This research examined how and why group membership diminishes the attribution of mind to individuals. We found that mind attribution was inversely related to the size of the group to which an individual belonged . Mind attribution was affected by group membership rather than the total number of entities perceived at once . Moreover, mind attribution to an individual varied with the perception that the individual was a group member. Participants attributed more mind to an individual that appeared distinct or (...) distant from other group members than to an individual that was perceived to be similar or proximal to a cohesive group . This effect occurred for both human and nonhuman targets, and was driven by the perception of the target as an entitative group member rather than by the knowledge that the target was an entitative group member. Taming the power of Wall Street was a principal campaign theme for Franklin Delano Roosevelt in the 1932 election. Roosevelt's election bore fruit in the Securities Act of 1933, which regulated the public offering of securities, the Securities Exchange Act of 1934, which regulated stock markets and the securities traded in those markets, and the Public Utility Holding Company Act of 1935 (PUHCA), which legislated a wholesale reorganization of the utility industry. The reform effort was spearheaded by the newly created (...) Securities and Exchange Commission, part of the new wave of experts brought to Washington to rein in business. PUHCA also marked the federal government's first significant incursion into corporate governance, with a corresponding reduction in the traditional role of investment bankers. The SEC's ascendance over the investment bankers was reinforced during FDR's second term by the Chandler Act of 1938, which provided the agency with a broad role in the bankruptcy reorganization of troubled companies.Enacting those statutes was only the beginning, as the scope and effectiveness of the SEC's regulatory efforts depended critically on navigating these new statutes past an initially hostile Supreme Court. After substantial delay in the lower courts, the securities statutes eventually got a friendly hearing in the Supreme Court, where a number of Justices came to the Court after serving as the "Founding Fathers" of the federal securities laws. Roosevelt's Supreme Court nominees were involved in drafting the new legislation, securing its passage in Congress and implementing a litigation strategy that successfully stalled final determination of the constitutionality of the securities laws until New Deal appointed justices were in place. Felix Frankfurter played an important role in shaping the Securities Act and PUHCA, and was a key advisor on litigation strategy to the Roosevelt administration. Hugo Black led the legislative battle to enact PUHCA against the utility companies. Stanley Reed and Robert Jackson were key courtroom advocates arguing PUHCA's constitutionality. William O. Douglas headed the study of Protective Committees that led to the Chandler Act and was Chairman of the SEC. In this article, we explore the role of the New Deal justices in enacting the securities laws, litigating the challenges brought against them and then interpreting these laws in securities cases before the Supreme Court. We show the important role that these New Deal justices played in ensuring a broad scope for the federal securities laws through generous interpretation. Once constitutional questions had faded, securities cases proved to be a critical testing ground for newly emerging theories of administrative law. We demonstrate the split over the importance of judicial review versus deference to the rule of experts that emerged among these Roosevelt appointees. Finally, we explore the relative lack of influence of Douglas and Frankfurter in these cases, despite their familiarity and experience with the securities laws. (shrink)

Flamm examines a dominant theme in Santayana’s philosophy: the spiritual life. He puts Santayana’s philosophy in dialogue with the novella Soul (Dzhan) by Andrey Platonov and examines the various ways Santayana associates crying with a materialist conception of the spiritual life.The association of crying and spiritual life is conspicuous enough in Santayana’s writings to merit exploration. In an astonishing variety of rhetorical modes Santayana writes of the various “cries” of spirit, of psyche, of soul, and of the human heart, emphasizing (...) the idea that it is through moral suffering that humans come to spiritual understanding (Some examples: “An impetuous spirit when betrayed by the world will cry …” (LR2, Chapter VIII, “Ideal Society,” p. 121); “the universal need and cry of human souls …” (LR3, Chapter XII, “Charity,” pp. 130–31); “spirit is physically the voice of the soul crying in the wilderness” (RB/RE, “The Nature of Spirit,” p. 568); “our very soul begins to cry for help” (RB/RE “On Cosmic Animism,” p. 576); “pain,” the “first form of distraction” in the psyche causes it to “awake with a sharp cry, a conscious protest” (RB/RE, “Distraction,” p. 679)). Santayana goes so far in one context to suggest that crying experiences testify to the existence of matter (“The more ecstatic or the more tragic experience is, the more unmistakably it is the voice of matter.” “Cross Lights,” SE, p. 25). In this chapter I link the various ways Santayana associates crying and spiritual life with the novella Soul (Dzhan) by Andrey Platonov (Andrey Platonov (1899–1951) was a Russian author whose works during the Stalinist era were heavily censored and banned and have only recently (relative to their importance, as of the late 1990s) begun appearing in approved English translations. I am a lover of Russian literature and no expert, but am prepared to agree with poet-translator Robert Chandler, who claimed (before he died in 2007) that Russians will come one day to recognize Platonov as their “greatest prose writer” (Chandler’s exquisite co-translation of Platonov’s Soul was chosen in 2004 as “best translation of the year from a Slavonic language” by the American Association of Teachers of Slavic and East European Languages)). Santayana in dialogue with Platonov offers a radiant picture of the materialist conception of spiritual life. (shrink)

An exploration of the theories, histories, practices, and contradictions of liberalism today. What does it mean to be a liberal in neoliberal times? This collection of short essays attempts to show how liberals and the wider concept of liberalism remain relevant in what many perceive to be a highly illiberal age. Liberalism in the broader sense revolves around tolerance, progress, humanitarianism, objectivity, reason, democracy, and human rights. Liberalism's emphasis on individual rights opened a theoretical pathway to neoliberalism, through private property, (...) a classically minimal liberal state, and the efficiency of “free markets.” In practice, neoliberalism is associated less with the economic deregulation championed by its advocates than the re-regulation of the economy to protect financial capital. Liberalism in Neoliberal Times engages with the theories, histories, practices, and contradictions of liberalism, viewing it in relation to four central areas of public life: human rights, ethnicity and gender, education, and the media. The contributors explore the transformations in as well as the transformative aspects of liberalism and highlight both its liberating and limiting capacities. The book contends that liberalism—in all its forms—continues to underpin specific institutions such as the university, the free press, the courts, and, of course, parliamentary democracy. Robert B. Brandom’s semantic inferentialism is an important and new theory of meaning in the contemporary, analytical philosophy of language. This theory is presented in an extensive way in the monograph entitled Making It Explicit: Reasoning, Representing and Discursive Commitment. The theory is pragmatic, normative, holistic and discursive. On the one hand, Brandom’s standpoint is glorified and on the other hand, it is controversial. This is why a metaphilosophical question arises: How to evaluate the impact of this theory into (...) the philosophy of language? Inferentialism emphasises a material inference, de re ascription and the usage of demonstratives. Such categories are “vertical” and they accent „connection” with reality. Nevertheless, Brandom also emphasises an anaphoric concept of reference and truth. It makes his standpoint valuable because anaphoric understanding of reference and truth delivers an additional explication of the usage of words “refer to” or “is true.” But such categories are “horizontal.” Brandom grasps the problem of acquiring empirical meaning by expressions which initiate anaphoric chains. This is why he proposes — as an attempt of solving the problem — a modification of semantic inferentialism by adding revisionary and fallibilistic epistemology. In addition, Brandom enforces his theory by normative pragmatics which applies categories of assertion, entitlement, various commitments and a “score-keeping.” However, it seems that what is still missing is a notion of truth stronger than the one proposed in the anaphoric conception. What is requested is a notion of truth expressed in terms of the relation of the correspondence between a language and a reality. The disadvantage of the idea of correspondence is that it is difficult to define in a satisfactory way. But an important advantage is that it is “a language-reality” relation and not only “a language-language” relation. The objection does not demolish inferentialism. It expresses only a general epistemological difficulty of defining truth. However, the importance of inferentialism is that it tries to unite various elements. The theory attempts to explicate — in a more adequate way — what a meaning is and to explain how it is acquired by expressions. (shrink)

When Dr. van Fleteren writes of the articles I criticized as dating from some twenty years ago, the unwary reader might infer that my criticism of those articles was, for its part, relatively recent. The fact is, however, that when the two connected articles I eventually criticized appeared in the volumes of Augustinian Studies, I wrote this reply while Fr. Robert Russell, of happy memory, was still at the helm, and was promised publication in the near future. Meanwhile, however, (...) Fr. Russell had the discourtesy to move on to a more intimate acquaintance with Augustine than any of us on this confused planet can boast of, and someone sowed cockle into field he had tended: in unaccountable fashion my article seems to have disappeared. Only a recent letter of inquiry on my part, and Fr. Allan Fitzgerald’s understanding reply, resulted in this renewal of dialogue between Dr. van Fleteren and me. The Kirillov Monastery at White Lake in the far north of the Muscovite state was home to the greatest library, and perhaps the only secondary school, in all of medieval Russia. This volume reconstructs the educational activities of the spiritual fathers and heretofore unknown teachers of that monastery. Drawing on extensive archival research, published records, and scholarship from a range of fields, Robert Romanchuk demonstrates how different habits of reading and interpretation at the monastery answered to different social priorities. Documentary as Exorcism is an interdisciplinary study that builds upon the insights of postcolonial studies, critical race theory, theological and religious studies and media and film studies to showcase the role of documentary film as a system of signifying capable of registering complex theological ideas while pursuing the authentic aims of documentary filmmaking. Robert Beckford marries the concepts of ‘theology as visual practice' and ‘theology as political engagement' to develop a new mode of documentary filmmaking that embeds emancipation from (...) oppression in its aesthetic. In various documentaries made for Channel 4 and the BBC, Beckford narrates the complicit relationship of Christianity with European expansion, slavery, and colonialism as a historic manifestation of evil. In light of the cannibalistic practices of colonialism that devoured black life, and the church's role in the subjugation and theological legitimation of black bodies, Beckford characterises this form of historic Christian faith as ‘colonial Christianity' and its malevolent or ‘occult' practices as a form of ‘bewitchment' that must be ‘exorcised'. He identifies and exorcises the evil practices of colonialism and their present impact upon African Caribbean Christian communities in Britain in films such as Britain's Slave Trade and Empire Pays Back through a deliberate process of encoding/decoding. The emancipatory impact of this form of documentary filmmaking is demonstrated by its ability to bring issues such as reparations to the public square for debate, and its capacity to change a corporation's trade policies for the good of Africans. For students of the poet, Robert Fallon's _Milton in Government_ fills a gap in modern knowledge of his life, the ten years he labored as Secretary for Foreign Languages to the English Republic. For Interregnum historians, the book offers a study of the international affairs of the Republic from a unique perspective, as well as a detailed analysis of the government bureaucracy that conceived and articulated foreign policy during the 1650s. Milton's decade of public service to the English Republic, (...) and the collection of State Papers which are the product of those years, have been either misunderstood or largely ignored by Miltonists, and their influence upon his poetry all but dismissed. Making extensive use of the State Papers Foreign in the Public Record Office, hitherto overlooked by literary scholars, and the Calendar of State Papers Domestic, Fallon offers the first definitive description of the poet's place in government. He finds Milton to be an indefatigable and highly knowledgeable public servant, closely involved in the expression of foreign policy, and responsible for many more documents than have been previously ascribed to him. His State Letters reveal him as a man intimately aware of international events, a consideration which leaves little doubt that his experience in government had a significant influence on his creative imagination. Fallon also provides a reading of Milton's tracts of 1659–1660, tracing the influence of a decade of public service in his political philosophy and questioning historians' conclusions that he was repudiating Cromwell's Protectorate in his appeal to stave off the Restoration. L'esthetique n'est pas plus la science exclusive du beau que la zoologie n'est la science exclusive du cheval: le sublime, le gracieux, le poetique, d'autres categories encore l'encadrent et forment systeme avec lui, s'organisant en couples antithetiques, en triades, a la limite en rosaces (classique, romantique) (...) intercalees l'une dans l'autre. Revenant sur les categories majeures, Blanche les considere ensuite une a une, chacune ayant sa problematique propre. Le beau, defini avant tout par la nettete d'une forme, maitrise (quand il s'y allie) la dimension de l'affectif et du voluptuaire. A l'inverse, le poetique n'a ni forme geometrique, ni lisibilite immediate et synoptique. Sa forme (son anti-forme) est le vague, le vaporeux. Son lieu d'election est le temps. Vient ensuite le decrescendo qui nous conduit du sublime, dont Blanche rappelle l'essence paradoxale, a la grace, categorie de l'aisance irenique, puis au joli, ou la dimension voluptuaire, le chatouillement des sens, prend toute la place, cotoyant a sa limite inferieure la sensibilite protopathique. Blanche s'interroge enfin sur le rapport entre style et categorie. Un style est un fait historique, localise et date; une categorie, au contraire, est un mode permanent d'appreciation esthetique. In response to growing concern in the 1980s about the quality of public education across the United States, a tremendous amount of energy was expended by organizations such as the Holmes Group and the Carnegie Forum to organize professional development schools or “partner schools” for teacher education. On the surface, the concept of partnering is simple; however, the practice is very costly, complex, and difficult. In _Schooling, Democracy, and the Quest for Wisdom_, Robert V. Bullough, Jr. and John R. (...) Rosenberg examine the concept of partnering through various lenses and they address what they think are the major issues that need to be, but rarely are, discussed by thousands of educators in the U.S. who are involved and invested in university-public school partnerships. Ultimately, they assert that the conversation around partnering needs re-centering, refreshing, and re-theorizing. (shrink)

In this paper I analyze representations of scholarly output for the purpose of identifying corrupt practices. Accordingly, the components of output—price, quantity, and time—are examined. A key part of the analysis is recognizing the unique role that the scholarly community plays in scholarship and the implications this has for the roles of groups other than the scholarly community. Finally, a survey of students indicates that particular representations of scholarly output are viewed by students as unethical.

The alphabet effect that showed that codified law, alphabetic writing, monotheism, abstract science and deductive logic are interlinked, first proposed by McLuhan and Logan, is revisited. Marshall and Eric McLuhan’s insight that alphabetic writing led to the separation of figure and ground and their interplay, as well as the emergence of visual space, are reviewed and shown to be two additional effects of the alphabet. We then identify more additional new components of the alphabet effect by demonstrating that alphabetic writing (...) also gave rise to Duality, and reductionism or the linear sequential relationship of causes followed by effects. We then review McLuhan’s claim that electrically configured information reversed the dominance of visual space over acoustic space and led to the reversals of cause and effect, and figure and ground. We then demonstrate that General System Theory first formulated by Ludwig von Bertalanffy, which also includes chaos theory, complexity theory and emergence and Jakob von Uexküll’s notion of umwelt also entail the reversal of many aspects of the alphabet effect such as the reversals of cause and effect, and figure and ground. Since the international community has offered their nearly unanimous condemnation of the system of apartheid in the Republic of South Africa, the topic of this essay might seem moot. However, the involvement and cooperation with the South African government of numerous governments, businesses, and other institutions suggest that those condemnations do not constitute the final word - certainly not politically, nor, perhaps, morally.

Tentative belief involves recognition that the belief in question may need revision and may even be false. It is sometimes said that religious faith requires complete confidence and that religious belief is incompatible with the critical self‐scrutiny that I am advocating. However, tentative religious belief is sufficient to sustain many important forms of religious commitment.
