents who have lost a child experience being part of an online course in therapeutic writing? What are the perceived benefits and challenges of writing in processing their grief? We followed an existential phenomenological approach and analyzed fieldwork notes (n= 13), qualitative data from the application and assessment surveys (n= 35;n= 21), excerpts from the journals of some participants (n= 3), and email correspondence with some participants (n= 5). We categorized the results in three meaning units: (1) where does my story begin? The “both and” of their silent chaos; (2) standing on the middle line: a pregnancy that does not end; (3) closures and openings: “careful optimism” and the need for community support. Participants experienced writing as an opportunity for self-exploration regarding their identities and their emotional world, as well as a means to develop and strengthen a bond with their children. They also experienced a sense of belonging, validation, and acceptance in the online group in a way that helped them make sense of their suffering. Online writing courses could be of benefit for bereaved parents who are grieving the unexpected death of a child, but do not replace other interventions such as psychotherapy. In addition to trauma and attachment informed models of grief, identity informed models with a developmental focus might enhance the impact of both low-threshold community interventions and more intensive clinical ones. Further studies and theoretical development in the area are needed, addressing dialogical notions such as the multivoicedness of the self. (shrink)

Robert Solomon criticized the philosophy of death for abstracting from human reality to treat our mortality as a collection of metaphysical puzzles. Nowhere is death less abstract than in our response to the death of our loved ones. The public face of our response is the memorial service and the eulogies that move us. Our experience of a eulogy can be as cathartic as Aristotle theorized as part of great tragedy. However, treating the oration as a work of art (...) seems inappropriate; seeking to understand our engagement in aesthetic terms disrespectful to the grieving. This paper attempts to resolve this paradox by exploring analogies between the structures of eulogies and those of tragedy, and showing that, rather than traditional aesthetics' "promise of happiness," our engagement is concerned with the "promise of meaning." Psychological research on the nature of empathy theorizes that humans are hard-wired to feel the experiences of others and this is undoubtedly at work in our emotional responses to literature and eulogies. Drawing on the work of Dacher Keltner, the paper argues that the key to the aesthetics of eulogies and literature lies in their power to invoke our "awe" in response to their words. (shrink)

In “Trompe L'Oeil”, the seventh episode of Westworld, Bernard Lowe discovers the plans for his own body. Bernard's are ready‐made by someone else and uploaded into his brain, apparently unrelated to any real events. Bernard has memories of his son Charlie, which he thought referred to a real boy with whom he had a real relationship, and whose real death is the cause of his inescapable grief. Bernard might respond that lifelong grief is an excessive response to the death of (...) a fictional character. He realizes that the memories of that trauma have been fabricated by Robert Ford. Whether Charlie is a lie, a fiction, or a stranger, by grieving for him Bernard is sharing in a very human kind of experience. As malicious as Ford's motives were, maybe he was right about the need for a “cornerstone” of suffering to make Bernard human. (shrink)

In the debate between positivism and non-positivism the argument from relativism plays a pivotal role. The argument from relativism, as put forward, for instance, by Hans Kelsen, says, first, that a necessary connection between law and morality presupposes the existence of absolute, objective, or necessary moral elements, and, second, that no such absolute, objective, or necessary moral elements exist. My reply to this is that absolute, objective, or necessary moral elements do exist, for human rights exist, and human rights exist (...) because they are justifiable. (shrink)

In this article, I take up two arguments in favor of the discursive model of legal argumentation: the claim to correctness argument and the dual nature thesis. The argument of correctness implies the dual nature thesis, and the dual nature thesis implies a nonpositivistic concept of law. The nonpositivistic concept of law comprises five ideas. One of them is the special case thesis. The special case thesis says that positivistic elements, that is, statutes, precedents, and prevailing doctrines, are necessary for (...) law in order to achieve legal certainty. Without this, law would not be as perfect as it could possibly be. But it says, at the same time, that this alone would not be enough to fulfill the claim to correctness. The claim to correctness refers not only to the real dimension of law, defined by statutes, precedents, and prevailing doctrines, but also to its ideal dimension, defined, first and foremost, by justice. The special case thesis is my oldest thesis. It has remained an essential element of my system over the years. Its connection with four other theses—the Radbruch formula, the human rights thesis, the idea of deliberative democracy, and principles theory—does not change this at all. On the contrary, this connection has lent greater strength to the special case thesis. (shrink)

According to the author there is no doubt that one has to distinguish between the justification and the application of norms. Problems are seen only to arise if one asks what exactly the distinction is and which consequences have to be drawn from it. Recently, Klaus Günther, in particular, has searched for this distinction and connected it with far‐reaching conclusions concerning the theory of norms, arguments, and morals. His theses are the object of the author's considerations.

Euripides: For cleverness and sound advice, and because we make the men of the cities better. Aristophanes, Frogs, 1008-1010 Thirty years ago, Robert Brustein, the dean of the Yale School of Drama, commissioned Burt Shevelove to (...) restage a production of Aristophanes' Frogs that Shevelove wrote during his graduate school days at Yale in 1941.1 The performances were to be held in the Olympic-size swimming pool of the Payne Whitney Gymnasium. Shevelove asked Stephen Sondheim, with whom he had collaborated on A Funny Thing Happened on the Way to the Forum, to compose the lyrics for the musical numbers and Carmen de Lavallade to choreograph the dance pieces. The cast included students at the Yale School of Drama (among the chorus were Christopher Durang, Meryl Streep, and Sigourney Weaver), and, as in 1941, members of the Yale swim team were assembled for the frogs. In addition to stripping the original Greek script of most of its topical allusions, Shevelove updated the comic agōn by replacing Aeschylus with Shakespeare and Euripides with George Bernard Shaw, whose detractors, much like Euripides' opponents, characterized him as "subversive" and "unpatriotic" and believed that his plays favored criticism over commitment. Broadway columnists traveled to New Haven to review the [End Page 127] performances, and, for the most part, the response was positive.2 Despite this acclaim, however, only a few other directors in the intervening years have dared to stage this imaginative adaptation.3The Lincoln Center Theater decided to mark its twentieth anniversary with a revision of this script that poses an answer to Aeschylus' question in Frogs, "Why should the dramatic poet be admired?" The production owes its very existence to the advocacy of Nathan Lane,4 who shrewdly decided to employ the talents of Tony Award-winning Susan Stroman as choreographer and director. Lane updated the original script, and he and Stroman convinced Sondheim to write additional songs for the libretto. In an interview with John Guare, Lane revealed that he saw Aristophanes' Frogs as speaking directly to challenges of our times: "There's something idealistic about the notion of someone believing that the arts can make a difference, that you can effect a change. Dionysos' dream to go down to Hades and bring back this great writer who could actually have an effect on the world, it's noble and touching and crazy—all at the same time. I found it moving, in light of what was going on in the world."5 Stroman, too, believed that Frogs could offer comfort not only to fifth-century Athenians embroiled in a thirty-year civil conflict but also to those trying to rebuild their lives after the recent terrorist attacks: "And when Nathan first brought this [script] to me, it was only a [End Page 128] year after September 11th. We were all still reeling. I think that's another reason I was attracted to the play immediately. Usually, when one grieves, you can go somewhere and have a little relief from it. But when September 11th happened, the entire city of New York was grieving. There was nowhere to go, and there would be nowhere to go for a very long time. No one was stepping forward who could truly speak about what just had happened. No one could find words to comfort us or explain these images we were overwhelmed with daily. There was no one to ease our hearts."6 Although the links that Lane and Stroman draw between fifth-century Athens and New York often work well—the topical jokes about George Bush elicited veritable "hooting and hollering" from the typically reserved Broadway theatergoers—the play's final message, that a dramatic poet, in this case Shakespeare, can save the world from its present woes (or at least help it along), seems unlikely to satisfy an audience whose... La première partie vise à montrer que la phénoménologie de Husserl porte en elle des thèmes par lesquels elle se soustrait au cadre métaphysique dans lequel elle s’est formée. La deuxième partie prétend que la phénoménologie politique de Hannah Arendt conduit à une mise en question de l’idéologie des droits de l’homme mais aussi à (...) une justification de l’idée des droits de l’homme. Cette section comprend en elle la reproduction d’un débat oral qui avait eu lieu sur France culture entre Claude Lefort, Alain Finkielkraut et Robert Legros. La troisième partie porte sur l’expérience phénoménologique d’autrui. Elle montre que cette expérience prolonge et renouvelle d’une part la conception kantienne de l’expérience du proprement humain, et d’autre part la conception tocquevillienne de l’expérience du semblable. The paper considers various ruminations on the aftermath of the death of a close one, and the processes of grieving and mourning. The conceptual examination of how grief impacts on its sufferers, from different cultural perspectives, is followed by an analytical survey of current thinking among psychologists, psychoanalysts and philosophers on the enigma of grief, and on the associated practice of mourning. Robert C. Solomon reflected deeply on the 'extreme emotion' of grief in his extensive theorizing on the emotions, (...) particularly in his essay 'On Grief and Gratitude', commenting that grief is 'often described as a very private, personal emotion, characterized by social withdrawal and shutting oneself off from the world' (2004: 73). While dialoguing with the spirit of Solomon by way also of a tribute to his immense insights, the paper engages in critical reflections on recent thinking in this area elsewhere - notably, in Heidegger, Freud, Nussbaum, Casey, Gustafson, and Kristeva - and offers a refreshing critique toward an alternative to the received wisdom. The rational choice assumption that any chosen behavior can be understood as optimizing material self?interest is not borne out by psychological research. Expressive motives, for example, are prominent in the symbols of politics, in social relationships, and in the arts of persuasion. Moreover, instrumentality is a mindset that is learned (perhaps overlearned), and can be situationally manipulated; because it is valued in our society, it provides a privileged vocabulary for justifying behaviors that may have been performed for other reasons, and (...) encourages the illusory belief in the universality of rational choice. In maintaining the plausibility of a metaethical argument for theism against the objections articulated by Stephen J. Sullivan, I will probe our differing suppositions with regard to the relation of theological to naturalistic metaethical theories, the starting point for the metaethical argument for theism, and the relation of the qualities of God's will to our (...) obligation to obey God. It describes how a new regime of capitalism has weakened and sometimes destroyed forms of social organization that had been established at the end of industrial capitalism. Part II considers the detailed development of various many-valued calculi, and some of the important metathereoms which have been proved for them. These three impressive volumes seem likely to be for some time the standard collection of Leibniz’s writings in Italian translation. Replacing two volumes of 1967-68, with the same title and publisher, which were edited by Domenico Omero Bianca, the new translation by Massimo Mugnai and Enrico Pasini offers the Italian reader an outstandingly comprehensive selection of Leibniz’s works in a presentation richly though unobtrusively illuminated by the latest scholarship. My chief aim in this review will be to give scholars working (...) in English an idea of the lines of study suggested by this new product of Italian scholarship, and the resources available in it. Leibniz's version of the ontological argument, a modal argument for theism on which he worked most intensively in the 1670s, has two stages. The first, an “incomplete” proof, concludes that God can only be a necessary being, and therefore if God's existence is possible, then God exists. The second stage is an a priori argument that the existence of such a necessary God is indeed possible. Leibniz's fullest attempts at a possibility proof turn on his conception of a most perfect (...) being, and the chapter concludes that they are not likely to succeed, in part because of difficulties in connecting the concepts of perfection and necessary existence. My aim in this article is to flesh out a new distinction between moral responsibility, as it is understood in light of Strawson’s “reactive attitudes,” and an institutional form of responsibility—a responsibility that employees bear for their work to their superiors. I show that Strawson’s view of responsibility is separate from organizational responsibility, and hence the responsibility of employees to their managers cannot be understood in terms of indignation or resentment, both of which are key Strawsonian concepts. The latter type (...) of responsibility can be understood in terms of objective attitudes, managerial demands, organizational standards, and related expectations. Based on a Cartesian and a Wittgensteinian notions of asymmetry between first- and third-person uses of psychological concepts, Strawson developed a view of responsibility that dissolves the above asymmetry. In contrast with the latter asymmetry, which focuses on those who ascribe psychological concepts to themselves and to others, Strawson’s view is centered on the recipients of reactive attitudes. According to his view, resentment and indignation differ because they are aimed at different recipients, something that cannot be applied in cases of organizational responsibility. (shrink)

Cette compréhensibilité des mobiles philosophiques les plus importants de la phénoménologie refondue jointe à la possibilité d'une compréhension globale et transversale de la textualité richirienne doit permettre en outre de réfléchir et de fonder la démarche tout entière. En accomplissant cette refondation de manière tout à fait originale, dans une oeuvre commencée en 1968 qui compte en 2012 près de dix mille pages, réparties en vingt ouvrages et près de deux cents articles, Richir poursuit le but et a comme ambition de bouleverser et de changer en profondeur les paramètres essentiels de la phénoménologie. Et, chemin faisant, la philosophie tout entière est à reprendre à nouveaux frais.
