ABSTRACTFor ten years, General Motors denied that an ignition switch that could easily be turned to ‘Off’ constituted a safety defect. Accidents, deaths and injuries resulted. Despite many, many suits against GM, the problem remained uncorrected. The explanations that have been proffered are interrogated in this article and others are suggested. It concludes that a bureaucratic legal department is partly to blame, and criticises how the legal department evaluated cases by their settlement value. It criticises GM’s culture of blaming drivers (...) for accidents. It concludes that the main problem at GM was not bureaucracy, but poor organisation of team management. GM was not organised for accountability without hierarchy. The article suggests that lawyers can play a key role in improving corporate decision making. (shrink)

Sanchez and Sanchez have selected, edited, translated, and introduced some of the most influential texts in Mexican philosophy, which constitute a unique and robust tradition that will challenge and complicate traditional conceptions of philosophy. The texts collected here are organized chronologically and represent a period of Mexican thought and culture that emerged from the Mexican Revolution of 1910 and which culminated in la filosofia de lo mexicano (the philosophy of Mexicanness). Though the selections reflect on a variety of philosophical questions, (...) collectively they represent a growing tendency to take seriously the question of Mexican national identity as a philosophical question--especially given the complexities of Mexico's indigenous and European ancestries, a history of colonialism, and a growing dependency on foreign money and culture. More than an attempt to describe the national character, however, the texts gathered here represent an optimistic period in Mexican philosophy that aimed to affirm Mexican culture and philosophy as a valuable, if not urgent, contribution to universal culture. Putnam and Searle famously argue against computational theories of mind on the skeptical ground that there is no fact of the matter as to what mathematical function a physical system is computing: both conclude (albeit for somewhat different reasons) that virtually any physical object computes every computable function, implements every program or automaton. There has been considerable discussion of Putnam's and Searle's arguments, though as yet there is little consensus as to what, if anything, is wrong with these arguments. In (...) the present paper we show that an analogous line of reasoning can be raised against the numerical measurement (i.e., numerical representation) of physical magnitudes, and we argue that this result is a reductio ad absurdum of the challenge to computational skepticism. We then use this reductio to get clearer about both (i) what's wrong with Putnam's and Searle's arguments against computationalism, and (ii) what can be learned about both computational implementation and numerical measurement from the shortcomings of both sorts of skeptical argument. We apply Benacerraf’s distinction between mathematical ontology and mathematical practice to examine contrasting interpretations of infinitesimal mathematics of the seventeenth and eighteenth century, in the work of Bos, Ferraro, Laugwitz, and others. We detect Weierstrass’s ghost behind some of the received historiography on Euler’s infinitesimal mathematics, as when Ferraro proposes to understand Euler in terms of a Weierstrassian notion of limit and Fraser declares classical analysis to be a “primary point of reference for understanding the eighteenth-century theories.” Meanwhile, scholars like (...) Bos and Laugwitz seek to explore Eulerian methodology, practice, and procedures in a way more faithful to Euler’s own. Euler’s use of infinite integers and the associated infinite products are analyzed in the context of his infinite product decomposition for the sine function. Euler’s principle of cancellation is compared to the Leibnizian transcendental law of homogeneity. The Leibnizian law of continuity similarly finds echoes in Euler. We argue that Ferraro’s assumption that Euler worked with a classical notion of quantity is symptomatic of a post-Weierstrassian placement of Euler in the Archimedean track for the development of analysis, as well as a blurring of the distinction between the dual tracks noted by Bos. Interpreting Euler in an Archimedean conceptual framework obscures important aspects of Euler’s work. Such a framework is profitably replaced by a syntactically more versatile modern infinitesimal framework that provides better proxies for his inferential moves. (shrink)

What does it mean to be an individual and how can an individual exist within society? Serious Leisure and Individuality examines the circumstances in the modern world that make for individual distinctiveness, and the role of these conditions in personal and social life. "The individual," said Friedrich Nietzsche, "has always had to struggle to keep from being overwhelmed by the tribe. If you try it, you will be lonely often, and sometimes frightened. But no price is too high to pay (...) for the privilege of owning yourself." Elie Cohen-Gewerc and Robert Stebbins explore the road to finding that privilege. They approach individuality by examining its relationship to freedom and being free, and by defining and elaborating on the concept of leisure space. They also look at individuality's place in community, citizenship, and globalization. The complex relationship between individuality and alienation is put under the microscope to highlight the negative side of being distinctive, which has adverse consequences for the individual and society. There are many studies on the modern individual that centre almost entirely on the person facing his local community and broader society. What is missing in the literature - and what Serious Leisure and Individuality provides - is a broad, comprehensive examination of individuality, particularly as it is rooted in leisure and the leisure-like areas of work. In his recent book The Measure of Mind Robert Matthews presents the most elaborate and convincing attempt to date to account for the propositional attitudes in measurement theoretic terms. In the first section of this paper I review earlier applications of measurement-theoretic conceptualization to the discussion of the mind, I outline Matthews' own account, and I raise two questions concerning it. Then, in the second section of the paper, I present a unified measurement-theoretic account of both linguistic meaning and (...) the propositional attitudes, in which a variant of Matthews' position is embedded. Such a unified account, I argue, yields satisfactory answers to the questions raised with respect to Matthews' original view, and demonstrates other advantages. (shrink)

Samuel Bagg's The Dispersion of Power: A Critical Realist Theory of Democracy is an excellent book. It lays out and defends, in detail, an ambitious new account of the significance of democratic institutions and practices, which it sees as centrally concerned with avoiding state capture. That account powerfully illuminates many important topics in democratic theory, responding in persuasive and novel ways to old questions as well as offering new areas to explore. However, its near-exclusive focus on domination by the very (...) wealthy may limit the insights it can provide. The idea of state capture's full power may only be made available though by adopting a more varied account of the common good that it stymies, and of the interests that may mobilize against those shared interests. No names are more closely associated with modern trade theory than Eli Heckscher and Bertil Ohlin. The basic Heckscher-Ohlin proposition, according to which a country exports factors in abundant supply and imports factors in scarce supply, is a key component of modern trade theory. In this book, Robert Baldwin traces the development of the HO model, describing the historical twists and turns that have led to the basic modern theoretical model in use today. Baldwin not only presents a clear (...) and cohesive view of the model's evolution but also reviews the results of empirical tests its various versions. Baldwin, who published his first theoretical article on the HO model in 1948, first surveys the development of the HO model and then assesses empirical tests of its predictions. Most discussions of empirical work on HO models confine themselves to the basic theorem, but Baldwin devotes a chapter to empirical tests of three related propositions: the Stolper-Samuelson theorem; the Rybczynski theorem; and the factor price equalization theorem. He concludes that the formulation and testing of these later models have improved economists' understanding of the forces shaping international trade, but that many empirical trade economists were so enamored of the elegant but highly unrealistic factor price equalization models developed from the insights of Heckscher and Ohlin that they have neglected investigation of other models without this relationship. This question is often on my mind, not least because for (...) the last seven years ofmy tenure at Stanford I studied ethnic conflict and filled my mind with the most discouraging images. I found myselfsaying on occasion that I felt ashamed to be a human being, which was only a slight exaggeration. I noted with wry amusement that a few years ago it was reported that the wolves were fleeing from the Caucasus in great numbers because ofthe human violence there, a sad irony in the light of Thomas Hobbes' motto, Homo homini lupus. I had long suspected thatthat was an insult to wolves, and now I had the proof. Lately we have Philip Gourewitch's new book on the Rwanda holocaust of 1994, where they killed one million people in ten weeks, not with weapons ofmass destruction butwith machetes and clubs primedwith six-inch nails, and Rwanda is a Christian country. The voice ofconscience cries out, "Where is our God?" in all this; why does He spend his time causing statues to ooze oil in suburban Massachusetts rather than defending the children of Kosovo against depraved nationalists.1 It is some comfort that the psalmist cried the same question and thus provides a convenient way into a meditation on violence in the Psalms. It occurs first in 42,3: "I have no food but tears / day and 1I refer to the phenomena reported in connection with the comatose teenage girl, Audrey Sosa, who is believed by some to be a channel for miracles. 152Robert Hamerton-Kelly night:/ and all day long men say to me,/ Where is now your God?" and again at 42,10, "Nearly breaking my bones / my oppressors insult me / as all day long they ask me / Where is now your God?" In 79, 10 it occurs in a national lament, "Why should the pagans ask, Where is their God?" and this recalls two prophetic oracles, in Joel 2,9, "Spare yourpeople Yahweh!/ Do not make your heritage a thing of shame, a byword for the nations./ Why should it be said amongthe nations,/ Where is their God?" and Micah 7,10 "When my enemy sees it (my vindication)/ she will be covered with shame,? she who said to me: Where is Yahweh your God?" So there are two classes of such sayings, one by an individual and one by the nation. Much ink has been spilled on the questions, Who is the victim?, and Who are the enemies? The answers have canvassed all the possibilities from the lone individual beset by spiritual temptations, or David himselfin his days and nights as a fugitive, to the nation beset by rival nations.2 The victim surrounded by persecutors is clearly a major category in the Psalms, present in two thirds ofthe collection; one hundred out ofthe one hundred and fifty explicitly or implicitly refer to a victim surrounded by enemies.3 Let me cut to the chase and recall that according to René Girard's mimetic theory, which I take as a point of departure, the situation of the victim surrounded by a mob ofenemies is a structural not an historical situation.4 The deep structure ofhuman history is a victim surrounded by the mob, a lamb slain since the foundation ofthe world. This deep structure controls the shape of emergent history but that emergence conceals its deep structure by turning history into myth. Myth covers up the blood stains and stifles the voice of the victim, myth accuses the victim, presents the victim as guilty or willing and the persecutors as innocent. To this day much that claims to be history is really myth. History happens only when the voice ofthe victim comes to word, and for that reason the gospel is irreducibly history and not myth. A legislação florestal brasileira pretérita é frequentemente interpretada de forma anacrônica. O objetivo deste artigo é contribuir para a compreensão da historicidade de tal legislação. De forma específica, serão analisadas, comparativamente, as propostas de alteração do primeiro Código Florestal Brasileiro até sua substituição em 1965. Apesar de modificações importantes, há uma permanência entre os textos analisados: as posturas conservacionistas, presentes em todos eles, só podem ser compreendidas quando atreladas à lógica produtivista e às políticas desenvolvimentistas evidenciadas no Brasil da época.

Confusion surrounds Catholic teaching on the use of assisted nutrition and hydration, specifically the question of when, if ever, its refusal or removal is ethical. This paper focuses on two often-neglected considerations: the relationship between means and mechanism, and an assessment of proportionality of the mechanism from the patient’s perspective. The authors draw on two critical principles of Catholic moral teaching: only ordinary means are required, and proportionality is subject to the perspective of the patient, not just that of experts (...) or the culture. The mechanisms that provide food and water have distinct benefits and burdens. Their proportionality is properly subject to analysis by the patient or surrogate, who determines which mechanism is acceptable in the patient’s situation. (shrink)

Frame Semantics includes context as a central aspect of the theory. Frames themselves can be regarded as a representation of the immediate context against which meaning is to be construed. Moreover, the notion of frame invocation includes context as one possible source of information comprehenders use to construe meaning. As the original implementation of Frame Semantics, Berkeley FrameNet is capable of providing computational representations of some aspects of context, but not all of them. In this article, we present FrameNet Brasil: (...) a framenet enriched with qualia relations and capable of taking other semiotic modes as input data, namely pictures and videos. We claim that such an enriched model is capable of addressing other types of contextual information in a framenet, namely sentence-level cotext and commonsense knowledge. We demonstrate how the FrameNet Brasil software infrastructure addresses contextual information in both database construction and corpora annotation. We present the guidelines for the construction of two multimodal datasets whose annotations represent contextual information and also report on two experiments: (i) the identification of frame-evoking lexical units in sentences and (ii) a methodology for domain adaptation in Neural Machine Translation that leverages frames and qualia for representing sentence-level context. Experimental results emphasize the importance of computationally representing contextual information in a principled structured fashion as opposed to trying to derive it from the manipulation of linguistic form alone. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. Henry Kyburg has developed an original and important perspective on probabilistic and statistical inference. Unlike much contemporary writing by philosophers on these topics, Kyburg's work is informed by issues that have arisen in statistical theory and practice as well as issues familiar to professional philosophers. In two (...) major books and many articles, Kyberg has elaborated his technical proposals and explained their ramifications for epistemology, decision-making, and scientific inquiry. In this collection of published and unpublished essays, Kyburg presents his novel ideas and their applications in a manner that makes them accessible to philosophers and provides specialists in probability and induction with a concise exposition of his system. This book is a historically informed and textually grounded study of the connections between Montaigne, the inventor of the essay, and Nietzsche, who thought of himself as an "attempter." In conversation with the Essais, Nietzsche developed key themes of his oeuvre: experimental scepticism, gay science, the quest for drives beneath consciousness, the free spirit, the affirmation of sexuality and the body, and the meaning of greatness. Robert Miner explores these connections in the context of Nietzsche's reverence for Montaigne-a reverence (...) he held for no other author-and asks what Montaigne would make of Nietzsche. Memory, mother of the Muses by Zeus, has nurtured culture for nearly three millennia while her nemesis, forgetfulness, has been demonized as an agent of destruction. In the modern age, however, memory has grown increasingly burdensome, opening the way for a more positive assessment of forgetfulness. Nietzsche praises animals for an inability to remember that preserves their innocence and happiness, and Freud documents the discontents of a civilization that cannot forget. ;In tracing the recent development of these issues, the dissertation (...) focuses primarily on Walter Benjamin, Hans Blumenberg, and Thomas Pynchon. Benjamin and his anguished "angel of history" show the destructive psychological effects of trying to use human memory as a secular form of redemption. Blumenberg's philosophy of history makes it possible to trace memory's responsibility for redemption to the modern age's inflated notion of the subject. Blumenberg's work also emphasizes the importance of metaphor and narrative in mediating and creating historical understanding, and this aesthetic distance weakens memory's redemptive relation to the past. Pynchon's protagonists, too, find that their desire to make historical meaning fully present is overshadowed by their fear of such presence. By reconciling themselves to a profane aesthetic distance from the past, Blumenberg and Pynchon redeem themselves from the melancholy engendered by an overly ambitious memory. ;Thus the dissertation attempts to recover a more modest and less oppressive memory by understanding it as a way to distance rather than redeem past injustices. This reconception of the function of memory helps establish an equilibrium between the pensive memory of Benjamin's "angel of history" and the innocent oblivion of Nietzsche's animals. ;In addition to the three major figures named in the title, the dissertation devotes sections and excursuses to Friedrich Nietzsche, Sigmund Freud, Ernst Cassirer, Martin Heidegger, Virginia Woolf, Ernst Robert Curtius, Elie Wiesel, Primo Levi, Michel Foucault, and Thomas Kuhn.
